12. Request by Ernie Laney to replace a Laser Jet Printer in the County Attorney's office. The
current printer is broken and not repairable. Cost will be approximately$450.00.
13. Request by Ray Truelove, Justice of the Peace Pct. 2.2, for a computer for a new employee
approved in the 2004 Budget, to be paid from Contingency. The cost for the computer and
licensing is approximately$1,496.00
14.Request by the Constables for Precincts 1, 2, 3 and 4 for approval of standardizing and
increasing the allowed number of non-paid Deputies to 20 for each Constable department.
15. Order Extending the Current Hours during which Alcoholic Beverages can be Sold and
Consumed in accordance with the Texas Alcoholic Beverage Code so that they are consistent
with those observed by the City of Bryan and the City of College Station.

REGULAR MEETING
NOVEMBER 25, 2003
A regular meeting of the Commissioners ' Court of Brazos
County, Texas was held at the Brazos Center in Bryan, Brazos
County, Texas, beginning at 6: 30 p.m. on Tuesday, November. 25,
2003 with the following members of the Court present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;

Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr. , Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
The first matter before the Court was a presentation by
Mervin Peters, representative of the Exposition Center
Advisory Committee. Mr. Peters brought a proposal to the
Court in which an assembly hall addition would be built on the
Expo Center site and would replace the Brazos Center. Funding
for the project would come from a state authorized Venue Tax
that is available to provide the revenue to build facilities.
This tax of 2% would be added to hotel and motel room rentals
and be paid by individuals staying overnight. Mr. Peters then

introduced Jim Singleton, Architect for the Expo Center. Mr.
Singleton gave an overview of the project as it stands today.
Mr. Singleton then introduced Mr. David Mendez of Bickerstaff,
Heath, Smiley, Pollan, Kever, & McDavid, LLP, the attorney
representing the County in the matter regarding the
availability of and appropriateness of the 2% Venue Tax to
funding this Assembly Hall.
410 Under citizen input/and or concerns, the following spoke:
Barry Bigger, 812 Halston Hills, College Station wanted
to speak on the Venue Tax and decided to wait until agenda
item number 8 is addressed.
The Court next considered Budget Amendment #03/04-7 .1
that would reallocate funds for the Non Departmental Division.
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached.
The Court next considered acceptance of Certificate of
4110 Authority and a Deed Without Warranty from Union Pacific
Railroad for right-of-way on I&GN Road in Precinct 1. On
motion by Commissioner Jones, seconded by Commissioner Peters,
the Court voted unanimously to authorize the County Judge to
accept on behalf of Brazos County a Deed Without Warranty and
Certificate of Authority from Union Pacific Railroad Company

for the expansion and improvements to I&GN Road.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of

employees as submitted on the attached Personnel 4-Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Mallard, the Court voted unanimously to
approve the changes as submitted.
The next matter before the Court was approval of an
Order Calling Special Venue Project and Tax Election for
the construction of a multi use regional facility called
the "Brazos County Assembly Hall Venue Project." The
election is to be held February 7, 2004 . On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the Order. Itt
The Court next considered adopting a Resolution
Declaring Intention to Reimburse Certain Expenditures with
borrowing proceeds. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted

unanimously to adopt the Resolution. A copy is attached.
The next matter before the Court was consideration of
an Order Levying Tax for Certificates of Obligation,
Series 2003. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to adopt
the Order levying Tax for Certificates of Obligation,
Series 2003.
1110 The Court next considered the selection of a dental
plan for Brazos County, effective January 1, 2004 . On
motion by Commissioner Mallard, seconded by Commissioner
Peters, the Court voted unanimously to change to the Blue
Cross Blue Shield plan. The Court explained that this is
a much-improved plan and offer the employees more
benefits.
The next matter before the Court was a request by the
Information Technology Department to replace a Laser Jet
printer located in the County Attorney' s office. On
motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the
request. Replacement cost is $450. 00.
The Court next considered a request by Justice of the
Peace, Precinct 2 Place 2 for a computer for a new
employee approved in the 2004 budget. The cost is

approximately $1, 496. 00 and is to be paid from
Contingency. On motion by Commissioner Cauley, seconded
by Commissioner Peters, the Court voted unanimously to
approve the request.
The next matter before the Court was a request by
Constables for Precincts 1,2, 3&9 for approval to
standardize and increase the allowed number of non-paid
deputies to 20 for each department. Commissioner Peters
moved to approve. Commissioner Jones seconded the motion.
The County Judge said that he did not see the need to
increase the number of deputies from 15 for each
department. Commissioners Jones, Peters and Mallard
voted "Aye". The County Judge voted "Nay" and
Commissioner Cauley abstained. The motion carried. The
Risk Manager asked that the Court create a policy like
the Sheriff' s Department for background checks.
The next matter before the Court was to consider
adoption of an Order extending the current hours during
which alcoholic beverages can be sold and consumed. On ( :
motion by Commissioner Mallard, seconded by Commissioner
Jones, the Court voted unanimously to adopt the Order for
extending the current hours during which alcoholic
beverages can be sold and consumed until 2:00 a.m. A

