Consider and take action on the Vess Oil Corporation utility permit to install a temporary 10" Polyurethane water line within and along the right-of-way of Jack Creek Road and Dilly Shaw Tap Road. Vol. --2 ��--_ pQ /? _ PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, vdth both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public wfio are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allowa member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter vdthout notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section 551.042. INVOCATION Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to attend or participate in the invocation and such decision wit have no impact on their right to actively participate in the business of the Court. W THE STATE OF TEXAS § COUNTY OF BRAZOS INTERLOCAL AGREEMENT BETWEEN BRAZOS COUNTY AND THE BRAZOS COUNTY HEALTH DISTRICT TO PROVIDE LIMITED NURSE PRACTITIONER SERVICES This Agreement between the Brazos County ("COUNTY"), a political subdivision of the State of Texas, and the Brazos County Health District ("DISTRICT"), a political subdivision of the State of Texas, is made pursuant to the provisions of the Interlocal Cooperation Act, V.T.C.A., Government Code, Chapter 791. WHEREAS, the District recognizes the need for Nurse Practitioner to provide health related services during the hours of operation of the District's Sexually Transmitted Disease ("STD") Clinics; and WHEREAS, the District desires to be assured of an established, continuous source for the provision of medical care services to meet the aforementioned needs of the District; and WHEREAS, the County is capable of providing the comprehensive medical services required to meet the aforementioned needs of the District; NOW, THEREFORE, in consideration of the mutual promises hereinafter set forth, the District, acting by and through its duly authorized Chairman of the Brazos County Board of Health and the County authorized County Judge, do hereby agree to the following: 1. Scope of Services —County agrees to provide Julie Anderson, Nurse Practitioner ("NP") to provide patient services, as defined in paragraph 4. below, to individuals presenting themselves to the STD Clinics at the District ("Services"). 2. Term and Termination a. Term — This Agreement shall be in effect for one (1) year term, commencing on September 1, 2018 and terminating on August 31, 2019, unless earlier terminated as provided hereinafter. The Agreement may be renewed by written agreement between the County and the District for three (3) additional one (1) year terms, upon the same terms and conditions set forth herein subject to funds being budgeted and payable out of the current revenues of the District. b. Termination by District— In the event that the District elects to terminate this Agreement_ prior to its termination date, the District shall furnish written notice of termination, as set forth in paragraph 20. below, to the County no later than thirty (30) days prior to the effective date of such termination. Termination by County — In the event that the County elects to terminate this Agreement prior to its termination date, the County shall furnish written notice of termination, as set forth in paragraph 20. below, to the District no later than ninety (90) days prior to the effective date of such termination. d. The District and County agree and understand that the services stated in this Agreement are to be performed by Julie Anderson, NP once she becomes employed with the County. If in the event that employment does not take place or that Ms. Anderson does not remain employed by the County this agreement will immediately terminate, 3. Clinic Schedule and Operatine Hours — County agrees to keep the District's STD Clinic staffed with a NP during the following times: 1:00 pm -2:30 pm Mondays, 3:30pm — 5:15 pm Wednesdays and 7:45am — 9:00am Fridays, for each week of the Agreement term. In the event that the time required for examination and treatment of clients registered for a STD clinic extends beyond the designated clinic hours, County agrees to complete services to all clients registered. In the event that the County is unable, due to illness, personal time off or other event, to provide the NP for any District STD Clinic, the County will notify the District as soon as possible through its Health and Wellness Clinic and/or its Human Resources Department. The District shall make alternative arrangements at that time in order to conduct the STD Clinic. STD Clinic hours may be changed by the mutual agreement of the parties. 4. Sexually Transmitted Disease Clinic Patient Services — During the hours set for the STD Clinics, the NP will as part of the District's STD program, perform the following duties: Examine and diagnose patients presenting to the District's STD Clinic; treat these patients according to the most current Center for Disease Control STD Treatment Guidelines; provide medical consultation for the District's nursing staff regarding the diagnosis and treatment of STD patients; and notify the medical management of all emergency situations arising from the evaluation and treatment of the District's STD patients. 5. District Support—The District will provide support staff including but not limited to clerical, translation, laboratory and nursing personnel necessary for the discharge of the County's duties in the provision of the District's STD Clinic services 6. Facilities—The District will provide, at the District's Office located at 201 North Texas Avenue Bryan, TX 77803, appropriate numbers of examination rooms, equipped with exam tables, stool(s) chair(s), wall mounted oto/ophthalmoscopes, telephone, and storage cabinets and one (1) office equipped with a desk, chair and telephone, as well as Electronic Medical Records Access. 