PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a
Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the
Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
it is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity
of the Court, as a body, or any member or members of the Court; or County employees, individually or collectively. Accordingly,
profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4, such other and/or criminal sanctions as may be authorized ,
under the Constitution, Statutes and Codes of the State of Texas.:
The County Commissioners Court can deliberate or take action curly if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge
and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing
policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the,Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in-:oart or as a whole. No member of the community is required to
attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business
of the Court.

REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on
Tuesday, January 18, 2022 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Steve Aldrich, Commissioner of Precinct 1;
Russ Ford, Commissioner of Precinct 2;
Nancy Berry, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk.

8. Approval of the attached purchase agreement for a vehicle and trailer from the City of
College Station in the amount of $20,000 for the Sheriff's Office.
Commissioner Berry questioned how the purchase price of the vehicle was decided,
noting that both the truck and trailer are well used. Purchasing Director Charles Wendt
explained that the price was decided on by the City of College Station and that the
vehicle was inspected by the Brazos County Fleet Services and determined to be
sound. He added that purchased new, the cost of the truck and trailer could be as much
as six figures.
Judge Peters invited Sheriff Wayne Dickey to elaborate on the decision for the Sheriff's
Office to purchase this vehicle. Sheriff Dickey stated that it is critical for the Emergency
Response Team to have reliable transportation and that while the truck and trailer are
used, it will be a great improvement over their current response capabilities.
A copy of the purchase agreement is attached.

18. Juvenile director's report on detention population.
Juvenile Director Linda Ricketson reported there are 30 juveniles in the detention center,
26 are male and 4 are female, and 29 have electronic monitors. There are 6 youth in
isolation as per medical protocol for new intakes. There are no juveniles positive for
COVID-19 and 2 staff members out.
19. Sheriff's report on inmate population.
Sheriff Wayne Dicky stated there were 587 inmates in jail, 492 inmates are male and 95
are female, 38 have electronic monitors and 15 are pending for processing. There are
33 inmates positive for COVID-19 and 304 inmates are in quarantine. There are 17 staff

20. Announcement of interest items and possible future agenda topics.
There were no announcements.
21. Call for Citizen input and/or concerns
Commissioner Cauley took a moment to acknowledge the passing of Oliver Wayne
Sadberry Jr., the former curator of the Brazos Valley African American Museum. She
asked that the Court consider doing a Proclamation for his family in his honor, as Mr.
Sadberry contributed a lot to this community. Judge Peters agreed that a Proclamation
would be a great idea. Commissioner Berry added that this is a great loss for the Brazos
County community.

No terms in this agreement may be changed, including report dates, payment schedule, and payment amounts. If any information entered by
the Texas Council on Family Violence is found to have been changed by the Vendor other than the Vendor's name, the Agreement for that

This agreement is by and between Texas Council on Family Violence (hereinafter "TCFV"),
and VENDOR NAME (hereinafter "Vendor"). This engagement is wholly represented as a
Vendor relationship. Services provided under this agreement are done as requested, not as
directed.

A. Vendor will promote collaboration among law enforcement, prosecution, other relevant DVHRT agencies, and the family violence center to
ensure an effective, comprehensive response to family violence.
B. Vendor agrees to submit goals and objectives to TCFV within 30 days of execution of vendor agreement.
C. DVHRT coordinators will provide a case tracking report for statistical analysis no later than the 5th of each month for the previous month. A
tracking form will be provided by TCFV, excluding any identifying information about the victim(s) or suspect(s) involved. The data gathered will
serve the following purposes:
1. Analyze progress toward goals and objectives.
2. Share best practices with victims and other organizations in Texas.
3. Serve as a learning platform for future training efforts and identify emerging issues.
D. The DVHRT coordinators will commit to attending regular teleconferences and training sessions where they share their successes,
failures, and challenges with other DVHRT coordinators to promote best practices with other DVHRT sites.
F. Submission of quarterly reports are required to share information on project successes, challenges, and case outcomes. Quarterly reports
will include all information requested by TCFV. Deadlines outlined below.
Vendor will contact TCFV if Vendor has any issues in meeting agreement terms.

