VOLS° PAGE 29 C COMMISSIONERS' COURT REGULAR MEETING NOVEMBER 11, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, November 11, 2003 with the following members of the Court present: 0110 Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr. , Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the pledge of allegiance. Under citizen input/and or concerns the following spoke: County Judge Clarified the situation with Commissioner Jones. He read ( Attorney General Opinion 1253 that states that even though an elected official has resigned he/she can continue to hold office until a successor is appointed. Demetrios Basdekas ' Requested that the Commissioners look into freezing the tax levy for senior citizens as the two cities have done. He discussed how society should treat senior citizens. VOL a b PAGE. O • Commissioners Court meeting November 11,2003 2 He reminded the court that the legislature has cleared the way for the Court to do this. Clyde Garland Spoke against Basdekas' idea saying that senior citizens should not be treated any differently. All people should be treated equally. The Court next considered two budget amendments: 1 . Budget Amendment #02/03-48, that would reallocate funds for County Court at Law #1, 1110 Road and Bridge Department, Courthouse Security and Inmate Commissary Fund; transfer funds from Contingency to Veteran' s Services, Commissioners Court, County Treasurer, Personnel, Building Maintenance, District Attorney, District Attorney Child Protective Services, District Clerk-Jury Services, District Clerk-Collections, 272nd District Court, 3615t District Court, Juvenile Court Referee, Magistrate, Justice of the Peace, Precinct 1, Justice of the Peace, Precinct 4, and Constable Precinct 3; transfer funds from the General Fund to Health & Life Insurance Fund, from Sheriff-Jail Administration to Health & Life Insurance Fund. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. 2. Budget Amendment 03/04-5 that would transfer funds from Reserve Contingency to Reserve Fund Balance and from Contingency to Computer Maintenance in the Information Technology Department. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. VOL ED PAGE 4-I r: � • Commissioners Court meeting November 11,2003 3 The Court next considered the following Claims as submitted by the County Treasurer for payment: 20047385 through 20047652 On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by 0110 Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered an Exemption from Competitive Bidding. Requirements of Local Government Code, Section 262.024 (a) (2) . This is for the purchase of Stop Loss Insurance from AIG. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment of all invoices for fiscal year 2003-2004 . (u The Court next considered adopting the Order Extending Election Precinct 45 to include portions of Election Precinct 7A that fall within the incorporated area of the City of Bryan, thereby extending the boundary lines of Election VOL 510 PAGE �� Commissioners Court meeting November 11,2003 4 Precinct 45 to follow the new City of Bryan city limit lines. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to adopt the Order. The Court next considered entering into Agreement with the Brazos Valley Veterans Memorial to provide recognition of the Brazos Valley Veterans by educating children about the sacrifices made by our veterans for the county which would foster a positive self image and assist in the prevention of drug and alcohol use and abuse. In consideration of the services provided by the Brazos Valley Veterans Memorial, the County agrees to pay to the Brazos Valley Veterans Memorial $10, 000 .00 for the 2003/2004 fiscal year. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to enter into agreement with the Brazos Valley Veterans Memorial and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached. The Court next considered a request to change flooring at the new office for Justice of the Peace, Precinct 1 from tile to carpet in the courtroom and front Court Clerk' s office.. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the change in flooring. Cost of carpeting will be $456.00. VOL 50 PAGE CD Commissioners Court meeting November 11,2003 5 The next matter before the Court was a request by Ernie Laney, Director of the Information Technology Department to renew the West Group CD-ROM Law Library yearly subscription service for legal research for FY 2004 . On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the request. Cost to Brazos County will be $15, 078 . 