Vol. Pg. 8 MINUTES OCTOBER 20, 2016 BRAZOS COUNTY COMMISSIONERS COURT WORKSHOP SESSION Call to Order The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 4:00 p.m. on Thursday, October 20, 2016 with the following members of the Court present: Duane Peters, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Sammy Catalena, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3, Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. Attached is a list of the citizens and officials in attendance. The County Judge called the meeting to order at 4:00 p.m. 2. Presentation and discussions regarding Municipal Utility Districts (MUDs) in general and MUD#1 in particular. Judge Peters started by saying that he is not a fan of Municipal Utility Districts (MUD) in general. He said his concerns have been appraisal caps as a result of MUDs and high school taxes. Steve Robinson with Allen Boone Humphries Robinson, LLP explained the infrastructure, finance and development of MUDs. Mr. Robinson said that MUDs provide water, sewer, drainage and road maintenance to areas that are unincorporated. These infrastructures are built to city standards and are also inspected by the Texas P9• Commission on Environmental Quality (TCEQ). He explained that MUDs are designed so that the new growth pays for its self. There is good quality infrastructure that will eventually become a part of the city. Permission must be obtained from TCEQ to sell bonds and voted on by the board members. Mr. Robinson stated that the construction contracts would be bid on and the developer takes all the risk not the tax payers. The developer will provide the funds for the infrastructure until the property can be paid for by the tax payers. The MUD will use bonds to pay the developer once the homes are on the tax rolls. He also said that they have entered into an agreement with the City of College Station to not only build the roads to city standards, but to also maintain the roads so that it does not become a burden to Brazos County. Commissioner Wassermann asked if the Brazos County would be providing law enforcement and fire protection. Mr. Robinson said that this MUD is in a fire district so the county would not provide fire protection, but the Brazos County Sheriff would provide law enforcement. Commissioner Catalena asked how many units would be in this MUD. Bill Mather with Texas World Speedway stated that the plan is for 2,000 plus lots and a possible school site. Also planned are 35 commercial acres and 15 urban acres. Mr. Mather discussed the need for affordable housing in this community and how the MUD can aid in that effort. He said according to today's market the homes built in the area would be in the $250,000 to $300,000 range. Commissioner Cauley asked if the County Engineer, Alan Munger has had the opportunity to review the information. Mr. Munger has reviewed it and has provided feedback even though the County has no authority in College Station ETJ and will be built to the city standards. Commissioner Mallard asked if the Sheriff has been notified he will be providing law enforcement. Mr. Mather stated that he has discussed this with Sheriff Kirk and he will provide law enforcement until the area is annexed by the city. Mr. Mather said he has also spoken to the fire district. Commissioner Wassermann asked if the lot sizes have diminished since the original plan. Mr. Mather said yes, the market demand is for more quality affordable housing and that is what they are planning to provide. A copy of the presentation is attached 3.
