Vol. Pg. .3 & . i PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal10 abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court; or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take'action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers ;may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. To make arrangements, please call (979) 361-4102. r MINUTES J U N E 7, 2022 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, June 7, 2022 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1; Russ Ford, Commissioner of Precinct 2; Nancy Berry, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Invocation and Pledge of Allegiance U.S. and Texas Flag — Judge Peters 2. Call for Citizen input and/or concerns There was no Citizen input. Consider and take action on agenda items: 3 - 22 3. Approval of Resolution 22-011 establishing a salary grievance committee process for elected officials. Initially a motion was made to approve the item by Commissioner Cauley and seconded by Commissioner Berry. During the discussion portion, Risk Manager Leslie Contreras presented the Commissioners Court with three coverage options regarding property insurance.,Ms. Contreras stated that due to several major incidents and other smaller incidents there have been 11 claims filed over the last 4 years, resulting in approximately 8 million dollars worth in claims. TAC Risk Pool'representative Lisa McCaig then gave her recommendation of Option 2. She believes the best course of action for the Commissioners Court to take is to choose the middle option and allow TAC to assist the County with their PropertyMaintenance Program to mitigate future damages. The Commissioners Court entered into discussion on the matter noting concerns of funding an increased deductible and taking into consideration the potential for catastrophic events. Commissioner Ford stated that he did not feel prepared to make a decision at this time and requested further information. Ms. McCaig explained that the deadline for property coverage renewal is July 1, 2022. Considering the fast approaching deadline, Commissioner Cauley requested the opinion of Auditor Katie Conner and Purchasing Director Charles Wendt. Ms. Conner explained other options the Court could consider if they choose not to continue with any of the options given by TAC such as, going out for bid to test the insurance market. Mr. Wendt added that while going out for bid is an option, it would be difficult to do prior to the renewal deadline. After further discussion by the Court a motion was made by Commissioner Berry to approve Option 2 with TAC Risk Pool. The motion was seconded by Commissioner Cauley. There were 4 ayes and Commissioner Ford voted against. The motion passed to approve Option 2. A copy of the given options is attached hereto. Motion: Approve, Moved by, Seconded by. Passed. 4-1. Ayes: Aldrich, Berry, Cauley, Peters. Nays: Ford. 7. Approval of Vehicle Use and Driver Policy. This policy is a minimum standard policy and will apply to all departments superseding all other previously approved driver and vehicle use policies. Initially a motion was made to approve the item by Commissioner Berry and seconded by Commissioner Cauley..During the discussion portion Commissioner Ford raised concerns regarding the efficiency of each employee having to complete a very thorough inspection of County vehicles prior to daily use. Commissioner Aldrich agreed stating that it was too much to ask of each individual employee and ultimately, inefficient. Risk Manager Leslie Contreras clarified that the daily inspections are a recommendation, not a requirement. Commissioner Cauley suggested a change in wording to better clarify that it is recommended and not required. An amended motion was made to table the item to correct the issue by Commissioner Berry and seconded by Commissioner Cauley. The Court voted unanimously to table the item. At this point, the County Judge announced the Court would consider items 23 through 27 and then return to convene into Executive Session. Having considered the previously noted agenda items, Civil Counsel Bruce Erratt submitted a written determination on the second session pursuant to 551.0725 that deliberation in an open meeting would have a detrimental effect on the position of the Court in negotiations with a third party. A motion was offered by Commissioner Aldrich to meet in closed Executive Session as per Mr. Erratt's recommendation. The motion was seconded by Commissioner Cauley and motion passed unanimously. The County Judge stated that the Court would discuss the session listed as "b" on the agenda first and then do session "a". At 10:43 a.m. the County Judge announced the meeting closed to the public, so the Court could convene into Executive Session as stated above. Juvenile Director Linda Ricketson reported there are 38 juveniles in the detention center, 29 are male and 9 are female, and 29 have electronic monitors. There are 5 youth in isolation as per medical protocol for new intakes. 25. Sheriff's report on inmate population. Sheriff Wayne Dicky stated there were 615 inmates in jail, 520 inmates are male and 95 are female, 65 have electronic monitors and 11 are pending for processing. . 26. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners Court of Brazos County hereby establishes a salary grievance committee as follows: 1. - The'salary grievance committee will be structured as provided in Texas Local Government Code Chapter 152.014(a)(2). a. The County Judge will operate as the committee chairman and the sole non -voting member. b. The nine public members and four alternate public members are to be selected as set forth in accordance with Texas Local Government Code Chapter 152.015. c. The salary grievance committee will be appointed by the Commissioners Court on or before August I" of each calendar year. 2. The National Center for Missing and Exploited Children estimate one out of 6 missing children of that age range are likely victims of trafficking, this would indicate 14 or more annually could be victims here in the Brazos Valley. When Waco's task force began in 2015 they recorded 4-6 cases annually; currently over 100 a year for the past 3 years. The DA's Office is still compiling data for this grant. Initial research shows 1 conviction for human trafficking, 1 dismissal for HT,1 conviction for Agg. To enhance capacity to identify, assist, and provide services to all victims of human trafficking, the Office for Victims of Crime (OVC) leads the Nation in supporting