PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a
Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the
Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity
of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly,
profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions:
1, cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge
and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing
policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to
attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business
of the Court.

BRAZOS COUNTY COMMISSIONERS COURT
REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South
Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday,
May 5, 2020 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Steve Aldrich, Commissioner of Precinct 1, Present by Teleconference;
Sammy Catalena, Commissioner of Precinct 2, Present by Teleconference;
Nancy Berry, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheets contain the names of the citizens_ and officials that were in
attendance.

3. Proclamation 20-028 declaring May 3-9, 2020 as National Correctional Officers and
Employees Week.
The Court approved a proclamation designating May 3, 2020 through May 9, 2020 as
National Correctional Employees Week. The County Judge read aloud the
proclamation recognizing the Correctional Officers and employees working in Brazos
County. Judge Peters invited Sheriff Chris Kirk to speak.
Sheriff Kirk thanked the Court and stated that this is an important week for officers. The
Sheriff said we have a lot of unsung heroes in our community including those in public
health currently fighting COVI D-19. He said that those in corrections are unsung heroes
everyday, their jobs are not glamorous and at times dangerous. Sheriff Kirk said he is
proud to say that as of today the detention center has had no positive cases and
commends his staff for their efforts in following the safety protocols.
Judge Peters thanked Sheriff Kirk, Wayne Dicky and everyone for the excellent job they
do.
Sheriff Kirk said he also wanted to thank and recognize the nurses who are working on
the front lines.
Juvenile Director Linda Ricketson added she would like to also commend her staff for
their work. She said the staff has been wonderful following health protocols and keeping
everyone safe.

National Nurses Recognition Week. The County Judge read aloud the proclamation
recognizing the important role nurses play to improve and promote health and wellness
in the community.

There was no claims.
16. Juvenile director's report on detention population.
Juvenile Director Linda Ricketson reported there are 16 juveniles in the detention center,
14 are male and 2 are female, and 21 have electronic monitors. Ms. Ricketson added
that there are 3 youth in isolation for 14 days as is the protocol for youth entering into the
center. She also noted that TJJD and placements are still closed at this time.
17. Sheriff's report on inmate population.
Sheriff Chris Kirk stated there were 490 inmates in jail, 416 inmates are male and 74 are
female, 31 have electronic monitors and 0 are pending for monitors. Sheriff Kirk added
that 2 inmates have been tested for the COVI D-19 virus and both were negative.
18. Announcement of interest items and possible future agenda topics.
Commissioner Berry thanked Jennifer Salazar, Leslie Contreras, Barbara Smith and
Judge Peters for the great "Back to Work" video for the employees. She reminded
everyone to wash their hands.
Commissioner Cauley said she was impressed with quality of the video and said
everyone did really well.

National Correctional Officers and Employees Week
WHEREAS, National Correctional Officers and Employees Week was first proclaimed on May 5, 1984, by President
Ronald Reagan when he signed Proclamation 5187 creating "National Correctional Officers Week," to recognize the men and
women who work in jails, prisons, and community corrections across the country; and
WHEREAS, National Correctional Officers and Employees Week became the official name the first week in May when, in
1986, the U.S. Senate officially changed the name from "National Correctional Officers Week"; and
WHEREAS, National Correctional Officers and Employees Week has been designated as the week of May 03, 2020, through
May 09, 2020, by the U.S. Department of Justice and the Federal Bureau of Prisons; and
WHEREAS, National Correctional Officers and Employee Week honors the work of Correctional Officers and Correctional
Personnel for their service with honor, respect, and integrity; and raises the awareness of the duties, hazards, and sacrifices
made by the Correctional employees; and
WHEREAS, National Correctional Officers and Employees week in Brazos County recognizes Correctional officers and
employees for their role in safeguarding the citizens of Brazos County by providing safe, secure, and humane incarceration of
offenders within their custody;
WHEREAS, National Correctional Officers and Employees week in Brazos County this year wants to recognize all
Correctional officers and employees for their acts of heroism, dedication to duty and commitment to our community during
the COVIDI9 outbreak of 2020;
NOW THEREFORE, BE IT RESOLVED that the Commissioners Court of Brazos County, does hereby proclaim the
week of May 03, 2020 through May 09, 2020, as "National Correctional Officers and Employees Week." All citizens are
encouraged to pay tribute to all the many Correctional Employees working in Brazos County for the vital public service they

