PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a
Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the
Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity
of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly,
profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge
and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing
policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to
attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business
of the Court.
The Commissioners Courtroom of the County Administration Building, 200 South Texas Ave., Suite 106, Bryan, TX 77803 is
wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive services must be made two

BRAZOS COUNTY COMMISSIONERS COURT
REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South
Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday,
December 3, 2019 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Steve Aldrich, Commissioner of Precinct 1, Absent;
Sammy Catalena, Commissioner of Precinct 2;
Nancy Berry, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheets contain the names of the citizens and officials that were in
attendance.

(a) The Court approved a Proclamation declaring December 2019 as National Influenza
Vaccination Month. The Court joins with the Mayors of the Cities of Bryan and College
Station to encourage all citizens to get the flu vaccine.
Judge Peters read aloud the proclamation and presented it to Sara Mendez with the
Health Department. Mrs. Mendez encouraged everyone to get the flu vaccine since it is
the best way to prevent the spread of the flu. Mrs. Mendez said that free flu shots will be
given today at 2:00 p.m. to 5:30 p.m. at the Brazos County Health Department. A copy
of the proclamation is attached.
Motion: Approve, Moved by Commissioner Irma Cauley, Seconded by Commissioner
Nancy Berry. Passed. 4-0. Ayes: Berry, Catalena, Cauley, Peters. Absent: Aldrich.
(b) Judge Peters swore Joe Don Warren into the office of Fire Chief in Brazos County,
Emergency Services District Precinct 4.
Commissioner Cauley congratulated Chief Warren and added that they are proud to
have him as the first paid Fire Chief in Precinct 4.
Chief Warren thanked everyone including the College Station, Bryan and Brazos County
Fire Departments for their support.

The Court voted unanimously to accept the recommendation of the Purchasing Agent

deliberate business and financial issues related to a contract being negotiated.
At this point, the County Judge announced the Court would consider items 22 through
26 then return to item 20.
Having considered the previously noted agenda items, at 10:22 a.m. the County Judge
stated that the Court would convene into Executive Session to deliberate business and
financial issues relating to a contract being negotiated pursuant to Section 551.0725 of
the Texas Government Code.
Bruce Erratt informed the Court that in order to meet under 551.025 the Court must
make a few determinations first. Texas Government Code Section 551.0725 provides
as follows:
The Commissioners Court of a county may conduct a closed meeting to deliberate
business and financial issues relating to a contract being negotiated if, before
conducting the closed meeting:
(1) The Court votes unanimously that deliberation in an open meeting would have a
detrimental effect on the position of the Commissioners Court in negotiations with a third
person; and
(2) The attorney advising the Commissioners Court issues a written determination that
deliberation in an open meeting would have a detrimental effect on the position of the
Commissioners Court in negotiations with a third person.
(3) Notwithstanding Section 551.103 (a), Government Code, the Commissioners Court
must make a tape recording of the proceedings of a closed meeting to deliberate the
information.

Bruce Erratt, Civil Counsel then submitted a written determination to be included in the
minutes that stated deliberation in an open meeting would have a detrimental effect on
the position of the Commissioners Court in negotiations with a third person.
At this point Commissioner Cauley moved to go into closed session in reference to
Section 551.0725. Commissioner Berry seconded the motion. It carried unanimously.
Having determined and voted that to deliberate in open meeting would have a
detrimental effect on the position of the Commissioners Court in negotiations with a third
parry at 10:24 a.m. the County Judge announced the meeting closed to the public so
that the Court could meet in Closed Executive Session.

At 10:46 a.m. the County Judge announced the meeting open to the public and
announced that no action would be taken on the Closed Executive Session.
22. Acknowledgement of the GFOA's Certificate of Achievement for Excellence in
Financial Reporting.
The Court acknowledged the Government Finance Officers Association's Certificate of
Achievement for Excellence in Financial Reporting awarded to the Brazos County
Auditors Office.
Commissioner Berry congratulated Auditor Katie Conner and her staff.
23. Juvenile Director's report on detention population.
Todd McKey reported there are 27 juveniles in the detention center, 21 are male and 6
are female, 22 have electronic monitors and 7 are pending for monitors.
24. Sheriff's report on inmate population.
Sheriff Chris Kirk stated there were 632 inmates in jail, 546 inmates are male and 86 are
female, 52 have electronic monitors and 11 are pending for monitors.
25. Announcement of interest items and possible future agenda topics.
Commissioner Cauley said she would like to have an update on how the School Safety
Officer Program is going. Judge Peters said that it could be placed on the agenda for
after the first of the year.

