A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, August 9, 1993, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #92/93-22,
which would transfer funds from Justice of the Peace Precinct
4 Place 1 to Data Processing and transfer funds from Non
Departmental to the Road and Bridge Department. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered approval of the certification

of the county maintained road mileage as submitted by the Road
& Bridge Engineering Aide, Ray Crow. The County Judge

informed the Court the County maintained 468 miles of roads.

Wilcox, the Court voted unanimously to approve the

Commissioners Court meeting August 9, 1993
certification submitted by the Road & Bridge Engineering Aide
and forward a copy to the State Department of Highways and
Public Transportation.
The Court next considered the request from Aquila
Southwest Pipeline Corporation to install two (2) gas
pipelines in the right-of-way of Bird Pond Road approximately
915.49 feet in length. The site is located in Precinct 3.
Accompanying the request is company check number 017458 in the
amount of $4,438.40. On motion by Commissioner Norton,
seconded by Commissioner Turner, the Court voted unanimously
to approve the request of Aquila Southwest Pipeline
Corporation and authorized the installation. A copy of the
request is attached hereto.
The County Judge explained that the Court held a public
hearing to consider the load zoning on Timbercrest Subdivision
roads to 30,000 lbs in Precinct 1 on Friday, July 30, 1993 at
8:30 A.M.. On motion by Commissioner Turner, seconded by
Commissioner Wilcox, the Court voted unanimously to load zone
the roads in the Timbercrest Subdivision to 30,000 lbs.
The Court next considered the request from the City of
College Station to maintain sewer lines in the rights-of-way
of Vista and Lori Lane in the Harvey Hillsides Addition in
Precinct 3. Commissioner Sims informed the Court that the
sewer line improvements were now completed and accepted by the
City of College Station. He stipulated that any destruction
by the City will be repaired and returned to the original
condition. On motion by Commissioner Sims, seconded by
Commissioner Turner, the Court voted unanimously to approve
the request of the City of College Station with the added
stipulation. A copy of the request is attached hereto.
The next matter for consideration was approval to
advertise for bids on Medical Services for Juvenile Services
and various Road and Bridge Annual Contracts. Commissioner
Sims stated he would investigate the cost of having a full
time physician at the Health Department providing medical

services for Juvenile Services and the Jail. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to authorize the Purchasing Agent to
advertise for bids for Medical Services for Juvenile Services
and Road and Bridge Annual Contracts. !
The Court next considered authorizing work outside of

county rights-of-ways for the enhancement of county road '
projects. The Road and Bridge Department requests permission
to enter the private property of P. J. Palasota off Elmo
Weedon Road for the excavation and removal of approximately
20,000 cubic yards of fill material for construction on Elmo
Weedon Road. On motion by Commissioner Sims, seconded by
Commissioner Wilcox, the Court voted unanimously to authorize I.`
the work.
The Court acknowledged receipt of the Extension service
reports for July 1993 and receipt of reports from County and
Precinct Officers showing revenues collected and remitted to
the County Treasurer. An excerpt from those reports is
attached hereto.
The Court proceeded to consider the change of status of
the following employees.

ted with the exception of Charles Howard and John Lyon. On
motion by Commissioner Wilcox, seconded by Commissioner

Charles Howard if there had been no exclusion of a six month
increase when he was hired. On motion by commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to hire John Lyons at a group 8 step 2 position.

On this'thei9th day of August 1993 at a special meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on August 9, 1993, the Court heard and approved
a budget amendment for the 1992-1993 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 28,
1992, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

The location or description of the proposed installation Is more fully shown by

1. The County Engineer must be notified prior to the beginning of construction in order that
they might be on hand to designate the actual location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County is in no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way in accordance
with governing laws.
6. That the line or lines will be constructed no less than forty-eight Inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (2') below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traffic
Qontrol Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
