PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section 551.042. INVOCATION Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business of the Court. Vol. .3 71 Pg. �� MINUTES OCTOBER 25, 2022 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting .of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, October 25, 2022 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1; Russ Ford, Commissioner of Precinct 2; Nancy Berry, Commissioner of Precinct 3; 1 rma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheets contain the names of the citizens and officials that were in attendance. Invocation and Pledge of Allegiance • U.S. and Texas Flag — Judge Peters 2. Call for Citizen input and/or concerns Dixie Bollin, mother of Larry Bollin who is incarcerated in connection with the Kent Moore Cabinet shooting, made allegations of issues within the Brazos County Jail and District Attorney's Office. Ms. Bollin stated that her son acted in self defense and demands changes to the Brazos County judicial system otherwise, she stated that she would take the issues further, if necessary. Roy Flores shared his opinion that lies are being told by the Regional Mobility Authority Chairman in relation to Proposition B on ballot for the November 8, 2022 Election. Vol. 322 — Pg. OaV-6 Judge Peters stated that Commissioners Court is not a forum to facilitate personal attacks. Consider and take action on agenda items: 3 -19 3. Ratification of the 2022 Brazos County tax rate per Section 26.05 (a) and (c) of the Texas Property Tax Code. The Commissioners Court voted unanimously to ratify the 2022 Brazos County tax rate established by Section 26.05 (a) and (c) of the Texas Property Tax Code, which provides for a total rate of $0.429411 per $100 of value which includes a debt rate of $0.040097 per $100 of value and a maintenance and operation rate of $0.389314 per $100 of value. Motion: Approve, Moved by Commissioner Nancy Berry, Seconded by Commissioner Irma Cauley. Passed. 5-0.. Ayes: Aldrich, Berry, Cauley, Ford, Peters. 4. Consider and take possible action on a county burn ban. Deputy Emergency Management Coordinator Jason Ware updated the Court on the continuation of dry weather conditions, despite the rain received on October 24, 2022. Mr. Ware shared that there is concern surrounding an active fire season. Commissioner Ford stated that he received 1.5 inches of rainfall last night and questioned whether tabling the burn ban for a week would be appropriate. Mr. Ware responded that the official rainfall amount countywide was only half an inch. Judge Peters asked for the recommendation of the fire chiefs to which, Mr. Ware replied three out of four are in favor of ordering the bum ban. Commissioner Cauley made a motion to order the bum ban and was seconded by Commissioner Berry. The Court voted four to one to pass the Order, with Commissioner Ford being the one opposing vote. Motion: Approve, Moved by Commissioner Irma Cauley, Seconded by Commissioner Nancy Bevy. Passed. 4-1. Ayes: Aldrich, Berry, Cauley, Peters. Nays: Ford. 5. Commissioner Berry thanked Ed Bull for the generous donation. Judge Peters also thanked Mr. Bull and stated that they are well on their way to getting everything set up for the Public Defender's Office. A copy of the donation form is attached. Juvenile Director Linda Ricketson reported there are 38 juveniles in the detention center, 29 are male and 9 are female, and 27 have electronic monitors. 23. Sheriff's report on inmate population. Sheriff Wayne Dicky stated there were 641 inmates in jail, 547 inmates are male and 94 are female, 48 have electronic monitors and 9 are pending for processing. Commissioner Ford asked Sheriff Dicky to explain the Jail mail situation referenced by Dixie Bollin during the Citizen input item. Sheriff Dicky explained that it is necessary to have mail scanned and sent electronically to eliminate the possibility of dangerous substances being sent through the mail and entering the Jail. 24. Announcement of interest items and possible future agenda topics. Commissioner Berry announced that early voting for the November 8, 2022 election has begun and listed the five early voting locations. 25. In November 2022, the RMAwill be asking Brazos Countyvotersto approve a $10 increase in the vehicle registration feel to support RMA activities. This document outlines the philosophy that the RMA will follow and the specific tasks that the RMA will undertake, should voters approve the increase in the county vehicle registration fee. Primary Roles of the RMA The RMA will serve primary three roles in addressing transportation needs and issues in Brazos County. • The RMA will undertake legislatively required actions to significantly reduce the time required to identify and implement a range of multimodal projects already prioritized by the Bryan/College Station Metropolitan Planning Organization (MPO) planning. process. • Working closely with local transportation partners, the RMA wil take a lead role in addressing key issues involving countywide transportation. • in cooperation with it's partners, the RMA will seek new and different funding streams to accelerate the development of locally propritized projects. 