THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON TUESDAY,
SEPTEMBER 7, 1993, AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF
THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,
BRYAN, TEXAS.

3. Consider and take action on budget amendments.
4. Consider and take action on the modification of Contract with
Government Records.
5. Consider and take action on load zoning on the following
county roads:
(a) Barron Road - Precinct 1
(b) Oak Hollow Subdivision Roads - Precinct 3
(c) Hollow Heights Subdivision Roads - Precinct 3
6. Consider and take action on request from GTE Southwest, Inc.
to install communication lines in the following county rights-
of-ways:
(a) South Dowling Road - Precinct 1

7. Consider and take action on request from Patterson Petroleum,
Inc. to install salt water disposal lines in the following
county rights-of-ways:
(a) River Road - Precinct 1
(b) Kemp Road - Precinct 4
8. Consider and take action on request from Sprint/United
Telephone to install communication line in county right-of-way
of White Switch Road in Precinct 1.
9. Reconsider and take action on Replat of Rainbow Acres
Subdivision/ Second Installment, and a variance from having to
acquire signatures from land owners in Precinct 3.

A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, September 7, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first matter before the Court was the modification of
the current contract with Government Records. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court
-voted unanimously to accept the recommendation of the
Purchasing Agent and modify the current contract with
Government Records, RFP 91-604 to include the following
phrase:
"any and all such records in your office that may
need to be 're-created', filmed, stored permanently
in special boxes or preserved during the remainder
of the contract period."
The Court next considered load zoning the following
county roads to 30,000 lbs:
Oak Hollow Subdivision Roads in Precinct 3
Hollow Heights Subdivision Roads in Precinct 3
and load zone to 30,000 lbs. with no through truck traffic:
Barron Road in Precinct 1

Norton, the Court voted unanimously to load zone the roads in
the Oak Hollow Subdivision and Hollow Heights Subdivision in
Precinct 3 to 30,000 lbs. and to load zone to 30,000 lbs. with
no through truck traffic Barron Road in Precinct 1.
The Court next considered two requests from GTE
Southwest, Inc.. The first to place a road bore in the right-
of-way of South Dowling Road approximately 0.2 mile northwest
of its intersection with Capstone Road to provide service to
a county resident. The site is located in Precinct 1. The
second request is to place a road bore in the right-of-way of
Pleasant Hill road approximately 0.5 mile from its inter-
section with Sandy Point Road to provide service to a City of
Bryan waste disposal location The site is in Precinct 4. On
motion by Commissioner Turner, seconded by Commissioner Sims,
the Court voted unanimously to approve the request of GTE
Southwest, Inc. and authorized the installation. A copy of
the request is attached hereto.
The Court next considered two requests from Patterson
Petroleum, Inc.. The first to place a road bore in the right-
of-way River Road approximately 2.0 miles southwest of its
intersection with Lightsey Lane for the purpose of installing
a salt water disposal line. Included with the request is
check #525 in the amount of $500.00. The site is located in
Precinct 1. The second request is to place a road bore in the
right-of-way of Kemp Road approximately 1.35 miles from its
intersection with FM 60 to install a salt water disposal line.
Included with the request is check #526 in the amount of
$500.00. The site is located in Precinct 4. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the two requests of
Patterson Petroleum, Inc. and authorized the installations.
The Court next considered the request from Sprint/United
Telephone for a cable installation in the right-of-way of
White Switch Road beginning approximately 1.3 miles west of FM
2154. The site is located in Precinct 1. On motion by Com-

missioner Norton, seconded by Commissioner Turner, the Court
voted unanimously to approve the request of Sprint/United
Telephone and authorized the installation. A copy of the
request is attached hereto.
The Court next considered approval of the replat of Lot
17, Block 7 of Rainbow Acres Subdivision/Second Installment.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to table consideration
until a later date.
The Court proceeded to consider the change of status of
the following employees.