7. Personnel —The District will provide, at its sole cost and expense, any support staff for the NP necessary for the provision of services during STD Clinics at the District, including but not limited to a Supervising Physician. Such Physician may provide supervision pursuant to a Collaborative Practicum Agreement and not on-site. 8. Ancillary Services — The District shall be responsible for those expenses for ancillary services necessary for the provision of services during the STD Clinics at the District, including but not --- — limited to laboratory, and pharmacy expenses that are in strict compliance with the District's standard operating procedures and standing orders. 9. Limitation on Services — The County shall provide only those services described herein, and shall not participate in any other programs and services of the District unless agreed by both parties in writing. The parties agree to meet once a quarter at a mutually agreeable time to discuss the smooth operation of the services set forth herein and to address problems that may arise in relation thereto. 10. Fees - The District shall set fees for the STD Clinic. Collections of fees and billing of the Services rendered in the STD clinics will be the responsibility of the District. 11. Financial Arrangement — District agrees to pay the County $68.56 per hour for each hour the NP spends at the STD Clinics. The NP will keep track of all of her time spent at the District STD Clinics and payment will be processed directly through payroll with the County 12. Reports — The County agrees to cooperate in any reasonable requests for reports the District deems necessary in order for it to comply with its contractual obligations to the Texas Department of State Health Services ("TxDSHS"). The requirements of this Section shall survive the termination of this Agreement 13. Compliance with the Law — The County agrees to comply with all State and Federal laws, rules and regulations including but limited to the Health Insurance Portability and Accountability Act and agrees to provide services to clients without discrimination of the basis of race, color, national origin, age, sex, disability, political or religious beliefs. 14 Confidentiality— All parties hereby warrant that they shall comply with all applicable federal and state laws, rules and regulations and District and County policies that pertain to patient confidentiality. All HIV related confidentiality policies implemented and followed by the County will be consistent with the model guidelines published by the Texas Department of State Health Services. 15. Insurance Requirements — The County will ensure that the NP obtains and provides certification to the District maintains Professional Liability Insurance with limits of at least $100,000 per occurrence and $300,000 aggregate. All insurance policy requirements shall be subject to the examination and approval of the District for their adequacy as to form and content, form of protection and insurance company. 16. Patient Records—All client or patient records created as a result of the District's STD Clinic shall be the property of the District. The County acknowledges the District's right to permit access to District STD patient records or provide copies for audit examination, evaluation, inspection, litigation or other circumstances to the TxDSHS. Notwithstanding any provision herein to the contrary, if requested by the County, in furtherance of this Agreement, the District Vol, % c4 pg, ! 7 may, in its sole discretion, share certain patient information with the County. The District shall obtain a release of medical information from the client,_ patient or someone authorized to act on _... his or her behalf, permitting the transfer of information to the County. 17. Indemnity — The parties hereto mutually agree, to the extent permitted by law, to indemnify, defend and hold each other harmless from and against any and all losses, damages, expenses or other claims which arise out of the acts or omissions of their own employees, agents and representatives. It is the specific intent of each party to insulate the other from any and all liability to the extent that it arises out the conduct of their respective employees, agents and/or representatives. To the extent permitted by law, each party will be protected from liability caused or allegedly caused by the employees, agents and/or representatives of the other. At all times during the performances of the Services, the NP shall be an employee of the County. The County's and District's indemnities of each other do not waive any protection each has under the Tort Claims Act of the State of Texas or any other Limitation. Each party agrees that neither the County nor District is waiving any Defenses or Immunities. 18. Venue and Choice of Law — This Agreement has been made under and shall be governed by the laws of the State of Texas. Performance and all matters related thereto shall be in Brazos County, Texas, United States of America and venue shall be in any court having jurisdiction in said county. 19. Entire Agreement and Amendment — This Agreement contains the entire understanding between the parties concerning the subject matter contained herein. There are no representations, agreements, arrangements, or understanding, oral or written, between or among the parties hereto, relating to the subject matter of the Agreement, which are not fully expressed herein. Any amendment of the Agreement must be in writing and executed by a duly authorized representative of each party. 