2 1 P a g e Vol. %1 Pg. _-:a_ BRAZOS COUNTY RESOLUTION LEVYING A TAX RATE FOR THE COUNTY OF BRAZOS FOR THE TAX YEAR 2022 WHEREAS, the Commissioners Court is responsible for the levy for adoption of a tax rate for Brazos County. Texas 77803 • Fax: (979) 361-4176 Vol. 37 j _ pg. ��� BRAZOS COUNTY BRYAN, TEXAS PROHIBITION OF OUTDOOR BURNING WHEREAS, in accordance with provisions of the Texas Local Government Code, Chapter 352, a drought condition exists or has existed in Brazos County, Texas as determined by Texas Local Government Code Chapter 352; and, WHEREAS, the Commissioners Court makes a finding that circumstances present in all or part of the unincorporated area of Brazos County create a public safety hazard that would be exacerbated by outdoor burning. BE IT THEREFORE ORDERED that the following regulations are hereby established for all unincorporated areas of Brazos County, Texas for the duration of the above mentioned declaration; Action Prohibited: A person violates this order if he or she bunts any combustible material outside of an enclosure serving to contain all flames and/or sparks, or orders such burning by others. 2. Enforcement: A. As soon as possible, a duly commissioned peace officer shall be sent to the scene to investigate the nature of the fire. B. Upon notification of suspected outdoor burning, the fire department assigned to the location of the fire shall respond to the scene and take immediate measures to contain and/or extinguish the fire. C. If in the opinion of the officer at the scene and/or the fire chief, the goal of the order can be attained by informing the responsible party about the prohibitions established by this order, the officer may, at his discretion, notify the party about the provisions of this order and request compliance with it. In such instances, an entry of the notification shall be made into the dispatchers log containing the time, date, and place of the warning, and the name of the person receiving the warning. At the discretion of the peace officer or the fire chief, second or flagrant violations of the order may be prosecuted in accordance with the statutes and procedures governing misdemeanors. 4. This Order prohibiting Outdoor Burning takes effect on October 25, 2022 and will expire on January 25, 2023 unless terminated earlier by the Commissioners Court or the County Judge. The Commissioners Court hereby designates to the County Judge the authority to terminate this Order in accordance with Local Government Code Section 352.081(c)(2). 5. This prohibition does not apply to prescribed outdoor burning activities related to public health and safety and/or trench -burning related to public health and safety that are authorized by the Texas Commission on Environmental Quality for: (1) firefighting training; (2) public utility; (3) natural gas pipeline or mining operations; (4) planting or harvesting of agriculture crops; or (5) burns that are conducted by a prescribed burn manager certified under Section 153.048 of the Texas Natural Resources Code" and meet t of Section 153.047 of the Texas Natural Resources Code. Vol. �377 Pg. 6. Exception(s): A. Welding Welding may be allowed under the following guidelines only: Provide a spotter for each welder, each cutter, each grinder, and for any activity that causes or may cause a spark. • Maintain a minimum perimeter around the welding area of a radius of 25 feet or three times the height of the actual welding, whichever is greater. (Example: if the welding is occurring ten feet off the ground, a perimeter of thirty (30) feet radium must be protected). The perimeter must be clear of vegetation and kept wet. FUNDING AGREEMENT BETWEEN BRAZOS COUNTY AND BRAZOS COUNTY SOIL & WATER CONSERVATION DISTRICT #450 THIS AGREEMENT FOR FUNDING ("Agreement") IS ENTERED INTO BY AND BETWEEN BRAZOS COUNTY, TEXAS, acting by and through its duly elected County Commissioners (hereinafter "County"), and the BWOS COUNTY SOIL $ WATER CONSERVATION DISTRICT #450 (hereinafter "District"), located in Bryan, Texas, and is effective October 1, 2022. RECITALS WHEREAS, the District, and County do hereby enter into a contractual agreement for the District to provide soil and water conservation services to the residents of Brazos County and to the County proper. The District as the recipient, shall furnish to the County's Auditor, at a minimum, documentation indicating the use of funds received from the County. The County's Auditor may require the recipient to provide information necessary for the County Auditor to properly account for all funds expended or received by the District; and WHEREAS, those services will include, but not be limited to, erosion control, water management, and rural development ("Services"). This will be carried out by planning and application through informal agreements with land users, or, as required by Federal or State law. An information and recognition program will be used to inform the public. Technical assistance is utilized through a Memo of Understanding between the District and the USDA - Natural Resources Conservation Service; and WHEREAS, erosion control will keep the land productive for its various uses for many