PROCLAMATION
National Nurses Recognition
WHEREAS National Nurses Day is a day we celebrate nurses and raise awareness
of the importance in their contributions to society. This day, May 6th is part of National
Nurses Week — a week that ends on May 12th and marks the birthday of Florence
Nightingale; and
WHEREAS President Ronald Reagan signed Proclamation 4913 on March 25, 1982 a proclaiming "National
Recognition Day for Nurses" to be May 6, and
WHEREAS Nursing has a variety of different level of skills as well as areas in which they contribute with each playing
an important role which facilities to maintain doctor -patient care; and
WHEREAS Nurses are one of the most integral parts of a medical team, fulfilling a crucial role
in providing patients and their families the highest level of care, as well as a key
means of emotional support, significantly contributing to improved patient and
family outcomes; and
WHEREAS Brazos County this year wants to recognize all Nurses in the Community as well as in connections for
their acts of heroism, compassion, dedication to duty and commitment to our community during the
COVID19 outbreak of 2020

General Summary:
Performs Administrative, essential and routine duties with organizational skills and the ability to coordinate with other Court staff all Court functions
and procedures necessary toward the operation of the Precinct Court. 'Must possess a thorough knowledge base of each Precinct office functions."
Essential Duties:
Manages the Court:
• Supervises the clerks, II & III and interns while they perform their duties of assisting JP4 patrons with the disposition of their citations, small
claim, debt claim and eviction petition filings; assisting when needed/making the decision when clerks are unsure.
• Maintaining intern log/payroll reports and submitting as needed to HR/school supervisors.
• Primarily in charge of making docket entries on the calendar to which clerks can add cases as needed for hearings, trials, etc.
• Always In communication with the Judge to inform them of upcoming docket entries and making changes when needed if there is a
conflict with the Judge's calendar.
Reporting and Fiduciary Role:
• Prepare monthly reports and submits appropriately for the following:
• DPS Conviction Reporting, OCA (Office of Court Administration), MVBA updates(collection agency), and monthly recapitulation(JP4
financial distribution).
• Submit a Quarterly report to OMNIBASE; accounts receivable for the charge added to a citation when a patron has not shown in the Court
to dispose of it (puts a hold on DL renewal).
• Prepare payment authorizations (PA) for the Judge to sign and submit to County Commissioners Court to have paid for all expenses not
previously requisitioned for.
• Periodically running reports within Odyssey to determine the status of certain cases (ie. deferred dispositions or driver safety courses that
are overdue, as well as failure to shows for citations)
• In charge of making sure all clerk tills are closed and balanced each evening and preparing the deposit to be put in the safe overnight and
picked up by a constable the next morning for deposit to the bank.
Bench/Jury Trial Role:
• Communicating with jury services when needing to request a jury panel for a jury trial set in the Court, either criminal or civil.
• Preparing the jury trial paperwork beforehand, checking in the jurors the day of the trial, distributing payment paperwork to the jurors and
assisting the Judge during the trial.
Magistration Duties:
• Once a month, JP's perform the county magistration duties for inmates incarcerated overnight within the county jail, this is done at the JP4
court, not offsite at the jail.
• Assist the Judge with the paperwork associated with each person magistrated, which may include issuing orders and bond conditions and
forwarding that paperwork to appropriate agencies, ie. arresting agency, County Attorney's office, Adult Probation and 911 dispatch.
• This is Monday thru Sunday of the given week. Clerks/Coordinator rotate M -F assisting the Judge and one clerk/coordinator will do Sat &
Sun (earning compensatory time). Weekends are rotated monthly among the clerks and ftll ft