Other Agreements:
A. it is understood by all parties that payment obligations created by this agreement are conditioned upon the availability of State or Federal
funds appropriated or allocated for the payment of such obligations. The term of this agreement shall commence on January 1, 2022 and
automatically terminate on October 31, 2022, unless extended or terminated in writing as otherwise provided for in this agreement. This
agreement may be modified only by written agreement of both parties and with 30 days' notice. Such amendments will require the signatures
of all parties included on the original agreement.
B. Force Majeure: it is expressly understood and agreed that the Vendor shall not be considered in default by TCFV due to circumstances
beyond Vendor's control and without its sole fault or negligence. These circumstances may include, but are not limited to: weather conditions,
injury or illness involving irreplaceable personnel, and acts of God or government beyond Vendor's control.
C. Vendor attests that neither the Vendor nor its principal employees are debarred, suspended, or otherwise excluded or disqualified under
the non -procurement common rule, or otherwise declared ineligible from receiving Federal contracts, certain contracts, and certain Federal
assistance and benefits.
D. Vendor must treat all information that is obtained through performance of this agreement, including, but not limited to, information relating
to applicants or recipients as confidential information to the extent that confidential treatment is required.
E. This agreement shall not constitute, create, or otherwise imply an employment, joint venture, partnership, agency or similar arrangement,
and nothing contained herein shall be construed as providing for the sharing of profits or losses arising from the efforts of either or both
parties here to. Each party to this agreement shall act as an independent entity, and neither party shall have the power to act for or bind the
other party except as expressly provided for herein. The Vendor shall not be eligible for any benefit available to employees of TCFV,
including, but not limited to, workers compensation insurance, state disability insurance, unemployment insurance, group health and life
insurance, vacation pay, sick pay, severance pay, bonus plans, pension plans, savings plans and the like. No income, social security, state
disability or other federal or state payroll tax shall be deducted from payments made to the Vendor under this Agreement. Vendor agrees to
pay all state and federal income taxes and other levies and charges as they become due on account of monies paid to TCFV hereunder, and
to defend, indemnify and hold TCFV harmless from and against any and all liability resulting from any failure to do so.
F. Either party mayterminate this agreement with thirty (30) days' written notice.

SURPLUS PROPERTY SALE AGREEMENT BETWEEN THE CITY OF COLLEGE
STATION AND BRAZOS COUNTY
WHEREAS, the City of College Station ("College Station") and Brazos County enter into this
Agreement for the purpose of selling surplus property that would normally be salvaged because
the property has reached the end of its useful life and has little value to College Station; and
WHEREAS, College Station has a 2010 Ford F-250 box van with a custom box and a 2005 24'
tandem axle cargo trailer (surplus property); and
WHEREAS, the Brazos County Sheriff desires to have the surplus property to serve the citizens
of Brazos County; and
WHEREAS, it is deemed in the best interest of the parties to enter into an agreement for the sale
of the surplus property because the sale serves a public purpose of protecting the citizens of Brazos
County and saves College Station the disposal expense or expense of auctioning the surplus
property; and
NOW THEREFORE, the parties, in consideration of the mutual covenants and conditions
contained herein, promise and agree as follows:
1. Surplus Property. College Station sells to Brazos County the following surplus property
for TWENTY THOUSAND DOLLARS ($20,000.00) payable to the City of College
Station.
i. 2010 Ford F-250 box van with a custom box with VIN 3FRNF66C29V130510.
ii. 2005 24' tandem axle cargo trailer with Serial No. 4U01 C24226A027094.
2. Delivery. Brazos County will pick up the surplus property from the College Station Fleet
Services Division on W. King Cole Drive in College Station at a mutually agreeable time
after payment is accepted by the City. Contact Troy Pemberton at temberton@cstx.gov

3. Effective Date. This Agreement is effective when signed by the last party whose signing
makes the Agreement fully executed.
4. Amendment. The terms and conditions of this Agreement may be amended upon the
mutual written consent of both parties. Mutual consent will be demonstrated approval of
the governing body of each party hereto. No modification to this Agreement shall be
effective and binding unless and until it is reduced to writing and signed by duly authorized
representatives of both parties.
5. Termination. The parties may terminate this Agreement at any time, with or without
cause, upon thirty (30) days written notice to the other party.