victim -centered and trauma -informed programs, policies, and resources that promote justice, access, and empowerment. This solicitation's purpose is to support multidisciplinary, collaborative model task forces to combat human trafficking, as defined by the Trafficking Victims Protection Act (TVPA) of 2000 and its reauthorizations. This program will provide funding for services to victims of human trafficking, as defined by 22 U.S.C. § 7102(11). Statutory Authority 22 U.S.C. § 7105(b)(2) and 34 U.S.C. §20705 Specific information The purpose of the Enhanced Collaborative Model (ECM) Task Force to Combat Human Trafficking Program is to develop, expand, or strengthen a multidisciplinary approach to fight human trafficking. This collaborative approach must include victim and social service providers, law enforcement and prosecution personnel (local, state, and federal), survivors, and a range of other governmental and non -governmental partners that work together to provide a diverse set of appropriate services for trafficking victims. ECM task forces also train law enforcement and other stakeholders in how to identify victims of trafficking in persons and related offenses, and conduct victim -centered and trauma -informed investigations to prosecute traffickers. This program expects a co -leadership model approach, with shared decision making by both the lead law enforcement and the lead victim service provider applicants. Purpose Area 1— Development of New Human Trafficking Task Forces: Task forces that are newly formed (formally operational less than 3 years) or have never received funding under the OJP ECM Task Force Program are eligible to apply. Purpose Area 1 funding will help new task forces with critical first steps related to starting up a multidisciplinary task force and establishing a strong foundation of task force codeadership structure, clear roles and responsibilities, and internal processes and protocols. Enhancing Access to Services and Promoting Survivor Autonomy OVC is committed to an approach to human trafficking that is trauma informed, victim centered, survivor informed, culturally competent, and evidence based. Definitions of key concepts are included below and more are available in the glossary of OVC's Model Standards for Serving Victims and Survivors of Crime. In line with these concepts and to enhance survivors' access to victim services, programs funded under this solicitation will engage in practices that remove barriers to receiving services and support survivor autonomy. This will increase victims' access to services by reducing certain requirements that may prohibit some individuals from engaging In services; promoting survivors' choice within service delivery; and protecting victim privacy and confidentiality. Successful grantees will demonstrate their commitment to this approach by maintaining the following (Note: many of these requirements are mandated by federal civil rights laws, while others reflect OVC's policy direction to recipients to enhance access to services and promote survivor autonomy): . procedures or policies that provide all survivors access to safe shelter, advocacy services, . counseling, meaningful access to language assistance services, and other assistance without exclusions based on actual or perceived sex, age, immigration status, race, religion, sexual orientation, gender identity, menial health condition, physical health condition, criminal record, involvement in commercial sex, Income or lack of income, or the age and/or sex of. their children. For youth - serving programs with justifiable mandatory requirements, a shared decisionmakinq model should be . project designs, products, services, and budgets that consider the unique needs of individuals with disabilities, limited English proficiency, or who are Deaf or hard of hearing, including accessibility for such individuals. Under the ECM co -leadership task force model, OVC defines — a victim -centered approach as one that places the crime victim's priorities, needs, and interest at the center of the work with the victim; providing nonjudgmental assistance, with an emphasis on client self-determination, where appropriate, and assisting victims in making informed choices; ensuring that restoring victims' feelings of safety and security are a priority and safeguarding against policies and practices that may inadvertently re -traumatize victims; ensuring that victims' rights, voices, and perspectives are incorporated when developing and implementing system- and community -based efforts that impact crime victims, a trauma -informed approach as assistance delivered with an understanding of the vulnerabilities and experiences of trauma survivors, including the prevalence of trauma and its physical, social, and emotional impact. The OVC ECM program defines a proactive approach as those strategies that go beyond traditional online and vice -style operations and involve more advanced investigative methods and criminal intelligence gathering and analysis. Proactive victim identification, investigative, and prosecution approaches involve in-depth pre -planning and active collaboration from victim service providers, prosecutors, and key multidisciplinary partners. Some examples of activities that would be considered proactive include leveraging existing data sources and criminal intelligence gathering and analysis to target investigative strategies based on the type of human trafficking crime; conducting concurrent financial Investigations; reaching out to vulnerable populations; engaging in community - oriented and awareness activities; and conducting assessments of data on labor industries in the community, such as prior safety or labor/wage violations or visa abuses. This ECM funding does not support efforts or operations that may be counter to a victim -centered and trauma - informed approach. For example, those approaches that do not align with the ECM model include those that target— • the purchasers of commercial sex and fall to result in the identification of one or more actual victims of human trafficking prior to an operation OR otherwise fail to involve a connection to one or more actual trafficking victims. • individuals engaged in commercial sex/"prostitution" for arrest as a means for identifying victims of trafficking. Such efforts may compromise victim safety by failing to properly screen for sex trafficking victimization, and may result in the arrest of victims of sex trafficking. OVC will give priority consideration to applications from