20. Conduct— The NP employed by the County to provide services hereunder shall be properly licensed by the State of Texas, supervised by a licensed physician provided by the District to supervise over the District's STD Clinics. The NP shall during the Term hereof, be a party to a Prescriptive Authority/Collaborative Practicum Agreement with both the County's and District's contract medical physicians licensed to practice in the State of Texas. The NP shall be able to perform the services required and conduct herself pursuant to the rules of conduct set forth in the Principles of Medical Ethics of the American Medical Association. The County agrees that the NP subject to this Agreement shall conduct herself in a professional manner and not engage in conduct, acts or behavior which could adversely affect or reflect negatively upon the District. If the NP engages in conduct or behavior, which the District deems to be detrimental to the District, the District may immediately terminate this agreement upon proper notice to the County. 21. Notices — All notices provided or permitted to be given under this Agreement must be in writing and may be served by depositing the same in the United States mail, addressed to the party to be notified, postage prepaid and registered or certified with return receipt requested. Notice given in accordance herewith shall be effective upon receipt at the address of the addressee. There will be no deductible for payments made under this provision, and any such payments are a part of, and not in addition to, the Company's Limits of Liability as described in the Declarations. 2. The Company will pay reasonable expenses incurred by the Insured at the Company's request to assist in the investigation of the Claim or defense of the suit, including actual loss of earnings up to $500 a day for each Insured because of time off from work, subject to an aggregate amount of $5,000 for each individual Insured for each Claim, not to exceed an aggregate amount of $10,000 per Policy Period. There will be no deductible for payments made under this provision, and any such payments are a part of, and not in addition to, the Company's Limits of Liability as described in the Declarations. 3. The Company will pay fines and penalties specified in the Health Insurance Portability and Accountability Act of 1996 (HIPAA), and the Health Information Technology for Economic and Clinical Health Act (HITECH) as assessed against the Insured, or assessed against third parties who make a claim on the Insured for indemnification or contribution for such fines and penalties based on violations and breaches of the privacy and security provisions of HIPAA, and HITECH, and/or regulations promulgated under said statutes relating to Protected Health Information (PHI) and electronic Protected Health Information (ePHI), but only if such violations or breaches arise out of professional services as described in the Declarations or from the handling of PHI or ePHI of the Insured's own personnel. For the purposes of"this coverage, Claim shall also include the notice of investigation, audit, and/or assessment of fines or penalties by the U.S. Department of Health and Human Services or the Office of Civil Rights in connection with violations of or breaches under HIPAA and/or HITECH. For the purposes of this coverage, Damages shall also include HIPAA and/or HITECH fines and penalties. The coverage described above is subject to a sub -Limit of Liability in an aggregate amount of $100,000. This sub -Limit of Liability is the maximum amount payable under this provision for the Policy Period, regardless of the number of violations and/or breaches by the Insured of the privacy and security provisions of HIPAA and HITECH and the regulations established thereunder arising from the performance of or failure to perform professional services as described in the Declarations. Any payments made under this provision are a part of, and not in addition to, the Company's Limits of Liability as described in the Declarations. 4. The Company will pay Damages or Claims Expenses as a result of Claims arising out of circumstances involving the use of excessive influence of power on any patient, or the actual or alleged inappropriate physical contact or contact that is deemed by or alleged by the plaintiff to be sexual or in any way unwelcomed, is limited to a sub -Limit of Liability of $250,000 each claim and $500,000 in the aggregate. This sub -limit of liability is part of and not in addition to the applicable Limits of Liability as shown in the Declarations. The performance of any service by any Insured while under the influence of intoxicants or illegal drugs. L. The ownership, maintenance, use (including operation, loading and unloading), or entrustment to others of any aircraft, automobile, motor vehicle, mobile vehicles or watercraft owned or operated by or rented or loaned to any insured. This exclusion includes the movement of patients in and out of any motor vehicle, aircraft, automobile or watercraft. M. 1. Obstetrical procedures, including but not limited to any emergency obstetrical procedures. Part III. Definitions A. Advertising Liability means injury arising out of one or more of the following offenses: 1. Oral or written publication of material that slanders or libels a person or organization or disparages a person's or organization's goods, products