PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a
Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the
Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity
of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly,
profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge
and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing
policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to
attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business
of the Court.

REGULAR MEETING -
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South -
Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday; =
August 13, 2019 with the following members of the Court present:

Jason Ware, Brazos County Deputy Emergency Management Coordinator gave a
report of the KB DI Drought Index average at 624, maximum at 658 and minimum at
572. Mr. Ware said three of the polled volunteer fire chiefs support a bum ban at this
time. He said that he also recommends issuing a burn ban.
The Court voted unanimously to approve an order to prohibit of outdoor burning effective
immediately and continuing for ninety (90) days.
Commissioner Catalena mentioned that even though the order is approved for ninety
days, it can be lifted if we get rain.

The Court approved a resolution renaming Greens Prairie Trail between Wellborn Road
and the city limits as Greens Prairie Road, and Greens Prairie Road West between

Commissioner Cauley said she had some questions and asked Purchasing Agent
Charles Wendt how many bids were received.
Mr. Wendt stated that only one proposal was submitted. He said that there was
information in the proposal that was not appropriate to be in the proposal. Mr. Wendt
added that one item that was requested was not addressed in the proposal. Mr. Wendt
said that they discussed the decision with legal counsel.
County Attorney Rod Anderson then said that their main concern was the item that was

not addressed in the proposal, so they decided to not accept the bid at this time.
Commissioner Cauley thanked them for the clarification.

At this point, Commissioner Catalena announced the Court would consider items 25

The Court acknowledged and congratulated Trudy Hancock on her election as Secretary
for the Texas Association of Elections Administrators (TAEA) on July 30, 2019.

27. Juvenile director's report on detention population.
Assistant Juvenile Director Lupe Washington reported there are 29 juveniles in the
detention center, 21 are male and 8 are female, and 19 have electronic monitors.
28. Sheriff's report on inmates.
Lieutenant Kevin Stuart stated there were 686 inmates in jail, 579 inmates are male and
107 are female, 42 have electronicmonitors and 23 are pending for monitors.
29. Announcement of interest items and possible future agenda topics.
There were no announcements.
30. Call for Citizen input and/or concerns
Chief Stewart stated this new school year will start the third year of service for the
School Resource Unit and they are preforming Active Shooter Training in all the
schools.

The foregoing minutes of the Commissioners Court Meeting held August 13, 2019 have

ORDER 19-017
PROHIBITION OF OUTDOOR BURNING
WHEREAS, in accordance with provisions of the Texas Local Government Code, Chapter 352, a drought condition
exists or has existed in Brazos County, Texas as determined by Texas Local Government Code Chapter 352; and,
WHEREAS, the Commissioners Court makes a finding that circumstances present in all or part of the
unincorporated area of Brazos County create a public safety hazard that would be exacerbated by outdoor burning.
BE IT THEREFORE ORDERED that the following regulations are hereby established for all unincorporated
areas of Brazos County, Texas for the duration of the above mentioned declaration;
1. Action Prohibited:
A person violates this order if he or she burns any combustible material outside ofan enclosure serving to
contain all flames and/or sparks, or orders such burning by others.
2. . Enforcement:
A. As soon as possible, a duly commissioned peace officer shall be sent to the scene to
investigate the nature of the fire.
B. Upon notification of suspected outdoor burning, the fire department assigned to the
location of the fire shall respond to the scene and take immediate measures to contain
and/or extinguish the fire.
C. If in the opinion of the officer at the scene and/or the fire chief, the goal of the order can
be attained by informing the responsible party about the prohibitions established by this
order, the officer may, at his discretion, notify the party about the provisions of this order
and request compliance with it. In such instances, an entry of the notification shall be
made into the dispatchers log containing the time, date, and place of the warning, and the
name of the person receiving the warning.
3. At the discretion of the peace officer or the fire chief, second or flagrant violations of the order may be
prosecuted in accordance with the statutes and procedures governing misdemeanors.
4. This Order prohibiting Outdoor Burning takes effect on August 13, 2019 and will expire on November 11,
2019 unless terminated earlier by the Commissioners Court or the County Judge. The Commissioners Court
hereby designates to the County Judge the authority to terminate this Order in accordance with Local
Government Code Section 352.081(c)(2).
5. This prohibition does not apply to prescribed outdoor burning activities related to public health and safety
and/or trench -burning related to public health and safety that are authorized by the Texas Commission on
Environmental Quality for: (1) firefighting training; (2) public utility; (3) natural gas pipeline or mining
operations; (4) planting or harvesting of agriculture crops; or (5) burns that are conducted by a prescribed
bum manager certified under Section 153.048 of the Texas.Natural Resources Code, and meet the standards
of Section 153.047 of the Texas Natural Resources Code.
6. . Exception(s):
A. ; Welding
Welding may be allowed under the following guidelines only:
Provide a spotter for each welder, each cutter, each grinder, and for any activity that causes or may
cause a spark.
• Maintain a minimum perimeter around the welding area of a radius of 25 feet or three times the
height of the actual welding, whichever is greater. (Example: if the welding is occurring ten feet
off the ground, a perimeter of thirty (30) feet radium must be protected). The perimeter must be
clear of vegetation and kept wet. If the perimeter cannot be cleared of vegetation, proper
precautionary measures must be taken (Example: protecting brush, etc, by utilizing fire resistant
tarps).
• Maintain a minimum of 100 gallons of water at the site.
• Maintain a minimum of one (1) water pressure fire extinguisher per spotter.
• No weldingshall occur if winds are greater than 20 mph or relative humidity is less than 30%.
• Prior to conducting any welding activity, the welder shall give notice to the Brazos County Risk
Manager and Brazos County Emergency Services (979-361-3888). The notice may be by phone
but shall give the name of the welder conducting the welding operation, the location of the
operation, cell phone number of other contact information, and the name of partyresponsible.
B. Outdoor Cooking
All outdoor cooking or open flame devices are prohibited.
• Unless the cooking device is propane or natural gas and has a complete and full enclosure that
ii utilizes at all times.
• Unless the cooking device is wood or charcoal and has a complete and full enclosure that is
utilized, and all areas around cooking device shall be clear of vegetation and/or combustible
materials or debris for a 5' radius.