generations. Sediment resulting from erosion clogs our local streams reducing water carrying capacity and resulting in local flooding. Excessive siltation ruins our local wetlands, and; therefore, reduces a dwindling wildlife habitat. Silt from erosion carries many pollutants directly into our local streams and rivers. Conservation practices consist of erosion control structures, erosion control ponds, gully shaping, diversions, vegetating old fields, proper management of grazing resources; and WHEREAS, water management includes recommendations for proper irrigation, flood control, and water quality. Irrigated crops account for 75% of all water used. Proper irrigation saves that resource for tomorrow's uses including domestic consumption. Proper irrigation helps to keep agriculture pollutants from entering underground water supplies. Conservation practices include total evaluation of irrigation systems and application procedures, precision land leveling, and underground pipelines. Water management includes floodplain management; and WHEREAS, the District's role in rural development in Brazos County is in providing fire protection utilizing.dry hydrants. Insurance rates outside the city limits can be lowered a great deal, as well as provide a reliable source of water to tight rural fires. WHEREAS, the District and the County have interacted ever since the inception of the District in 1942. Many conservation problems affect not only the individual landowner but the County itself. NOW THEREFORE, the parties agree to the following terms and conditions. AGREEMENT PAYMENT AMOUNT FOR FY 2023 County hereby agrees to pay the District a total payment of $5,000.00 ("Funds") for the year beginning October 1, 2022 and ending September 30, 2023 for services provided to the County. Payment of such sum will be paid upon receipt of invoice. ACCOUNTING AND AUDIT The District agrees that Brazos County, or its designated representative, shall have the right to review and to copy any records and supporting documentation pertaining to the performance of this Agreement. The District agrees to maintain such records for possible audit for a minimum of three (3) years after the termination date of this Agreement unless a longer period of records retention is stipulated. The District agrees to allow the auditor(s) access to such records during normal business hours and to allow interviews of any employees who might reasonably have information related to such records. The District agrees that Brazos County, or its designated representative, shall further have the right to review and to copy any records and supporting documentation for prior years in which Brazos County provided funds to the District under prior Agreements. Brazos County Commissioners Court may, in its sole discretion, require that an independent financial audit be performed on the records of the District. If an independent financial audit is performed, a management letter will be prepared by the auditor as part of the process and a copy of said management letter shall be delivered to the Brazos County Commissioners Court. The management letter shall identify issues that might not otherwise require disclosure in the District annual financial report, but which are of concern to or under the suggestion of the auditor. If the Brazos County Commissioners Court determines that the audit will be conducted by an independent third party, all costs and expenses associated with said audit will be solely paid for by the District. Richards, D:O. "AKA" Richards Emergency Services, PA ("Provider"). 1. Provision of Services - The Provider agrees to provide medical and .health services, and, medical. director services, at. the Brazos County Jail, Brazos County Juvenile Detention Center and the'Brazos County Employee Health and Wellness Clinic in: accordance with E x h i'b i t `-A" and this A g r e;e'm ant . This includes all necessary physician and medical director services as set; forth in the Exhibit "A" and this Agreement:, 2. Terms and Conditions - The terms and conditions 'of this Agreement are as set forth below and in Exhibit "A". Except ,as otherwise stated, modified or supplemented in this Agreement. Provider must implement procedures and oversight to maintain compliance with applicable laws, and. the regulations of the Texas Commission on Jail Standards, with regard to delivery of the services. 3. Term of Asreemenl - Unless -terminated earlier as provided herein, the term .of this Agreement is One (1) year beginning on the date, that the medical malpractice insurance has been obtained and/or confirmed; but no later than September 1, 2020 and ending no later:than August 31, 2021. Additionally, this Agreement is renewable,, in, its enfirety., for additional one (1) year terms;as agreed to by the parties. 