16. Request from Expo Center to purchase CAT DP35N diesel forklift in place of the
Kubota Loader that was approved in FY17 HOT Capital Budget and in place of the CAT
DP 30N diesel forklift that was approved in court on 11/8/16.
17. Payment Authorization to Best Western in the amount of $1081.48 for the District
Attorneys Office; a purchase order was not obtained in advance.
18. Approval of the Bryan Broadcasting Radio Tower Lease Reimbursement Agreement
between Brazos County and the BVCOG.
19. Permission to advertise RFP # 17-253 Expo Expansion Phase III.
20. Consider and take action to close, vacate and abandon the right of way of Old Highway
90 (105). Roadway has not been in use or maintained for quite some time and
therefore, there is no public interest served by retaining this right of way. The
abandoned right of way is in the James Whitesides Survey, A-57 of Brazos County. Site
is located in Precinct 1.
21. Consider and take action on Bryan Texas Utilities (BTU) cost estimate of $12,060.49 for
the relocation of four (4) poles along with guys and anchors on Smetana Road. This
work is needed in order to accommodate the improvements to be made to Smetana
Road from SH 21 to the Union Pacific Railroad crossing. Site is located in Precinct 4.

PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court, wth both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a
Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the
Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity
of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly,
profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge
and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite ebsting
policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required
to attend or participate in the invocation and such decision wII have no impact on their right to actively participate in the
business of the Court.
The Commissioners Courtroom of the County Administration Building, 200 South Texas Ave., Suite 106, Bryan, TX 77803 is
wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive services must be made two

REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South
Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday,
November 22, 2016 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheets contain the names of the citizens and officials that were in
attendance.

Patrick Gendron praised the Brazos County Juvenile Justice Center and the staff. Mr.
Gendron stated that he was thankful for all their hard work. He also complimented the
Court on their expertise in law enforcement and education. Mr. Gendron commended
the District Attorney for allowing the current prosecutor to continue in the Juvenile
division and be effective with her knowledge. He stated that it is all working very well.

At this point, the County Judge announced the Court would consider items 27 through
29 then return to convene into Executive Session.
Having considered the previously noted agenda items, at 10:23 a.m. the County Judge
stated that the Court would convene into Executive Session to a) discuss or deliberate
economic development negotiations, b) to discuss personnel matters, and c) to
deliberate business and financial issues related to a contract being negotiated.
At this point the County Judge asked Bill Ballard, Civil Counsel if he is issuing a written
determination that deliberation in an open meeting would have a detrimental effect on the
position of the Commissioners Court in negotiations with a third person. Mr. Ballard
responded that it was his determination that deliberation in an open meeting would have
a detrimental effect on the position of the Court in negotiations with a third person. He
then handed his written determination to be included in the minutes.
On motion by Commissioner Mallard, seconded by Commissioner Cauley the Court
voted unanimously to meet in Executive session per Bill Ballard's recommendation.
Judge Peters announced the Court would deliberate on Executive Session b first since
the District Attorney needs to get back to his office.

26. Consider and possible action on executive sessions.
At 11:45 a.m. the County Judge announced the meeting open to the public and
announced that no action would be taken on the Closed Executive Session.
Commissioner Wassermann read the following statement and directed Civil Counsel to
go forward with negotiating an Interlocal Agreement (ILA) with College Station
Independent School District for School Resource Officers with the understanding that
any agreement will have a financial cost to Brazos County of zero dollars.
Commissioner Wassermann requested that the ILA be brought back to the Court for
consideration before December 31, 2016.
27. Sheriff's report on inmate population.
Sheriff Chris Kirk stated there were 621 inmates in jail, 548 inmates are male and 73 are
female, 42 have electronic monitors and 12 are pending for monitors.
28. Announcement of interest items and possible future agenda topics.
Commissioner Cauley announced the 2016 RSVP Volunteer Recognition Event on
Tuesday, December 13, 2016 at 11:00 a.m. at the College Station Hilton Hotel.
Commissioner Catalena thanked Constable Donald Lampo, Ernest Stutts, their staff and
all who helped with the Annual Thanksgiving Employee Luncheon.

In accordance with Section 4.05.3 of Human Resources Policy Manual, I am asking your
consideration of the following modifications to Road & Bridge Department Work Schedules.
To maintain efficiency of the department and its road crews, we will continue to work 10 hour days.
To provide greater service and availability to the Public — the department will operate and be
available to the public Monday — Friday.
Beginning, January 2, 2017 - Public Hours will he posted as:
7:30-5:00 Monday — Thursday
7:30 — 3:00 Friday
As the Fleet Shop personnel will depart this facility by 3:30 on Friday, there are security concerns
with remaining open past 3:00 with only 2 employees in the office who will be at our secluded
location until the road crew returns to the Yard closer to the end of the work day.

