A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, May 17, 1993, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court again tabled consideration of the late hours
permit for alcohol sales.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the City of
Bryan to hold a joint election for the purpose of electing a
United States Senator and a City Council Member, Place 5.
This is done in accordance to Section 271.002 (a) of the
Election Code. On motion by Commissioner Norton, seconded by
Commissioner Wilcox, the Court voted unanimously to enter into
contractual agreement with the City of Bryan to hold a joint
election on Saturday, June 5, 1993. A copy of the contractual
agreement is attached hereto.

Commissioners Court meeting May 17, 1993
The Court next considered awarding the following bids
Bid No. 93-684 - Pager Service
Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Southwestern Bell for the
lease of digital pagers under State
Contract and acceptance of the bid
submitted by Spot Joint Venture for the
voice pagers. On motion by Commissioner
Sims, seconded by Commissioner Norton,
the Court voted unanimously to accept the
.recommendation of the Purchasing Agent
and award the contract to Southwestern
Bell and Spot Joint Venture. A copy of
the bid tabulation is attached hereto.
The Court next considered the request from Ferguson
Burleson County Gas Gathering System to place a road bore in
the right-of-way of Koppe Bride Road approximately 0.4 mile
west of its intersection with Hopes Creek Road to install an
8 inch steel pipe line. Included with the request is company
draft 44011 in the amount of $500.00. The site is located in
Precinct 1. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve the request of Ferguson
Burleson County Gas Gathering System and authorized the
installation. A copy of the request is attached hereto.
The Court next considered the request from Wickson Creek
Special Utility District to place a 2.0 inch road bore int the
right-of-way of Edge Cut Off road approximately 390.0 feet
from Nichols Road in order to install a water line. The site
is located in Precinct 2. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Wilcox, seconded by Commissioner Norton, the
Court voted unanimously to approve the request of Wickson
` Creek Special Utility District and authorized the
installation. A copy of the request is attached hereto.
The Court next considered the request from Brushy Water
Supply to place a road bore in the right-of-way of Mark Street
approximately 270.0 feet from its intersection with Old Jones
Road. The site is located in Precinct 4. The County Engineer

stated that all appeared to be in order and recommended
approval. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to approve
the request of Brushy Water Supply and authorized the
installation. A copy of the request is attached hereto.
The Court next considered approval of the final plat of
the Benjamin Graham Subdivision/Vacating and Replating.
Holland Winder, County Engineer, stated that he had reviewed
the plat with the plat review committee and it appeared to be
in order. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court unanimously approved the final
plat of the Benjamin Graham Subdivision/Vacating and
Replating.
The Court next considered approval of the preliminary
plat of the Porterfield/Watson Subdivision Phase III. Holland
Winder, County Engineer, stated that he had reviewed the plat
with the plat review committee and it appeared to be in order.
Commissioner Wilcox asked about the right-of-way along Leonard
Road. The County Engineer informed him that it was coming off
of only one side of the road. On motion by Commissioner
Turner, seconded by Commissioner Norton, the Court unanimously
approved the final plat of the Porterfield/Watson Subdivision
Phase III.
The Court proceeded to consider the change of status of

OONTRACT FOR JOINT SLBCTION
THE STATE OF TEXAS:
COUNTY OF BRAZOS •
This agreement, made this L, day of May, 1993, by and
between BRAZOS COUNTY and THE CITY OF BRYAN.
W I T N E S S E T H
WHEREAS, the Governor of the State of Texas has ordered a
special runoff election to be held in all counties on Saturday,
June 5, 1993 for the purpose of electing a United States Senator;
and
WHEREAS, the Mayor of the City of Bryan has ordered a runoff
election on Saturday, June 5, 1993 for the purpose of electing a
City Councilmember; and
WHEREAS, Section 271.002 (b) of the Texas Election Code
authorizes more than one political subdivision to enter into an
agreement to hold elections jointly;
WHEREAS, BRAZOS COUNTY and the CITY OF BRYAN, will hold
elections on the same day; and
WHEREAS, the parties to this agreement desire that a joint
election be held that is cost effective and convenient for the
citizens of Brazos County and the City of Bryan;
NOW THEREFORE BE IT RESOLVED that a joint election be held by
BRAZOS COUNTY, TEXAS and the CITY OF BRYAN, TEXAS under the
following terms and condition, and the parties herewith agree with
said conditions:

I. That there shall be one ballot that contains the names of the
candidates for the office of United States Senator and the
office of Bryan City Councilmember.
II. That there shall be one set of ballot boxes to be used at the
common polling places.
III. That election forms used and records maintained be combined in
a manner convenient and adequate to record and report the
results of the election for BRAZOS COUNTY and the CITY OF
BRYAN.

IV. That the tabulation of the precinct results shall be in a
manner to facilitate the canvass of the returns by the
Commissioners Court for the office of United States Senator
and by the Bryan City Council for the office of Bryan City
Councilmember.
V. That the implementation and actual management of the joint
election shall be with BRAZOS COUNTY. The implementation and
management of the election shall include the following:
A. The securing of qualified individuals to serve as
election judges for each voting box within the voting
precinct.
B. The securing of the location and facilities where and
within which election is to be located.
C. The securing of the official ballots and election
materials and supplies requisite to the proper
administration of elections under the Texas Election
Code.
D. Securing of a contract for election services and supplies
which includes counting of ballots with Texas Voting
Systems, Inc.
E. County to be responsible for conducting early voting at
the Brazos County Courthouse, Galilee Baptist Church,
Arena Hall, College Station Independent School
Administration Building and Memorial Student Center on
Texas A&M Campus.
D. City of Bryan to be responsible for conducting early
voting at the City of Bryan Municipal Building/
VI. The amount to be paid by the CITY OF BRYAN to BRAZOS COUNTY
for the services rendered by said County in the Special Runoff
Election to be held on Saturday, June 5, 1993 is:
A. BRAZOS COUNTY will pay all cost in total.
B. CITY OF BRYAN will reimburse BRAZOS COUNTY for certain
costs in accordance with the following schedule.
1. Fifty percent of all costs incurred for polling
places located in the City of Bryan.

clerks at all polling places located in the City of
Bryan.

Fifty percent of cost of services and supplies for
seventeen polling places located in the City of

5.
Fifty percent of costs of early Ballot Board and
Central Counting Station.

Formal notice Is hereby given that (Applicant) Ferguson Burleson County Gas Gathering System
proposes to place a (type) 8" Steel Pipe
pipeline within the right-of-way (road) Koppe Bridge Road
In Brazos County, Texas as follows:
The location or description of the proposed Installation is more fully shown by
3 copies of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to deslgnate the actual location of the Installation.
2. That all damage to the roadways and right-ol-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
f3. That the line will be constructed and maintained on the County right-of-way In accordance
with governing laws.
* That the line or lines will be constructed no less than forty-eight Inches (481 lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (21 below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open pit be allowed within four feet of the shoulder of the road.
a That all 61103 will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. • Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test
shall be conducted by an Independent Geotechnlcal testing firm; copies of all test results
shall be fumished to the office of the Brazos County Engineer.
11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Stress and Hlahwavs, published by the Texas Department of
Transportatlon, and all other Stste and Federal laws governing utility construction.

Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
