BRAZOS COUNTY COMMISSIONERS COURT
REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on
Tuesday, May 25, 2021 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Steve Aldrich, Commissioner of Precinct 1;
Russ Ford, Commissioner of Precinct 2;
Nancy Berry, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4, Present by Teleconference;
Karen McQueen, County Clerk.
The attached sheets contain the names of the citizens and officials that were in
attendance.

3. Resolution 21-011 honoring Brazos County Commissioners Executive Assistant Candy
Gallego.
The Court voted unanimously to adopt Resolution 21-011 honoring Brazos County
Commissioners Executive Assistant, Candy Gallego for her 36 years of service to
Brazos County. The County J udge read aloud the resolution and presented her with a
plaque.
Mrs. Gallego stated how thankful she was for her time with the County. She started her
career with the County when she was just seventeen years old and valued her time
working under many different elected officials. Throughout her years with the County she
got married, had kids and now has a grandchild. Mrs. Gallego says she was able to enjoy
spending time with her family while also truly enjoying her work, stating it was "the best of
both worlds". The court expressed their gratitude for her dedicated service.

4. Approve the Order dividing Election Precinct 79 and combining into Election Precinct 4
due to annexation by City of Bryan (Order 2482 City of Bryan).

5. Approval of donated or unclaimed property left by inmates leaving the Brazos County
Jail.

6. Request to approve Amendment No. 4 to Service Agreement between TAMU Health
Science Center and Brazos County regarding the Advanced Nursing Education-Sexual
Assault Nurse Grant.
A copy of the service agreement is attached.

7. Request from County Auditor's Department for a Payment Authorization to XTGlobal,
nc. in the amount of$30,910.00 for Oracle consulting services. The invoice exceeded
the amount of the Purchase Order.

8. Request from Facilities Services for a Payment Authorization to Garland DBS I nc. in the
amount of for$592.82 for Lane Closure Service. A Purchase Order was in place, but
due to an oversite, it was not paid on the original Purchase Order.

9. Retroactive Termination of the Temporary Policy on Face Coverings in the Brazos
County Courthouse.
Judge Peters explained the temporary policy was for the common areas of the Brazos
County Courthouse, but face coverings may still be required in the courtrooms. A copy
of the Order is attached.

10. Authorization for the County Judge to submit a form to the Texas Comptroller requesting
a portion of unclaimed capital credits received from electric cooperatives for the year
2020 be returned to Brazos County.

The Court acknowledged receipt of the Extension Service reports submitted in May
2021 and acknowledged receipt of reports from the following County and Precinct
Offices showing revenues collected and remitted to the County Treasurer:

20. Juvenile Director's report on detention population.
Juvenile Director Linda Ricketson reported there are 35 juveniles in the detention center,
27 are male and 8 are female, and 22 have electronic monitors with 3 pending for
monitors. There are 19 youth in isolation as per medical protocol for new intakes.
21. Sheriff's report on inmate population.
Sheriff Wayne Dicky stated there were 585 inmates in jail, 522 inmates are male and 63
are female, 42 have electronic monitors and 12 are pending for processing. There are
no inmates positive for COVI D-19. There are 2 staff members out for COVI D-19
related medical reasons. The Brazos County Jail has met the requirements set by the
state to stop reporting the weekly COVI D-19 numbers. Sheriff Dicky stated that this was
the last COVI D-19 update that he will be providing for Commissioners Court. Judge
Peters said the Sheriff's Office did a great job making it through the pandemic.
22. Announcement of interest items and possible future agenda topics.
Commissioner Ford recognized the Road and Bridge Department for going above and
beyond in resolving a drainage issue in the Timberwilde subdivision. He stated that
Darrell Kolwes was able to negotiate the County obtaining some Right of Way in order to
fix the problem. Judge Peters echoed Commissioner Ford's commendation, stating that
last week he noticed a culvert beginning to collapse and called Road and Bridge. Jon
Jones promptly responded to assess and mitigate the situation.

PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters,both on and off the agenda,and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting.Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court,with both judicial and legislative powers,created under Article V,Section 1 and Section 18 of the Texas Constitution.As a
Constitutional Court,the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code.Accordingly,members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court;in participating in public discussions before the Court;and in all actions in the presence of the
Court.Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group.Neither is it the intention of the Court to allow a member(or members)of the public to insult the honesty and/or integrity
of the Court,as a body,or any member or members of the Court,or County employees, individually or collectively.Accordingly,
profane,insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated.Violation of these rules may result in the following sanctions:
1.cancellation of a speaker's time;
2.removal from the Commissioners Court;
3.a Contempt Citation;and/or
4.such other and/or criminal sanctions as may be authorized
under the Constitution,Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting.During the public comment period,speakers may address matters not listed on the published agenda.The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court.However,responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public.To ensure the public has notice of all matters the Commissioners Court will consider,the County Judge
and/or Commissioners may choose not to respond to public comments,except to correct factual inaccuracies,recite existing
policy in response to an inquiry or to ask that a matter be listed on a future agenda.See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court.The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole.No member of the community is required to
attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business
of the Court.

Resolution
WHEREAS, On August 19, 1985, Candy Gallego began working as a clerk for the
Brazos County Clerk's Office; and
WHEREAS, On September 21, 1992, Candy Gallego began working as Office
Manager for the Brazos County.Attomey; and
WHEREAS, On June 23, 2001 Candy Gallego was promoted to Executive Assistant
to the Brazos County Commissioners Court; and
WHEREAS, Candy Gallego has proven to be a dedicated employee with the utmost
integrity, always performing the highest caliber of work; and
WHEREAS, Candy Gallego has decided to retire effective June 30, 2021.
NOW, THEREFORE, BE IT RESOL VED that the Commissioners Court of Brazos
County takes this opportunity to honor Candy Gallego and thank her for her 36 years
of service to Brazos County, and to wish her the very best in her retirement.

