E 3 97 1='g. —� PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as maybe authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. To make arrangements, please call (979) 361-4102. - dal. 7 Pg. — MINUTES MAY 2, 2023 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos, County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, May 2, 2023 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1; Chuck Konderla, Commissioner of Precinct 2; Nancy Berry, Commissioner of Precinct 3; . Wanda J. Watson, Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Invocation and Pledge of Allegiance • U.S. and Texas Flag - Commissioner Konderla 2. Call for Citizen input and/or concerns There was no Citizen input. 3. Presentations and/or Discussions a. Presentation by Alan Day, General Manager, Brazos Valley GCD • Annual Report from The Brazos Valley Groundwater Conservation District Alan Day, General Manager of the Brazos Valley Groundwater Conservation District (BVGCD) provided the Court with a summarization of the status on their current projects. Vol. 397 Pg. 5 Mr. Day stated that there are 6,646 registered wells with the BVGCD. He discussed the current and future impact attributed to the continuous pumping of those wells as it relates to the water levels in the aquafers. Commissioner Aldrich asked for clarification on the exportation of water from neighboring counties and whether any future well projects are on the horizon. Mr. Day responded to the Commissioner's questions with further information on the economic feasibility of future projects. Judge Peters requested information on the impact that the water exportation has caused in the Brazos Valley. Mr. Day stated that while there has been an impact on the water levels, there is no cause for concern. A copy of the presentation is attached. b. Presentation by Charles Wendt, Brazos County Purchasing Agent • Cl P 22-624 Architect for Road & Bridge/Heavy Fleet Building Purchasing Agent Charles Wendt updated the Court on the status of the new Road and Bridge building. Mr. Wendt discussed the plan to renovate the existing building at a cost of approximately $2.2 million dollars. The renovation will be completed in two phases. Phase One will include making the old Agriculture Extension Office habitable, in order for Road and Bridge personnel to operate there during the remodel. Phase Two will be the remodel of the Road and Bridge Building. Commissioner Konderla commended Purchasing for finding a way to complete the project under budget. A copy of the presentation is attached. Consider and take action on agenda items: 4 -19 4. Presentation and donation of Historic Brazos County Courthouse Newel Post and a block of red Limestone from the 1892 courthouse to Brazos County with a value of $2,500 by Justice Bill and Barbara Vance. Judge Peters introduced Justice Bill Vance, former Brazos County Judge and Justice of the 10th Court of Appeals. He then explained the historical significance behind the donation of the newel post and limestone. Judge Peters stated that he is excited to have both items back in Brazos County adding that they will be put on display in the Courthouse. Justice Vance came forward to speak. He noted that the newel post was part of the original Courthouse built in 1892 and gave further background on how he acquired both items. He stated that he was happy to donate the newel post and limestone back to the County. The Court thanked Justice Vance for his generous donation. Having considered the previously noted agenda items, Civil Counsel Bruce Erratt submitted a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Court in negotiations with a third party. A motion was offered by Commissioner Aldrich to meet in closed Executive Session as per Mr. Erratt's recommendation. The motion was seconded�by Commissioner Konderla and motion passed unanimously. At 11:05 a.m. the County Judge announced the meeting closed to the public, so the Court could'convene into Executive Session as stated above. Judge Peters reported there are 35 juveniles in the detention center, 26 are male and 9 are female, and 27 have electronic monitors. 22. Sheriff's report on inmate population. Chief Deputy Paul Martinez stated there were 710 inmates in jail, 610 inmates are male, 100 are female and 51 have electronic monitors. 23. Announcement of interest items and possible future agenda topics. Commissioner Konderla congratulated the Edge, Texas community for the designation of a historical marker. He stated that it is a fantastic historical community. Commissioner Aldrich announced that the MS-150 event was a success and that they hope to, have more volunteers next year. Judge Peters commended Collections Director Tanya Skinner for being featured in the County Progress magazine due to her great work in Collections. 24. Call for Citizen input and/or concerns' Patrick Baca stated that while attending the Wall that Heals, Vietnam Veterans Memorial, he was able to speak with numerous Veterans that are excited about the potential for Brazos County to have a Veterans Treatment Court. Mr. Baca thanked the County for the progress being made to determine the need of such a Court. Commissioner Berry noted the moving experience she had while visiting the Wall that Heals, Vietnam Veterans Memorial. 