Station and Brenham, and the Counties of Washington, Grimes, and Brazos, and Texas A&M
University entered into an interlocal agreement (the "Agreement") for the construction,
acquisition, implementation, operation and maintenance of the Brazos Valley Wide Area
Communications System (BVWACS); and
WHEREAS, Section 11 of the Agreement provides for the'addition of new parties to the
BVWACS system; and
WHEREAS, Section 6 of the Agreement provides for the amendment of the Agreement;
and
WHEREAS, Madison County wishes to become a full BVWACS party; and
WHEREAS, Madison County agrees to abide by all covenants outlined in the Agreement;
and
WHEREAS, the existing BVWACS parties wish to amend the Interlocal Agreement to
add Madison County as a full BVWACS party; and
WHEREAS, the Brazos Valley Council of Governments has arranged to have a six -
channel 700MHz RF site equipment rack provided for installation at a tower site, located at 1101
E. Collard Street in Madisonville; and
WHEREAS, Madison County has agreed to, furnish space on said tower and in the
associated equipment shelter,
NOW, THEREFORE, the BVWACS parties and Madison County hereby agree as follows:
1. Unless expressly written herein, the terms of this amendment shall follow the terms of the
Agreement and will continue until September 30, 2023, as defined in Section 2 of the
Agreement.

2. Madison County will fund any and all costs associated with bringing the RF infrastructure
into service. This includes, but is not limited to, preparation of the existing tower shelter
for proper operation and protection of existing and new equipment based on industry best
practices, as well as any grant funding provided by the State of Texas or locally budgeted
funds.
3. Madison County understands that costs associated with being a BVWACS Party are
calculated every year, based on the number of subscriber devices they have in service on
the BVWACS System versus the total Operating, Maintenance, and Capital Fund Budgets.
4. Madison County further understands that, if their initial subscriber count is insufficient to
cover the actual maintenance and operation costs of their membership, they will be
responsible for payment of a sufficient number of subscriber units to offset those costs.
5. Madison County understands that, once their actual number of subscriber units in-service
is sufficient to cover the actual maintenance and operation costs of their membership, they
will be billed at their actual subscriber count.
6. Madison County agrees to provide antenna and equipment shelter space at the tower
located at 1101 E. Collard Street in Madisonville, as well as prepare the shelter for the
installation of new equipment in a manner consistent with industry best practices for the
installation and protection of RF equipment at tower sites, including any reconfiguration
of existing equipment as may be necessary, working in conjunction with the BVWACS
Radio System Manager to determine the best course of action, and Madison County agrees
that they will be wholly responsible for any and all lease fees that may be charged by the
owner of said tower structure, so long as they remain a BVWACS Party.
7. Madison County will receive subscriber devices, at no cost, from the Brazos Valley
Council of Governments, at a quantity to be coordinated between Madison County and the
BVWACS Radio System Manager, in an effort to lessen the initial Capital Expenditure
burden on Madison County. Madison County agrees that they will receive the subscriber
devices only, and Madison County will be financially responsible for any costs associated
with purchasing the necessary accessories to put the subscriber devices into service,
including any batteries, antennas, microphones, speakers, power cables, installation
services, or any other ancillary costs.
8. In accordance with Section 4.B. and 53 of the Agreement, Madison County shall appoint
One (1) official to the BVWACS Governing Board, and One (1) primary representative
and One (1) alternate representative to the BVWACS Operating Board.
9. The BVWACS Parties agree that, for testing and verification purposes, RF site
infrastructure and subscriber units may become active prior to the effective date of this
Amendment. The BVWACS Parties further agree that, should these units become active
prior to the effective date of this Amendment, Madison County shall not be billed for this

4 AND MADISON
This First Amendment to the Interlocal Agreement for Managing Entity by the BVCOG
for the Brazos Valley Wide Area Communications System (BVWACS) is entered into this
day of 2020 and is effective as of October 1, 2020.
WHEREAS, the Brazos Valley Council of Governments and the Cities of Bryan, College
Station and Brenham, and the Counties of Washington, Grimes, and Brazos, and Texas A&M
University (BVWACS Parties) entered into an interlocal agreement (the "Agreement")..for
Managing Entity by the BVCOG for the Brazos Valley Wide Area Communications System
(BVWACS); and
WHEREAS, Article 7 of the Agreement provides for Changes and Amendments of the
Agreement; and
WHEREAS, Madison County is a new BVWACS party subsequent to execution of the
First Amendment to the Second Restatement of the Interlocal Agreement for the Construction,
Acquisition, Implementation, Operation and Maintenance of the Brazos Valley Wide Area
Communications System (BVWACS); and
and
WHEREAS, the BVWACS parties wish to amend this Agreement to add Madison County;
WHEREAS, Madison County agrees to abide by all covenants outlined in the Agreement;
NOW, THEREFORE, the BVWACS parties hereby amend the Agreement as follows:
1. The Agreement is amended to include the Cities of Bryan, College Station and Brenham,
and the Counties of Washington, Grimes, Brazos, and Madison, and Texas A&M
University.