task forces that attest explicitly in their proposal narrative that ECM task force funds will— • be used to take affirmative measures to avoid arresting, charging, or prosecuting victims of human trafficking for any offense (absent a public safety threat) that is the direct result of their victimization; • not be used to require a victim of human trafficking to collaborate with law enforcement officers as a condition of access to any shelter or restorative services. Ensuring Civil Rights Federal laws prohibit recipients of funding administered by the OJP from discriminating in the delivery of services on the basis of age, race, color, national origin, religion, or disability. Applicable federal laws also prohibit recipients from discriminating on the basis of disability in their employment practices, and from discriminating against employees and beneficiaries on the basis of sex in funded education or training programs. Recipients are also obligated under federal civil rights laws to provide meaningful access to their programs and activities for persons with limited English proficiency. Involve all task force partners in actively planning and executing a range of proactive approaches that include victim -centered and trauma -informed investigations and prosecutions. 6. Investigate, refer, and prosecute both sex and labor trafficking cases at the local, state, tribal, and federal levels. Applicants may view the Prosecution Case Review tool developed for multidisciplinary task forces. 7. Assist victims of sex trafficking and labor trafficking in achieving increased safety, independence, self-sufficiency, and well-being by providing appropriate services. 8. Collect data and conduct ongoing assessment activities to determine if the program is meeting its stated goals and objectives. Detiverables Purpose Area 1 task forces will be expected to conduct and complete the following: 1. Establish and formalize the task force leadership, membership, and structure to ensure broad membership and engagement with essential agencies and individuals, to include survivor leaders/advocates. Within 12-18 months of award acceptance, the grantee will submit a Memorandum of Understanding (MOU) to OVC documenting the structure, personnel, and roles of task force members. 2. Develop and expand collaborative partnerships among federal, state, local, and tribal law enforcement, prosecution, nongovernmental, labor, and regulatory agencies and system- and community -based service providers. 3. Identify a full-time task force coordinator or director to manage the day-to-day work of task force activities. The coordinator or director will manage partnership growth and sustainability and ensure completion of both the administrative and operational activities of the multidisciplinary task force. The coordinator or director may be supported from either the victim service provider agency or the law enforcement agency. Within the 12-18 months of award acceptance, conduct a data -driven community assessment , factoring in the experiences of task force stakeholders, to identify areas within the community where vulnerabilities for trafficking exploitation may be occurring. OVC may request a written summary of the community assessment results. 5. If requested and under the direction of OVC and OVC TTA providers, provide peer support to newer task forces by participating in a minimum of two webinars or presentations to highlight promising practices in human trafficking task force operations, investigations, and victim services. To ensure effectiveness in achieving grant activities and deliverables, grantees will work closely with OVC and OVC's competitively selected TTA partners to participate in information sharing sessions, engage in peer -to -peer learning exchanges about promising and effective practices, and receive subject matter expertise that is relevant to investigating and prosecuting human trafficking cases as part of a high -functioning, multidisciplinary task force. These TTA activities will support task force grantees in improving their capacities by addressing the objectives and mandatory activities of effective task force operations and completing quality deliverables in a timely manner. OJP anticipates that the multidisciplinary task forces and related law enforcement and prosecution personnel will leverage TTA resources from a variety of federal agencies. At a minimum, applicants must identify the total number of victims they previously identified and served within the targeted geographic area, and the types of victims assisted (sex and/or labor trafficking victims). 3. Describe the communities to be served, including the geographic area, populations in the service area, and any groups that are vulnerable to human'trafficking. Applicants should identify any relevant underserved communities in their geographic area using data to support (e.g., community data, census data, client data, etc.). 4. Describe current efforts to address the service needs of trafficking survivors in the geographic area, Including programs funded through OVC, the Department of Health and Human Services (HHS), the Office on Violence Against Women, or with Victims of Crime Act (VOCA) state victim assistance funds. Explain how the proposed project is not duplicative and targets identified gaps. b. Project Design and Implementation The application must provide a clear link between the proposed activities and the need identified in the "Statement of the Problem" section above. Budget and Associated Documentation Budget Worksheet and Budget Narrative (Web -based Form) The applicant will complete the JustGrants web -based budget form. See the OJP Grant Application Resource Guide for additional information. Funds awarded through this program are designed to support costs for key program activities: task force coordination; personnel and related travel for investigations and prosecutions; crime and intelligence analysis; direct victim services; training; community outreach; and ongoing data collection and program assessment. The applicant should reflect the elements listed below in the Budget Worksheet and Narrative: Victim Service Providers Priority within the budget should reflect sufficient funding dedicated to the provision of services, either directly or through project partners. Specific services should be clearly outlined within the budget. Law Enforcement Agencies Personnel (positions funded 100 percent with overtime funds are discouraged) to support law enforcement investigations and prosecutions, to