The purpose of the Public Hearing was to consider load zoning on Timbercrest Subdivision Roads to 30,000 pounds. The following members of the Court were present: R. J. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to grant an exemption from competitive bidding requirements of Local Government Code, Section 262.024(a)(7)(A) for the purchase of professional services from the firm of Durst, Wood Milberger and Asso- ciates, L.L.P. as outside auditor for Brazos County and the Brazos County Health Department for fiscal year of 1992-1993. 337 f ii 01 Commissioners Court meeting August 2, 1993 The Commissioner Sims read aloud a Resolution urging that prayer be returned to the public school systems of this nation. On motion by Commissioner Sims, seconded by Commissioner Wilcox the Court moved to adopt the Resolution and forward it to Denton County Commissioner Precinct 3, Scott Armey, who is spearheading the effort to reinstate prayer in the public schools. The Court next considered a request from the head of Data Processing to realign salaries in her department. One position would be eliminated and the money divided between two positions. On motion by the County Judge, seconded by Commissioner Turner, the Court voted unanimously to approve the request submitted by the head of Data Processing to realign salaries in her department. •I On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to adopt a resolution authorizing the County Judge to make application to the Criminal Justice Division, Office of the Governor, for grant funds to purchase juvenile services for selected juvenile offenders and to authorize the County Judge to accept such grant funds should they be tendered. The Purchasing Agent stated that after checking with other entities buying the same uniform she felt the prices were equitable. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to ` discontinue coverage on the older Road & Bridge equipment. A list of the pieces to be deleted from comprehensive/collision insurance is attached hereto. ' The next matter for consideration was the adoption of a Resolution to collect $1.50 in additional fees required currently under the Texas Motor Vehicle Registration Act, on each vehicle registered in Brazos County. Such fees would be used for school crossing guards within each city and for such other child welfare measures as determined by the cities. On motion by Commissioner Turner, seconded by Commissioner Sims, the court voted unanimously to adopt an order imposing a school guard crossing fee on each vehicle registered in Brazos County and to file the Order with the Texas Department of Transportation for implementation. The Court next considered authorizing the expenditure of $1,600.00 to relocate 500 feet of water line on Andert Road at Wildewood Estates in Precinct 3. Commissioner Sims explained that the developer of the subdivision will donate the additional right-of-way to straighten out the curve in the road. Wickson Water has a water line in the additional right- of-way. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to authorize the expenditure of $1,600.00 to relocate 500 feet of water pipeline on Andert Road. The Court considered the official notification to the public of Landfill Closure, Municipal Solid Waste Permit No. 1793: A. Millican League, A-39, 22.88 acres (Kathy Flemming Road) Brazos County Texas. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve the Official Notification To The Public and the i Affidavit To The Public. r i i R i i' i Y r i r i Commissioners Court meeting August•2, 1993 The Court next considered the request from Wickson Creek Special Utility District to construct a 2.0 inch road bore for water line in the right-of-way of Grassbur Road for the • purpose of providing service to a resident. The site is located in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from GTE Southwest, Inc. to place a buried cable 2,538 feet in the right-of-way of Fountain Switch Road. The site is located in Precinct 4. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the request of GTE Southwest, Inc. and authorized the installation. Holmgreen Brazos County, Texas 300 East 26th Street Bryan, Texas 77803 This letter is written to confirm our understanding of the services we are to provide for Brazos County for the year ended September 30, 1993. We will audit the general purpose financial statements of Brazos County as of and for the year ended September 30, 1993. The County's Annual Report includes statistical data that will be subjected to certain auditing procedures applied in our audit. Our audit will be made in accordance with generally accepted auditing standards and will comply with the requirements of the Single Audit Act of 1984, as supplemented, pertaining to Federal and State assistance awards, will be in accordance with generally accepted government auditing standards, the standards for financial and compliance audits contained in Government Auditing Standards issued by the U.S. General Accounting Office, the provisions of OMB Circular A-128, Audits of State and Local Governments, and will include tests of the accounting records and other procedures we consider necessary to enable us to express an opinion that the financial statements are fairly presented in conformity with generally accepted accounting principles. We shall prepare all the separate reports regarding compliance with laws and regulations, and on reportable conditions, if any. If our opinions are other than unqualified, we shall fully discuss the reasons with you in advance. Our procedures will include tests of documentary evidence supporting the transactions recorded in the accounts and direct confirmation of receivables and certain other assets and liabilities by correspondence with selected individuals, creditors, and banks. We will request written representations from your attorneys, and they may bill you for responding to this inquiry. At the conclusion of our examination, we shall also request certain written representations from you and the County Auditor about the financial