Adjourn. a COMMISSIONERS' COURT SPECIAL MEETING JULY 6, 1993 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, July 6, 1993, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Asst. to County Judge Bea Green Secretary to Commissioners Rhonda Seaton Auditor's Office Shelley Turek Treasurer's Office Rita J. Watkins Sheriff's Office Bobby A. Riggs Sheriff Frank Palermo Road & Bridge Joe E. Smith Road & Bridge Buddy Meadows Deputy Constable Pct. 4 Duane Peters Constable Pct. 4 Richard L. Vance Engineer Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendment #92/93-19, which would reallocate funds budgeted for the office of Constable Precinct 3. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. on motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to appoint Commissioner Norton as the county designee to the Texas Association of Counties special meeting on August 19, 1993. The purpose of the meeting is to consider a proposed amendment to the Constitution of the Texas Association of Counties. The next matter for consideration was an agreement for 40 e ' i i 9 J } { • Commissioners Court meeting July 6, 1993 the administrative services of Thompson, Derrig and Slovacek regarding Brazos County's Section 125 Cafeteria Plan. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to enter into Agreement for Administrative Services with Thompson, Derrig and Slovacek for the administration of the Section 125 Cafeteria Plan for 1993- 1994. The Court next considered a request from the County Attorney's office for a personal services contract with Zortec for programming hours by Mike Pappafotis in order to complete a hot check system. This request is necessitated by the loss of all data on the hard disk of the Monroe computer. Because of the loss of the information the County Attorney's office can no longer account for funds owed to merchants for checks collected or for checks turned in by offenders. Cost of the programming hours will be $7,600.00 plus expenses. On motion by Cbmmissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of the County Attorney for a personal services contract with Zortec and stated that payment should come from "Hot Check" funds. The Court next considered the request from Wellborn Water Supply Corporation to place a road bore in the right-of-way of Batts Ferry Road approximately 930.0 feet from its intersec- tion with Minter Springs Road in order to install a 2 inch water line. The site is located in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Wellborn Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from GTE Southwest to place a buried cable in the northwest right-of-way of Barron Road beginning at a point 500.0 feet southwest of the junction of Barron Road and Dove Trail. The site is located in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve A 11 r' a Commissioners Court meeting July 6, 1993 the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Sprint to place a communications cable in the right-of-way of Rock Prairie Road. The site is located in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Sprint and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from The Nolan Group, Inc. to place a road bore in the right-of-way of Britten Road approximately 0.1 mile from its intersection with Smetana Road to install a 3.0 inch low pressure gas gathering pipe line. Included with the request is company check #1139 in the amount of $500.00. The site is located in Precinct 4. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of The Nolan Group and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the final plat of the Porterfield/Watson Phase III Subdivision, Lots 21-24. The subdivison is located in Precinct 4. On motion by Commis- sioner Turner, seconded by Commissioner Norton, the Court unanimously approved the final plat of the Porterfield/Watson Phase III Subdivision, Lots 21-24. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requests permission to enter the private property of Jane Moore on Dilly Shaw Tap Road to dispose of expired livestock. Commissioner Sims was informed that the local restuarant charge was for the Jail Standards inspectors. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. The effective date of this agreement will commence with the Plan year beginning September 1, 1993. Adhtibtratar The Company shall be the Plan Administrator and Thompson, Derrig & Slovacek, P.C., hereinafter referred to as the "Administrative Firm" shall be engaged as a subcontractor in the performance of administrative services for the plan A&A dstrattve services to be provided by Administrative Finn 1. Prepare and conduct one seminar to explain the Cafeteria Plan to the employees. 2. Provide participant election forms to be used during the enrollment process. 3. Process initial enrollment forms and revocation forms to initiate the administration function 4. " Provide each participant with Reimbursement Claim Vouchers and instructions for filing claims. 6. Provide reimbursement checks to employees on a bi-weekly basis. 6. Provide a check register for all checks printed on a bi-weekly basis. 7. Provide each participant a Statement of Account on each flex check 8. Provide forms to the County for use by the County in communicating participant terminations and changes of family status. 9. Provide annual child care statements of participant. 10. Provide annual preparation of Form 6500. 11. Present informational seminar to the employee group. ResponsiWities of the County 1. Report participant terminations and changes of family status to Administrative Firm to be effective 2 weeks after receipt. 2. Reconciliation of payroll amount redirected to the Cafeteria Plan based on reports provided bi-weekly by Administrative Firm 3. Distribution of checks and participant statements of account to County employees. 4. Provide Administrative Firm with blank check stock for use in preparing reimbursement checks. 8. Actual signing of reimbursement checks. 6. Initiate any action required in the event plan(s) become discriminatory. Fees and Terms of Payment At each reimbursement period we wM prepare a check from your'T'lex" account for the amount of our fee for that period. The County will remit that check to the Administrative Firm upon receipt. The fee schedule is attached as Exhibit A. The Administrative Firm has the right to change the fee schedule by giving at least 60 days notice to the County. Reports and Data All reports and data remain the property of the County. Administrative rum will provide the County all data, upon request, in the electronic or printed format used by Administrative Finn in its administration procedures. e I r' r r I i F I 1a 414 r a • t Brazos County June 17, 1993 Software In the event the County wishes to self-administer the Cafeteria Plan, Thompson, Derrig & Slovacek, P.C., a professional corporation of Certified Public Accountants in Bryan, Texas will sell to the County the software written to administer the Cafeteria Plan at the price in effect at that time. Any time required to train company personnel will be charged at our normal per diem rates. Teens of the Agreement This agreement will be effective from the date both parties execute this agreement until it is terminated. The proposed cable will be buried to a minimum depth of 30 inches. UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches, trees and other terrain features, it is more practical to plow in center of road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30" except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36". The following are requirements which are made on the contractor: 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jurisdiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be immediately repaired to the satisfaction of the Engineer and Public Authorities having jurisdiction over highway and road right-of- way where involved. 4. Trenches shall be promptly back-filled with earth, and mechanically tamped at six (6) inch lifts so that the earth is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. The County Commissioners Court may require the owners to relocate this line, for valid reasons under the law, by giving thirty (30) days written notice. a. Where communication facilities are located on county road ROW the Telephone Company will relocate said facilities at no expense to the County. b. Where communication facilities are located on private property the County will reimburse the Telephone Company for the relocation of said facilities. At any place where a communications line crosses over a county road, it shall be constructed and maintained at least eighteen (18) feet above the surface of the traffic lane. Please notify forty-eight (48) hours prior to starting construction of the line, in order that a representative may be present. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. it.