include analytical and intelligence functions that directly support human trafficking cases. All Grantees • Administrative costs: Administrative costs are costs related to the salary and fringe benefits of executive -level leadership and accounting/financial administration. Administrative costs must be reasonable and allocable • Travel for required trainings: Applicants should budget to support staff travel to attend trainings related to human trafficking and/or multidisciplinary team operations (e.g., conflict resolution, strategic planning). Match: Applicants should include a description in the Budget Narrative as to cash or in -kind match that is included in the project budget. As required by OVC, task force grantees should budget to send their task force coordinator, lead law enforcement representative, prosecutor, and lead victim service provider to three 2-day events (in person, virtual, or to be determined) over the 36-month project. The events may be determined by OVC and will involve cross - sector trainings covering topics and strategies related to multidisciplinary human trafficking task forces. Other travel proposed related to professional development training will be considered, but will require prior approval from OVC and may require additional justification post -award. If the applicant is seeking priority consideration under Priority B based on the identification of at least one proposed subrecipient as a culturally specific organization, the proposed funding for the subrecipient in the web - based budget form must be a minimum of 30% of award funding. Financial Management Questionnaire (including applicant disclosure of high -risk status) The applicant will download the questionnaire, complete it, and submit it by uploading it as an attachment in JustGrants. Disclosure of Process Related to Executive Compensation If applicable, applicants will submit a description of the process used to determine executive compensation by uploading the document and an attachment in JustGrants. Additional Application Components Task Force Organizational Chart: Applicants must submit an organizational chart that depicts how the task force is (or will be) structured and how it will integrate both sex and labor trafficking into overall task force operations and service delivery. The chart should outline key task force leadership (including individual name, title, and organization), any subcommittees, and if applicable, connection to any existing local, state, or regional human trafficking task force that may Impact or overlap with the ECM task force's identified target geographic area. Letters of Intent (Purpose Area 1) and Task Force Memorandum of Understanding/Agreement (MOU/MOA) (Purpose Area 2) Purpose Area 1 applicants must submit Letters) of Intent (LOi) signed by the following individuals: • The head of the applicant law enforcement agency. • The head of the applicant victim service organization. • A representative of at least one federal law enforcement agency —Homeland Security Investigations (HSI) or the FBI —with jurisdiction over the proposed geographic region of the task force. The LOI must demonstrate a commitment to active engagement and substantive participation in task force activities, if the application is funded. The LOi can be submitted jointly or separately. If the proposed geographic area of the task force Includes tribal lands, applicants should also submit an LOI from a tribal law enforcement agency, including Bureau of Indian Affairs (BiA) direct service law enforcement, BIA contract law enforcement, tribal law enforcement, or another applicable law enforcement agency with jurisdiction within tribal land. Successful Purpose Area 1 applicants will have 12-18 months from the date that they accept the award to develop a task force MOU deliverable (as described In the Deliverables section and below.) Purpose Area 2 applicants must submit a task force MOU or MOA that articulates the specific roles and responsibilities of each partner and the level of involvement each agency will have in the overall task force operations. At a minimum, the MOU should include the following information: Task force name. 1. Purpose and commitment to the task force vision, mission, and objectives. 2. Roles and responsibilities of the law enforcement and victim service partners with regard to core functions of task force co -leadership and task force administration. 3. Signatures from, The lead law enforcement agency. The lead victim service provider. Federal law enforcement representation, preferably both FBI and HSI. Participation of both HSI and the FBI has been identified as a promising practice of the most successful OJP-funded task forces. If the proposed geographic area of the task force includes tribal lands, the MOU should also Include a signature from tribal law enforcement, including BIA direct service law enforcement, BIA contract law enforcement, tribal law enforcement, or another applicable law enforcement agency with jurisdiction within tribal land. Purpose Area 2 applicants should anticipate that if they fail to submit an MOU, submit an MOU that does not include signatures from all of the required partners, or submit an MOU that does not meet all of the required elements, it will have negative implications during the peer review process. Should a decision be made to make an award, it may result in the Inclusion of award conditions that preclude the law enforcement grantee and the victim service provider grantee from accessing or using award funds, pending submission and acceptance of a fully executed Task Force MOU. All applicants are encouraged to seek an MOU signature from the United States Attorney's Office (USAO) that has jurisdiction over the geographic region covered by the task force. Plans to Implement a Range of Proactive Approaches to Include Victim -Centered and Survivor- and Trauma - Informed Investigations and Prosecutions This attachment should not exceed 10 pages and must include the following; • A statement that the lead law enforcement applicant and the lead victim service provider applicant both provided input and concur with this plan. • The organizational unit from which investigative or prosecutorial efforts are/will be based. • A description of the staffing plan. • A description of how the lead law enforcement agency and lead victim service provider will work collaboratively with all task force members (other service providers, other law enforcement or regulatory agencies, survivors, etc.) in conducting victim -centered investigations. • A description of the various investigative and outreach strategies that the law enforcement agency and service provider does or will employ to investigate all forms of trafficking. • An explanation of how other federal, state, local, and tribal law enforcement human trafficking investigations and prosecutions are or will be coordinated. • A description of how tips related to crimes of human trafficking are or will be investigated. • A description of how victims of trafficking involved in investigations are or will be identified by law enforcement and referred for services. • If applicable, a description of any existing protocols that address identifying victims, interviewing victims, and notifying victims of their rights as crime victims. • A description of how victim confidentiality is or will be maintained by the law enforcement agency. An award condition will be added to successful applicants' award package indicating that this plan will be reviewed and approved by OVC before the applicant will be able to access a portion of Its grant funds. Curriculum Vitae or Resumes Position descriptions and resumes for key positions should be tailored to the applicant to demonstrate the qualifications of staff involved in the project. Tribal Authorizing Resolution An application in response to this solicitation may require inclusion of tribal authorizing documentation as an attachment. Capabilities and Competencies (20%) - evaluate the administrative and technical capacity of the applicant to successfully accomplish the goals and objectives. 4. Plan for Collecting the Data Required for this Solicitation's Performance Measures (10%) - evaluate the applicant's understanding of the performance data reporting requirements and the plan for collecting the required data. 5. Budget (10%) - evaluate for completeness, cost effectiveness, and allowabiiity (e.g., reasonable, allocable, and necessary for project activities). Review Process Applications submitted under this solicitation that meet the basic minimum requirements, will be evaluated for technical merit by a peer review panel(s) in accordance with OJP peer review policy and procedures using the review criteria listed above. OJP screens applications to ensure they meet the basic minimum requirements prior to conducting the peer review. Overview It is the intent of Brazos County to operate County -owned or leased motor vehicles (Fleet), equipment, and personal vehicles used on County business in the safest manner possible. We will only allow drivers who meet our hiring criteria to drive on County business and expect our drivers to comply with our safety policies and procedures and state law in order to do our part to make the roads as safe as possible. Purpose To outline Brazos County's commitment to, and expectations of, those who operate County - owned or leased vehicles, equipment, and personal vehicles used while conducting County business. Application This policy applies to all employees who operate motor vehicles and equipment while conducting County business. This includes County -owned or leased vehicles, equipment, and personal vehicles while conducting County business. Policy Enforcement Elected officials/department heads, managers, and supervisors are designated and required to enforce the policy at the departmental level to ensure the safety of all employees. This policy is the minimum standard in which all County departments must follow. County departments can create more restrictive, not less restrictive policies, if needed. County Responsibilities The County will: • Provide vehicles, where appropriate, that meet all federal/state mandated safety requirements. • Require driving records at the time of hire for all drivers that will be assigned to operate County -owned or leased vehicles and equipment on County business. • Maintain a list of drivers authorized to operate County -owned vehicles on County business. List will be kept and maintained by Risk Management. • Support and enforce the County Vehicle Use & Driver Policy. • Check driver's licenses for County employees who operate County owned vehicles, leased vehicles, or personal vehicles on County business. Human Resources and Risk Management may perform these checks at time of hire and periodically throughout employment with Brazos County. • Notify officials and department heads of status changes 'involving employees who operate personal and County -owned or leased vehicles. County -owned or leased Vehicles and Equipment Driver List All employees that will operate a County -owned or leased vehicle and equipment on County business must be on the list of approved drivers. The list will indicate the driver's qualification status. Only drivers on the list may operate County -owned or leased vehicles and equipment. All elected officials and department heads will be required to notify Risk Management of any changes to an employee's driver's license status. Driver Qualifications Every driver on the drivers list must, always maintain a valid driver's license. Drivers that do not maintain a valid license may be removed from positions that require driving. Drivers removed from positions that require driving may be reassigned according to specific department policies if they qualify for currently available positions that do not require driving. If they do not qualify for a current position that does not require driving, they may be terminated. Safe Vehicle Operation Drivers will operate vehicles and equipment in a safe and lawful manner and do what is reasonably expected to avoid fleet incidents/crashes and injuries to passengers. Vehicle Restraints Drivers will always ensure that all occupants of the vehicle wear seat belts at all possible times when the vehicle is in use. Passengers should not travel in vehicles that are not equipped with restraints in areas of the vehicle intended for cargo or where seats with restraints are not available. Vehicle Security All vehicles shall be locked when not in use. Vehicles should .be parked in a secure location and valuables shall be secured out of sight when the vehicle is not in use. Operating Vehicles While Impaired Drivers shall not operate the vehicle/equipment while under the influence of drugs or alcohol, or under any other conditions in which the driver's ability to operate the vehicle or equipment safely is inhibited or impaired. Employees who violate this policy will be subject to immediate disciplinary action, up to, and including, dismissal from employment. See the "Policy on Drugs and Alcohol" for further information. Passengers Persons not employed by Brazos County are permitted to ride in County vehicles as passengers, if necessary, to conduct County business. At no time should family members ride in County owned or leased vehicles. The only exceptions to this rule are emergency situations, County vehicles being driven in a community parade, National Night Out, and other community events that promote citizen awareness and citizen safety. At no time will a person not employed by Brazos County be permitted to drive a County owned or leased vehicle or equipment. Vol. PO.