The Court next considered the reappointment of the
County Judge to the Brazos County Emergency
Communications District, effective January 1, 2004 . On
motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to reappoint the
County Judge to the Brazos County Emergency

The next matter for consideration was approval of
tax refund applications from the following individuals

The Court next considered approval of the Final Plat
of Cedar Rock Addition, 35.53 Acres in Precinct 1.
Richard Vance, County Engineer, stated that he had
reviewed the plat and all appeared to be in order. On
motion by Commissioner Jones, seconded by Commissioner

Peters, the Court voted unanimously to approve the final
plat of Cedar Rock Addition, 35.53 Acres as submitted.

On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to
approve the minutes as submitted. .

There was no citizen input and/or concerns.
There were no Agency/Board/Committee reports by Court
members.
There being no further business to come before the
Court, the meeting was adjourned.

ORDER CALLING SPECIAL VENUE PROJECT AND TAX ELECTION
THE STATE OF TEXAS
COUNTY OF BRAZpS
WHEREAS,the voters of Brazos County("County")approved in 2001 the construction of a
county coliseum(the"Expo Center");and
WHEREAS, the County's current multi-use facility utilized for commercial, social,
educational, political and other community-related events (the "Brazos Center") is not located
adjacent to the Expo Center;and
WHEREAS,the Brazos County Commissioners Court(the"Commissioners Court") seeks to
construct a multi-use regional facility adjacent to the Expo Center to be used for all manner of
community-related events including, butnot limited to, meetings, picnics, reunions, banquets,
exbrbits, art shows, receptions, lectures, conventions, demonstrations, rehearsals, trade shows,
competitions,rodeos and carnivals("Project"or"Brazos County Assembly Hall Venue Project");and
WHEREAS,the Project will replace the Brazos Center;and
WHEREAS,the Brazos Center will,upon approval ofthe Project,be used for office space for
various departments of the County;and
WHEREAS,the Commissioners Court seeks to contemporaneously construct the Project with
the Expo Center;and
WHEREAS, the Commissioners Court understands that the method of financing the
construction of the Project and the Expo Center are different and that the funds to pay for each must
be maintained and accounted for separately,and
WHEREAS, the Commissioners Court has, among others, the power to provide for the
planning, acquisition, establishment, development, construction, renovation, operation, or
maintenance of a venue project under Local Government Code Chapter 334;and
WHEREAS, the Commissioners Court hereby finds and determines that it is in the public
interest to call and conduct a special election on the question of approving the Project;and
WHEREAS,the Commissioners Court hereby finds and determines that the need to finance
the Project necessitates that it is in the public interest to authorize the imposition and collection of a
hotel occupancy tax at a rate not to exceed two percent(2%)ofthe price paid for a room in a hotel in
the County;and

WHEREAS, the Commissioners Court hereby finds and determines that it is in the public
interest to call and conduct a special election on the question of approving the hotel occupancy tax;
and
WHEREAS,the Commissioners Court has determined that the next available uniform election
date is February 7,2004,and that this date would constitute an appropriate date for a special election
IT IS, THEREFORE, ORDERED BY THE BRAZOS COUNTY COMMISSIONERS
COURT THAT:
Section 1. Call of Election;Date;Eligible Electors;and Hours. A special venue project
and tax authorization election(the"Election")shall be held on Saturday,February 7,2004,which is
sixty-two (62)or more days from the date of the adoption of this order(the"Order"),within and
throughout the territory ofthe County at which all resident,qualified electors of the County shall be
entitled to vote. The hours during which the polling places are to be open at the Election shall be
from 7:00 o'clock a.m. to 7:00 o'clock p.m.
Section 2. Voting Precincts: Polling Places; Election Judges. The presently existing
boundaries and territory ofthe respective Brazos County Election Precincts are hereby designated as
the voting precincts of the County for the Election. The Commissioners Court further finds,on the
recommendation of the County Election Board, that combination of the territory of some of the
Brazos County Election Precincts into voting precincts of the County served by a single polling place
for the purposes of this Election will adequately serve the voters of the consolidated precincts,and is
a more efficient and cost effective administration of this Election and such voting precincts are hereby
combined and are designated with the corresponding numbers of the two or more Brazos County
Election Precinct Numbers of the underlying precincts(for example,Precinct No. 121/130). A list of
all of the County's voting precincts and combined voting precincts is included in Exhibit A to this
Order,which is hereby incorporated by reference as if fully set out in the body of this Order. The
polling place for each voting precinct,as recommended by the County Clerk,and for each combined
voting precinct, as designated by the Commissioners Court, is also indicated in Exhibit A to this
Order.
The Commissioners Court shall appoint the Presiding Election Judge and Alternate Presiding
Election Judge for each consolidated voting precinct for the election. Election judges for
consolidated precincts shall be appointed from among the judges appointed for the precincts
comprising the consolidated precinct. The Alternate Presiding Election Judge may serve as the
Presiding Election Judge for the precinct in the absence of the Presiding Election Judge.
In the event that the County Judge or the County Clerk shall determine from time to time that
(a)the polling places hereby established and designated shall become unavailable or unsuitable for
such use,or it would be in the County's best interests to relocate the polling places,or(b)that the
Presiding Election Judges,Alternate Presiding Judges shall become disqualified or unavailable,the
County Judge is hereby authorized to designate and appoint in writing substitute polling places,