00. The next matter for consideration was approval for the „ Purchasing Agent to advertise the following bids: a. Bid 2004-004, Cold Mix Limestone/Concrete Pavement b. Bid 2004-005, Purchase of Fencing Supplies c. Bid 200-006, Fence Building d. Bid 2004-007, Motor Grader blades On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for the previously noted bids. The Court next considered awarding the following bids: a. Bid 2003-052, Road Signs and Sign Post Becky Stephens, Senior Buyer, recommended acceptance of the bid submitted by Signs and Blanks as Primary Vendor and the bid submitted by Vulcan Signs as Secondary Vendor. b. Bid 2003-054, Oversized Limestone Aggregate Becky Stephens, Senior Buyer, recommended acceptance of the bid submitted by Young Contractors as Primary Vendor and the bid submitted by Hanson Aggregates as Secondary Vendor. Bid 2003-055, Heavy Machinery Rental Becky Stephens, Senior Buyer, recommended acceptance of the bid submitted by Equipment Support Services as Primary Vendor on items 1,3, 14 and 26 and as Secondary Vendor on items 2, 11 and 13; acceptance of the bid submitted by Mustang Rental Services as Primary Vendor on items 2, 5, 8, 9, 11, 12, 16, 19,20, 21,23,24 and 25 and as Secondary Vendor on items 3, 4, 17,18 and 22; R. B. Everett as Primary Vendor for items 15 and 18 and as Secondary vendor on items 12, 14, 16 and 19; We Rent It as Primary Vendor for Items 4, 13, 17 and 22 and as Secondary Vendor for items 1, 8,20, 21, 23,24, 25 and 26. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendations of the Senior Buyer and award the contracts as noted. A copy of each bid tabulation sheet is attached The Court proceeded to consider the following Blanket Purchase Order: Lange Documents District Attorney $1, 200 On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered acceptance of a Warranty Deed for right-of-way on Koppe Bridge Road in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from George Brown, Jr. for the expansion VOL bb PAGE In Commissioners'Court meeting November t I,2003 7 and improvements to Koppe Bridge Road. Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Mallard Said that Bryan PD Officer, Chris Jadlowski is serving in Iraq. St. Joseph Church is accepting donations for postage to send gifts donated. If anyone would like to contribute, he would be glad to deliver it to the church. Commissioner Jones k : Informed everyone that the Court will be voting on holidays next week There was no citizen input and/or concerns. Under Agency/Board/Committee reports by Court members, the following spoke: County Judge a. He met with Amtrack officials yesterday at the Hilton Hotel. The speaker indicated that the route covers 16 states. He made a plea for us to write our congressmen for funding. It was a great presentation, but he said he didn' t feel we needed to spend that kind of money. b. He wished Reverend Jones a Happy Birthday c. He informed the Court that the Expo Committee will make a presentation to the Commissioners Court very soon. There being no further business to come before the Court, the meeting was adjourned. WITNESSETH: WHEREAS,Article 3,Section 52-a of the Constitution,Section 381 of the Local Government Code of the State of Texas and V.A.T.S. §5190.6 provide for COUNTY to engage in economic development activities;and WHEREAS,a primary focus of economic development inquires is the quality of arts programs in a community;and WHEREAS,BVVM provides recognition of Brazos Valley veterans of the COUNTY including education for Brazos County children about the sacrifices made by our veterans for the country which foster positive self-image and thereby assists in prevention of drug and alcohol • use and abuse;and WHEREAS,Article 152m,V.A.T.S. recognizes that the health,education,and general welfare of the citizens of the State of Texas require promotion and education about the performing,dramatic,visual,and literary arts;and VOLS PAGES@ WHEREAS,said Article permits COUNTY to provide funding for cultural education facilities,and is to be liberally construed;and WHEREAS, BVVM provides funding to the memorial,in part,for facilities acquisition and upkeep,and WHEREAS,Article 5190.7,V.A.T.S.permits COUNTY to assist with urban enterprise zones,and, WHEREAS,BVVM through its funding programs has provided benefit to Brazos County,Texas through programs attracting over 100,000 participants,and resulting in significant • purchases of goods from Brazos County merchants;and WHEREAS,Chapter 318 of the Local Government Code of the State of Texas provides for historic preservation;and WHEREAS,other programs provided by COUNTY are directly benefited by BVVM and its member organizations. NOW,THEREFORE,COUNTY and BVVM hereby agree as follows: I. BVVM through its promotion of Brazos Valley Veterans agrees to provide the above enumerated services which it has provided and agrees to continue to engage in support of veterans. COUNTY,for and in consideration of the services provided to COUNTY,hereby agrees to pay to BVVM a lump sum payment of TEN THOUSAND DOLLARS($10,1100)for the year beginning October 1,2003 and ending September 30,2004. BVVM agrees to provide an account of how the$10,000 was distributed to meet the above described services.
