AUGUST 30, 1993
I
A special meeging of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, August 30, 1993, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #92/93-24,
which would reallocate funds budgeted for Constable Precinct
4, Buildings & Yards and Constable Precinct 3. It will
transfer funds from Non Departmental to Data Processing and
reallocate funds within the insurance fund. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered an Order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law II on
August 30, 1993 and September 2 & 3, 1993 to allow Judge Ryan
to have surgery on her hand. On motion by the County Judge,

seconded by Commissioner Sims, the Court voted unanimously to
approve the order naming James A. Amis, Jr. as Special Judge
for County Court at Law I for the dates of August 30, 1993 and
September 2 & 3, 1993. A full copy of the order is attached
to and made a part of these minutes.
On motion by Commissioner Sims, seconded by Commissioner
Turner, the Court voted unanimously to appoint the following
persons as presiding judge and alternate judge for the current

Commissioners Court meeting August 30, 1993
On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to combine the
various polling places for the November 2, 1993 Constitutional
Amendment Election. These are the same polling places used
for the Senatorial Election.

The next matter for consideration by the Court was the
awarding of the Nunn Jones Road Improvement Project for the
Road and Bridge Department Bid No. 93-694. It was the
consensus of the Court to reject all bids and rebid the
project.

The Court next considered the request from Bexco
Operating, Inc. to place a road bore in the right-of-way of
Steep Hollow Road to install a 4.0 inch low pressure water
line. Included with the request is company check number 8290
in the amount of $500.00. The site is located in Precinct 3.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the request of
Bexco Operating, Inc. and authorized the installation. A copy
of the request is attached hereto.
The Court next considered the request from Wickson Creek
Special Utility District to place a 2 inch road bore in the
right-of-way of Doe Circle/Deerfield Estates approximately 600
feet from its intersection with Deer Run Drive to install a
3/4 inch water line. The site is located in Precinct 3. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to approve the request of Wickson
Creek Utility District and authorized the installation. A
copy of the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of Robert Murphy off Elmo Weedon
Road and the private property of Tracy R. Peters also on Elmo
Weedon Road. Both entries to the properties were to excavate
drainage outlet channels to allow water to drain from culverts
under the roadway. On motion by Commissioner Sims, seconded
by Commissioner Turner, the Court voted unanimously to
authorize the work.
The Court next considered the request from Fairview
Smetana WSC for a road bore in the right-of-way of Pleasant
Hill Road approximately 0.3 mile from its intersection with
Sandy Point Road for a water line installation. The site is
located in Precinct 4. On motion by Commissioner Turner,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Fairview Smetana WSC and authorized the

THAT WHEREAS, on August 30, 1993, the Court heard and approved

Texas.

reasonably included in the original budget adopted September 28,

Among other proceedings had, the following proposed order was

WHEREAS, the Honorable Sarah Ryan, Judge of the County Court
at Law No. 2 of Brazos County, Texas, having made known to the
Commissioners Court of Brazos County, Texas, that on August 30 -
September 3, 1993 she will be in having surgery on her hand; and
WHEREAS, she has requested the appointment of the Hon. James
A. Amis, Jr. to sit as Special Judge of the County Court at Law

dockets for those days, and to have and exercise all powers of a

Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.
James A. Amis, Jr., sit and hear all matters that are, or may be,
docketed on any of the Court's dockets on the above-mentioned days
and shall have and exercise all powers of such Special Judge in
relation to the matters involved;
WHEREAS, the Court having considered the proposed order and
deeming that it should be approved; it is therefore:

1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way In accordance
with governing laws.
6. That the line or lines will be constructed no less than forty-eight Inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (2) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and in no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698: test
shall be conducted by an independent Geotechnlcal testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Highway-$, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) September 1, 1993

Formal notice is hereby given that WICKSON CREEK SPECIAL UTILITY
DISTRICT (Applicant), proposes to place a WATER LINE
within the right-of-way of DOE CIRCLE (name of
road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other

road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
1 understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same becpme necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to 'any existing utility lines in the right-of-way.
5. That the 1 ine will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no. less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