Presiding Election Judges,or Alternate Presiding Election Judges. The County Clerk shall give such
notice as is required by the Election Code. Furthermore,the County Judge or the County Clerk is
hereby authorized to allow Presiding Election Judges or Alternate Presiding Election Judges,upon
request,to designate cnd appoint such additional clerks as may be required from time to time to assist
at polling places in order to efficiently cavy out the duties of the office, giving such notice as is
required by the Election Code.
Section 3. Proposition. At the Election there shall be submitted to the resident,qualified
electors of the County the following proposition(the"Proposition"):

ROOM IN A HOTEL IN THE COUNTY, ALL FOR THE PURPOSE OF
FINANCING THE VENUE PROJECT?
Section 4. Ballots. The ballots shall be suitable for use with an electronic voting system,
and shall otherwise conform to the requirements of the Election Code so as to permit the electors to
vote"FOR"or"AGAINST"the aforesaid measures which shall appear on the ballot substantially as
follows:

paid for a room in a hotel in the County all for the purpose of
financing such venue project.
Section 5. Conduct of Election. The Election shall be conducted utilizing a direct record
electronic (DRE) voting system by election officers, including the Presiding Election Judges
appointed hereunder and Alternate Presiding Election Judges or clerks,in accordance with the Texas
Election Code and the Constitution and laws of the State of Texas and the United States of America.

Section 6. Election information to be provided in Spanish. The County Clerk and any
other election officers appointed by the Commissioners Court responsible for the preparation of
notices,instructions,orders,ballots,and other written material pertaining to the Election shall cause
each such document to be translated into and furnished to voters in both the English language and the
Spanish language in order to aid and assist voters speaking Spanish as a primary or an alternative
language to properly participate in the election process. In addition,the County Clerk and other
responsible election officers are hereby authorized and directed to make available to the voters having
the need of an individualcapable of acting as a translator and speaking both English and Spanish
languages who will assist Spanish speaking voters in understanding and participating in the election
process.
Section 7. Office Hours of County Clerk. The County Clerk,Ms.Karen McQueen,shall
maintain office hours as required under the Texas Election Code during the period beginning three
days after the effective date of this Order and ending not earlier than the fortieth(40th)day after the
day of the Election. The County Clerk shall maintain an office open for'election duties for at least
three hours each day, during regular
office hours, on regular business days during the period
designated in this section. The County Clerk shall maintain in her office,the documents,records,and
other items relating to the Election and shall receive documents on behalf of the County that are
required by the Texas Election Code.
Section 8. Early Voting.
Early Voting Clerk
In accordance with the Texas Election Code,Ms.Karen McQueen,County Clerk,is hereby
designated as the Early Voting Clerk for the Election. The Clerk's official mailing address for the

Early Voting by Mail

law to vote early by mail, the Early Voting Clerk shall provide each voter with a ballot with
instructions to mark the ballot indicating his or her vote"FOR"or"AGAINST"the Proposition on an
optic scan ballot utilized for early voting by mail at the Election.