on a daily water balance, where a drought factor is balanced with precipitation and soil moisture (assumed to have a
maximum storage capacity of 8 -inches) and is expressed in hundredths of an inch of soil moisture depletion. The drought

A RESOLUTION RENAMING GREENS PRAIRIE TRAIL BETWEEN WELLBORN
ROAD AND THE CITY LIMITS AS GREENS PRAIRIE ROAD, AND GREENS
PRAIRIE ROAD WEST BETWEEN STATE HIGHWAY 6 AND THE CITY LIMITS AS
GREENS PRAIRIE ROAD; AND PROVIDING AN EFFECTIVE -DATE.
WHEREAS, there are streets located within Brazos County, Texas ("County") that are named
"Greens Prairie Road West" and "Greens Prairie Trail" that have caused confusion among the
traveling public as currently named and configured; and
WHEREAS, the County strives to maximize efficiency for emergency responders and to
maintain street names that are clearly distinguishable from others within the local 9-1-1 service
area; and
WHEREAS, the proposed street name changes have been supported by the Brazos County
Emergency Communications District and the City of College Station, Texas; and
WHEREAS, the Commissioners Court of Brazos County desires to rename Greens Prairie Trail
between Wellborn Road and the city limits as Greens Prairie Road, and Greens Prairie Road
West between State Highway 6 and the city limits as Greens Prairie Road to assist in providing
continuous street name corridors as depicted in Exhibit "A" attached hereto and incorporated
herein for all purposes; and
WHEREAS, the property owners currently addressed off of Greens Prairie Road West and
Greens Prairie Trail have been notified of the proposed street name changes and may continue to
receive mail from the U.S. Postal Service at the current address or the new one for up to one and
a half years to assist in the transition;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF
BRAZOS COUNTY, TEXAS:
PART 1: That the street currently named Greens Prairie Trail between Wellborn Road and the
city limits be renamed Greens Prairie Road as graphically depicted as Area 3 in Exhibit "A"
attached hereto and made a part of this Resolution for all purposes.
PART 2: That the street currently named Greens Prairie Road West between State Highway 6
and the city limits be renamed Greens Prairie Road as graphically depicted as Area 4 in Exhibit
"A" attached hereto and made a part of this Ordinance for all purposes.
PART 3: The County Judge or his designee is authorized to expend funds and to take all
measures reasonably necessary to give effect to the street name changes in accordance with this
Resolution.
PART 4: If any provision of this Resolution or its application to any person or circumstances is
held invalid or unconstitutional, the invalidity or unconstitutionality does not affect other
provisions or application of this Resolution, that can be given effect without the invalid or
unconstitutional provision or application, and to this end the provisions of this Resolution are
severable.
PART 5: This Resolution goes into effect immediately.

Principal Investment Strategy
The fund pursues its investment objective by investing only in government securities (Le, securities issued or guaranteed as to
principal and interest by the U.S. government or its agencies or instrumentalities, including those with floating or variable rates of
interest), repurchase agreements collateralized solely by government securities and/or cash, and cash. The fund is a money
market fund subject to the maturity, quality, liquidity and diversification requirements of Rule 2a-7 under the Investment
Company Act of 1940, as amended, and seeks to maintain a stable share price of S1.00.