6. Release. Brazos County assumes full responsibility for the use of the surplus property
and hereby releases, relinquishes, and discharges the City, its officers, agents,
volunteers, and employees from all claims, demands, and causes of action of every
kind and character. This release shall apply regardless of whether said claims,
demands, and causes of action are covered in whole or in part by insurance and
regardless of whether such injury, death, loss, or damage was caused in whole or in
part by the negligence of College Station or Brazos County.
7. Warranty Disclaimer. The sale and purchase of the surplus property shall be "as is" and
"without warranty, express or implied, as to quality, condition, fitness for known purpose,
or any other kind." Brazos County understands and agrees the goods or property are sold
"as is" and with no warranty of any kind and used at Brazos County's risk or any other
future user's risk.
8. Invalidity. If any provision of this Agreement shall be held to be invalid, illegal, or
unenforceable by a court or other tribunal of competent jurisdiction, the validity, legality,
and enforceability of the remaining provisions shall not in any way be affected or impaired
thereby. The parties shall use their best efforts to replace the respective provision or
provisions of this Agreement with legal terms and conditions approximating the original
intent of the parties.
9. Written Notice. Unless otherwise specified, written notice shall be deemed to have been
duly served if delivered in person or sent by certified mail to the last business address as
listed herein.

10. Entire Agreement. It is understood that this Agreement contains the entire agreement
between the parties and supersedes any and all prior agreements, arrangements, or
understandings between the parties relating to the subject matter. No oral understandings,
statements, promises, or inducements contrary to the terms of this Agreement exist. This
Agreement cannot be changed or terminated orally. No verbal agreement or conversation
with any officer, agent, or employee of any party before or after the execution of this
Agreement shall affect or modify any of the terms or obligations hereunder.
11. Texas Law. This Agreement has been made under and shall be governed by the laws of
the State of Texas.

12. Place of Performance. Performance and all matters related thereto shall be in Brazos
County, Texas, United States of America.
13. Authority to Enter into Agreement. Each party has the full power and authority to enter
into and perform this Agreement, and the person signing this Agreement on behalf of each
party has been properly authorized and empowered to enter into this Agreement. The
persons executing this Agreement hereby represent they have authorization to sign on
behalf of their respective City.
14. Waiver. Failure of either party, at any time, to enforce a provision of this Agreement, shall
in no way constitute a waiver of that provision, nor in anyway affect the validity of this
Agreement, any part hereof, or the right of either party thereafter to enforce each and every
provision hereof. No term of this Agreement shall be deemed waived or breach excused
unless the waiver shall be in writing and signed by the party claimed to have waived.
Furthermore, any consent to or waiver of a breach will not constitute consent to or waiver
of or excuse of any other different or subsequent breach.
16. Agreement Read. The parties acknowledge that they have read, understand and intend to
be bound by the terms and conditions of this Agreement.
16. Assignment. This Agreement and the rights and obligations contained herein may not be
assigned by any party without the prior written approval of the other parties to this
Agreement.
17. MuItiple Originals. It is understood and agreed that this Agreement may be executed in a
number of identical counterparts, each of which shall be deemed an original for all
purposes.

■ Orientation to AEL Program requirements and enroll qualified students at BCDC for high
school equivalent instruction and testing and AEL Programs.
The Brazos County Detention Center agrees to provide:
■ Meeting space at no cost to BVCOG/WSBVB for program service delivery at 1835 Sandy
Point Road, Bryan, Texas for AEL students;
■ Program planning and adjustment contact person;
■ Payment directly to the Brazos Valley Council of Governments/Worldorce Solutions
Brazos Valley Board's AEL Subcontractor for the administration of high school
equivalency testing to BCDC inmates who have participated in the adult education and
literacy training and have been identified as proficient in instruction to be tested on the
subject matter;
• Provide payment directly to the testing agency when and if available, covering costs
associated with inmates at BCDC, who have participated in the adult education and
literacy traiiiuig and have been identified as proficient in instruction to be tested on the
subject matter;
• Coordination with Workforce Solutions Brazos Valley Board and their Subcontractor to
provide services to all recipients of workforce development and Adult Education and
Literacy services at BCDC;
• Office staff with the professional development necessary to assist Brazos Valley Council
of Governments/WorlJorce Solutions Brazos Valley with the ability to serve individuals
at BCDC, who have barriers to employment, including individuals with disabilities.
Both parties agree to provide:
■ Share the responsibility for student eligibility determination and assessment testing and
promote the utilization of Worldorce services to its students;
• Share information regarding the availability of serx4ces, education and trauning services,
employment opportunities, availability of supportive services and accept eligible
applicants into applicable programs for the provision of appropriate services;
• Maintain the confidentiality of records and agree and acknowledge that all information is
confidential by law and will only be used for the purposes outlined in this agreement;
■ Participate in joint planning, as appropriate;
• Exchange information and coordinate activities and programs for a more streamlined
and efficient adult education and literacy program;
■ Provide cross -training between the staff of the parties regarding policies and
procedures, as requested or needed;
■ Identify opportunities for collaboration, coordination, and elimination of barriers for
effective service delivery;
• Use consumer data only in the administration of the Parties' programs.
I. Allocation of Costs
The participants in this agreement assume full responsibility for their respective costs
associated with the performance of the terms of this Agreement. In no event, except as may

