HomeMy WebLinkAbout2021-08-10 10:00 REGULAR MEETING r T E op 6 YOF$ MINUTES AUGUST 10, 2021 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday,August 10, 2021 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1; Russ Ford, Commissioner of Precinct 2; Nancy Berry; Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4, Karen McQueen, County Clerk;Absent. The attached sheets contain the names of the citizens and officials that were in attendance. 1. Invocation and Pledge of Allegiance -U.S. and Texas Flag—Judge Peters 2. Call for Citizen input and/or concerns Purchasing Director, Charles Wendt introduced the Purchasing Department's newest employee, Beth Martinez. Consider and take action on agenda items: 3-19 3. Proclamation 21-009 declaring August 2021 as Community Health Worker Month for the Community Health Workers and the National Community Health Workers Training Center. Vol. a pg. 1 The County Judge read aloud Proclamation 21-009 declaring August 2021 as Community Health Worker Month for the Community Health Workers and the National Community Health Workers Training Center. Denise Martinez from the National Community Health Workers Training Center stated that her and her team are proud to serve the community and they are grateful for the recognition they are receiving.A copy of the Proclamation is attached. Resolution 21-013 to adopt the Hart I nterCivic Verity Voting System. The Court voted unanimously to adopt Resolution 21-013 to adopt the Hart I nterCivic Verity Voting System.A copy of the Resolution is attached. Approval of County Transportation Infrastructure Fund Grant reimbursement in the amount of$855,679.00 used for Merka Road reconstruction. A copy is attached. Motion:Approve, Moved by Commissioner Nancy Berry, Seconded by Commissioner Irma Cauley. Passed. 5-0. Ayes:Aldrich, Berry, Cauley, Ford, Peters. 6. Approval requested from the Purchasing Department to declare a list of surplus property as salvage in accordance with Local Government Code 263.152 and authorize destruction or other means of disposal. Approval of Contract with Cenikor-Odyssey for Juvenile Residential Services. A copy of the service contract is attached. Presentation of the Brazos County Proposed Budget for Fiscal Year 2021-2022. Budget Officer Irene Jett presented the attached proposed budget for Fiscal Year 2022. 11. Discuss and propose 2021 Tax Rate. The Court voted unanimously to propose a tax rate of .4935 and to establish the date and time for a public hearing on the proposed budget for Fiscal Year 2021-2022 for August 31, 2021 at 1:30 pm in the Commissioners Courtroom along with the public hearing on the tax increase for August 31, 2021 at 1:45 pm in the Commissioners Courtroom. Consider and vote on the FY 2022 proposed salaries and allowances for elected county and precinct officials. The Commissioners Court voted unanimously on the proposed salaries and allowances for elected county and precinct officials for Fiscal Year 2022. At this point, the County Judge announced the Court would consider items 20 through 24 and then return to convene into Executive Session. Vol. \J pg. Having considered the previously noted agenda items, at 10:47 a.m.the County Judge stated that the Court would convene into Executive Session to deliberate pursuant to Section 551.0785 as stated above. Consider and possible action on Executive Sessions. At 10:58 a.m.the County Judge announced the meeting open to the public. On motion by Commissioner Cauley, seconded by the Commissioner Aldrich,the Court voted unanimously to approve a specific procedure for a certain Brazos County employee. Acknowledgement of the OrderAppointing CountyAuditor. The Commissioners Court acknowledged the appointment of County Auditor, Katie Connor and thanked her for doing a great job. 21. Juvenile Director's report on detention population. Juvenile Director Linda Ricketson reported there are 34 juveniles in the detention center, 28 are male and 6 are female, and 21 have electronic monitors. There are 4 youth in isolation as per medical protocol for new intakes. 22. Sheriff's report on inmate population. Sheriff Wayne Dicky stated there were 555 inmates in jail,482 inmates are male and 73 are female, 50 have electronic monitors and 3 are pending for processing. Commissioner Cauley asked Sheriff Dicky for an update on the COVI D-19 numbers in the jail. Sheriff Dicky stated that there are currently 2 positive inmates and 1 staff member positive. 23. Announcement of interest items and possible future agenda topics. There were no announcements. 24. Call for Citizen input and/or concerns There was no Citizen input. 25. Adjourn. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court,with both judicial and legislative powers,created under Article V,Section 1 and Section 18 of the Texas Constitution.As a Constitutional Court,the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code.Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court;in participating in public discussions before the Court;and in all actions in the presence of the Court.Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. PROCLAMATION Recognizing Brazos County Community Health Workers in the month of August WHEREAS, Community Health Workers are nationally recognized as essential front-line public health workers by government agencies, and they play a key role in advancing health equity, increasing access to care,and reducing health disparities, WHEREAS,Improving the health of populations requires sustainable,multi-sector collaborations between healthcare providers,public and state agencies, and their community stakeholders;and WHEREAS,The 4,000+Texas Community Health Workers and Community Health Worker Instructors serve a vital role in improving the health of their communities through community outreach and health education,and WHEREAS,Texas was the first state to formally recognize Community Health Workers as members of the public health workforce through the signing of House Bill 1864 and is one of the few states that offers a statewide Community Health Worker(CHW)certification; and WHEREAS,Denise