The fund is a "government money market fund," as that term is defined in Rule 2a-7, and as such is required to invest at least
99.5% of its total assets in securities issued or guaranteed as to principal and interest by the U.S. government or its agencies or
instrumentalities, repurchase agreements collateralized solely by cash and/or government securities, and cash. The fund normally
invests at least 80% ofits net assets in government securities and repurchase agreements collateralized solely by government
securities (.e., under normal circurrr_stances, the fund will not invest more than 20% of its net assets in cash and/or repurchase
agreements collateralized by cash). The securities in which the fund invests include those backed by the full faith and credit of the
U.S. government which include U.S. Treasury securities as well as securities issued by certain agencies of the U.S. government
and those that are neither insured nor guaranteed by the U.S. government.
Principal Risks
An investment in the fund is not a bank deposit. It is not insured or guaranteed by the Federal Deposit Insurance Corporation
(FDIC) or any other government agency. You could lose money by investing in the fund. Although the fund seeks to preserve the
value of your investment at $1.00 per share, it cannot guarantee it will do so. The fimd's yield will fluctuate as the short -teem
securities in its portfolio mature or are sold and the proceeds are reinvested in securities with different interest rates. The fund

Records Management and Archive Plan
I. Background (Statutory History)
The 77th Texas Legislature passed HB 370 in 2001 to allow border county's to assess a
$5.00 Records Management and Preservation Fee for the preservation of older records
filed with the County Clerk.
The 78th Legislature passed SB 1731 amending the original legislation -allowing all
county's to collect this fee with Commissioner's Court approval. The County Clerk is
proposing to collect this fee at this time.
This legislation amends Local Government Code, Section 118.011 (b & f), to enable the
Commissioner's Court to adopt a Records Management and Records Archive Fee for the
preservation and automation of previously filed and recorded real property and vital
statistics records as part of their regularly adopted annual budget.
The 83rd Legislature passed HB 1513 amending -Government Code, 118.011 (b & f)
allowing the Commissioner Court to set and collect a Records Management and Records
Archival Fee not to exceed $10.00 on non -court related filings.
H. Bill Summary
• Begins on approval of the County of Brazos 2020 Annual Budget. The fee must
be set and itemized in the county's budget as part of the budget preparation
process.
• Termination: The 79th Legislature extendedthisbill indefinitely.. The $10.00 fee
is assessed on any instrument, document, paper, or other record that the County
Clerk is authorized to accept for filing or recording (deed or official public
records, assumed names, and marriage licenses). However, the 83 n legislature
approved a sunset effective September 1, 2019 to reduce the amount collected
back to an amount not to exceed $5.00. HB 686 passed the 86th Legislative
Session removing the sunset date.
• The $5.00 fee is assessed on any original civil case filings.
• The fee may be used only to provide fiends for specific records management and
preservation and archival projects, including for automation purposes — in
accordance with this written plan.
• Changes to the plan must be approved by Commissioner's Court. The plan may
be modified as required.
III. Purpose
Some of Brazos County official records have been computerized and automated in
electronic format since the late 1950s. The County Clerk's office is progressive in the
preservation of current records, utilizing the original Records Management and Archival
Fees from 1991 forward. However, this funding has not been sufficient to electronically
preserve and restore the older documents that have a priceless historical value. In order to
preserve and enhance the integrity of the existing system for recording and preserving
public documents; the County Clerk seeks to preserve existing original records by
restoring or re-creating old volumes, digitizing older microfilm and paper records, re -
indexing old handwritten and typed indexed books and converting all older media into an
electronic_ format and importing this newly created data into the existing computer
system.
IV. The overall goal and vision of the County Clerk's office is to:
• Modernize and upgrade old record systems in the office
• Continue to add records and information to your existing computer system.
• Eliminate or reduce manual lookups and searches.
• Expedite record searching by having more records available for electronic
retrieval.
• Create a complete electronic records back-up for disaster recovery.
• Provide more public information to the citizens of the County via the
Intra/Internet.
• Continue to eliminate the need for paper records.
• Preserving original records by reducing daily usage.
• Reclaiming much needed space in the public records area.
• Constriction of new records storage facility.

The Legislature has provided a means to raise revenue for the records management and preservation

in "phases" as money is accrued and deposited into a special revenue account. The completion of the
initial phases will preserve the original records, provide more space in the public records area, and
continue to modernize the Clerk's office through available technology.