4. Fee - Provider's annual fee for .services under this Agreement is° Two Hundred Thousand Dollars: and No Cents ($200,000). This ,fee is inclusive of all professional services to be provided 'by the Provider. The fee does not include costs retained by the County, such as malpractice insurance, §uppli'es, medications, County employee salaries, or outside care. 5.. Termination - This Agreement may be terminated by the County after thirty (30) days written notice and opportunity to cure (if cure is possible)for any of the following reasons: a) failure of Provider to provide the:services as promised; b) irreconcilable conflict between Provider and 'County Staff (employees and/or patients); c) repeated violations,of Jail security rdles;, d) negligence in rendering care to patients; e) sexual, racial or other type of prohibited harassment by medical staff of Jail staff; inmates or county employees; any romantic relationship between a member of medical staff and any inmate; g) violation of confidentiality laws relating to health care information;; h) failure. or refusal to cooperate with Jail staff in. the investigation of grievances or complaints; i) determination after an internal investigation, notice,.and an opportunity to be heard that the. Provider has violated the civil .rights of an inmate; or j) arrest of.Provider for a felony or misdemeanor of Class B or above. 7. Immediate Termination - The County may terminate this Agreement immediately and without any notice or cure period if: a) Provider is convicted of a felony or a misdemeanor. of Class B .or above; b) A court- determines that the Provider failed to provide medical care to any inmate at the Jail in accordance with the accepted standard of care; c) Suspension or revocation of medical license; d) Violation of the civic rights of an inmate as determined by- a court of competent jurisdiction; or e) Where care is so objectively deficient as to create a risk to County, Patients and potential liability to the County. 8. Termination by Provider - Provider may terminate this Agreement after 30 days written notice to the County and opportunity to cure if the -County fails to .pay the ,fee .payments as required herein. 9. Notice of .Termination - If in the event the Provider .provides written notice to the County of termination and/or. the Provider desires not to renew this contract. Provider agrees to continue a month to month, agreement for the same services and rate with the County for a reasonable period of time so, that an appropriate replacement can. be, found and traiisitioned into the Provider.'.s position. 10. MedicaI Judgment .Medical care must be rendered based on medical judgment 2Vol. 3 7Y P and the medical needs of the patient at all times. The Provider has exclusive control of the standard of care and treatment that a patient receives and is in no way subordinate to any other County employee or elected official in that determination. The Provider shall exercise the degree of professional skill appropriate in the relevant medical community in carrying out its duties under this Agreement. 11. Independent Contractor - Provider shall not be considered an employee of the County for any purpose, including but not Iimited to payroll taxes and withholding, health insurance, unemployment insurance, or retirement. The Provider is an independent contractor providing professional medical services using its own training, skill and medical judgment. 12. Employment Decisions - Relating to County Employees. The Provider shall have the authority to temporarily remove a medical employee from duty if necessary for patient welfare. Employment decisions involving demotion, unpaid suspension or termination will be made by the County Judge and/or County Commissioners. All final hiring and firing decisions relating to medical personnel rest with the County Judge and/or County Commissioners. 13. Peer Review - As part of the Provider's duties as Medical Director, the Provider shall establish a peer review process for medical personnel when appropriate. 14. Insurance - Malpractice insurance shall be either obtained by the County or the Provider. For the purpose of meeting the terms of this Agreement, liability limits are required to be one million ($1,000,000) per occurrence and three million ($3,000,000) aggregate. 'If the Provider obtains the malpractice insurance, the County shall reimburse the Provider for that portion of insurance that covers the terms of this .Agreement. Provider agrees to comply with any reasonable request from the County to procure said Insurance. The Provider shall submit proof of insurance coverage prior to the start of services which shall name Brazos County as an addition insured. Proof of insurance shall also be submitted by the Provider at any other time during the term of this Agreement on the reasonable request of the County. The insurance policy must contain a 30-day notice to the County before expiration or termination. 15. Indemnity — The Provider and the County mutually agree to indemnify and hold each other harmless and defend each other, their officers, agents and employees from and against any and all claims, losses, damages, causes of action, suits and liability of any kind, including all expenses of litigation, court costs and attorney's fees, for injury to or death of any person or any breach of contract, arising .out of each parry's own negligent acts. 16. Third Parties - No provision of this Agreement shall inure to the benefit of any third party, including, but not limited to, inmates or employee patients. No other person or entity other than Physician and County may enforce any portion of this Agreement. 