PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make commerit at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; iri participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the. County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except -to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section 551.042. INVOCATION Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business of the Court. VOL MINUTES DECEMBER 29,2020 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, December 29, 2020 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1; Russ Ford, Commissioner of Precinct 2; Nancy Berry, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. Juvenile Director's report on detention population. Juvenile Director Linda Ricketson reported there are 10 juveniles in the detention center, 6 are male and 4 are female, and 28 have electronic monitors. There are 4 new youth in medical isolation as per protocol. Ms. Ricketson thanked the Court for taking such good care of the people that work for the County through this pandemic. She also thanked Sheriff Kirk and his staff for all of their support through this. 11. Sheriff's report on inmate population. Sheriff Kirk announced that this would be his last report. He has served the county for 40 years. He reported there were 493 inmates in jail, 440 inmates are male and 53 are female, 12 have electronic monitors and 8 are pending for monitors. There have been 14 bookings in jail, 43 were released, 27 were bussed to TDC and 12 were held for magistrate hearings. Sheriff Kirk stated that 0 inmates are positive for COVI D-19 and 1 inmate is quarantined. There are 5 staff members that are positive and 11 are in quarantine. Judge Peters thanked the Sheriff again for his service and he received a standing ovation from everyone in the courtroom. 12. Acknowledgement of monthly reports submitted in December 2020. The Court acknowledged receipt of the Extension Service reports submitted in December 2020 and acknowledged receipt of reports from the following County and Precinct Offices showing revenues collected and remitted to the County Treasurer: County Clerk District Clerk Constable Precinct 2 Constable Precinct 3 Sheriff 13. Announcement of interest items and possible future agenda topics. Vol. pg --245— County Auditor, Katie Conner announced that the timesheets in Oracle is now live. Employees will have to transfer anything entered into Clockwise to Oracle. She said this is a good time to troubleshoot and try entering time while there is a light staff working. She stated that employees may contact the IT Help Desk, herself, or the Treasurer's office for help. Judge Peters stated that he appreciates all her hard work on Oracle. Commissioner Berry said that she would like Santos Navarette, Brazos County Health District Director to give a report on how the roll out of the vaccine is going and when it will be available for everyone. Commissioner Aldrich agreed with Commissioner Berry and stated that Mr. Navarette will be present in Court on January 5th to give the report. 14. Call for Citizen input and/or concerns Samuel Smith, representing a group of small businesses in Brazos County spoke to express concern about the Executive Order issued by the Governor. He understands we are over the COVID threshold and are looking at closing the bars and reducing capacity at the restaurants again. He explained the stress and struggles of small business owners and said he understands the County Judge is trying to follow the Governor's order. However, he asked that he look at how the Galveston County Judge has handled things. Galveston County has said they are not able to enforce this and are choosing not to enforce it. Mr. Smith implored the County Judge to take a closer look at the impact on business owners, the community and everyone that works for them. Bary Ivins, owner of the Corner Bar, Carney's Pub and the Kyle House stated that he is a former bar owner now operating as a restaurant. He said reducing the capacity to 50% would not hurt him much now while the students are gone. He isn't reaching 50% capacity now anyway. He works in the bar industry and has been able to wear a mask, practice social distancing and avoid getting COVID. He asked that the County Judge consider not following the Governor's order like the Galveston County Judge did. He said it didn't make sense to punish business owners when Bexar County is going to have $10,000 people at a football game today while their restaurants and bars are reduced and closed. He asked the County Judge to consider that a small business like his coffee shop being reduced to 50% may prevent him from reopening after the holidays. 15. Adjourn.
