REGULAR MEETING
NOVEMBER 4, 2003
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, November 4, 2003 with the
74 following members of the Court present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard; Commissioner of Precinct 3;
Carey Cauley, Jr. , Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge asked the Reverend Jones to give the
invocation and then the County Judge led the pledge of
allegiance.
Under citizen input/and or concerns the following spoke:

Said he faxed a letter to the Court about septic systems
and would like help with compliance.
The Court next considered Budget Amendment #02/03-47. 1
that would reallocate funds for the office of the County
Judge. On motion by Commissioner Cauley, seconded by

Judge. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached.
The Court next considered Budget Amendment #03/04-4 . 1
through 03/04-4 .6 that would adjust funds in the State Lateral
Road Fund, reallocate funds for County Court at Law #2 (2) and
Purchasing Department, transfer funds from Capital Improvement
to Judicial Software and from General Fund to Road and Bridge
Department. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the budget amendment .as submitted, a copy of which is
attached. Commissioner Jones noted that we may need to
develop a policy on how to handle unused positions. We seem
to be getting more budget amendment requests using dollars
from unused positions.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted. •
The next matter for consideration by the Court was
adopting a Resolution establishing the Brazos County Public
(410 Document Cost Recovery Policy and Schedule of Charges. On
motion by the County Judge, seconded by Commissioner Cauley,
the Court voted unanimously to adopt a resolution establishing
the Brazos County Public Document Cost Recovery Policy and
Schedule of Charges. A copy of the fee schedule is attached.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:

On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the refund
applications.
The Court next considered a request by Ernie Laney,

Director of the Information Technology Department, to carry
forward $5, 316. 88 from the Computer Maintenance budget for FY
2003 to the same line item in the FY 2004 budget (account
651500) . The funds were encumbered in September of 2003 but
the work was not completed until after the beginning of the
new budget year. On motion by Commissioner Cauley, seconded
by Commissioner Peters, the Court voted unanimously to carry
forward $5, 316.88 from the Computer Maintenance budget for FY
2003 to the same line item in the FY 2004 budget. 1110
The next matter before the Court was a request to renew
the software agreement with SunGard Pentamation for fiscal
year 2004. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to renew the
agreement with SunGard Pentamation at a cost of $12,768 .74 .
This agreement is in effect from October 1, 2003 through
September 30, 2004 . A coy is attached.
The Court next considered approval of the Funding
Addendum for FY 2004 for support of the Brazos County Health
Department. Brazos County' s portion is as follows: )

Mallard, the Court voted unanimously to approve the funding

On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to receive,
approve and order filed as submitted the Treasurer' s report
for September 2003. A copy of which is attached to and made a
part of these minutes.
The Court proceeded to consider the following blanket

Cingular Wireless Emergency Management $500
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2004-003, Purchase of Motor
Graders. On motion by Commissioner Jones, seconded by
Commissioner Peters, the Court voted unanimously to authorize
the Purchasing Agent to advertise for bids for motor graders.
a The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262. 024 (a) (8) . This is for the purchase of prepared meals
from Winkies Catering to feed participants in the Army
Program. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve

the Exemption of Competitive Bidding Requirements and
authorized the payment of invoices for fiscal year 2003-2004.
The Court next considered approval of the Final Plat of
Briner Subdivision, Lots 1-8, Block 1, 106. 95 Acres out of a
Called 1, 025. 87 Acre Tract located in Precinct 3. Richard
Vance, County Engineer, stated that he had reviewed the plat
and offered the following comment:
1. Add requirements concerning the clearing of rights-
of-way and Public Utility Easements to the General
Notes section of the plat. 010
On motion by Commissioner Mallard, seconded by Commissioner
Peters, the Court voted unanimously to approve the final plat
of Briner Subdivision, Lots 1-8, Block 1, 106.95 Acres out of
a Called 1, 025.87 Acre Tract subject to the developer
complying with the exception noted by the County Engineer.
Commissioner Jones also noted that the Extraterritorial
Jurisdiction should stop at 300 feet and not cross over. The
County Engineer agreed.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Koppe Bridge Road in Precinct 1. On

Peters, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from Robert C. Washington for the expansion and improvements

The Court next considered acceptance of a Warranty Deed
for right-of-way on Koppe Bridge Road in Precinct 1. On
motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from Patricia Johnson for the expansion and improvements to

The Court next considered acceptance of a Warranty Deed
for right-of-way on Koppe Bridge Road in Precinct 1. On
motion by Commissioner Jones, seconded by Commissioner
Mallard, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from Juanita James for the expansion and improvements to
Koppe Bridge Road.
The next matter before the Court was a request by Ramiro
Quintero, Justice of the Peace Precinct 4, for approval to
} pay an invoice from Sav-On dated August 20, 2003 with funds
from their 2004 budget. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve payment of the invoice in the amount $194 .42.

RESOLUTION
Brazos County Public Document Cost Recovery Policy
and Schedule of Charges
WHEREAS, Chapter 552,of the Government Code(V.T.C.A.)provides for the
release of public information upon request;and
•
WHEREAS,§552.261 (Subchapter F—Cost of Copies)provides that the cost to ..
the public to obtain a copy of documents and data maintained by the county'shall be
reasonable; and
WHEREAS, §552.262 provides the County with the ability to adopt the charges
established by the Texas Building and Procurements Commission for such services; and
WHEREAS,the Commissioners Court is of the opinion that the fee schedule as
adopted by the Texas Building and Procurements Commission is reasonable for the copy
services in Brazos County;
NOW THEREFORE,we,the undersigned members of Commissioners Court for
Brazos County,Texas hereby order that all fees charged for copies of public information
will be in accordance with those mandated by the Texas Building and Procurements
Commission. /
