J. Holmgreen, County Judge, Presiding; ; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; q Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Barnett Aquila Pipeline Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered approval of the minutes of the Commissioners' Court meetings held January 4, 1993, January 11, 1993, January 19, 1993 and January 25, 1993. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the minutes as submitted. At the request of the owners of Koppe Bridge Bar and Grill, consideration of the late hours permit for alcohol sales has been tabled until a later date. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to adopt a Resolution authorizing the Clerks of the County Courts at Law of Brazos County, Texas to collect civil fees and criminal costs authorized by H.H. 66 for a period of twelve months, beginning Jj I- Commissioners Court meeting May 10, 1993 r July 1, 1993 and to forward a certified copy of the Resolution to the Comptroller of Public Accounts of the State of Texas. The Court next considered entering into agreement with Jim Swigert, Auctioneer SWICO Auctions for the sale of surplus equipment, furniture and fixtures belonging to Brazos County on June 12, 1993. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to enter into agreement with Jim Swigert, Auctioneer SWICO Auctions for the sale of surplus equipment, furniture and fixtures belonging to Brazos County on June 12, 1993 and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached hereto. A representative of Cen-tex Auctioneering Service stated that they had not been notified of the auction. The Purchasing Agent informed the Court that she had received three (3) telephone quotes, one from Art Ring at 8% and Buck Buchanan at 6%. Commissioner Sims requested that Cen-tex be notified of the next auction. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(A). This is for the purchase of professional service and the preparation of the Comprehensive Annual Financial Report by Durst, wood, Milberger and Associates, L.L.P.. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for all professional services from the designated vendor for the fiscal year 1993. The Court next considered the request from GTE Southwest to place a buried cable in the north right-of-way of Broach Road beginning approximately 200.0 feet northwest of Alexander Road for a distance of 1845.0 feet. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Wilcox, seconded by Commissioner Norton, the 11 01 0 Commissioners Court meeting May 10, 1993 Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by Ferguson Burleson County Gas Gathering System to place a road bore in the right-of-way of KRC Lane approximately 734.0 feet northwest of its intersection with OSR to install a 4 inch pipe line. Included with the request is a draft in the amount of $500.00. The site is located in Precinct 4. The County Engineer stated that all appeared to be in order and recom- mended approval. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Ferguson Burleson County Gas Gathering System and authorized the installation. A copy of the request is attached hereto. -The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requested permission to enter the private property of Regan Brown on Britten Lane to open a creek and waterway at two (2) locations in order to protect a county road. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court acknowledged receipt of the Extension Service reports for April 1993 and the Court acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. The Court proceeded to consider the change of status of the following employees. When the Constable of Precinct 7 asked for an extra employee, he said the person would be used as a bailiff and to transport money. Commissioner Sims did not see a need any longer for armored car service. Commissioner Norton said he would look into it. Commissioner Sims then questioned check #97476 for payment to VISA for a book. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. H.B. 66, provides a mechanism for judicial salary supplementation by the State of Texas to the County through the collection for a twelve month period of a $20.00 civil filing fee and a 510.00 cost for certain criminal convictions. other than a conviction arising under any law that regulates pedestrians or the parking of a motor vehicle; and WHEREAS. H.B. 66 requires adoption of a resolution by Commissioners Court to collect such fees and cost; and WHEREAS. the Commissioners Court of Brazos County, Texas, adopted resolutions authorizing the Clerks of the County Courts at Law of Brazos County, Texas to collect such fees and cost for a period of twelve months beginning July 1, 1992; and WHEREAS. H.B. 66 requires annual recertification for the collection to such fees and costs for the next twelve-month period, it is THEREFORE, RESOLVED by the Commissioners Court of Brazos County, Texas that the Clerks of the County Courts at Law of Brazos County, Texas, shall, pursuant to H.B. 66, collect the civil fees and criminal costs authorized by H.B. 66 for a period of twelve months, beginning July 1, 1993; and be it FURTHER RESOLVED that a certified copy of this resolution be filed with the Comptroller of Public Accounts of the State of Texas not later than June 1, 1993. That the line will be constructed and maintained on the County right-of-way In accordance with governing laws. That the line or lines will be constructed no less than forty-eight Inches (481 lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (7) below the center of the roadway. 7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope and In no case shall an open pit be allowed within four feet of the shoulder of the road. 8. That all sties will be barricaded during the construction period. 9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985. 10. Ditch line shalt be compacted to 90% standard density ASTM-Test method No. D-698; test shall be conducted by an Independent Geotechnical testing firm; copies of all test results shall be fumished to the office of the Brazos County Engineer. it.