be provided in a Supplemental Agreement, shall any party be obligated to pay or reimburse
any expense incurred by another party under this Agreement.
II. Subcontracts
All subcontracts or other agreements entered into by the parties to fulfill the purpose of this
Agreement must require subcontractors or other parties to fulfill the respective party's
requirements described in the Allocation of Costs section. A copy of any such subcontract(s)
or agreement(s) entered into by a party shall be provided to the other party in this agreement.
III. General Provisions
The parties understand that each party should be able to fulfill its responsibilities under this
Agreement per the provisions of the law and regulations governing the party's acthdties. Nothing
in this agreement is intended to negate or otherwise render ineffective any such provisions or
operating procedures. The parties assume full responsibility for their cost and performance under
the terms of this Agreement.
If at any time either party is unable to perform its functions under tlus Agreement consistent-%N7ith
such party's statutory and regulatory mandates, the affected party shall immediately provide
written notice to the other parties to establish a date for resolution of the matter.
Comply with the Federal requirements against Prohibition on Trafficking persons found in the
Trafficking Victims Protection Act of 2000 (TVPA), as amended (22 U.S.C. 57104(g)).
Comply with the requirements of the Americans with Disabilities Act of 1990, PL 101336,10ISt
Congress, 2nd Session,104 Stat.327 (July 26,1990).
Any dispute between the Brazos County Office of Sheriff and Blinn College Adult Education
regarding this MOU will be governed by Alternative Dispute Resolution for Use by
Governmental Bodies, Chapter 2009, Texas Governiiient Code, and any applicable Model Rules
promulgated by the Office of the Attorney General and/or the State Office of Administrative
Hearing of the State of Texas. Any notice of dispute tendered by the Performing Party should
be addressed to the President of the Receiving Party.
As a condition to the award of financial assistance from the Department of Labor under Title I
of WIOA, the grant applicant assures that it can comply with the nondiscrimination and equal
opportunity provisions of the following laws and will remain in compliance for the duration of
the award of federal financial assistance:
(A) Section 188 of the Workforce Innovation and Opportunity Act (WIOA), which prohibits
discrimination against all individuals in the United States based on race, color, religion, sex
(including pregnancy, childbirth, and related medical conditions, transgender status, and
gender identity), national origin (including limited English proficiency), age, disability, or
political affiliation or belief, or against beneficiaries on the basis of either citizenship status or
participation in any WIOA Title I -financially assisted program or activity;