statements and related matters. An audit is based primarily on the selective testing of accounting records and related data; therefore, our audit will involve judgment about the number of transactions to be examined and the areas-to be tested. Because our audit will not be a detailed examination of all transactions, there is a risk that material errors, irregularities, or illegal acts, including fraud or defalcations, may exist and not be detected by us. However, we shall advise you of any matters of that nature that come to our attention. Page 2 July 9, 1993 We understand that the County Auditor's Office will provide us with the financial statements and basic information required for our audit, as well as other information which we request, and that the County is responsible for the accuracy and completeness of that information. We will advise about appropriate accounting principles and their application and will assist in the preparation of your financial statements, but the responsibility for the financial statements remains with the County. This responsibility includes the maintenance of adequate records and related controls, the selection and application of accounting principles, and the safeguarding of assets. Our examination is not specifically designed and cannot be relied on to disclose material weaknesses in accounting controls. However, if we become aware of such material weaknesses or other reportable conditions, we shall communicate them to you in a separate letter. 11 We understand that you will reproduce the financial statements as part of the County's annual report, and you agree to provide us with printer's proofs or masters for our review and approval before printing. You also agree to provide us with a copy of the final reproduced material for our review before it is distributed. Any audit working papers will be available to you for a period of not less than 3 years after the date of the report, or longer if requested by the cognizant agency, to representatives of that cognizant audit agency (or its designee), other government audit staffs, and the General Accounting Office. Our fees for these services will be based on the actual time spent computed at a discount from our standard hourly rates because it is off season work, plus out-of-pocket costs such as postage, etc. Our hourly rates vary according to the degree of responsibility involved and the experience level of the personnel. The fee for our services for the September 30, 1992 audit was $33,000.00. Because of a recent departure of the assistant county auditor who was quite involved in the year end closing and the statement preparation process, and the probable departure of the County Auditor before September 30, 1993, we are concerned about the condition of the 1993 year-end records, the 1993 financial statements, and the timeliness of their completion. It is our opinion that even the best of personnel replacements will have a difficult time becoming acquainted with all of the facets of Brazos County's activities so near the year-end and be in a position to perform the year-end work and statement preparation without significant problems. Furthermore, the statement preparation is with a special computer software which is separate and apart from the County's computer system. As far as we know, no other person in the department has worked with this software. All of these matters have a significant bearing on the amount of time which will be required of us. Accordingly, we are unable to quote an estimated fee. However, we do state that our total fee will be based, as in the past, on significantly discounted fees because most of the work is off season. f i • Page 3 July 9, 1993 Our fee estimates in the past have been based on the assumption that the financial statements would be available for our use by November 15. This has rarely been the case with the result that an increasing amount of the audit work encroached on our "tax season". If financial statements as of and for the year ended September 30, 1993 are available for our use by November 15, 1993, we expect to issue our reports on or about February 25, 1994. We appreciate the opportunity to be of service to Brazos County and believe this letter accurately summarizes the significant terms of our engagement. Our premiums would be ordinary vehicles with law enforcement s vehicles or Road & Bridge equipment. Premiums are determined by how many ' vehicles we have and how they are used. We do have blanket coverage in the sense that if we were to have an accident before a new vehicle got insured, that vehicle would still be covered. TEXAB ORDER I14POSING SCHOOL GUARD CROSSING FEE WHEREAS, the Texas Legislature has authorized counties to impose, by order, a $1.50 fee in addition to the fees required currently under the Texas Motor Vehicle Registration Act, on each vehicle registered in Brazos County, Texas on or after October 1, 1991; and WHEREAS, the monies collected under such Order are to be remitted to the cities in the County after an administration charge is deducted along, with a deduction in an amount equal to the money attributed to County residents who do not live in the incorporated areas of the county; and WHEREAS, the monies paid to the cities in the county under the law are to be used for school crossing guards in the cities and for certain other child welfare measures as may be determined by the city councils; and r WHEREAS, the City of Bryan and the City of College Station have each presented the Commissioners Court with Resolutions requesting the Brazos County Commissioners Court to impose a $1.50 per vehicle fee as authorized by the Texas Legislature; and WHEREAS, the Commissioners court is desirous of honoring the Resolutions presented by the Cities of Bryan and College Station; NOW, THEREFORE, be it resolved by the Commissioners Court of Brazos County, Texas, that: 1. Brazos County impose a $1.50 fee, in addition to the fees required currently under the Texas Motor Vehicle Registration Act, on each vehicle registered in Brazos County, Texas. 2.