Main Early Voting Polling Place
The Main Early Voting Polling Place is hereby designated as:

Early voting by personal appearance shall be conducted at the main Early Voting Polling Place
at the dates and times set forth on the attached Exhibit B,incorporated herein for all purposes during
the period from January 21 thru February 3,2004. The Main Early Voting Polling Place shall also
remain open on the day of the Election during the hours the polls are required to be open for voting
pursuant to the Texas Election Code.
• Additional Temporary Branch Early Voting Polling Places
The Commissioners Court hereby establishes additional Temporary Branch Early Voting
Polling Places as set forth on the attached Exhibit B,incorporated herein by reference. Early voting
by personal appearance shall be conducted at such additional Branch Early Voting Polling Places on
the dates and at the times set forth in Exhibit B during the period from January 21 thru February 3,
2004.
Early Voting Ballot Board
Ms.Bea Green is hereby appointed as the Presiding Judge ofthe Early Voting Ballot Board to
count and return early voting ballots in accordance with the Texas Election Code. Ms.Green shall
appoint two(2)or more election clerks,iand such judge and clerks shall constitute the Early Voting
Ballot Board and shall perform the duties set forth for such board in the Election Code.
Section 9. Declaring Results. If a majority of the resident, qualified electors of the
County voting at the Election,including those voting early,shall vote in favor of the Proposition,then
the Brazos County Assembly Hall Venue Project shall be designated as a community venue project
and the related tax shall be imposed and collected and bonds payable therefrom may thereafter be
(` °} issued by the Commissioners Court. '
Section 10. Training of Election Officials. Pursuant to the Election Code,a public school
of instruction for all election officers shall be held as arranged or contracted for by the County Clerk.
Section 11. Notice of Election. Notice ofthe Election,stating in substance the contents of
this Order,shall be published one time in the English and Spanish languages,in a newspaper published
within the County's territory at least ten(10) days and no more than thirty (30) days before the
Election and as otherwise may be required by the Texas Election Code. Notice of the Election shall

also be posted on the bulletin board used by the Commissioners Court to post notices of the
Commissioners Court's meetings no later than the 21st day before the Election.
For each precinct that is combined to form a consolidated precinct,not later than the l Othday
before the Election, the County shall also post, at the polling place used in the preceding general
election,notice of the precinct's consolidation and the location ofthe polling place in the consolidated
precinct. This notice must remain posted continuously through election day. A copy of the notice of
a consolidated precinct must be delivered to the Secretary of State not later than February 7,2004.
Section 12. Authority ofthe County Judge. The County Judge shall have the authority to
take,or cause to be taken,all actions reasonable and necessary to insure that the Election is fairly held
and ballots and returns properly counted and tabulated for canvass by the Commissioners Court,
which actions are hereby ratified and confirmed.
Section 13. Preamble Incorporation. The recitals contained in the preamble hereof are
hereby found to be true,and such recitals are hereby made a part of this Order for all purposes and •
are adopted as a part of the judgment and findings of the Commissioners Court.
Section 14. Inconsistent Provisions. All orders and resolutions,or parts thereof,which are
in conflict or inconsistent with any provision of this Order are hereby repealed to the extent of such
conflict, and the provisions of this Order shall be and remain controlling as to the matters ordered
herein.
Section 15. Governing Law. This Order shall be construed and enforced in accordance
with the laws of the State of Texas and the United States of America.
Section 16. Severability. If any provision of this Order or the application thereof to any
person or circumstance shall be held to be invalid,the remainder of this Order and the application of
such provision to other persons and circumstances shall nevertheless be valid,and the Commissioners
Court hereby declares that this Order would have been enacted without such invalid provision.
Section 17. Notice of Meeting. The Commissioners Court officially finds,determines,
recites and declares that written notice of the date,hour,place,and subject of the meeting at which
this Order is adopted was posted on a bulletin board located at arplace convenient to the public at rcz
least 72 hours preceding the scheduled time of the meeting as required by the Open Meetings Law,
Chapter 551,Texas Government Code,as amended;and that such meeting was open to the public as
required by law at all times during which this Order and the subject matter thereof was discussed,
considered and formally acted upon.
Section 18. Authorization to Execute. The County Judge is authorized to execute and the
County Clerk is authorized to attest this Order on behalf ofthe Commissioners Court,and the County
Judge is authorized to do all other things legal and necessary in connection with the holding and
consummation of the Election.