or services; 2. Oral or written publication of material that violates a person's right of privacy; 3. Misappropriation of advertising ideas or style of doing business. B. Bodily Injury means physical or mental harm, sickness or disease sustained by a person, including death resulting from any of these at any time. C. Claim means a written demand for monetary or non -monetary relief received by the Insured during the Policy Period, including the service of suit, or the institution of an arbitration proceeding. Additionally, Claims that arise from an incident, occurrence or offense first reported by the Insured during the Policy Period and accepted by the Company in accordance with Part IV. A. Notice of Claim will be considered a Claim first made during the Policy Period. D. Pollutants means any solid, liquid, gaseous or thermal irritant, contaminant or toxin, whether live or inanimate, including but not limited to, smoke, vapor, soot, fumes, acids, alkalis, chemicals, metals, silica, lead, lead compounds or materials containing lead, asbestos, asbestos compounds or materials containing asbestos, radon, waste or any like substances. Waste includes materials to be recycled, reconditioned or reclaimed. Part IV. General Conditions. The following Conditions are a precedent to coverage under the Policy: A. Notice of Cancellation and Nonrenewal The Named Insured may cancel this policy by mailing or delivering to the Company advance written For other than nonpayment of premium or deductible, the Company will give the Named Insured sixty (60) days written notice prior to cancellation or nonrenewal of this policy by mailing or delivering the notice to the first Named Insured's last known mailing address. If the Company cancels the policy due to the Named Insured's failure to pay a premium when due, this policy may be cancelled by the Company giving not less than 10 days written notice of cancellation. The cancellation notice will state the effective date of the cancellation and the policy will terminate on that date. If cancelled by the Company, the earned premium will be computed pro -rata. If cancelled by the Insured, the earned premium will be computed short rate. E. Premium and Audit Premium for this coverage is computed in accordance with the Company's rules and rates. Any premium shown as advance premium may be a deposit premium only. If the premium is a deposit premium, at the close of each audit period, the Company will compute the earned premium for that period. Audit premiums are due and payable upon notice. The Company may examine and audit the Insured's books and records at any time during the Policy Period and within three years after the final termination of this policy, as far as they relate to the subject matter of this policy. The first Named Insured as shown in the Declarations must keep records of information the Company will need for premium computation and upon request must send the Company copies of the information. F. Authorization The first Named Insured listed in the Declarations agrees to act as the Named Insured with respect to the giving and receiving of all notices, exercising of the Extended Reporting Period option, canceling of the policy, paying of all premiums and deductibles and the receiving of any return premiums that may become due. G. Change This policy contains all of the agreements concerning the insurance provided. The first Named Insured shown in the Declarations is authorized to make changes in the terms of this policy with the Company's consent. The policy terms can be amended or waived only by endorsement issued by the Company, and made a part of this policy. H. Subrogation In the event of any Claim under this policy, the Company will be subrogated to all the Insured's rights of recovery against any person or organization, and the Insured will execute and deliver instruments and papers and do whatever else is necessary to secure such rights. The Insured will do nothing after the loss to prejudice such rights. I. Other Insurance This policy will be excess over, and will not contribute with, any other existing insurance, unless such other insurance is specifically written to be excess of this policy. If such other insurer refuses to defend such Claim or suit, the Company shall be entitled to the Insured's rights against all such insurers for any Claim Expenses incurred by the Company. SCOPE OF WORK Project requirements established through meetings with the user indicate renovations to approximately 5,080 square feet in the existing office building. The facility will be designed with one office space, one toilet, storage areas, and mechanical room. The existing partitions, flooring,.ceiling and doors will be demolished. The exterior walls will be insulated to meet energy code throughout the facility. The facility ceiling will be open to the roof deck. A new Fire Sprinkler System, fire alarm, a fire detection system, new LED lighting, humidity control and HVAC supplies throughout. The outside of the facility will be painted, and the windows and storefront will be replaced. Handicap parking and access to the building will be designed. Approximately 3,940 square feet will be for the County Clerk's Secure Storage. The storage space will be designed for high density storage units and meet the records storage guidelines provided by Brazos County. New floor sealer and TAS Compliant toilet will be designed for the County Clerk's space. Two existing HVAC units willbe relocated to concrete pads on the ground and the system will be arranged for back-up operation. New ducts will be run through the existing masonry wall. General Requirements 1. Adequate drainage shall be maintained in ditches at all times. 