Vol. � Pg• 1��.— PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. Fbwever, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section 551.042, INVOCATION Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business of the Court. MINUTES JANUARY 30, 2018 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, January 30, 2017 with the following members of the Court present: Duane Peters, County Judge, Presiding; Steve Aldrich, Commissioner of Precinct 1; Sammy Catalena, Commissioner of Precinct 2; Nancy Berry, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. Deputy Emergency Management Coordinator Jason Ware reported that the KBDI vol. to % Pg,�� fL Drought Index is 341 and continues to rise even with the small amounts of rain we have received. Mr. Ware stated that the volunteer Fire Departments have fought seventeen (17) fires since January 1, 2018. He said that seventy (70) acres of land has been damaged and out of that seventy (70) acres nine (9) of those were controlled burns. Mr. Ware recommended issuing a burn ban. Commissioner Catalena asked if the area Fire Chiefs are on board with issuing a burn ban. Mr. Ware answered yes they are. Commissioner Cauley offered a motion to issue a thirty (30) day burn ban. The motion was seconded by Commissioner Berry and passed unanimously. Motion: Approve, Moved by Commissioner Irma Cauley, Seconded by Commissioner Nancy Berry. Passed. 5-0. The Court approved as submitted a Proclamation declaring February 10 - April 6, 2018 as 8 weeks of fun and fitness known as Walk Across Texas. The County Judge read aloud and presented the Proclamation to Flora Williams with the AgriLife Extension Service. Mrs. Williams thanked the Court and Brazos County employees for their support and invited everyone to join in the Walk Across Texas fun. Mary Parrish with the Brazos County Health Department described the Walk Across Texas program and gave information on how employees can register their teams. She encouraged everyone to attend the Kick -Off Event on Saturday, February 10, 2018 at 10 a.m. at the Post Oak Mall in the J.C. Penny area. Sheriff Chris Kirk stated there were 605 inmates in jail, 517 inmates are male and 88 are female, 46 have electronic monitors and 8 are pending for monitors. Sheriff Kirk thanked the Court for attending the press conference for First Net on January 25, 2018. Sheriff Kirk then gave a small presentation to show the Court the rifle vests that were purchased through a grant. Sheriff Kirk said that Brazos County was awarded $120,000.00 to purchase thirty (30) rifle vests for officers in the Sheriff's Office, Constables, County Attorney and District Attorney. The Sheriff thanked the Court for their support of the grant. Judge Peters thanked the Sheriff for all they do and said that it is important to do all they can to keep our law enforcement officers safe. 27. BRAZOSCOUNTY COMMISSIONER'S COURT DAY OF , 20_&' /,0: of AM/PM, Name (PLEASE PRINT) Organization (PLEASE PRINT) 66L4� dad, 4�" v e�� vblA P9.1� BRAZOS COUNTY BRYAN, TEXAS ORDER 18-004 PROHIBITION OF OUTDOOR BURNING WHEREAS, in accordance with provisions of the Texas Local Government Code, Chapter 352, a drought condition exists or has existed in Brazos County, Texas as determined by Texas Local Government Code Chapter 352; and, WHEREAS, the Commissioners Court makes a fmding that circumstances present in all or part of the unincorporated area of Brazos County create a public safety hazard that would be exacerbated by outdoor burning. BE IT THEREFORE ORDERED that the following regulations are hereby established for all unincorporated areas of Brazos County, Texas for the duration of the above mentioned declaration; 1. Action Prohibited: A person violates this order if he or she bums any combustible material outside of an enclosure serving to contain all flames and/or sparks, or orders such burning by others. 2. Enforcement: A. As soon as possible, a duly commissioned peace officer shall be sent to the scene to investigate the nature of the fire. B. Upon notification of suspected outdoor burning, the fire department assigned to the location of the fire shall respond to the scene and take immediate measures to contain and/or extinguish the fire. C. If in the opinion of the officer at the scene and/or the fire chief, the goal of the order can be attained by informing the responsible party about the prohibitions established by this order, the officer may, at his discretion, notify the party about the provisions of this order and request compliance with it. In such instances, an entry of the notification shall be made into the dispatchers log containing the time, date, and place of the warning, and the name of the person receiving the warning. 3. At the discretion of the peace officer or the fire chief, second or flagrant violations of the order may be prosecuted in accordance with the statutes and procedures governing misdemeanors. 4. This Order prohibiting Outdoor Burning takes effect on January 30, 2018 and will expire on March 1, 2018, unless terminated earlier by the Commissioners Court or the County Judge. The Commissioners Court hereby designates to the County Judge the authority to terminate this Order in accordance with Local Government Code Section 352.081(c)(2). This prohibition does not apply to prescribed outdoor burning activities related to public health and safety and/or trench -burning related to public health and safety that are authorized by the Texas Commission on Environmental Quality for: (1) firefighting training; (2) public utility; (3) natural gas pipeline or mining operations; (4) planting or harvesting of agriculture crops; or (5) bums that are conducted by a prescribed burn manager certified under Section 153.048 of the Texas Natural Resources Code, and meet the standards of Section 153.047 of the Texas Natural Resources Code. O .If there_ are any areas within the plat that include aFEMA-mapped Floodplain with a Zone A classification, or if there exists within or adjacent to the plat any water courses whose upstream drainage basin is larger than 64 acres, the plat shall also skew the extent of the 100 -Year Floodplain as determined by an engineering study under the seal of a Registered Professional Engineer. This study shall. be sufficient in scope to determine and establish a BFE for all points within the plat. ❑ BFE's shall be shown for all points.within the plat, as determined by the results of an engineering. study. This First Amendment to Consultant Services Agreement ("Amendment") is entered into and effective on the 1st day of January, 2018, by and between Brazos County and Consultant. WHEREAS, Brazos County and Consultant entered into an agreement for professional services on the 1st day of September, 2017; and WHEREAS, the parties agree that there is a need to amend Paragraph "2. Payment" effectively striking the referenced "Attachment A" which refers to Consultant's "Statement of Work" in the Consultant Services Agreement between Brazos County and Consultant. WHEREAS, any payment terms previously described by the original Consultant Services Agreement and Attachment A/Statement of services are hereby stricken and shall be controlled by this amendment. WHEREAS, this amendment supersedes any prior or previous agreement as to payment for Consultant Services and so far as both parties agree in writing to the amendment, this amendment supersedes any prior process previously agreed upon to amend the Agreement and/or Attachment A/Statement of Work; and NOW THEREFORE THE PARTIES AGREE AS FOLLOWS: A. Amendment As of the 1st day of January 2018, the remaining amount available on the Consultant Services Agreement is Thirty Nine Thousand Three Hundred Forty Seven Dollars and Twenty Cents ($39,347.20) which shall be paid at a flat rate to the Consultant over the remaining nine (9) months at a rate of Four Thousand Three Hundred and Seventy One dollars and Ninety One Cents ($4,371.91) per month which shall be payable on the last day of each month.