Executive Summary
SB 1685 provides for a fee not to exceed $10.00 to be imposed for filing of a suit,
including an appeal from an inferior court, or a cross -action, counterclaim, intervention,
contempt action, motion for new trial, or third -party petition, in a district court in the county.
The District Clerk's Office wants to take advantage of new legislation that is designed to
preserve archived records by adding an archive fee to each filing of a suit. This fee is to be
dedicated to that task. The majority of the permanent records in the District Clerk's Office are
paper based. These records are used by our office for the public and are vulnerable to loss by
wear and tear.
. The purpose of this document is to define the restoration and preservation, digital
capture, stage, retention and management of archive records belonging to the District Clerk.
This Preservation and Restoration Records Plan is intended to be a "Living Document". It will be
updated as a new products and procedure evolve. It is the intent of the District Clerk to follow
guidelines set by the Texas State Library and Archives Commission.
Goal
The Goal is to capture and archive all cases prior to January 1, 1990, regardless of media
type they currently are in, as efficiently as possible. The District Clerk's Office is also looking at
restoring records, suspending or reducing deterioration of public records, improving the public
access to the documents in a manner that reduces the risk of deterioration.
Scope
The Scope of this document includes the following:
• All District Clerk records filed with the District Clerk before January 1, 1990
• Plans to capture records electronically to improve public access.
• Plans to restore and preserve records with significant historical value.
• Future plans are to improve public and governmental access.
This document addresses the restoration and preservation needs of the District Clerk Records
Archive. No other departments addressed.
The effective date of this action is September 1, 2019, and expires September 1, 2024

Inventory
Currently the District Clerk's Office holds over 100 record books which includes indexes
for Civil Cases, Divorces, Adoptions, Grand Jury Records, Felonies and Misdemeanors. The District
Clerk's Office also has over 80 boxes of historical cases many with historical significance. The
cases include Civil, Divorce, Adoptions, and Felonies.
Current Accessing Methods
Records prior to January 1, 1990 are accessed by the public through a request to our
office due to the cases not being imaged. Our office currently has to find the Index for the
records we are seeing to obtain the cause numbers before we can physically pull the file to
obtain copies for the public. These records are kept in our storage facility at 200 S. Texas Ave,
Bryan, Texas 77803
Restoration and Preservation Plan
Fiscal Year 2019-2020
It is the plan of the District Clerk's Office to scan a portion of the paper documents in
house and fund temporary full or part time employees to capture all records filed in the District
Clerk's Office prior to January 1, 1990. These images will be integrated into the existing District
Clerk records and retrieval systems and enhance the public's access to public records.
The District Clerk plans to award a bid to an outside vendor to restore and preserve all
records with significant historical value. The restoration process will ensure the legibility of
these public documents for future generations.
Revenue collected and not expended in the fiscal year will be carried forward and used
on other archive projects.
Projected Revenue
The County Auditor, Fang Deng, estimates the revenue this will bring is approximately
$16,500.00 per year.

Statement of Work
Texas A&M University: Faculty members from the College of Nursing (CON) at Texas A&M
University (TAMU) will serve as managing partner for the consortium. As such, all grant funds
will stay with TAMU. The CON is expected to:
• Host monthly meetings to plan the testimony preparation and mock testimony
simulations.
• Deliver the Texas SANE/Forensic Nursing Education Course curriculum.
• Schedule the trainees for the experiential learning simulations for mock testimony (voir
dire and expert testimony in a sexual assault case).
• Provide registration information to the Criminal Justice Partner as necessary.
• Support the cost of trainee lodging, travel, and per diem.
• Provide continued professional development opportunities related to forensic health care
topics.
• Develop and implement a community of practice in which grant participants will receive
mentorship. Criminal Justice Partners will have access and will be able to participate in
the community of practice.
• Evaluate the training program and make improvements based upon feedback from
partners and participants.
• Provide to the Criminal Justice Partner $10,000 per year for each year of the project to
off -set costs incurred by the Criminal Justice Partner site.
Criminal Justice Partner: Criminal Justice Partner will contribute to the project in the
following manner:
• Be available for experiential learning simulations for two days at least once a year, during
the project period. Dates will be determined based upon availability of the courtroom and
attorney(s).
• Provide a courtroom setting for two days, at least once a year for the experiential learning
simulation sessions.
• Assign qualified attorney(s) to participate in experiential learning simulations for
testimony preparation, voir dire and mock testimony and to provide feedback to grant
participants during the simulations. The time required would be 8 hours per day for each
attorney for a minimum of (2) days per year.
• Identify a point of contact for communication and participate in project meetings that will
occur monthly for the first year of the project and bi-monthly for years 2 and 3 of the
project.
• Participate in project evaluation efforts.