(B) Title VI of the Civil Rights Act of 1964, as amended, which prohibits discrimination on the
bases of race, color and national origin;
(C) Section 504 of the Rehabilitation Act of 1973, as amended, which prohibits discrimination
against qualified individuals with disabilities;
(D) The Age Discrimination Act of 1975, as amended, which prohibits discrimination on the
basis of age; and
(E) Title IX of the Education Amendments of 1972, as amended, which prohibits
discrimination on the basis of sex in educational programs.
The grant applicant also assures that, as a recipient of WIOA Title I financial assistance, it
will comply with 29 CFR part 38 and all other regulations implementing the laws listed above.
This assurance applies to the grant applicant's operation of the WIOA Title I -financially
assisted program or activity, and to all agreements the grant applicant makes to carry out the
WIOA Title I -financially assisted program or activity. The grant applicant understands that
the United States has the right to seek judicial enforcement of this assurance.
In case any provision hereof should be held to be illegal, invalid or unenforceable in any respect,
such illegality, invalidity or unenforceability shall not affect any other provision of this MOU,
and this MOU shall be construed as if such invalid, illegal or unenforceable provision had never
been included in this MOU.
This MOU constitutes the entire agreement hereto with respect to the subject matter hereof
and supersedes any prior understanding or written or oral agreements between the parties
concerning the subject matter of this MOU. No amendment or modification of the terms of the
MOU shall be binding on either party unless the same is in writing, dated after the date hereof,
and is duly executed by the party against whom enforcement is sought.
Each person signing this MOU on behalf of a party hereby confirms for the benefit of the
other party to this MOU that any requisite approvals from the governing body of such party
have been obtained, and all prerequisites to the execution, delivery and performance hereof
have been obtained by or on behalf of that party. Execution and delivery of the MOU by
exchange of email or fax copy bearing the signature of a party will constitute a valid and
binding execution and delivery of the MOU by such party.
IV. Compliance with the Prison Rape Elimination Act
The Brazos County Detention Center, as an operation of the Brazos County Sheriff's Office, will
comply with the Prison Rape Elimination Act (PREA). The Detention Center has a Zero
Tolerance Policy regarding sexual abuse and sexual harassment. The Detention Center will
conduct a background investigation on all proposed employees, volunteers, or other contractors
that may have contact with inmates. Background checks will be conducted at least every five
(5) years for all contractors.
The BCDC shall ensure that all volunteers and contractors who have contact with inmates have
been trained on their responsibilities under the agency's sexual abuse and sexual harassment
prevention, detection, and response policies and procedures. Any contractor or volunteer who
engages in sexual abuse is prohibited from contact with inmates and shall be reported to law

enforcement agencies and to relevant licensing bodies, unless the activity was clearly not
criminal. The facility will take appropriate remedial measures and prohibit further contact with
inmates in the case of violation of sexual abuse or sexual harassment policies by the contractor.
The contractor has an affirmative duty to disclose any misconduct in violation of the sexual
abuse and sexual harassment policy. Material omissions regarding such misconduct, or the
provision of materially false information, are grounds for termination of this agreement.
V. Amendment or Cancellation of the Agreement
The Agreement may be amended at any time in writing and by mutual consent of the parties.
The Agreement may be canceled by either party upon 30 days written notice to the other party
unless the cancellation is for cause-i.e., a material and significant breach of any provisions of this
Agreement in which case it may be canceled upon delivery of written notice to the other party.
This agreement is effective on the date of execution and will remain in effect until either party
cancels the agreement or June 30, 2022. The parties to this agreement reserve the right to modify
the scope, direction, structure and content of this agreement based upon legislative changes,
Texas Worldorce Commission directives and availability of funding or other circumstances as
warranted and agreed upon by both parties.