18.. Anplicable Law and Venue - This Agreement shall be construed according to, and the rights of the parties shall be governed by, the laws of -the State of Texas. Venue of any action arising out of this Agreement shall be in a court of competent jurisdiction -in Brazos County, Texas. 19. .Assignability - This Agreement is not assignable by the Provider without the prior writing consent of the County. 20. Miscellaneous - This Agreement may only be amended by a writing signed by both parties. If any of the provisions of this Agreement are found by a court of competent jurisdiction to be invalid or unenforceable, they shall be-severabld from the remainder of this Agreement and shall not cause the invalidity or unenforceability of the remainder of this Agreement. PROVISIONS OF SERVICE Service Aaency, shall provide: • Residential services, including.food, shelter and supervision. • Necessary counseling services including individual, family, and.group sessions. • Education through its residential Campus • A completed application for Medicaid for the youth upon admission. Each youth placed at the Service Agency will have a written initial Service Plan (ISP) completed by the appropriate Service Agency Staff within (S) days and a (90) day review will be completed every (90) days from the time of admission with a (30) day review in between. A copy of the reviews will be sent to the appointed Probation Officer. The provision does not apply to youths 'receiving Emergency Care, Service Agency shall: • provide each youth's Probation Officer with a written report of the youth's progress on a monthly basis. • ensure that the County approves, in. writing the youth's participation in any furloughs, home visits, or extended agency trips. • ensure that -unless, otherwise stipulated by the County, the youth may visit freely with parent(s) and relatives at the Service Agency in accordance with established Service Agency policies. • ensure that suspected or alleged cases of child abuse are immediately reported to the County Placement Officer, proper authorities and the Department 6f Protective and Regulatory Services.. .If a youth in placement at the Service Agency makes an unauthorized departure, becomes seriously ill, 'is involved in an incident of a serious nature, the Service Agency shall notify the youth's Probation Officer -and the County Placement Officer immediately and ensure that the parents and proper authorities, including the Texas Department of Protective and Regulatory Services are notified. The County reserves the right to terminate the youth's placement at the Service Agency at its discretion. The Service Agency must not release the youth to any person or agency without the express consent of the County. The Service Agency -is under no obligation to accept a youth who is deemed inappropriate for placement in the program -by the Service Agency. !Vol. 3 7 Pg. 0 H. PAYMENT.FOR SERVICES 'For and in consideration of the above -mention- services, the County agrees to pay the Service Agency $1.97.69.per.day per youth -for SPECIALIZED and $277.37 per day per youth for INTENSE. This fee does not exceed the actual .cost of children in in the Service Agency, and does not exceed the amount allowed in the current CJD Maximum'Itate Schedule. The County a er es to pay the Service Agency based on the TDFPS level of care:(LOC) as currently effective or subsequently amended. Service Agency shall submit -a billing statement to the County for services on a monthly basis. Each billing statement shall contain the natne'of the youth(s) along with the number of days (stated consecutively):for which payment is requested. 'Recognized that a part of the youth's -rehabilitation, program may include time away from the Service Agency :such as weekends, -holidays etc.. The Service Agency must retain space for the youth until their -retgrn. The County will pay the above agreed .amount for such regular scheduled days away from the Service Agency or its program providing fihey do not exceed (16) days at a time., The Service Agency is under no obligation to retain space for the youth.in an unauthorized departure situation. The County agrees to provide transportation for the youth(s) to and from Service Agency at the time of .admission and discharge. Should the Service Agency provide transportation services, reimbursement for transportation cost must be approved by a member of the County Juvenile Probation Department. The Service Agency is respon§ible for all transportation incidentals to the care of the youth, including medical and dental visits. Service Agency may request that the parents contribute to transportation cost -for furlough -from placement. .Medical and Dental services shall be reimbursed by the County upon the submission of a billing .statement/invo-ice for said services. III. EXAMINATiO'N' OF PROGRAM AND RECORDS The Service Agency agrees to maintain and make available for inspection, audit, or reproduction, by an authorized representative of the County and the State of Texas. Books, documents, and other evidence pertaining to the -receipt and expenditure of any and all funds received under this Contract, herein after called the records. 