Martinez, CHWI,MPH,Training Center Manager,leads the efforts of the National Community Health Worker Training Center,Texas A&M School of Public Health, which to date has served over 7,000 trainees; and WHEREAS,The National CHW Training Center is housed within the Center for Community Health Development(CCHD), located at Texas A&M University's School of Public Health,and in 2010,CCHD established the National Community Health Worker Training Center - (NCHWTC)in response,to partner community needs identified through research in the local area; and WHEREAS, Community Health Workers are being recognized for their passion and dedication to improving community health. SERVICES andTAYNIENTS 1. The Service Agency agrees to provide individualized and comprehensive teaching and instructional services in the areas of behavior management and self-help skills to alleged or adjudicated juvenile offenders while residing in the Service Agency's facilities, in accordance with the protocol stated in paragraph B below. 2. The Service Agency further agrees to provide basic care and necessities for the physical, mental, and emotional well-being of such juveniles while residing in the Service Agency's facilities, which care and necessities shall meet the minimum standards of the Child Care Licensing Act of 1975, and the specialized needs of each resident'juvenile.The Service Agency furthermore agrees to comply with the Contracted Components of Care as attached and incorporated to this contract, in addition to any updates to the Contracted Components of Care provided by the Texas Juvenile JusticeDepartment. 3. The Service Agency is under no obligation to accept a juvenile who the Service Agency deems inappropriate for placement with the Service Agency. 4. For placements which are not covered under Title 1V-E of the United States Code,the Court agrees to pay the Service Agency an amount not to exceed $197.69 perdayper juvenile or current state approved foster care rate for the services and care specified in paragraphs 1 and 2 above. 5. For juveniles placed in the facility under the Title IV-E program,the Court Agrees to pay the facility no more than the negotiated rate or a rate based on the TDPRS levels of-care as currently effective or subsequently amended,with no other contribution or use of federal funds. 6. For a juvenile whose case plan involves scheduled time away from the Service Agency's facility,the Service Agency will retain space for such juvenile until he or she returns.In that event,the Court will pay the Service Agency pursuant to this contract for up to ten consecutive days while the juvenile is away from the Service Agency's facility. 7. In the event of a juvenile's unauthorized departure from the Service Agency's Agency,and thereafter the Service Agency will retain space for that juvenile until the earliest of- (a)the expiration of five consecutive days following the unauthorized departure,or(b)the Service Agency's last regular billing day of the month during which the departure occurred. 8. Payments for the Service Agency's services and care will be made monthly on -- - I JPage Vol. pg. —1�P approved requests for payment which shall be submitted no later than ten days following the last day of the month for which payment is requested. 9. Each request for payment must include the names of juveniles for whom payment is requested and,for each juvenile, an itemization reflecting each date for which services and care were rendered pursuant to this contract. In accordance with section 231.006 of the Texas Family Code,the Service Agency certifies that the individual or business entity named in this contract is not ineligible to receive the specified payment and acknowledges that this contract may be terminated and payment withheld if this certification is inaccurate. 11. The Service Agency further certifies that it is a vendor in good standing with the Texas Comptroller of Public Accounts. 12. For all non-emergency treatment,including dental,vision,medical,and mental health services, the Service Provider must obtain prior authorization from Juvenile Probation. 13.If an emergency examination,EMS treatment,health care treatment,and/or hospitalization outside the Facility (hereinafter, "Outside Treatment") is required for a child placed in the Facility, the Administrator of the Facility(hereinafter,"the Administrator")is authorized to secure the Outside Treatment at the expense of Juvenile Probation.The Administrator shall notify Juvenile Probation of Outside Treatment within twenty-four(24)hours of its IY.CASE MANAGEMENT 1. Each juvenile placed with the Service Agency shall have a written case plan developed by the supervising juvenile probation officer of the Court. The case plan must address the relevant criminogenic needs identified by a risk and needs assessment_The juvenile shall have child specific goals, outputs and measurable outcomes based on the Texas Health and Human Services Commission Substitute Care Provider Outcome Standards. The supervising juvenile probation officer of the Court, in consultation with Service Agency staff,will bear responsibility for modifying the case plan as may be appropriate from time-to-time. 2. During each calendar month, the case plan shall be reviewed jointly by the Service Agency staff, the juvenile, the juvenile's parents and guardians, and the supervising juvenile probation officer. The case plan will be used to assist in preventing or controlling the juvenile's alleged delinquent behavior or alleged conduct indicating a need for supervision. The Service Agency shall make reasonable efforts to secure the presence of each juvenile at mutually convenient locations and times for monthly status and progress reviews. A Service Agency staff member with personal knowledge of the juvenile's progress in the facility shall participate in each monthly review, along with the juvenile probation officer of the court,and shall prepare a written summary of each review,with a copy to the supervising juvenile probation officer. Copies of the original case plan and monthly case plan reviews shall be maintained and kept by the Service Agency. 