�s Distraction -Free Driving Numerous studies have demonstrated that using a cell phone while driving increases the risk of a crash by four times, and texting increases crash risk by 23 times. Brazos County employees must refrain from using tablets and cell phones, either hand-held or hands -free, while operating a motor vehicle. Brazos County employees should not initiate or respond to phone calls, nor read or respond to text messages or emails while driving a County -owned vehicle. Brazos County employees who need to make an emergency call while on the road should first park the vehicle in a safe location. Law Enforcement is excluded from this section. Smoke -Free Workplace The County prohibits smoking within County buildings or offices; therefore, the use of tobacco products in County -owned vehicles and equipment is also prohibited. This includes but is not limited to vape products, snuff, cigarettes, etc. Employees who violate this policy may be subject to disciplinary action. Vehicle Inspection It is the responsibility of fleet users to perform routine pre and/or post inspections on vehicles and equipment. Departments should establish policies to ensure that checks are accomplished. Inspection criteria may vary for each County office or department, and for each type of vehicle or equipment. Therefore, inspection criteria should be coordinated with and approved by Fleet Services. The following are basic rules of thumb for inspecting vehicles and equipment that are recommended for individual department policies. Pre -Trip Inspection: 1. Perform a visual walk around inspection of the, vehicle for fluid leaks or obvious damage. 2. Inspect the following fluid levels where appropriate. a. Engine oil b. Cooling system level c. Transmission fluid level d. Hydraulic fluid levels 3. Inspect the engine compartment for loose or frayed belts, hoses, etc. 4. Check all lights (headlights, brake lights, and turn signals) are all working. 5. Check tire pressure to ensure compliance with the manufacturer's specifications. 6. Check the tires for cracks, nails/screws, gouges, worn down treads, balding. 7. Check to ensure that windshield wipers are in good working condition and wiper fluid is adequate. 8. Check the windows and windshields for cracks, chips, dirt, and grime that can affect visibility. 9. Check the registration and inspection sticker to verify it is current (not expired). Paae 4 of 12 10. Check the mirrors for dirt, smudges, or damage that could obstruct the view of the driver. Vehicles with defects that affect the vehicles' safety should not be driven until the vehicle is repaired. Cleanliness of Vehicle It is the responsibility of departments and drivers to maintain the interior of the vehicles. County provided vehicles are considered a working environment and must be kept clean to keep the driver and passengers safe. If a vehicle used for work becomes cluttered and full of trash, debris, material, or equipment it can; become hazardous to the worker and affect the safety of everyone on the road. 1. Store all items away from the main sitting area of the vehicle or,make sure they are secure. 2. Remove items from under the vehicle seats, especially items that can roll like water bottles. 3. Clear folders, tools, beverage containers, or any other items from dashboards. 4. Clean mud or snow off shoes before operating the vehicle. 5. Clean up spills and throw away trash promptly. 6. If you become distracted by a spill or item that has fallen in the vehicle, pull over and stop in a safe area before you tend to it. 7. Keep the vehicle you are using clean and maintained. 8. Store material in an orderly manner to keep the vehicle clean and organized. 9. Secure all loose items. 10. Avoid piling objects too high, inside or outside of the vehicle, to ensure the driver can always see clearly. II If not stored and secured properly, ladders, materials, and equipment have the potential to slide off the vehicle while traveling down a roadway resulting in hazardous conditions for other drivers. Keep all items, including ladders, that are in a truck bed, or on the roof rack, tied down to ensure they do not become dislodged while driving. Never place long materials such as pipes, poles, or rods through windows or openings into the main cab of a vehicle. (Workers could become impaled by these objects and/or serious injury can occur). Materials that extend past the vehicle's tailgate or rear bumper should be marked and flagged to alert other drivers of the large load being hauled. Ensure lids are closed on any open containers in the bed of your truck to prevent objects flying out and striking other vehicles on the roadway. Vehicle Maintenance The vehicles and equipment owned or leased by the County are on a preventative maintenance schedule based on miles or hours of operation. Any repairs needed to ensure the safe operation of the vehicle/equipment shall be performed prior to the vehicle being used. It is the Page 5 of 12 r voi. Pg. department's responsibility to make sure that all vehicles and equipment are being properly maintained. Departments and drivers should contact Fleet Services for questions regarding maintenance of a vehicle or equipment. Vehicle Operation Drivers should operate the vehicles/equipment per the guidelines in the manufacturer's operating manual. Drivers are expected to be familiar with a vehicle/equipment prior to using it and be able to operate lights, horn, emergency flashers, and other equipment. Towing trailers on County business Towing of trailers while on County business is prohibited, unless approved by the employee's supervisor, elected official, or department head as necessary for legitimate work -related duties. Trailers owned by the County should be towed by County -owned or leased vehicles. Take Home Vehicles Only elected officials and department heads have the authority to give an employee authorization to take a County owned vehicle