THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
APRIL 26, 1993, AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF
THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,

APRIL 26, 1993
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, April 26, 1993, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first matter before the Court was to appoint a
Central Counting Judge and Early Balloting Board Judge for the
May 1, 1993 Senatorial Election. On motion by Commissioner
Norton, seconded by Commissioner Turner, the Court voted
unanimously to appoint Frank Boriskie as Central Counting
Judge and Evelyn Anderholm as Early Ballot Board Judge for the
May 1, 1993 Senatorial Election.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Texas Voting
Systems for supplies and services for the Special Election to
be held on May 1, 1993. For the amount of $12,600.00 paid by
Brazos County, Texas Voting Systems, Inc. will provide
services and supplies for the election of May 1, 1993. On
motion by Commissioner Sims, seconded by Commissioner Wilcox,

Commissioners' Court meeting April 26, 1993
the Court voted unanimously to enter into contractual
agreement with the Texas Voting Systems, Inc.. A copy of the
contractual agreement is attached hereto.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to approve list of surplus
items for the Brazos County auction on June 12, 1993. A copy
of the list is attached hereto.
The Court next considered Change Order No. 1 to the
roofing and repairs contract to County buildings in the amount
of $35,270.50. On motion by Commissioner Turner, seconded by
the County Judge, the Court voted unanimously to approve
Change Order No. 1. A copy is attached to and made a part of
these minutes.
The next matter for consideration was approval of the
proposal submitted by Gilbert Trucking Company for the
demolition and removal of the burned Road and Bridge building
on Martin Luther King Street in Bryan. This action was
necessary because it is a health and safety hazard. On motion
I by Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to have Gilbert Trucking Company do
the demolition and removal of the burned building on Martin
Luther King Street.
The Court next considered four (4) requests submitted by
GTE Southwest. The first request is to install a buried cable
4 along and parallel to the west right -of -way of Clay Pit Road
f beginning 0.25 of a mile from its intersection with Stousland
1
Road for a distance of 2700.0 feet in a southwesterly
direction. The site is in Precinct 1. The second request is
to work in the right -of -way of Broach Road for the excavation
of a hole to tie into existing buried cable. The site is
+ located in Precinct 2. The third request is to install buried
cable along the northwest right -of -way of Nunn Jones Road
beginning at SH 30 for a distance of 123.0 feet in a
southwesterly direction. The site is located in Precinct 3.

parallel to the south right -of -way of Prospect Lane /Vista Oaks

Subdivision beginning at its intersection with Twisting Trail

in a southeasterly direction for a distance of 528.0 feet.
The site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval of

all four requests. On motion by Commissioner Wilcox, seconded
by Commissioner Norton, the Court voted unanimously to approve
the four requests of GTE Southwest and authorized the
installations. A copy of each request is attached hereto.

The Court next considered approval of the preliminary

plat of the Keller Woods Subdivision. Holland Winder, County
Engineer, stated that he had reviewed the plat and it appeared
,
to be in order. Commissioner Wilcox reminded the Court that
the Subdivision Regulations required a minimum width of 70
feet for right -of -way. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court unanimously
approved the preliminary plat of the Keller Woods Subdivision
in Precinct 3. Commissioner Wilcox stated that he opposed
approval based on the fact that it is a collector road and 80
feet of right -of -way would be necessary.
The Court next considered authorizing work outside of
county rights -of -ways for the enhancement of county road

projects. The Road and Bridge Department requested permission
to enter the private property of Mary Dworaczyk's on Dilly

Shaw Tap Road to clear out an existing drainage channel. On

motion by Commissioner Norton, seconded by Commissioner
Turner, the Court voted unanimously to authorize the work.
The Court received, approved and ordered filed as

submitted the Treasurer's report for March 1993 and the second
quarter fo fiscal' year 1993. A copy of both reports is
attached to and made a part of these minutes.

This contract, made thlsa►th day of April, 1993, by and between TEXAS VOTING
SYSTEMS, INC., a Texas Corporation, and BRAZOS COUNTY, State of Texas.
WITNESSETH:
Whereas, Texas Voting Systems, Inc. Is in the business of selling election services, and;
Whereas, BRAZOS COUNTY is desirous of employing the services of Texas Voting Systems
Inc. in connection with the SPECIAL ELECTION to be held on May 1, 1993, in Brazos
County, Texas, and;
Now, Therefore, in consideration of the premises and mutual promises and obligations
herein set forth, it Is agreed:
1.
TEXAS VOTING SYSTEMS, INC. will provide the following supplies:
(a) 25,000 numbered and printed Official Ballot Cards.
(b) All required hinged ballot pages and punched masks.
(c) Sample ballots and demonstration ballot cards.
(d) Forty four (44) election sets to Include five Early Voting Precincts, one Early
Voting Canvassing set, and one Central Counting set.
(e) All required seals for the voting equipment.
(f) Custom ballot layout for each voting precinct for checking correct ballot
pages.
(g) Writs and Notice of Election.
(h) Precinct polling place supplies (pens - tape - extra stylus) as required.
(1) Early Voting mail-out official ballot labels as required.