3. If a juvenile makes an unauthorized departure from the Service Agency's facility,or becomes seriously ill, or is involved in an incident of a serious nature,the Service Agency shall I j �iiotify the juvenile's supervising probation officer and the County Placement Officer immediately, and shall?gromptly notify the juvenile's parents and guardians. For plats where a FEMA-mapped Floodplain with a Zone AE classification exists within the plat, the BFE established by the accompanying FEMA- published flood study may be substituted for the engineering study. ❑ A minimum lowest finished floor elevation (FFE) for Buildings shall be established for each Lot within the plat. This minimum FFE shall be twelve (12) inches higher than the highest spot elevation that is located within five (5) feet outside the perimeter of the Building, or two-feet above the BFE, whichever is higher. ❑ If any areas within the plat include a 100-Year Floodplain (as determined by the results of an engineering study or as established by FEMA), a benchmark shall be established by the Owner within or immediately adjacent to the boundary of the plat. The location, description and elevation of the benchmark are required to be identified on the face of the plat. The elevation of this benchmark shall utilize the same vertical datum as that used in the engineering study to determine the FFE. ❑ A separate drawing containing both existing and proposed topographic information at 2-FT contour intervals along with the plat boundaries, Easement locations (existing & proposed), and culverts (existing & proposed). ❑ The certification language as found in Appendix C for both the Commissioner's Court approval and the County Clerk's filing certificate shall be located on the face of the plat. These signatures shall be obtained after approval by the Brazos County Commissioner's Court. ❑ If any Lot within the plat will be served by a well or an On-site Sewage Facility (OSSF), a letter must be provided by the Brazos County Health District stating they have examined the plat and that it is in compliance with the Brazos County On-site Sewage Facility (OSSF) Regulations, Construction Standards for On-site Sewage Facility (OSSF) Regulations as published by the Texas Commission on Environmental Quality (TCEQ). This letter must be signed by a representative of the District prior to Final Plat approval. V0_1. pg. �� ❑ If the plat contains a water well site, there shall be a depiction of the TCEQ separation requirements per Title 30, Part 1, Chapter 290, Subchapter D Rule §290.41. ❑ If rural route mailboxes are proposed, the plat note as found in Appendix G.2 for placement of such mailboxes shall be shown on the face of the plat. ❑ If any areas of the plat are located outside of all incorporated areas, the plat note as found in Appendix G.1 regarding the requirement to obtain a unique Development Permit from the Brazos County Floodplain Administrator prior to locating or altering a structure or land shall be placed on the plat. ❑ It is the responsibility of the Owner to assure that the proposed name of the Subdivision is not duplicated. The dedication of all Easements and rights-of-way shall be accomplished free of liens. The Owner shall be responsible for coordinating with all Utility Providers the location of all utility Easements that are shown on the Final Plat. ❑ Building Setback Lines for each proposed Lot as defined herein. For Subdivisions located within an Extraterritorial Jurisdiction (ETJ), this may be shown on the drawing or included as a plan note. ❑ Metes and bounds description of the property to be subdivided shall be certified by a Registered Professional Land Surveyor (RPLS), describing a beginning point and reciting bearings and distances to a corner of the original land grant survey of which the Subdivision is a part, according to the best available data. This study shall be sufficient in scope to determine and establish a BFE for all points within the plat. ❑ BFE's shall be shown for all points within the plat, as determined by the results of an engineering study. For plats where a FEMA-mapped Floodplain with a Zone AE classification exists within the plat, the BFE established by the accompanying FEMA- published flood study may be substituted for the engineering study. ❑ A minimum lowest finished floor elevation (FFE) for Buildings shall be established for each Lot within the plat. This minimum FFE shall be 12-inches higher than'the highest spot elevation that is located within five feet outside the perimeter of the Building, or two-feet above the BFE, whichever is higher. ❑ If any areas within the plat include a 100-Year Floodplain (as determined by the results of an engineering study or as established by FEMA), a benchmark shall be established by the Owner within or immediately adjacent to the boundary of the plat. The location, description and elevation of the benchmark are required to be Identified on the face of the plat. Each phase must be able to stand alone to meet requirements of these Regulations. ❑ Location and size of all existing and proposed subsurface and surface water drainage facilities, including water bodies on or immediately adjacent to the subject property and detention basins, if needed. ❑ If the proposed Preliminary Plan is to be a Private Subdivision (containing privately maintained Roads), the title of the plan shall contain the phrase, "A Private Subdivision". Refer to Article 8 for additional requirements. ❑ This check list along with the required copies of the plan shall be submitted to the County Engineer for approval. ❑ Include a description of contributing drainage to the proposed Subdivision. The submittal shall include the area, slope and type of Development in the contributing area. ❑ Drainage narrative in compliance with the BCEDG. ❑ Clearly indicate the method of sanitary sewage treatment and/or disposal such as, but not limited to, municipal sewer service, private sewage disposal system and On-site sewage facilities including the size and location of all proposed sewer mains and manholes.