Families First Coronavirus Response Act (FFCRA)
FMLA Leave Expansion (EFMLA) and
Emergency Paid Sick Leave Policy (PSL)
Purpose
To comply with the Families First Coronavirus Response Act and to assist employees
affected by the COVID-19 outbreak with job -protected leave and pay, where applicable.
This policy will be in effect until December 31, 2020. Our existing FMLA leave policy still
applies to all other FMLA-qualifying reasons for leave outside of this policy.
Expanded FMLA Leave
Employee Eligibility
All current employees who have been employed with Brazos County for at least 30 days
and are actively scheduled for work are eligible for leave under this policy.
Employees laid off or otherwise terminated on or after March 1, 2020, who are rehired
on or before December 31, 2020, are eligible for leave upon reinstatement if they had
previously been employed with Brazos County for 30 or more of the 60 calendar days
prior to their layoff or termination.
For purposes of the Expanded FMLA policy, emergency responders are excluded. An
emergency responder is an employee who is necessary for the provision of transport,
care, health care, comfort, and nutrition of such patients, or whose services are
otherwise needed to limit the spread of COVID-19. This includes but is not limited to
military or national guard, law enforcement officers, correctional institution personnel,
fire fighters, emergency medical services personnel, physicians, nurses, public health
personnel, emergency medical technicians, paramedics, emergency management
personnel, 911 operators, public works personnel, and persons with skills or training in
operating specialized equipment or other skills needed to provide aid in a declared
emergency as well as individuals who work for such facilities employing these
individuals and whose work is necessary to maintain the operation of the facility.
Specifically, for Brazos County, this includes employees in the following departments:
Sheriffs Office, Juvenile, Constable Pct. 1, Constable Pct. 2, Constable Pct. 3, and
Constable Pct. 4.
Reason for Leave
Eligible employees who are unable to work (or telework) due to a need to care for their
child when a school or place of care has been closed, or when the regular child care
provider is unavailable due to a public health emergency with respect to COVID-19.
"Child" means a biological, adopted or foster child, a stepchild, a legal ward, or a child of
a person standing in loco parentis, who is:
• Under 18 years of age.
• 18 or older and incapable of self-care because of a mental or physical disability.
"Child care provider" means a provider who receives compensation for providing child
care services on a regular basis, including:
• A center -based child care provider.

• A group home child care provider.
• A family child care provider (one individual who provides child care services for
fewer than 24 hours per day, as the sole caregiver, and in a private residence).
• Other licensed provider of childcare services for compensation.
• A childcare provider that is 18 years of age or older who provides child care
services to children who are either the grandchild, great grandchild, sibling (if
such provider lives in a separate residence), niece or nephew of such provider,
at the direction of the parent.
"School" means an elementary or secondary school.
Duration of Leave
Employees will have up to 12 weeks of leave to use through December 31, 2020, for the
purposes stated above. This time is included in and not in addition to the total FMLA
leave entitlement of 12 weeks in a 12 -month period.
For example, if an employee has already taken 6 -weeks of FMLA leave, that employee
would be eligible for another 6 weeks of FMLA leave under this policy.
Increments & Intermittent Use of Leave
Employees may take expanded FMLA leave intermittently and in any increment agreed
to with their Department Head/Elected Official. For example, an employee may only
need 4 hours per day of leave to care for his or her child or may only need to do so on
Tuesdays and Thursdays. Managers and employees are expected to be flexible in
scheduling wherever possible.
Pay During Leave
Leave will be unpaid for the first 10 days of leave; however, employees may use
accrued leave during this time. The employee may also elect to use the paid leave
provided under the Emergency Paid Sick Leave Act, as further explained below. After
the first 10 days, leave will be paid utilizing the Paid EFMLA Leave Code. Any unused
portion of this pay will not carry over to the next year.
For employees with varying hours, they may utilize Emergency Paid Sick Leave or
EFMLA for the budgeted average number of hours for their position.
Employee Status and Benefits During Leave
While an employee is on leave, Brazos County will continue the employee's health
benefits during the leave period at the same level and under the same conditions as if
the employee had continued to work. While on paid leave, the employer will continue to
make payroll deductions to collect the employee's share of the premium. During any
unpaid portions of leave, the employee must continue to make this payment per
instructions from the HR department.
If the employee contributes to any optional insurances, Brazos County will continue
making payroll deductions while the employee is on paid leave. During any portion of
unpaid leave, the employee will have the option to pay premiums directly or upon their
return to receiving a paycheck.