home. This authorization will only be granted to an employee who is performing standby duty and is subject to being called out on County business after County operational business hours. Some officials or employees are allowed to take home vehicles assigned to them for travel to and from work and for call -outs. The County's vehicles are classified as either "exempt" or "non-exempt" as prescribed by law. Employees to whom a "non-exempt" vehicle is assigned for take-home will likely incur a federal income tax liability for the fringe benefit of commuting to and from work. Most pickups, vans and automobiles are classified as "non-exempt" vehicles, except where the employee is subject to frequent call -outs for the County's purposes. Clearly marked police and public safety vehicles used by employees on call 24-hours and is required to use the vehicle for commuting are exempt from the fringe benefit tax liability. All personal use of County owned vehicle is prohibited. Take home vehicles that are being used for personal use are NOT considered "exempt" and employee should keep track of mileage and submit a Fringe Benefits form through the Human Resources Department. Driving to, from and during on -duty for County business are considered exempt and will not need to be tracked. For further information on the status of a take home vehicle and potential fringe benefit income that will be included on your W-2, please contact the County Auditor's Office. Personal Use No County owned or leased vehicle or equipment shall be used for any purpose that does not benefit Brazos County. Some usage may benefit both the County and the user, but the benefit to the County must be paramount and controlling, and the benefit to the employee incidental and "de minimus". Vol. / pg. ik While performing county business -employees may make what is considered a convenience stop so long as it does not require a detour from their direct travel route. This could include stopping for a lunch break at a restaurant, trip to the. Brazos County Health and Wellness Clinic or doctors appt. or -a small personal errand limited to five or ten minutes and allows the employee the benefit of taking care of limited personal errands of little consequence and is not intended to be used for purposes that expend a greater amount of time. If an employee is in doubt about a circumstance, they must obtain permission from the appropriate department head before proceeding. Department Heads and Elected Officials cannot grant permission for something that would violate other conditions written in this policy. Unauthorized Use Employee agrees to indemnify and hold harmless Brazos County from and against any and all losses, costs, judgments, damages, claims, or liabilities growing out of or resulting from any unauthorized use of a County or leased vehicle or from use of said vehicle by an unauthorized driver having care, control or custody of said vehicle. Fleet Incident/Crash/Vandalism Reporting A fleet incident/crash shall be defined as any damage incurred to a County -owned or leased vehicle or equipment regardless of fault. This shall include collisions involving other vehicles and equipment, obstacles, pedestrians, animals, overturning, jackknifing, vandalism, and other damage that is not considered normal wear and tear. Vandalism shall be defined as the act of maliciously damaging County -owned or leased vehicles or equipment. Drivers must report all fleet incidents/crashes/vandalism involving a County -owned or leased vehicle and equipment to the proper chain of command in their department. Prompt reporting is essential to limit liability, and employees are expected to report all fleet incidents/crashes as soon as possible. The employee involved in the incident or a department representative shall report all fleet incidents/crashes/vandalism to Risk Management as soon as possible using the Brazos County Accident Report Form. Departments may use a departmental form, if the form contains at a minimum, the information contained in the Accident Report Form. Accident Report Form is in each vehicle glovebox in a yellow envelope with "How to Respond to a Vehicle Accident" instructions and other forms that may be needed. If an employee is involved in a crash, the following procedures apply: 1. Contact Department foreman, supervisor, or department designee or call 911 to report the crash. Request Emergency Medical Services (EMS) if anyone has been injured. 2. Wait for the emergency responders. 3. In the event of an accident involving injuries you are encouraged provide assistance to any injured party only to the reasonable level of your training, experience and comfort level. Under no circumstances should you move an injured person unless directed to do so by emergency medical personnel and/or circumstances exist that would cause a Page 7 of 12Vol. 361. __.... o reasonable person to believe that not moving an injured person could cause further injury or death (i.e. drowning or proximity to fire). 4. Get the names, addresses, and phone numbers of all witnesses to, the crash. 5. Note the location, time of day, weather, and road conditions. 6. Take photos of the scene if possible. 7. Provide only your name, department, and Risk Management's phone number to others involved in the crash. 8. Answer any questions asked by the responding law enforcement officer. 9. Do not admit any guilt or liability. 10. Department designee shall fill out an Accident Report Form and provide a copy to Risk Management along with photos if available. Crash Investieation and Data Analysis Risk Management will review all fleet incidents, crashes, and vandalism involving County - owned or leased vehicles/equipment, and report findings to the elected or appointed department head or his or her designated person. In investigations, Risk Management may assist with determining facts and whether the employee was at fault. When the facts are known, a supervisor and/or department designee and Risk Management will determine the best strategy to prevent a recurrence of this type of fleet incident, crash, and or vandalism. The official or department head shall review the findings and recommendations and is responsible for implementing corrective action. Claims Settlement Departments must report all crashes to Risk Management using the Brazos County Accident Report Form. Risk Management will file all claims by contacting either Texas Association of Counties and /or any 3rd Party insurance involved. If the other party is at fault in a fleet incident, crash, or