COMPANY LINE INSTALLATION
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
August 17, 1993
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Wellborn, Texas as follows:
Take Wellborn Road, turn right on North Graham Road
past Rolling Ridge Trailer Park, turn left on South
Dowling Road past Country Meadow Lane, turn right or.
gravel road to 13544 S. Dowling Road. Propose to bore
under S. Dowling Road to provide service to Anne Carter.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line w-li be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin on Aug 20, 1993.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-o_-way of a County Road
in Brazos County, Texas as follows:
Take Sandy Point Road west off FM Road 2818, turn
left on Pleasant Hill Road, go approximately 1/2
mile to City of Bryan Waste Disposal Site. Proposed
bore under Plesant Hill Road will provide service
to City of Bryan at tnis locaticn.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line will be constructed and

Formal notice is hereby given that (Applicant)_ Patterson Petroleum
proposes to place a (type)_ salt water disposal line
pipeline within the right-of-way (road) River Rnad
In Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by
.4 copies of the drawings attached to this notice. (See Exhibits 1 S 2 attached)
1. The County Engineer must be notifled prior to the beginning of construction In order that
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way In accordance
with governing laws. '
6. That the line or lines will be constructed no less than forty-eight Inches (48-) lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (21 below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and in no case shall an open pit, be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test
shall be conducted by an Independent Geotechnlcal testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Traffic
r&troi Devices_ for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

Dear Sir:
Formal notice is hereby given that United Telephone-Midwest A Sprint ,
Company. proposes to install a Buried Communications Cable upon and along
the right-of-way of county roads in Brazos County, Texas,
as follows:
IMPROVED ROADS (paved) - The contractor will plow cable in backslope with
8' of right-of-way line. Pipe will be bored under all paved county roads
extending from ditch line to ditch line with a minimum cover of 30".

UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches,
trees and other terrain features, it is more practical to plow in center
of road. In these cases, the cable will be plowed in the center of the
road. Not applicable in County.
BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or
disposed of and not left in the ditch. Rocks brought up by tractor or
plow will be disposed of.

DEPTH OF CABLE - All cables will be placed at a minimum depth of 30"

except where crossing dams or ditches. at which locations the depth of
cables will be at a minimum of 36".
The following are requirements which are made on the contractor:
1. The plowing equipment shall be subject to the approval of the
Engineer and the Public Authorities having jurisdiction over highway
and road rights-of-way.
2. The equipment and construction methods used by the contractor shall
be such as to cause minimum displacement of the soil. The slot made
in the soil by the cable plow shall be closed immediately by driving
a vehicle track or wheel over the slot or by other suitable means.
3. Damage to banks, ditches, driveways. and roads caused by the equipment
shall be immediately repaired to the satisfaction of the Engineer and
Public Authorities having jurisdiction over highway and road right-of-
way where involved.
4. Trenches shall be promptly back-filled with earth. and mechanically

tamped at six (6) inch lifts so that the earth is restored to original
grade to assure no hazard to vehicular, animal or pedestrian tratfic.

No trenches shall be left open overnight.
5. The usual 10% fees withheld from contractor until repairs are made
t
satisfactory with Engineer ano Public authorities naving jurisdiction
of right-of-way involved.

Navasota
Brazos County will not be held liable at any future
date for accidental damages to the buried cable plant by road working
equipment such as maintainers, hole diggers, etc. In the event of
such damages the Telephone Company will be notifited immediately.
The County Commissioners Court may require the owners to relocate this
line, for valid reasons under the law, by giving thirty. (30) days
written notice.
a. Where communication facilities are located on county
road ROW the Telephone Company will relocate said
facilities at no expense to the County.
b. Where communication facilities are located on private
property the County will reimburse the Telephone Company
for the relocation of said facilities.
At any place where a communications line crosses over a county road, it
shall be constructed and maintained at least eighteen (18) feet above
the surface of the traffic lane.
Please notify forty-eight (48)
hours prior to starting construction of the line. in order that a
representative may be present.
The locations of the proposed lines are more fully shown by the copies
attached to this notice.
Construction of this line will begin on or after the 20th day of
September . 1993.