'The Service Agency agrees that it will permit the County to examine and evaluate its program of services provided under the terms of this Contract and to review the -youth's record. The examination and evaluation of the program will include unscheduled site visitations and observations of the program .in operation. The Service Agency shall provide the County such descriptive.information on contracted youth as requested. The Service Agency agrees to maintain these Records for (7) years after final payment or,until the State approved audit if any, has,been made and all questions there from resolved. IV. FEE ASSESSMENT Provide certification eligibility, Under Section 231.006 Family Code, the vendor or applicant certifies that -the individual .or:business entity named in this contract bid, or application is not ineligible to receive the specified grant, loan or payment and acknowledges that this contract may be terminated and .payment -may be withheld if this certificate is inaccurate. Youths :and their.famiiies shall not be assessed for services by the Service Agency, unless the Court _specifies arrangements. This does not prelude reasonable attempts to seek voluntary contribution from families of the County for donations of -clothing, personal articles, and funds. to assist in supporting ,youth's rehabilitation. If A youth is eligible for fiscal support from another State Agency or Organization, the Service Agency shall ensure that the County is not -charged for such -fiscal support for which is .otherwise eligible..' Service Agency Is hereby notified.that, state funds are used to pay for services rendered to the County Juvenile Probation Department. For this reason, Service Agency shall account separately for the receipt and expenditure of all funds. Service Agency agrees to make claims for payment or direct any payment disputes to the County Juvenile Probation's Fiscal Officer. Service Agency will not contact other department :employees regarding -any claims of payment. V EQUAL OPPORTUNITY _ The Service Agency will not discriminate against -any employee, applicant or patient because of race, religion, color, national origin, age, or handicapped condition. The Service Agency will take affirmative .action to ensure that applicants and employees are treated with respect during employment without regard to their race, religion, color, sex, national origin,- or handicapped condition. VI. TERMINATION This Contract may be terminated by either party, upon (10) days written notice to -the other parry of the intention to terminate upon expenditure of funds. The County may upon (30) calendar days written notice to Service Agency, to terminate the contract in any one of the following circumstances if. Service -Agency fails to comply with the County's reporting requirements, the objectives, terms, .conditions, or standard of this contract applicable federal, state, of local laws, rules regulations.and ordinances, or any other requirements set forth in this contract. If Service Agency fails to perform the work and services required by this contract within the time specified herein or any extension thereof. Service.Agency fails to correct its noncompliance with any terms or provisions,ofthis contract within (30) calendardays (or any extensions.as authorized by the -County in writing) after receiving notice of noncompliance or funds allocated to the County by the State should become -reduced, depleted, or unavailable during the Contract term. NH. LAWS AND VENUE In any legal action arising under this contract, the. laws shall apply and venue shall be in San Patricio County, Texas. VIIL CONTRACTED PERIOD The term of this agreement is for twelvemonths, commencing September 1, 2022 and ending August 3:1, 2023,-unless one party notifies the other in writing, at least (30) days prior to the expiration of said term, of its intention to not renew this agreement. ice -Provider hereby represents and warrants the Vol. 379 Pg. 6 O That it has all necessary right, title, license and authority to enter into this Agreement, Service. Proof of such certification, approval or license shall be provided to the County Juvenile Probation Department within (10) days of execution. of this :document. The Service Agency shall -instruct his insurance agent or carrier to furnish to the County a Certificate of insurance attesting to the issuance of the following parts of this section. Please note that such Certificates of Insurance and must be- issued and then approved by Brazos County Risk Management. The Certificate of Insurance must be approved by Risk Management before any services can be rendered. The Service Agency shall furnish and keep in full force the following insurance during the term of this Contract: General Liability with limits for bodily injury and for property damages of not less than $1,000,000 aggregate, with Brazos County named as an additional insured with waiver of subrogation in favor of Brazos County. Professional Liability (Errors and.On-fissions) insurance appropriate to the services being provided, with limitno less than $1,000,000 per occurrence or claim, $2,000,000 aggregate. If the Service Agency maintains broader coverage and/or higher limits than the minimums shown above, Brazos County requires and shall be entitled to the broader coverage and/or the higher limits maintained by the Provider. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to Brazos County. Abuse and molestation insurance as an endorsement to the professional liability policy with coverage for damages arising out of actual or threatened physical abuse, mental injury, -sexual molestation, negligent: hiring, employment, supervision, investigation, reporting to proper authorities, and retention of any person for whom the Service Agency is responsible including 'but not limited to Service Agency and Service Agency's employees and volunteers. Policy endorsement's definition of an insured shall include the Service Agency, and the Service Agency's employees and volunteers. Coverage shall be written on an occurrence basis in an amount of not less than $1,000,000 per occurrence. Any annual aggregate limit shall not be less than $2,000,000. These limits shall be exclusive to this required coverage. Incidents related to or arising out of physical abuse, menial injury, or sexual molestation, whether committed by one or more individuals, and irrespective of the number of incidents or injuries or the time period or area over which the incidents or injuries occur, shall be treated as a separate occurrence for each victim. Coverage shall include the cost of defense and the cost, of defense shall be provided outside the.coverage limit. Commercial Automotive Liability with $1,000,000 CSL for Bodily Injury and Property Damage Liability with Brazos County named as an additional insured with waiver of subrogation in favor of Brazos County. All of the aforementioned policies and Certificates of Insurance should be issued immediately after the Service Agency receives notification of contract approval. Vol. 3 7 % Pg. E The Service Agency agrees to release and hold harmless Brazos County from any and all claims and liability due to the acts of the Service Agency's employees and the operation of his equipments The Service Agency also agrees to hold harmless Brazos County from -any and all expenses, -including attorney fees'Ancurred by Brazos County in litigation or otherwise resisting such claims or liabilities as a result of the Service Agency's'employees' activities. Further, the Service Agency agrees to protect, uidemnify and hold harmless Brazos County from and.against all claims, demands .and causes of action of every kind and character brought by any.employees of the Service Agency against Brazos County due to personal injuries and/or death to such employee resulting from any neglect act, by either commission or omission on the park of the Service Agency or Brazos County. X. PROVISIONS OF SERVICE The County agrees to purchaser 24 hour therapeutic child care from the Service Agency who is licensed by the Texas Commission on Alcohol & Drug Abuse as a Substance Abuse Treatment Facility, herein referred to as Commission, to provide Levels of care of Level I, Level II, Level III, and Level IV, such levels as defined by the Commission's licensing standards. Service Agency agrees'to provide room board and supervision and care, 24 hours a day. In order to determine the quality of services for the youth's placements, Service Provider agrees to define goal outputs, -and measurable outcomes. The progress for each youth -is monitored through a Level Point System., The System is designed to -help staff assess rewards and assign consequences as part of the behavioral modification modality. The behavioral, emotional, and physical and education statue of each youth is taken into consideration. Assessment of the youth's progress through the level system and successful completion of the Initial Service Plan will carry the following weight (1) Unit Behavioral 40%- (2) Therapy/Treatment Plan Participation 25%; Recreational Therapy Participation 15%;.and School Participation 20% in the determination of the discharge prognosis and program completion. XI. PLAN OF SERVICE Service Agency agrees to develop a written Initial Service Plan(ISP) for each youth. Each (ISP) will define.goals, outputs, and measurable outcomes that directly relate to the program .objectives. XH. THE INITIAL SERVICE FLAN AT MINIMUM Have goals for the Youth to learn adequate social skills, refrain from hostile aggressive acts -toward others, and learn how to develop positive relationships with the family unit and/or society that will help toward a. resolution of the problem(s) for which treatment is purchased and learn how to develop a chemical free lifestyle. Enhance and/or develop and further educational skills for the youth Vol. J 7 Pg. �S Successfully complete ,the program with a minimal number of incidents. Provide at least 150 hours of counseling. Provide individual therapy at least weekly and group therapy at least two. times per week and Group counseling three times per"week, and family therapy as geographically possible. All therapy and .counseling sessions shall be performed by the appropriate Qualified Credentialed Counselor (QCC). The QCC must meet the requirements as determined