RESOLUTION DECLARING INTENTION TO REIMBURSE CERTAIN EXPENDITURES
WITH BORROWING PROCEEDS
WHEREAS,Brazos County,Texas(the"Issuer")desires to pay capital expenditures in connection with the
design, planning, acquisition, construction, equipping, and/or renovating certain projects or facilities, more
particularly being described as the new Brazos Center(the"Project");
WHEREAS,Chapter 1201,Texas Government Code,as amended("Chapter 1201"),permits the Issuer to
use the proceeds of obligations to reimburse the Issuer for costs attributable to the Project paid or incurred before the
date of issuance of the obligations for the purpose of financing public works projects,which include the Project;and
WHEREAS,the Issuer finds,considers,and declares that the reimbursement of the Issuer for the payment
of such capital expenditures will be appropriate and consistent with the objectives of the Issuer's programs and,as
such, chooses to declare its intention, in accordance with the provisions of Section 1.150-2(3) of the Treasury
Regulations,to reimburse itself for such payments at such time as it issues obligations to finance the Project.
NOW, THEREFORE, BE. IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS
COUNTY,TEXAS THAT:
Section I.This Resolution declares the intention of the Issuer to reimburse the expenditures for the Project ( ;
with the proceeds of a borrowing. The Issuer presently intends to reimburse the expenditure by incurring debt the 'w.' `
interest on which is excludable from gross income under section 103 of the Internal Revenue Code of 1986, as
amended.
Section 2. The Issuer reasonably expects to incur debt, in one or more series of obligations, with an
aggregate maximum principal amount now estimated to not exceed$5,750,000 for the purpose of paying the costs of
the Project A portion of the proceeds received by the Issuer from a borrowing in an amount estimated not to exceed
$5,750,000 are reasonably expected to be used to reimburse the General Fund from which such capital expenditures
are expected to be made for the Project in an amount not to exceed$5,750,000.
Section 3.The Issuer intends that this Resolution satisfy the official intent requirement set forth in Section
1.150-2(e)of the Treasury Regulations and evidences its intentions under Chapter 1201. The Issuer has no funds or
sources of funds, other than the proceeds of the debt to be incurred, which the Issuer has,or reasonably expects to
be,reserved,allocated on a long-term basis,or otherwise set aside in the Issuer's budget or other financial policies
with respect to the expenditures to be reimbursed,
Section 4. All costs to be reimbursed pursuant hereto will be original expenditures within the meaning of
Section 1.150-2(d)(3) of the Treasury Regulations. None of the expenditures to be reimbursed pursuant to this
Resolution have been allocated to expenditures entered on the books and records of the Issuer earlier than the date
on which such expenditures are paid. Moreover,no debt obligations will be issued by the Issuer in furtherance of
this Resolution after a date which is later than 18 months after the later of(1)the date the expenditures are paid or
(2)the date on which the property,with respect to which such expenditures were made,is placed in service. ..
Section 5. The Issuer declares that this Resolution will be maintained as a public record available for '
inspection by all persons in accordance with the provisions of Chapter 552,Texas Government Code and that no
later than 30 days after this date,this Resolution will be made available for inspection by all members of the general
public at the offices of the Issuer.
Section 6.This Resolution shall be liberally construed to evidence the intent of the Issuer to comply with
state and federal income tax law in the issuance of tax exempt obligations for the Project.

WHEREAS, the Commissioners Court of Brazos County, Texas (the "Commissioners Court"),
being the governing body of Brazos County, Texas (the "County"), adopted an "Order Authorizing the
Issuance of $10,000,000 `Brazos County, Texas Certificates of Obligation, Series 2003' and Other
Matters Related Thereto" on November 18, 2003 (the "Order"), which authorized the issuance of the
"Brazos County,Texas Certificates of Obligation, Series 2003"(the"Certificates");and
WHEREAS,the Commissioners Court desires to levy a tax to pay the Certificates in accordance
with Article XI, Section 7 of the Texas Constitution and Section 271.053,Texas Local Government Code,
as amended,in place of applicable language appearing in Section 5(a)of the Order;and
WHEREAS, in accordance with the provisions of Section 81.006, Texas Local Government
Code, as amended, the Commissioners Court hereby finds and determines that this order is adopted at a
regularly scheduled meeting of the Commissioners Court;

Section 1. During each year while any of the Certificates or the interest thereon are outstanding
and unpaid, the Commissioners Court shall compute and ascertain a rate and amount of ad valorem tax

such interest comes due,and to provide and maintain a sinking fund adequate to pay the principal thereof
as such principal matures(but never less than 2%of the original principal amount of the Certificates as a
sinking fund each year); and said tax shall be based on the County's latest approved tax rolls, with full

valorem tax is hereby levied,and is hereby ordered to be levied,against all taxable property in the County
for each year while any of the Certificates or the interest thereon are outstanding and unpaid,and the tax
shall be assessed and collected each such year and deposited to the credit of the"Brazos County,Texas
Certificates of Obligation, Series 2003 Interest and Sinking Fund". The ad valorem taxes sufficient to
provide for the payment of the interest on and principal of the Certificates,as such interest comes due and
such principal matures, are hereby pledged irrevocably to such payment, within the limit prescribed by
law.
