Adjourn. 1 COMMISSIONERS' COURT REGULAR MEETING JUNE 14, 1993 1 dp A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, June 14, 1993, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Absent; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Carol Palmer Bea Green Cheryl Turney Frank Palermo .Joe E. Smith Sandie Walker Shelley Turek Rita J. Asst. to County Judge Secretary to Commissioners Auditor's Office Road & Bridge Road & Bridge Treasurer Treasurer's Office Sheriff's Office Sheriff KBTX-TV KBTX-TV Attorney EDC Brazos County Resident EDC EDC Commissioner Norton gave the invocation and led the pledge of allegiance. The Court first considered Budget Amendment #92/93-18, which would transfer funds budgeted for the Non Departmental Department to Justice of the Peace Precinct 4 Place 2 and to Elections. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter for consideration was approval to adver- tise for bids for uniforms for the Sheriff's Department. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to authorize the Purchasing Agent to advertise for uniforms for the Sheriff's Department. V I~ a • Commissioners Court meeting June 14, 1993 The Court next considered a request from Constable Precinct 2, James P. Marrow, to appoint Charles M. Payne as Reserve Deputy Constable. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request from Constable Marrow to appoint Charles M. Payne as Reserve Deputy Constable. The next matter for consideration was a Texas County & District Retirement System Buy-Back Application to buy back prior service submitted by Randy Sims. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to forward the application of Randy Sims to the Texas County and District Retirement System along with his check for Seven Thousand Eight Hundred Nineteen Dollars and Seventy Five cents ($7,819.75) which represents the amount of deposits previously withdrawn, the amount of withdrawal charge accrued as of December 1991 and the additional charge after December 1991 to date of redeposit. The Court next considered an Exemption from Competitive . i Bidding Requirements of Local Government Code, Section 262.024(a)(A). This is for the purchase of personal and/or professional service, Computer Consulting from Dr. Dan Colunga. On motion by the County Judge, seconded by Commis- sioner Norton, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for all professional services from the designated individual for the period January 1993 through December 1993. The next matter for consideration by the Court was a written request submitted by the District Attorney requesting approval for out of state travel for Assistant District Attorneys Deena Wallace and Lisa Tanner. Mrs. Wallace and Mrs. Tanner would be traveling to Chicago, Illinois to attend the Fourteenth Annual Conference of the "Association of Government Attorneys in Capital Litigation" August 4-7, 1993. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to grant the request from •I s Commissioners Court meeting June 14, 1993 the District Attorney and approved payment of out of state travel expenses for Mrs. Wallace and Mrs. Tanner. The next matter for consideration was participation in a Revolving Loan Fund Program. This is a program administered by the Economic Development Council to loan money to small businesses. The cities of Bryan and College Station and Brazos County will pay $17,000 annually, the local banks and the Brazos County Industrial Foundation will pay $10,000 each. There will be $500,000.00 in matching funds by the Federal Economic Development Council. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to participate in the Revolving Loan Fund Program subject to approval from the Attorney General's Office that the County can participate. The next matter for consideration was a waiver of the County Subdivision ordinance for lot 10 Smetana Forest Subdi- vision. John Hawtrey, attorney, stated that lot 10 had two (2) houses set upon it. One was sold in 1985 the approximate time that the Subdivision Ordinances were passed. He asked that the County grant a variance so that Mrs. Nemec can sell the other house on the lot. He also said that the original deed had an improper description. The County Judge asked if the Health Department had looked at the septic systems. Mrs. Nemec informed the Court that the Health Department had inspected the systems and that one had to be reworked. She also stated that the correction deed would give the smaller tract the extra land to equal 1/2 acre required by the Septic Tank Regulations. On motion by the County Judge, seconded by Commissioner Turner, the Court voted unanimously to grant the variance subject to approval by the Health Department and the filing of the corrected surveys. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requests permission to enter the private property of Clara Armstrong on the north f i i t . I ' I Commissioners Court meeting June 14, 1993 side of Hollow Heights Drive to clear out an existing drainage channel. On motion by Commissioner Wilcox, seconded by Com- missioner Turner, the Court voted unanimously to authorize the work. The Court acknowledged receipt of the Extension Service reports for May 1993 and acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. The Court proceeded to consider the change of status of the following employees.