Procedure for Requesting Leave
All ,employees requesting FMLA leave must provide written notice of the need for leave
to Human Resources as soon as practicable. Verbal notice will otherwise be accepted
until written notice can be provided.
Notice of the need for leave must include:
• The name and age of the child or children being care for.
• The name of the school, place of care, or child care provider that closed or
became unavailable due to COVID-19 reasons.
• A statement representing that no other suitable person is available to care for the
child or children during the period of requested leave. For children over the age
of 14, a statement indicating the special circumstances that require the employee
to provide care, --during daylight hours.
On a basis that does not discriminate against employees on FMLA leave, Brazos
County may require an employee on FMLA leave to report periodically on the
employee's status and intent to return to work.
Emergency Paid Sick Leave
Eligibility
All current employees scheduled but unable to work (or telework) due to one of the
following reasons for leave:
1. The employee is subject to a federal, state or local quarantine or isolation order
related to COVID-19.
2. The employee has been advised by a health care provider to self -quarantine due
to concerns related to COVID-19.
3. The employee is experiencing symptoms of COVID-19 and seeking a medical
diagnosis.
4. The employee is caring for an individual who is subject to either number 1 or 2
above.
5. The employee is caring for his or her child if the school or place of care of the
child has been closed, or the child care provider of such child is unavailable, due
to COVID-19 precautions.
6. The employee is experiencing any other substantially similar condition specified
by the secretary of health and human services in consultation with the secretary
of the treasury and the secretary of labor.
"Child" means a biological, adopted or foster child, a stepchild, a legal ward, or a child of
a person standing in loco parentis, who is:
• Under 18 years of age.
• 18 or older and incapable of self-care because of a mental or physical disability.
"Individual" means an immediate family member, roommate or similar person with
whom the employee has a relationship that creates an expectation that the employee
would care for the person if he or she self -quarantined or was quarantined. Additionally,
the individual being cared for must: a) be subject to a federal, state or local quarantine
or isolation order as described above; or b) have been advised by a health care provider
to self -quarantine based on a belief that he or she has COVID-19, may have COVID-19
or is particularly vulnerable to COVID-19.

Amount of Paid Sick Leave
All eligible full-time employees will have up to 80 hours of paid sick leave available to
use for the qualifying reasons above. Eligible part-time employees are entitled to the
number of hours worked on average. For employees with varying hours, they may utilize
Emergency Paid Sick Leave or EFMLA for the budgeted average number of hours for their
position.
Increments and Intermittent Use of Leave
When working from home, employees may take emergency paid sick leave
intermittently and in any increment agreed to with their Department Head/Elected
Official. As in the example for FMLA leave, an employee may only need 4 hours per day
of leave to care for his or her child or may only need to do so on Tuesdays and
Thursdays. Managers and employees are expected to be flexible in scheduling
wherever possible.
For those not teleworking and currently working onsite, an employee may only take
intermittent leave for reason 5 above, to care for his or her child when the school or
place of care is closed, or the caregiver is unavailable due to COVID-19-related
reasons. Per the regulations, as all other reasons for emergency paid sick leave could
potentially expose an employee or others in the workplace to the virus, employees must
either use the full amount of paid sick leave or use it in full-day increments until the
reason for leave is over and it is safe for the employee to return to work.
Rate of Pay
Emergency sick leave will be paid at the employee's regular rate of pay utilizing the Paid
Sick Leave Code.
Interaction with Other Paid Leave
The employee may use emergency paid sick leave under this policy before using any
other accrued paid time off for the qualifying reasons stated above.
Employees on EFMLA leave under this policy may use emergency paid sick leave
concurrently with that leave. Emergency paid sick leave may also be used when an
employee is on leave under traditional FMLA for his or her own COVID-19-related
serious health condition or to care for a qualified family member with such a condition
Procedure for Requesting Emergency Paid Sick Leave
Employees must notify their manager or Human Resources of the need and specific
reason for leave under this policy. A form for requesting Emergency Paid Sick Leave is
available. Verbal notification will be accepted until practicable to provide written notice.
Documentation supporting the need for leave must be included with the leave request
form, such as:
• A copy of the federal, state or local quarantine or isolation order related to
COVID-19 applicable to the employee or the name of the government entity that
issued the order.