TEXAS VOTING SYSTEMS, INC. will provide the following services:
(a) Assemble two hundred twenty five(225) voting devices, and check each unit.
(b) Provide complete ballot layout and design.
(c) Conduct one (1) class for election Judges and clerks of election procedure.
(d) Conduct one (1) class for all central counting personnel if required.
(e) Assist with Early Voting as required.
(f) Prepare all supplies for use in the Individual precincts.
(g) Assist in the preparation of the computer test deck and holding of the Official
Test of the vote count computer.
(h) Assistance on election day, as required, to Include the central counting station.
(i) Provide any consulting services before and after the above mentioned elec-
tion.
Q) Provide repair crews for the voting device repair in the individual precincts
on election day.
(k) All required EDP programing for above mentioned election.

BRAZOS COUNTY, State of Texas, will be responsible for, and hereby assumes
the following duties and obligations in regard to the SPECIAL ELECTION to be
held on May 1, 1993.
(a) Payment of all Election Judges, Alternate Judges, and Clerks of Election,
to include the central counting station.
(b) Furnish Texas Voting Systems, Inc. a complete list of all candidates and issues
for all races to be conducted in the above mentioned election.
(c) All reports, expense accounts, canvass of the election, conduct of the elec-
tion at the individual polling places, and any other statutory requirements
as required by the Texas Election Code and /or the Federal Voting Rights
Act and not specifically covered above.

The consideration to be paid by BRAZOS COUNTY, to TEXAS VOTING SYSTEMS,
INC. for the services and supplies to be rendered by said corporation in the SPECIAL
ELECTION to be held on May 1, 1993 is twelve thousand six hundred dollars and

Re: Reroofing and roofing repairs to
Brazos County Buildings
Dear Judge Holmgreen:
Preparatory to starting work on the referenced project, core samples were
taken on the various roofs to determine the condition of the substrates
and whether asbestos bearing materials had been used on the original roofing.
1. Laboratory reports are negative for the presence of asbestos.
2. Area No. 2: (refer to attached plan). approximately 3000 sq. ft. should
be changed to include removing 112" of existing urethane foam. recoaming
and applying new coating. Only the recoating was originally specified.
COST INCREASE FOR THIS AREA: $5.106.00
3. Area No. 3: Existing 2" thick "Fesco Board" rigid insulation below both
the existing foam roof and the underlying built -up roof is saturated.
Removal of this wet material was only recently discovered and was not
included in the original contract.
COST INCREASE FOR THIS AREA: $5.462.50
4. Areas No. 4 and No. 5: Existing foam on both of these areas is saturated
with water which necessitates a complete tear -off of the existing foam
roof and replacement instead of recoating only.
COST INCREASE FOR THIS AREA: $24,702.50
1 recommend acceptance of these changes for a total of $35,270.5G. If more
information is needed at this time, please advise.

GENERAL TELEPHONE NOTICE OF COMMUNICATION
COMPANY LINE INSTALLATION
April 7, 1993
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY ENGINEER:
Formal notice is hereby given that GTE will construct a
communication line within the right -of -way of a County Road
in Brazos County, Texas as follows:
Beginning in the West ROW of Clay Pit Road, approximately
1/4 mile South of the intersection of Stousland Road and
Clay Pit Road, we will construct a buried line along
parallel to and 5' inside ROW a distance of 2700' to
end of road to serve new and future subscribers.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right -of -way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin on or after May, 1993.

ATTENTION COUNTY ENGINEER:
Formal notice is hereby given that GTE will construct a.
communication line within the right -of -way of a County Road
in Brazos County, Texas as follows:
Work location is on Broach Road 4/10 mile Northwest
of Alexander Road. A dig up will be made on an
existing buried cable. Buried drop will be placed
from the splice pit on to property owned by Larry
Satterwhite.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right -of -way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
i granted in the future and any provision or provisions so con-
strued shall be null and void.

Dear Mr. Winder:
In preparation for the County's road widening project on Nunn Jones
Road, we have made plans for relocating GTE facilities in the area.
Upon investigation, we have found that the only work affecting our
facilities is at the junction of Hwy 30 and Nunn Jones Road and
within 150' of that junction.
On the State right -of -way, we will be boring across Nunn Jones Road
and replacing a section of cable. On Nunn Jones Road, we will be
placing 123' of buried cable at 5' within the Northwest right -of-
way in order to abandon the cables on the Southeast side of the
road.
This work is scheduled to begin on 5 -1 -93 on Work Order 3POOIHC.