25. Adjourn. E 397 Pg. Most�of the work on the plan will begin during 2023 culminating with final adoption during the summer of 2025. • GMA-12 met several times during 2022 as the process of setting desired future conditions for all relevant - aquifers began its fourth planning round. The five Districts involved are: - Brazos Valley GCD (Brazos, Robertson) - Mid -East Texas GCD (Madison, Leon, Freestone) - Post Oak -Savannah GCD (Burleson, Milam) - Fayette County GCD - Lost Pines GCD (Lee, Bastrop) - The GMA 12 Explanatory Report was submitted to the Texas Water Development Board January 28, 2022 for review of administrative completeness. - The GMA 12 Explanatory Report and required paperwork were declared administratively complete on July 1, 2022. - The final adoption by directors of the Brazos Valley GCD desired future conditions for all relevant aquifers occurred August 10, 2022. Monitoring Well Network: • 195 wells are currently in the network 460 water level measurement were obtained in 2022 covering all .eight aquifers. " • Water level measurements are the basis upon which the aquifers are managed. The average of the measurements across the District determines the rate we are approaching the.DFC. • The adopted DFC for the Siimsboro aquifer is 262'. This simply means that the District desires the artesian head (static level) to be no more than an average of 262' lower (average across the District) in 2070 than 'it was in 1999. This measurement is achieved by averaging well measurements, up dip and down, and comparing that to the modeled amount for 2070. In April 2021 the District measurement was 43', well above our DFC. There has been a 16.4% reduction in artesian head pressure over the 22-year period. • The DFCs adopted in November 2021 during the GMA 12 planning process and the artesian head decline within each aquifer are: Aquifer DFCs ft drawdown Artesian Head Decline (2000-2070) (2000-2070) HOOPER SIMSBORO CALVERT BLUFF CARRIZO QUEEN CITY SPARTA YEGUA JACKSON Production Fees: 167' 6' 262' 43' 11Z' No change 84' 11' 44' No Change 53' 12' 67' +8' • 2022 productions fees were as follows: - Public water supply production fees were assessed at $0.04625/1000 gallons produced - Agricultural rate was $0.1875/acre foot - Steam electric rate was $0.2941/6cre foot - Industrial rates were $0.04625/1000 gallons produced - Transport rate was $0.17/1000 gallons produced minus the applicable production fee rate Vol. Pg. --. = Fees to be collected on 2022 production - $805,182.24 Grant Program: Implemented in 2014. Anyone can apply for grant funds with a project that will demonstrably produce water conservation. BVWaterSmart Lawn Irrigation Network rolled out ih February 2015. Involves a weather station/wireless rain gauge network that covers approximately 186 square miles in Brazos County. Entities involved include College Station, Bryan, Wellborn SLID, dnd Wickson"Creek SLID. Bryan is a partner in the project but opted to self -fund their portion without using grant money. - Grant funds were used to establish a website/webmaster program to alert, via email push, homeowners as to the amount of water for lawn irrigation weekly throughout the year. This is also viewable over the internet. - KBTX Conservation Tips aired from year-round to promote water conservation and promote the Irrigation Network. $31,000 was dedicated to this effort in 2018. - During the March 15th to September 1st period, the website received 288,627 visits from 15,674 individual users driven almost exclusively by the promotional advertisements. - The promotions are being done again in 2023 during the time frame mid -March through September with $21,000 dedicated. Cost share grant funding for newly installed Agricultural Pivot Irrigation remote control systems was, initiated in FY2020. During 2022, the District entered into cost share contracts on three (3) units. Cost sharing is at ' a rate of 50% of the total cost of equipment and installation with a maximum of $1,000.00/unit. FY2022 cost to the District was $3,000.00. Cost share grant funding for newly installed Agricultural soil moisture sensors was initiated in FY2022. During 2022, the District had no applications for purchases of soil moisture sensors. Cost sharing is at a rate of 50% of the total cost of equipment and installation with a maximum of $1,000.00/unit. FY2022 cost to the District was $0.00. Rules: • There were no rules changes made during 2022. The Rules Committee met December 8, 2022 for the annual review of the rules. Well Plueginr• - • A well plugging protocol was adopted by the Board in August, 2015 and extended in February, 2019-that mirrors the plugging rules established by the Texas Department of Licensing and Regulation (TDLR) except for: Brazos River Alluvium wells must be plugged under a more stringent protocol to avoid contamination of the aquifer. This is a blanket well plugging variance for all Brazos River Alluvium Aquifer wells in botli Brazos and Robertson counties. No variances fees are charged by the TUR to drillers due to our establishment of a District variance. The variance will remain in effect as long as the TDLR rules relating to well plugging do not change. A more robust well plugging program was put in place to incentivize the plugging of abandoned or deteriorated water wells. The District now pays 75% of the cost of plugging up to a $1000 reimbursement. 4 wells were plugged during 2022 under grant contracts totaling $3,784.89. The distributed number reflects the curriculum being readily available online. • The annual "Water Field Day" at the Robertson County Fairgrounds solely for all Robertson County 51h grade students was,postponed due to concern of COVID 19. The field day has been rescheduled for late May 2023. • The annual Brazos County "Water Field Day" for 511 grade students at Pecan Trail Intermediate School was postponed due to concern of COVID 19. The field day'has been rescheduled for late May 2023. • Adult educational presentations by the District included BCS Home & Garden Show and the Tri-County ` Winter Crop Meeting (BRAA•water levels) for agricultural producers. District Management Plan Update: • The District Management Plan was reviewed during 2018 as required under Chapter 36 of the Texas,.Water Code. Every five years, the Plan must reflect the updated goals and objectives of the DistrictrThe District initiated the'r{eview one year earlier than required in order to include the newly adopted Desired Future Conditions. The Plan has been submitted for preapproval and blessed for final adoption by the Board.