by the Contractor's Licensing Agency. The (ISP) shall .contain the reasons for placement and specific details pertaining to goals and future objectives. It shall provide, at minimum, each youth's Probation -Office with written reports of the youth's progress on a monthly basis. Service Agency will not release the youth to. any person or agency without the express consent of the County Juvenile Probation Department. Service Agency will obtain approval from the County for Youth's participation in any furloughs, home visits, or extended agency trips. XIII. OUTCOME MEASURES Evaluation of the contract by the County will be performed by using the following OUTCOME MEASURE: (1) 80% of placements remain chemical free and without incident for one year from the time of discharge; (2) 80% of placements will successfully complete their transition back into public schools without further incidents; (3) 80% of placements will report improved family functioning; and (4) 80% ofprogress reports will be received in a timely manner. XIV. PRISON RAPE ELIMINATION ACT Service Agency shall adopt and comply with all federal, state, county, and city laws, ordinances, regulations and standard ,applicable to the provisions of the services described herein and the performances of all the"obligations undertaken pursuant to the contract including the Prison Rape Elimination Act of 2003 (PREA) which establishes a zero -tolerance standard against sexual assault -of incarcerated persons, including juveniles, and addresses the detection, elimination, prevention and reporting of sexual assault in facilities in housing adult and juvenile offenders [PREA§ 115.312(a)]. Under PREA, Service Provider shall make available to the CPO all incident -based aggregated data reports for every allegation of sexual abuse at its facility or facilities, and all such data may be requested by the Department of Justice from the previous calendar year no later than June 30 [PREA§115.876 and (f)]. Under PREA, the Service Agency shall be subjected to annual contract monitoring by the .County Juvenile Probation. Department to ensure. that the Service Provider, is complying with the PREA Standards [PREA§ 115.312 (b)]. To comply with this standard the Service Agency will make available to the CPO all incident -based aggregated sexual abuse data within 24 hours of the allegation. Certain interviews and outreach efforts may be completed by the Auditor telephonically during this phase. The pre -audit phase will take approximately 8 weeks -to complete. Phase It: Onsite Audit This phase will be geared to take advantage of the limited time onsite. An entrance meeting will be held with facility leadership -to review the audit schedule, discuss expectations, and select interviews. The Auditor will conduct a thorough examination of the entire facility and observe routine activities. The Auditor will interview staff, contractors. volunteers, and residents. The Auditor will also review and retain key documents maintained by the facility. These elements will form the foundafiari of a practice -based audit methodology. The agency shall bear the burden of demonstrating compliance with the PREA standards. The Auditor will complete the Auditor Compliance Tool that reviews each provision of every standard, An exit meeting will be held with facility leadership to review next steps and timelines and to obtain any additional- information arid documentation the Auditor may still need. The onsite audit phase depending on the size of,the facility and the availability and scheduling of interviews could take up to three days to complete. Phase III: Post-Onsite Audit The Auditor has 45 days to review all the evidence collected using a triangular approach, write an interim report (or final report if there are no corrective action items) and submit the report to the audited facility and/or agency. Frequent communication between Auditor and PREA staff will be necessary during this phase. The report will be submitted through the PREA Resource Center's Online Audit System with a hard copy emailed to thef facility. The interim report will identify noncompliance and corrective action steps to be taken by the facility. Phase IV: Corrective Action and Final Report Noncompliance and corrective action are normal and expected parts of a PREA audit. The Auditor will identify deficiencies; recommend corrective actions to be taken, identify timelines; and serve as a guide to the facility and agency -as they make the changes necessary to become fully PREA compliant. The corrective action period may last up to 180 days from the issuance of the interim report. The Auditor will take all necessary and appropriate steps to verify Implementation of the corrective action plan. After the corrective. action period, the Auditor will issue a final audit report within 30 days. The final audit report will be the only report issued to the facility that must be made publicly available. The agency may lodge an appeal with the Department of Justice regarding any specific audit finding that it believes to be incorrect. Such appeal must be lodged within 90 days of the Auditor's final determination. The agency shall bear the cost of a re -audit.