BRYAN BROADCASTING RADIO TOWER LEASE
REIMBURSEMENT AGREEMENT
This Radio Tower Lease Reimbursement Agreement ("Agreement') is between
BRAZOS COUNTY (hereinafter "County") and the BRAZOS VALLEY COUNCIL OF
GOVERNMENTS (hereinafter "BVCOG"). The purpose of the Agreement is to provide
for the reimbursement of lease fees and utilities fees incurred by BVCOG as a result of
their administration of the Tower Site License Agreement ('Tower License') between
BRYAN BROADCASTING CORPORATION, a Delaware corporation ("Licensor"), and
the BRAZOS VALLEY COUNCIL OF GOVERNMENTS ("Licensee') (Attached as
Attachment "A").
RATES FOR REIMBURSEMENT
The County agrees to reimburse the cost of the administration of the Tower License.
These cost include: Three Thousand Twenty Eight Dollars and Twenty Cents ($
3,028.20) per quarter ("License Fee') for the 2017 fiscal year in quarterly installments.
Additionally, the County agrees to pay BVCOG Three Hundred Sixty Dollars ($ 360.00)
per quarter ("Utilities Fee") for the 2017 fiscal year in quarterly installments.
RESPONSIBILITIES OF BVCOG
For and in consideration of the funding provided by the County, the BVCOG agrees to
administer the Tower License pursuant to all laws and regulations of the United States
and the State of Texas in the best interest of the County.
TERM
This Agreement is for one (1) year, from October 1, 2016 until September 30, 2017.
CANCELLATION
This Agreement may be cancelled by either of the parties hereto upon sixty (60) days
written notice.

AUDIT
BVCOG agrees that County, or its designated representative, shall have the right to
review and to copy any records and supporting documentation pertaining to the
performance of this Agreement. BVCOG agrees to maintain such records for possible
audit for a minimum of three (3) years after the termination date of this Agreement,
unless a longer period of records retention is stipulated. BVCOG agrees to allow the
auditor(s) access to such records during normal business hours and to allow interviews
of any employees who might reasonably have information related to such records.
BVCOG agrees that County, or its designated representative, shall further have the right
to review and to copy any records and supporting documentation for prior years in
which County provided funds to the BVCOG under prior Agreements. Any audit will be
conducted by County personnel or an independent third party, as determined by the
Brazos County Commissioners Court. If the Brazos County Commissioners Court
determines that the audit will be conducted by an independent third party, all costs and
expenses associated with said audit will be solely paid for by County.
During said audit, BVCOG shall require that a management letter be prepared by
auditor. The management letter shall identify issues not required to be disclosed in the
annual financial report but shall state any concerns and suggestions noted during the
audit. Annual financial statements (audited if available) are available to the Brazos
County upon request within six (6) months of completion.
INDEMNITY
Any monetary loss suffered by the County from mistake, fraud or other conditions can
be recovered from the BVCOG only to the extent of available insurance.
AMENDMENT
This Agreement shall be automatically amended by the amendments made to the Act
by the State Legislature. In all other respects, this Agreement may be modified,
amended, altered or extended only by a written amendment signed by the parties.
GOVERNING LAW
This Agreement shall be executed in and shall be governed by the laws of the State of
Texas. Venue shall be in Brazos County, Texas.

Each party hereto agrees to perform any further acts and to execute and deliver any
further documents, which may be necessary to carry out the provisions of this
Agreement.
FORCE MAJEURE
Neither party shall be liable for any failure or delay in performance under this
Agreement (other than for delay in the payment of money due and payable hereunder)
to the extent said failures or delays are proximately caused by causes beyond that
party's reasonable control and occurring without its fault or negligence, including,
without limitation, failure of suppliers, subcontractors, and software providers, phone
and internet service providers, carriers, or other parties to substantially meet its
performance obligations under this Agreement, provided that, as a condition to the claim
of nonliability, the party experiencing the difficulty shall give the other prompt written
notice, with full details following the occurrence of the cause relied upon and an
expected date when obligations under this Agreement will be resumed.
SEVERABILITY
If any clause or provision hereof is invalid, unenforceable or illegal under present or
future laws, or held to be invalid by a court of competent jurisdiction, the validity and
enforceability of the remaining provisions or portions hereof shall not be affected.
ENTIRE AGREEMENT
This Agreement contains the entire agreement between the parties. There are no
representations, agreements, arrangements or understandings, oral or written, between
or among the parties hereto, relating to the subject matter of the Agreement, which are
not fully expressed herein.
FISCAL FUNDING
Notwithstanding any provisions contained herein, the obligations of the County under
this Agreement are expressly contingent upon the availability of funding for each item or
obligation contained herein for the term of the Agreement and any extension thereto.
BVCOG, or any other person or entity directly or indirectly employed by the BVCOG or
any other person or entity to whom the BVCOG may be liable to, shall have no right of
action against the County in the event the county is unable to fulfill its obligations under
this Agreement as a result of lack of sufficient funding for any item or obligation from
any source utilized to fund this Agreement or failure to budget or authorize funding for
this Agreement during the current or future fiscal years. In the event that the County is
unable to fulfill its obligations under this Agreement as a result of lack of sufficient
funding, or if funds become unavailable, the County may, in its sole discretion, provide

funds from a separate source or may, in its sole discretion, terminate this Agreement by
written notice to the BVCOG at the earliest possible time under the circumstances.