AND COMBINING INTO ANOTHER ELECTION PRECINCT
WHEREAS,the City of Bryan approved Ordinance#2482 annexing 29.184 acres of land
located in Voting Precinct 79; and
WHEREAS, the new boundary lines of the City of Bryan do not follow the existing
election precinct lines created by Brazos County; and
WHEREAS, Section 42.007 states "A commissioners court may not establish a county
election precinct containing territory inside a city with a population of 10,000 or more and
unincorporated territory outside the city"; and
WHEREAS, the Commissioner's Court is desirous of complying with the City of Bryan
city limit lines, and the Texas Election Code;and
WHEREAS, compliance with the Texas Election Code requires the division of one (1)
voting precinct and combining the annexed portion into another voting precinct; and
WHEREAS, Section 42.008 (1) of the Texas Election Code provides for combining
election precincts;
NOW THEREFOR BE IT RESOLVED BY THE COTVMSSIONERS COURT OF
BRAZOS COUNTY,TEXAS,that
Pursuant to Section 42.007 of the Texas Election Code that Election Precinct 79 be
divided to follow the City of Bryan city limit lines in Brazos County, Texas,to wit:
1. Election Precinct 79 be divided and be combined with Election Precinct 4;
2. Election Precinct 4 be extended to follow the new City of Bryan city limit lines and
vote at the current polling location;

Retroactive Termination of the Temporary Policy on Face Coverings in the Brazos County
Courthouse
WHEREAS,on June 1,2020 Brazos County Commissioner's Court adopted a Temporary
Policy on Face Coverings in the Brazos County Courthouse as to the Common Areas, in response
to the COVID-19 Pandemic.
WHEREAS,on May 18,2020,Texas Governor,Greg Abbott issued Executive Order GA-
36, which prohibits a governmental entity, including a county, city, school district, public health
or a governmental official from requiring any person to wear a face covering or mandate that
another person wear a face covering; with limited exceptions.
WHEREAS, GA-36 goes into effect at 11:59 P.M. on Friday May 21, 2021 and
supersedes Brazos County's Temporary Policy. Brazos County has removed all "required"mask
signage pursuant to its Temporary Policy as of May 20, 2021 at 5:00 P.M to ensure full County
compliance with GA-36.
NOW THEREFORE BE IT ORDERED,by the Brazos County Commissioner's Court,that the
Temporary Policy on Face Coverings in the Brazos County Courthouse be TERMINATED

Reservations from and Exceptions to Conveyance and Warranty:
There is hereby EXCEPTED and RESERVED from this conveyance,and retained in
favor of the Grantor,their heirs,executors,administrators,successors and assigns,in
perpetuity,all of the oil,gas,liquid hydrocarbons,residue gas,the products and by-
products of the foregoing,sulphur,coal, lignite, uranium,and all other minerals in,
on or under the hereinabove described property; provided,however, Grantor, their
heirs,personal representatives,executors,successors and assigns shall have no right
of ingress and egress at any times for the purpose of mining, drilling, exploring,
operating and developing said lands for oil, gas, and other minerals or for storing,�.
removing, transporting, processing or marketing the same there from. This
reservation and exception shall,however,include the right of Grantor,its successors
and assigns,to grant leases on the property to develop same by directional drilling,
pooling, unitization, or subsurface gasification, or liquefaction processes.
Notwithstanding anything herein to the contrary,the Grantee shall have the right to
use, without additional compensation, any stone, earth, gravel,caliche, iron ore or
any other road building material upon,in or under the property for the construction
and maintenance of road or roads thereon, such materials, for the purposes of this
conveyance,being herein defined as not constituting"other minerals."
This conveyance is made and accepted subject to any and all conditions,restrictions,
if any,relating to the hereinabove described property,to the extent,and only to the
extent,that the same may still be in force and effect,shown of record in the office of
the County Clerk of Brazos County,Texas.
Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty,grants,sells and conveys to Grantee the property,together with all
and singular the rights and appurtenances thereto in any wise belonging,to have and hold it to
Grantee,Grantee's successors or assigns forever. Grantor binds Grantor and Grantor's heirs,

This conveyance shall grant the rights herein specified only as to that portion ofthe above described
Property more particularly described on the attached Exhibit A,known as the"Easement Area",and
any additional area outside the Easement Area necessary to install and attach equipment,guy wires,
and anchors necessary and incident to the uses of the Easement Area to erect,construct,install,and
thereafter use,operate,inspect,repair,maintain,reconstruct,modify and remove the following:
Electric distribution lines;
Water lines and sanitary sewer lines,connecting lines,
access facilities,and related equipment;
Storm sewers and collection facilities;
Television,telephone,information and communication lines;
Drainage ditches,drainage pipes and all other
drainage structures,surface and subsurface;
upon,over and across the said Property as described and any ways,streets,roads or alleys
abutting same,and to cut,trim and control the growth of trees and other vegetation on and in the
Easement area or on adjoining property of GRANTOR,which might interfere with or threaten
the operation and maintenance of any public utility equipment,accessories,or operations. It
being understood and agreed that any and all equipment and facilities placed upon said Property
by a public utility entity shall remain the property of that entity.
GRANTOR hereby expressly acknowledges that it is the owner of this Property.
GRANTOR expressly subordinates all rights of surface ube,incident to the mineral estate owned
by GRANTOR,to the above-described uses of said surface by GRANTEE. GRANTOR will
provide GRANTEE with the names and addresses of all lenders, if any,and agrees to lender's
subordination on behalf of GRANTEE, if any.