vandalism with a County -owned vehicle or equipment, then Risk Management will file a claim with the other party's insurance. The County's insurance carrier can assist with this process depending on the circumstances. Fleet Incident/Crash/Vandalism Review Each fleet incident/crash/vandalism involving a County -owned or leased vehicle or equipment will be reviewed by Risk Management and the department involved to determine if the driver did everything within reason avoid the crash. Each fleet incident/crash/vandalism will be classified as preventable or non -preventable. Fleet incident/crash/vandalism preventability Vol. a- _L P9: could be used in determining a driver's qualification to operate County -owned or leased vehicles and equipment in the future. Depending on the circumstances surrounding each fleet incident/crash, the following corrective actions are possible: Oral Counseling Driver training Driver education Written reprimand Suspension Probation Termination Motor Vehicle Records (MVR) Brazos County employees must exercise the utmost care in the use of County -owned or leased equipment and vehicles to minimize damage. Human Resources may do an MVR review prior to employment to determine an individual's qualifications to drive a County owned or leased vehicle or personal vehicle on County business to determine the individual's qualifications. During the term of employment, the Risk Management department may at any time perform an MVR review on employee for cause or for periodic qualifications audits. Elected officials and department heads can request an MVR review of an employee through Risk Management for cause. Drivers of County -owned or leased vehicles or equipment must notify their supervisor, Risk Management or Human Resources when any on or off the job changes in the following: 1. Suspended or revoked or restricted license 2. Changes in the ability to operate a motor vehicle due to injury or -illness that impacts safe operation of the vehicle 3. Prescription changes that could affect driving ability ` Risk Management should be notified of any changes listed above to update the Driver Qualification List. Risk Management will review driver record reports and make appropriate recommendations to the elected official or department head. Drivers with any of the following violations in the last 3 years, barring appeal, will be disqualified as a driver of a of County -owned or leased vehicles or equipment: 1. Driving under the influence of alcohol or a controlled substance 2. Refusing to submit to a test to determine alcohol or controlled substance concentration 3. Leaving the scene of a crash 4. Vehicular manslaughter/homicide S. Using vehicle to commit a felony 6. Suspended or revoked or restricted license Drivers removed from positions requiring driving may be reassigned according to specific department policies if they qualify for currently available positions that do not require driving. If they do not qualify for a current position that does not require driving, they may be VOL � � P0. terminated. In case of an arrest for a violation listed above, the official or department head may, based on business necessity, take appropriate action, up to and including dismissal from employment. Right of Appeal With the approval of the elected official or department head, a person hired by the County may appeal a disqualification not based on items 4,5, or 6, above. The County Judge's Office may, at its discretion, after due consideration of the County's best interests and the recommendation of the elected official or department head and Risk Management, consider lifting the disqualification or restricting the employee vehicle or equipment operation in lieu of permanent disqualification. Post Fleet Incident/Crash Training Drivers with violations, fleet incidents, and/or crashes may be required to complete driver safety training. Driver Training It is required that every employee who will operate a County -owned or leased vehicle or equipment be trained in. safe operation. All employees are required to attend defensive driver training at least every 2-3 years. Brazos County has 2 certified instructors to maintain this training requirement. To schedule training for your department please contact Risk Management. Program Acknowledgement Drivers will read and sign the Vehicle Use & Driver Policy Acknowledgement Form upon receiving a County -owned or leased vehicle or being assigned to operate County -owned or leased equipment. Drivers will return the signed form to their department designee or supervisor. The original Vehicle Use and Driver Policy Acknowledgement Form must be sent to the Risk Management Department. > II. Personal Vehicles Used on Brazos County Business Safe Vehicle Operation Drivers operating personal vehicles used on County business and drivers operating other non - County vehicles on County business will operate the vehicles in a safe and lawful manner and do what is reasonably expected to avoid crashes and injuries to passengers. Insurance limits Every vehicle used on County business must have liability coverage at least at the minimum levels required by state law. Verification of coverage Employees operating their own vehicles on County business must be able to provide proof of V01. P. ,I insurance in case of a traffic violation or crash. State registration sticker must be up-to-date and displayed properly on the vehicle. MVR rritaria Employees may be required to meet the same MVR criteria as County -owned vehicle drivers as outlined in this policy. Employees using personal vehicles on County business may be subject to disciplinary actions in accordance with the County -owned or Leased Vehicles and. Equipment Section of this policy. Seat belts Drivers should always ensure that all occupants of the vehicle wear seat belts when possible, when the vehicle is in use. Business passengers should not travel in vehicles that are not equipped with restraints in areas of the vehicle intended for cargo or' where seats with restraints are not available. Other Requirements Employees using personal vehicles on County business may be required to comply with all the requirements as outlined in the County -owned or Leased Vehicles and Equipment Section. Program Acknowledgement Drivers will read and sign the Vehicle Use & Driver Policy Acknowledgement Form upon being authorized to operate a personal vehicle on County business. Participating Entities will only be required to pay for materials actually received and/or services actually provided.
