MINUTES OCTOBER 16, 2018 BRAZOS COUNTY COMMISSIONERS COURT WORKSHOP SESSION Call to Order The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 2:00 p.m. on Tuesday, October 16, 2018 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1, Absent; Sammy Catalena, Commissioner of Precinct 2; Nancy Berry, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. Attached is a list of the citizens and officials in attendance. The County Judge called the meeting to order and invited others to speak. 2. Presentation and discussions regarding voting equipment. Purchasing Agent Charles Wendt gave a presentation on the survey results of the two systems that were tested in the mock election. The two systems were Hart I ntercivic and Election Systems and Software, LLC (ES&S) Mr. Wendt also pointed out the equipment differences in both systems.. Commissioner Berry asked what system is currently being used. Mr. Wendt answered that we are using Hart. Commissioner Catalena asked about the trade in value of the equipment we currently have. Mr. Wendt said that it is outdated, but may have some value to counties using the same system. Mr. Wendt then stated the first year total cost for both systems are close in price. He commented that this is a long term investment and the five year cost of each system showed Hart to cost less. He said that Hart will hold the price for the first five years. Commissioner Cauley asked for warranty information from both companies. Elections Administrator Trudy Hancock stated that both companies are certified by the Secretary of State and have at least a one year warranty. Mr. Wendt said that he would look into getting more information regarding the warranty. Commissioner Cauley asked how many machines would be purchased. Mr. Wendt stated 420 total machines would be purchased from Hart, which would be 360 voting machines and 60 ADA compliant machines. He also said that different machines will be used for early voting and the general election. Mr. Wendt said that 350 total machines from ES&S would be purchased. He explained that with ES&S the same machines can be used for both early voting and the general election. Commissioner Cauley asked what would be done with the old machines. Mrs. Hancock answered there are some counties interested in our old equipment. She also stated that with either system she thinks more machines will need to be purchased in the next five years due to growth. Commissioner Berry asked if the Hart ADA machines can be used by non disabled voters as well. Mrs. Hancock said yes, if we are busy there will be 420 machines that can be used. Commissioner Cauley mentioned that at the mock election she had a disabled person in line in front of her that was not happy with the Hart system. She said the ES&S system was better for the disabled voter. Next to speak was Fran Duane representing the Democratic Party. Ms. Duane stated that at the mock election there were long lines at the Hart system because the machine was not working properly. She stated that the printers went down and someone from Hart could not tell her who would fix the printer if it goes down. She said the process was cumbersome. She then said she was impressed with the ES&S system and how easy it was to use and understand. She also liked the curbside voting service. Ms Duane stated that the Democratic Party recommends the ES&S system. Bob Davis spoke next. Mr. Davis is the Primary Coordinator for the Republican Party. He said he thought the ES&S system was cumbersome. He said you have to take the paper to the scanner and going to two different machines would be difficult for elderly and disabled voters. Mr. Davis mentioned that the ES&S curbside machine is larger than the Hart machine. He also mentioned workers possibly needing the oath of assistance to be able to assist people in scanning their ballots. Disc keys would also be needed for judges with the ES&S system and is not clear on how all of these things would work He said all of his comments today were based on the Republican Party judges that work the elections. Mr. Davis stated that he personally knows the voter Commissioner Cauley spoke of and said she was frustrated with the Hart paper option and not the electronic machine. oma= pg. Mrs. Hancock cleared up which systems from each company we are considering to purchase. She also noted that the curbside option that ES&S demonstrated at the mock election is not certified by the state. Mrs. Hancock explained that the entire machine would have to be taken out to the voter and then someone would have to take the ballot in and scan it. There is the question if that person has to be given the oath of assistance. She then described the disc process for both systems and gave a report of her concerns. Mrs. Hancock stated that she has discussed the two systems at great length with her staff, the Cities of Bryan and College Station, and others. She said she has security concerns with ES&S and therefore recommends Hart. Commissioner Berry then asked Mary Lynn Stratta and Tanya Smith if they would like to speak and give their recommendations. Mary Lynn Stratta with the City of Bryan stated that after observing the mock election she believes that in terms of voter satisfaction the voters preferred the paper ballot. Mrs. Stratta said she has security concerns with the ES&S system and it is cumbersome. Tanya Smith with the City of College Station said that she agrees with Trudy Hancock and Mary Lynn Stratta and would recommend Hart, but she will support whatever decision is made. Commissioner Cauley then asked if anyone else would like to speak. There being no one else wishing to offer commentary for or against the voting equipment, the meeting was adjourned. 3. We witnessed the actual vote and tally/tabulations of two systems, and appreciate your invitation to comment. Our review - and this comment - includes no budget analysis. No initial or long-term cost figures were provided, so none were considered. We vote for ES&S Expressvote. Voter -confidence, the bedrock of any vote, formed our recommendation. ES&S Expressvote provided that voter -confidence in the integrity, accuracy and security of the vote from placing the vote through tally/tabulation of the vote. Specifically, we found: • The ES&S Expressvote voting line moved smoothly and efficiently. • The vote -testers found ES&S vote screens to be user-friendly. • The vote -testers liked the straightforward and easy to read printout from the machine - it comes directly from the machine. • ES&S explained, during and after the presentation, the numerous safeguards over the vote. • Company representatives fielded questions professionally and thoroughly. The voters who tested the two systems were impressed with ES&S Expressvote. Several people did express concerns that the survey taken at the conclusion of the test did not request the type of information, which would shed light on preferences. Thank you for inviting us to participate in this process. We ask the Court to purchase the ES&S Expressvote system in the form presented to us this summer. �? Fa