2. Permittee will use best management practices ("BMP") (EPA and TCEQ both provide lists of examples of BMPs) to minimize erosion and sedimentation resulting from the proposed installation. 3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed representative. 4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior occupant. 5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, permittee will be liable to the County or other utilities running through the right of way. 6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is determined that inconvenience to the public exists, then the County Engineer will decide whether such project will be allowed or if an alternative exists so as not to inconvenience the public. A Safely Reauiremenfs I. Proper traffic control measures must be put in place prior to beginning work and remain in place during the duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control Devices (TMUTCD). See Traffic Control Requirements below. 2. During construction, all safety regulations of the Texas Department of Transportation shall be observed. 3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may be necessary, in order to safely conduct the public through the project area. Company shall provide flagmen, signs, signals or devices necessary to provide complete safety to the public. 4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners. 5. No cable, conduit and/or pole line shall be laid, constructed, maintained and/or repaired so as to constitute a danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the County Engineer. C. Traffic Control Plan 1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided a. Any construction (i.e. pit, excavation, hole) left open overnight, requires specific nighttime traffic control measures pursuant to the TMUTCD; Vol.__ Pg._ b. If construction is within ten (10) feet of the roadway; or c. Any work performed in the road right-of-way; 2. Plan must be attached to the permit and kept at the job site anytime work is being performed. 3. Plan must set forth the time of completion for the job. D. Design Standards I. All overhead installations shall conform to clearance standards of the Texas Department of Transportation and the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section 181.045. 2. All pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure safety to the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate location at the company's expense. Exceptions may be approved by the County Engineer. 3. All underground installations shall (these are minimum depths — utility may place deeper): a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement; b, be at least thirty-six (36) inches below ditch flow line when installation is within the area measured from top of bank to top of bank; c. be at least forty-eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below; d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of less than 60 feet. 4. Water Lines: All water lines must be a minimum 36 -inches below the ditch flow line and cased. Waterlines shall be cased if crossing under the roadway. 5. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated locations based upon the type of utility. The locations shall be as follows: (measured from back of right-of-way). Power— 0 to 2 feet, nominally 1' Phone — 2 to 4 feet, nominally 3' Gas — 4 to 6 feet, nominally 5' Cable -6 to 8 feet, nominally 7' 6. Any installation within ten (10) feet of edge of pavement shall meet the following: a. location must be approved by the County Engineer or his representative b. backfilled with cement stabilized material. c. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity. d. all excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed during a rainy period or at other times where excess water cannot be prevented from entering the trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material as soon as weather permits; e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the County Engineer or his representatives. f. no side or lateral tamping to fill voids under the base and pavement materials is allowed. 11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event Company damages the slope, shoulder or any other portion of the right-of-way, Company will be responsible for repairing the damage and replacing the right-of-way to the condition it was prior to commencing construction. 12. Operation of construction and/or maintenance equipment on the traveled surface of any improved County road will not be permitted, except in an instance whereby the laying, construction, maintenance and/or repair of cables, conduits and/or pole tines cannot be accomplished by any other method and in this event all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD requirements. 13. In the event said construction and/or maintenance and/or repair requires Company to remove, cut or jeopardize any section of the road (asphalt, cement, road base, etc.), Company will be required to provide a performance bond or letter of credit securing necessary repairs. Said bond amount will be determined by the County Engineer. 14. The applicant shall submit a letter of "No Objection" from the Army Corps of Engineers for all designated wetlands and environmentally sensitive lands. E. General Requirements 1. .Adequate drainage shall be maintained in ditches at all times. 