Written documentation by a health care provider advising the employee to self -
quarantine due to concerns related to COVID-19 or the name of the provider
who advised the employee.
The name and relation of the individual the employee is taking leave to care for
who is subject to a quarantine or isolation order or is advised to self -quarantine.
The name and age of the child or children being cared for; the name of the
school, place of care, or child care provider that closed or became unavailable;
and a statement that no other suitable person is available to care for the child
during the period of requested leave.
o For children over age 14, a statement indicating the special
circumstances that require the employee to provide care during daylight
hours.
Once emergency paid sick leave has begun, the employee and his or her manager
must determine reasonable procedures for the employee to report periodically on the
employee's status and intent to continue to receive paid sick time.
Carryover
Paid emergency sick leave under this policy will not be provided beyond December 31,
2020. Any unused paid sick leave will not carry over to the next year or be paid out to
employees.
Job Protections
No employee who appropriately utilizes emergency paid sick leave under this policy will
be discharged, disciplined or discriminated against for work time missed due to this
leave.

A. General Requirements
I . 'Adequate drainage shall be maintained in ditches at all times.
2. Permittee will use best management practices ("BMP") (EPA and TCEQ both provide lists 'of examples of
BMPs) to minimize erosion and sedimentation resulting from the proposed installation.'
3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property
shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or
appointed representative.
4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior.
occupant.
5. Permittee shall not interfere with.othe'r utilities located in the right of way. In the event damages occur,
permittee will be liable'to the County or other utilities running through the right of way..
b. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is
determined that inconvenience to the public exists, then the County Engineer will decide whether such
project will be allowed or if an alternative exists so as not to inconvenience the public.
B. Safety Reauiremenis
1. Proper traffic control measures must be put in place prior to beginning work and remain in place during
the duration of the job. 'All traffic control measures must follow the Texas Manual of Uniform Traffic
-Control Devices (TMUTCD). See Traffic Control Requirements below.
2. During construction, all safety regulations of the Texas Department of Transportation shall be observed.
3. Permittee must take such precautions and measures,'includingplacing and displaying safety devices,' as
may be necessary, in order to safely conduct the public through the project area. Company shall provide
flagmen, signs, signals or devices necessary to provide complete safety to the public.
4. .Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property
owners.
5. No'cable, conduit and/or pole line shall be laid, constructed, maintained and/or repaired so as to constitute'
a danger or hazard of any kind to..persons or vehicles using such road. Any poles placed in the Right of
Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved .
by the County Engineer.
C. Traffic Control Nag
1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided
for the following: .
a. Any construction (i.e. pit, excavation, hole) left open overnight, requires specific ni hg_ttime traffic
control measures pursuant to the TMUTCD;

b. If construction is within ten (10) feet of the roadway; or
c. Any work performed in the road right-of-way;
2. Plan must be attached to the permit and kept at the job site anytime work is being performed.
3. Plan must set forth the time of completion for the job.
D. Design Standards
1. All overhead installations shall conform to clearance standards of the Texas Department of Transportation
and the pole be placed.in the designated area for power specified as set forth in the Texas Utilities Code,
Section 181.045.
2. All pole installation (including lighting) shall be placed at the backside of the.Right of Way to ensure . * .
safety to the public. Any pole placed in violation of this requirement will be required to be moved to the. .
appropriate location at the company's expense. Exceptions may be approved by the County Engineer.
3. All underground installations shall (these are minimum depths — utility may place deeper):
a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement;
b. be at least thirty-six (36) inches below ditch flow line when installation is within the area measured
from top of bank to top of bank;
c. be at least forty-eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For
high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below;
d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of.
less than 60 feet.
4. Water Lines: A[1 water lines must be a minimum 36 -inches below the ditch flow line and cased.
Waterlines shall be.cased if crossing under the roadway.
5. Utilities in all new developments that have 60 feet or greater of -right of way shall be installed within
designated locations based upon the type of utility. The locations shall be as follows: (measured from
back of right-of-way).
Power—.0 to 2 feet, nominally_]' ..
Phone — 2 to 4 feet, 'nominally 3'
Gas — 4 to 6 feet, nominally.5'
Cable - 6 to 8 feet, nominally 7'
6. Utilities with less than 60 feet right-of-way in.all new developments shall install the utility in a similar.
manner as referenced in No. 3 above; however, the County Engineer or its designated representative will
provide final approval of each utility location.
7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400'
if left. open overnight or unattended.
8. Crossings under a county road shall:
a. be bored or jacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT;
b. be pressure grouted for the full length of the crossing # the annular space between pipe and casing and
soil exceeds one.(1) inch. Brazos County must be given 24 hours notice of pressure grouting
operations and have the opportunity to have an inspector on site to observe pressure grouting
operations;