AMMENDED INTERLOCAL COOPERATION CONTRACT
I. CONTRACTING PARTIES AND AUTHORITY
The Department of Public Safety (DPS) and Brazos County are contracting under the authority of Texas
Government Code Chapter 791(the Interlocal Cooperation Act).
DPS certifies that it has authority to perform the services contracted for by authority granted in Texas
Government Code Chapter 411.
Brazos County certifies that it has the authority to contract for the services by authority granted in
Local Government Code Chapter 262 (County Purchasing Act), and Texas Code of Criminal Procedure
art. 2.17.
II. BACKGROUND AND PURPOSE
Brazos County has a need for assistance in testing of seized drug analysis of evidence and requests that
DPS provide seized drug analysis of evidence submitted by Brazos County.
DPS has the ability to assist in this regard and agrees to provide Seized Drug analysis of evidence
submitted by Brazos County.
III. STATEMENT OF SERVICES
DPS will perform the following services.
A. DPS will analyze evidence submitted by Brazos County requesting seized drug analysis.
B. At its discretion, DPS will assign the services of two full time equivalent (FTEs) to perform
analysis under this Contract. Each FTE will be a DPS employee.
C. DPS will attempt to provide a thirty -calendar -day or less turn -around time, from the date of
submission to the DPS Laboratory, for seized drug cases with two items or less tested. Turn-
around time for case submissions with more than two items tested could exceed thirty
calendar days for analysis. Case submissions with additional requests for testing outside the
scope of the contract (for example, friction ridge development on seized drugs cases) will
delay the completion of the case. Cases will be expedited but the total analysis time will
exceed 30 days.
D. The assigned DPS FTEs will work on Brazos County cases awaiting seized drug analysis up
until the monthly contract amounts are tested before examining evidence from other
agencies as long as this Contract is in place.
E. At its discretion, DPS will assign the FTEs other work after the monthly contract amounts
are tested under this Contract, within the parameters of DPS Crime Laboratory policies and
procedures. Case submissions by Brazos County will not exceed 140 cases per month (seized
drug) or 364 items tested, whichever is reached first under this Contract.
F. If under this Contract, Brazos County does not submit the monthly contract amounts, DPS
will assign the FTEs other backlogged work.
G. DPS will provide Brazos County a Certificate of Analysis for each case submitted under this
Contract.
Brazos County understands or will perform the following.
A. Brazos County understands that DPS is solely responsible for the employment and
management of the DPS personnel. Brazos County understands that it will have no input
into DPS's decisions regarding management or work of DPS personnel.
B. Brazos County will ensure that a valid subpoena is issued to any DPS Laboratory analyst
needed for court testimony with at least two weeks prior notice when available.
C. Brazos County will continue to follow all laboratory policies and procedures outlined in
DPS's Laboratory Customer's Handbook, unless otherwise noted.
Misdemeanor evidence analysis is permitted at discretion of Brazos County but the
testing will count toward the 140 cases and 364 items tested per month. No
additional testing (such as friction ridge analysis) will be included on misdemeanor
cases submitted.
If all items submitted require testing, this must be communicated on the submission
form accompanying the evidence submission.
D. Cases submitted to DIPS from Brazos County during the duration of this Contract will not be
outsourced to a lab outside of the DPS Laboratory System for analysis.
E. Brazos County will not be responsible for paying any testimony fees associated with
testimony given in any judicial proceeding in connection with services provided by DPS
pursuant to the provisions of this Contract. If testimony is required by former or retired DPS
employees, DPS is not responsible for the associated travel costs; Brazos County may be
responsible for per diem including travel expenses. Testimony fees are not included in this
expectation.
F. Brazos County understands the DPS cannot compel testimony of former or retired
employees who provided work under the Contract.
G. Brazos County understands that if testimony is needed for a case previously worked by a
former or retired employee, it will work with the appropriate entity to:
Evaluate whether a peer review affidavit by a current employee can serve in place of
testimony

ii. Encourage the use of video testimony as authorized by statute
iii. Submit the evidence for re -analysis only using the current Expedite Analysis / Re-
analysis Request form after all other options have been exhausted. Cases requiring
re -analysis will not count toward the monthly number of cases submitted or items
tested. Additionally, the evidence may be worked by any qualified DPS employee,
not necessarily the individual hired under this Contract.
H. Brazos County understands DPS provides standard litigation packets upon request. If
discovery material beyond a litigation packet is required for every case completed under
this Contract, additional personnel resources must be included.
IV. CONTRACT AMOUNT AND BASIS FOR CALCULATING COSTS
The four year contract termamount will not exceed $741,282.20. This amount is intended to cover the
actual cost of having two DPS Forensic Scientists available to Brazos County during its business hours
and it includes salary, equipment, and operational costs (see Exhibit A). Brazos County will remit to DPS
by check all costs for performing the services as identified. To accomplish the stated goals of the
agreement, DPS may invoice for more than the annual amount stated in Exhibit A for any given year.
The cumulative total of those invoices will not exceed the total of the Contract.
V. TERM OF CONTRACT AND AMENDMENTS
This contract is effective December 5, 2021. The contract will terminate on August 31, 2025, or upon
written request of either party with 30 calendar days' written notice, whichever occurs earlier. This
contract may only be amended or extended by mutual written agreement of the parties.
VI. NOTICE
The respective party will provide any required notice as noted in this section. Either party may change
its information in this section by giving the other party written notice and the date upon which the
change will become effective. '

1 talked to Laura in the Property Tax department this morning. She attempted to transfer me to you and the call
got dropped. I tried to call her back, and the call was disconnected again. Per her instructions, I am emailing you
and sending you this letter which I will also mail via USPS today.
We own 2 properties in Brazos County, one of the property's taxes are paid by us personally and the other
property's taxes are paid through escrow. I mistakenly paid the taxes for the wrong property. I am requesting
that the funds from the Tang Cake taxes be applied to the tax bill for Jones Butler, with the remaining balance
refunded to us ($787.41).