COUNTY OF BRAZOS
WHEREAS, the Brazos County Commissioners Court desires to close, abandon, and vacate
a public road upon the following tracts:
Tract 1: all that portion of a tract of land being 21.23 acres of land; and Tract 2: all that
portion of a tract of land being 16.07 acres of land. Both tracts are situated in the James
Whitesides League, Abstract No. 57, Brazos County, Texas, and being parts of that certain
called 40.99 acre tract as described in deed from G.W. Lott to Grimes and Brazos Counties
of record in Volume 77, Page 481, Deed Records of Brazos County, Texas, said 21.23 and
16.07 acre tracts being more particularly described by metes and bounds in Exhibit A,
attached hereto and incorporated herein by reference;
WHEREAS, Texas Transportation Code

§251.001 defines "abandon" as to "relinquish the

county shall order that public roads be laid out, opened, discontinued, closed, abandoned, vacated
or altered." TEXAS TRANSPORTATION CODE §251.051 (a)(1); and
WHEREAS, Texas Transportation Code §251.051(b)(1) states "a unanimous vote of the
commissioners court is required to close, abandon, or vacate a public road." TEXAS
TRANSPORTATION CODE §251.051(b)(1); and
WHEREAS, no person that owns property that abuts the portion of the public road being
closed, abandoned and vacated has attempted to enjoin the entry or enforcement of this order.
TEXAS TRANSPORTATION CODE §251.058(a)(1); and
WHEREAS, the portion of the public road being closed, abandoned and vacated does not
provide the only ingress or egress to any property adjacent to it. TEXAS TRANSPORTATION CODE
§251.058(a)(2); and
WHEREAS, title to the portion of the public road being closed, abandoned and vacated to
the center line of the road will vest on the date this order is signed by the county judge in the owner
of the property that abuts the portion of the road being closed, abandoned and vacated, and a copy
of this order shall be fled in the deed records of the county and serves as the official instrument of
conveyance from the county to the owner of the abutting property. TEXAS TRANSPORTATION
CODE §251.058(b).
NOW, THEREFORE, IT IS ORDERED, upon proper notice and announcement as required
by law, and upon motion duly made and seconded, and passed by a unanimous vote, as indicated
by the signatures of the County Commissioners below, the public road upon the following tracts is
hereby closed, abandoned and vacated:
Tract 1: that certain tract of land being 21.23 acres of land in the James Whitesides League,
Abstract No. 57, Brazos County, Texas being part of that certain called 40.99 acre tract as

FURTHERMORE, BE IT ORDERED that this Order serves as the official instrument of

Your request for service to your site on Smetana Rd has been investigated.
Your cost to provide this service is $12,060.49. Included in this cost is the relocation of (4) poles (2) 30
pole will be replaced with (2) 35' pole, the exiting 35' pole will he replaced with a 40' pole and the
existing 40' pole will be replaced with 45' pole.. The internal wiring serving your structure (if applicable)
and the installation of the meter can, weather head, etc. is your responsibility.
Please note that this AIC amount is based on the line routing we discussed and is subject to change 90
days from the date of this letter.
BTU will furnish the electric meter and meter can to you at no cost. However, you or your electrician
must pick up the meter can from the BTU warehouse located at 611 Union Street, Bryan, Texas. Please
reference your assigned investigation number, 1609-R-32001, when obtaining the meter can from the
BTU warehouse.
Before your project can be scheduled construction, I need the following items returned to me:
AIC invoice and payment with investigation number referenced on the check,
BTU's Information Desk at 205 E. 28" Street is open between the hours of SAM and 5PM, Monday
through Friday excluding City holidays. They will be happy to assist you with accepting your AIC
payment and any other requested paperwork.
Please use your assigned investigation number, 1609-R-32001, to identify any correspondence you may
have with our office. A copy of the project job print is included. I appreciate the opportunity to answer

COMMISSIONERS COURTS: DELIBERATION REGARDING CONTRACT BEING
NEGOTIATED WITH THE COLLEGE STATION INDEPENDENT SCHOOL DISTRICT;
CLOSED MEETING.
The Commissioners Court ("Court") has proposed to deliberate the negotiation of a
contract related to establishment of a school resource officer program between Brazos
County and the College Station Independent School District in closed session. The
Court wishes to deliberate the business and financial issues of the proposed contract.
Texas Government Code §551.0725 provides that the Court may deliberate the
business and financial issues of this contract in closed session If, before conducting the
closed meeting:
(1) the Court votes unanimously that deliberation in an open meeting would have a
detrimental effect on the position of the Court In negotiations with a third person; and
(2) the attorney advising the commissioners court Issues a written determination that
deliberation in an open meeting would have a detrimental effect on the position of the
commissioners court in negotiations with a third person.
(b) Notwithstanding Section 551.103(a), Government Code, the commissioners court
must make a tape recording of the proceedings of a closed meeting to deliberate the
Information.
It is my determination that deliberation in an open meeting would have a detrimental
effect on the position of the Court in negotiations with a third person.