the Brazos County Health District recognizes December 2019 as National Influenza
Vaccination Month; and
the Brazos County Health District wants to remind the citizens of Brazos County that
even though the holiday season has begun, it is not too late to get a flu vaccine; and
a yearly flu vaccine is recommended for everyone 6 months and older; and
most people who get the flu will recover in a few days to less than two weeks, but some
people will develop serious flu complications such as pneumonia, bacterial infections,
hospitalizations or even death; and
�exea�;
people at high risk of serious flu complications include young children, pregnant
women, people with certain chronic health conditions like asthma, diabetes, heart
disease or lung disease, and people 65 years and older; and
getting vaccinated yourself may also protect the people around you, including those
who are most vulnerable to serious flu illness, like babies and young children, older
people, and people with certain chronic health conditions.
I, Andrew Nelson, as Mayor of the City of Bryan, and 1, Karl P. Mooney, as Mayor of
the City of College Station, and I, Duane Peters, as County Judge of Brazos County,
and acting on behalf of our respective councils and commissions, do hereby proclaim

Whereas, Texas Voting Systems, Inc. is the business of selling election services and supplies; and

TEXAS VOTING SYSTEMS, INC. will provide the following suppues:
(a) Thirty-three (33) custom gathered election sets (26 for Election Day, 5 for Early Vote, I for Early
Voting Ballot Board and 1 for Central Counting).
(b) Two thousand (2,000) sample ballots
(c) All required numbered seals for touches and controllers
(d) Vote center supply packs (pens, tape, paper clips, tacks, and highlighters ) as required

TEXAS VOTING SYSTEMS, INC. will provide the following services:
(a) Pre -define voting equipment (242 Touches, '27 Controllers for Election Day, 48 Touches,
5 Controllers for Early Vote, 2 Touches, 2 Controllers for Public Test)
(b) Transport and set up equipment at 5 Early Voting locations, tear down and pick up equipment and
return to warehouse
(c) Transport equipment to 21 vote centers and return to the warehouse atter the election
(5 vote centers are to be picked up and returned by the election judges.)
(d) Back up of the equipment atter the election
(e) Provide assistance on Election Day as required to include Central Counting
(f) Provide consulting services before and after the election

The SRU Sergeant's primary responsibility is supervising the SRU, performing those
essential duties assigned to the position by BCSO. Those essential duties include but are not
limited to, direct supervision of daily activities of subordinates; maintaining proper records,
report and logs; directing investigations; and ensuring proper staffing levels are met. The
SRU Sergeant may also cover an SRD's assigned campus during instances when the SRD is
away (e.g., arrest of offender, illness, etc).
The SRU Sergeant is responsible for the campuses specifically serviced by BCSO Deputies
in accordance with the Q.A. Campuses not serviced by BCSO should report all criminal
matters to the law enforcement agency with primary jurisdiction (i.e., College Station Police
Department).
The SRU Sergeant may, as available, visit campuses within CSISD not specifically named in
the ILA. These visits will focus on engaging with students and staff in order to promote
positive community -law enforcement relationships.
B.
ARTICLE V
SRD DUTIES AND RESPONSIBILITIES
Section 5.1 Administrative Duties, shall have the following added:
In situations of a health or safety emergency as determined by CSISD, the BCSO will be
provided remote access to CSISD surveillance equipment through means of a secure
login/password system or similar secure means. The extent of this access will be

COMMISSIONERS COURTS: DELIBERATION REGARDING CONTRACT BEING NEGOTIATED TO
PURCHASE ELECTION EQUIPMENT; CLOSED MEETING.
The Commissioners Court ("Court") has propose_ d to deliberate the negotiation of a contract
related to contracting for professional services. The Court wishes to deliberate the business
and financial issues of the proposed contract negotiations.
Texas Government Code §551.0725 provides that the Court may deliberate the business and
financial issues of this contract in closed session if, before conducting the closed meeting:
(1) The Court votes unanimously that deliberation in an open meeting would have a
detrimental effect on the position of the Court in negotiations with a third person; and
(2) The attorney advising the Commissioners Court issues a written determination that
deliberation in an open meeting would have a detrimental effect on the position of the
Commissioners Court in negotiations with a third person.
(3) Notwithstanding Section 551.103(a), Government Code, the Commissioners Court must
make a tape recording of the proceedings of a closed meeting to deliberate the information.
It is my determination that deliberation in an open meeting would have a detrimental effect on
the position of the Court in negotiations with a third person.