c. TxDOT Standard Specification Item 476 shall be followed for all boring, jacking, tunneling and joints.
9. Bore Pits:
a. no pits shall remain open longer than 2 days;`
b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above.
c. pits shall NOT be located within ten (I0) feet from the edge ofpavement without prior approval from'
the County Engineer or his representative;
d. when pits are to remain open for more than 8 hours, due diligence wilt be used in protecting the spoil
pile to prevent: drainage problems;
e. based upon soil conditions, the County Engineer or his representative may require shoring to protect
pavement integrity;
f. based upon soil conditions, the County Engineer or his representative may require pit4`be placed'
further from the edge of road.
10. Any installation within ten (10) feet of edge of pavement shall meet the following:
a. location must be approved by the County Engineer or his representative
b, backfilled with cement stabilized material.
c. based upon soil conditions, the County Engineer or his representative may require shoring to
protect pavement integrity.
d. 'all excess water and mud shall be removed from the trench. prior to backfilling. Any backfill placed
during a rainy period or at other times where excess water cannot be prevented from entering the
trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized
material as soon as weather permits;
e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the
County Engineer or his representatives.
f.. no side or lateral tamping to fill voids under the base and pavement materials is allowed.
11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event
Company damages*the slope, shoulder or any other portion of the right-of-way, Company will be
responsible for repairing the damage and replacing the right -of -.way to the condition it was prior to
commencing constriiction.
12. Operation of construction and/or maintenance equipment.on the traveled surface of any improved County'
road will not be permitted, except in an instance whereby the laying, construction,'maintenance and/or
repair of cables, conduits and/or pole lines cannot be accomplished by any other method and in this event.
all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided
meeting TMUTCD requirements.
13.. In the event said construction and/or maintenance and/or repair requires Company to remove, cut or
Jeopardize any section of the road (asphalt, cement, road base, etc.), Company will be required to provide.
a performance bond or letter of credit securing necessary repairs. Said bond amount will be determined by
the County Engineer.
19.. The applicant shall submit a letter of "No Objection" from the Army Corps of Engineers for all
designated wetlands. and environmentally sensitive lands.
E Enrerrency work
1. In the event Company is required to perform emergency services, that requires excavation in a County
Right of Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company

shall notify County Engineer within 24 hours of beginning construction/repairs. This will allow the
County Engineer's Office an opportunity to inspect the site to ensure the integrity of the County Right of
Way and traffic safety controls used.
F. Repairs to existiite facilities
1. Maintenance and/or repair to existing cables, conduits, and/or pole lines which require disturbance of the
soil, shall not be performed until plans describing such maintenance and/or repair have been approved by
the County Engineer or its designated representative and a permit has been obtained.
G. Relocation of utilities
L When and if the County Engineer determines that it is necessary for the construction, repair, improvement,
alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables'or other .
facilities and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated .
thereon, as required by the County Engineer within a reasonable time as determined by the County
Engineer and Utility Company, and at the expense of the Utility Company.
H. Hick Pressure Pipelines
1. 'All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to
controlled access or non -controlled access installations, should contain the following additional
information in the description of the permit.
-diameter
-wall thickness
-material specification
-minimum yield strength "
-maximum operation pressure of the pipeline
2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied
for both the carrier pipe and the casing.
3. -Assurance must also be given that the installation material and design meet the minimum Federal Safety
Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed.. .