2. Permittee will use best management practices ("BMP") (EPA and TCEQ both provide lists of examples of BMPs) to minimize erosion and sedimentation resulting from the proposed installation. 3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed representative. 4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior occupant. 5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, permittee will be liable to the County or other utilities running through the right of way. 6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is determined that inconvenience to the public exists, then the County Engineer will decide whether such project will be allowed or if an alternative exists so as not to inconvenience the public. A Safety Reauirements 1. Proper traffic control measures must be put in place prior to beginning work and remain in place during the duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control Devices (TMUTCD). See Traffic Control Requirements below. 2. During construction, all safety regulations of the Texas Department of Transportation shall be observed. 3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may be necessary, in order to safely conduct the public through the project area. Company shall provide flagmen, signs, signals or devices necessary to provide complete safety to the public. 4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners. 5. No cable, conduit and/or pole line shall be laid, constructed, maintained and/or repaired so as to constitute a danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the County Engineer. C. Traffic Cantrol Plan 1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided -....for the.fallowing:--- a. Any construction (i.e. pit, excavation, hole) left open overnight, requires specific nighttime traffic control measures pursuant to the TMUTCD; b. If construction is within ten (10) feet of the roadway; or c. Any work perforined iii the road right-of-way; '— — — — 2. Plan must be attached to the permit and kept at the job site anytime work is being performed. 3. Plan must set forth the time of completion for the job. D. Design Standards L All overhead installations shall conform to clearance standards of the Texas Department of Transportation and the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section 181.043. 2. All pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure safety to the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate location at the company's expense. Exceptions may be approved by the County Engineer. 3. All underground installations shall (these are minimum depths — utility may place deeper): a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement; b. be at least thirty-six (36) inches below ditch flow line when installation is within the area measured from top of bank to top of bank; c. be at least forty-eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below; d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of less than 60 feet. 4. Water Lines: All water lines must be a minimum 36 -inches below the ditch flow line and cased. Waterlines shall be cased if crossing under the roadway. S. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated locations based upon the type of utility. The locations shall be as follows: (measured from back of right-of-way). Power — 0 to 2 feet, nominally V Phone — 2 to 4 feet, nominally 3' Gas — 4 to 6 feet, nominally 5' Cable — 6 to 8 feet, nominally 7' 6. Utilities with less than 60 feet right-of-way in all new developments shall install the utility in a similar manner as referenced in No. 3 above; however, the County Engineer or its designated representative will provide final approval of each utility location. 7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if left open over night or unattended. 8. Crossings under a county road shall: a. be bored or jacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT; b. be pressure grouted for the full length of the crossing if the annular space between pipe and casing and soil exceeds one (1) inch.—Brazos County 'must be given 24 hours notice of pressoie groutingr'­ operations and have the opportunity to have an inspector on site to observe pressure grouting operations; FV _01 % � p9 7,2f c. Any installation within ten (10) feet of edge of pavement shall meet the following: a. location must be approved by the County Engineer or his representative b. backfilled with cement stabilized material. c. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity. d. all excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed during a rainy period or at other times where excess water cannot be prevented from entering the trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material as soon as weather permits; e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the County Engineer or his representatives. f. no side or lateral tamping to fill voids under the base and pavement materials is allowed. 11. Company must be careful to notjeopardize the slope or integrity of the shoulder of the road. In the event Company damages the slope, shoulder or any other portion of the right-of-way, Company will be responsible for repairing the damage and replacing the right-of-way to the condition it was prior to commencing construction. 12. Operation of construction and/or maintenance equipment on the traveled surface of any improved County road will not be permitted, except in an instance whereby the laying, construction, maintenance and/or repair of cables, conduits and/or pole lines cannot be accomplished by any other method and in this event all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD requirements. 13.
