PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at
the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional
Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a
Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation
under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular,
Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to,
and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the
Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and
appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of
the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or
group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity
of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly,
profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial,
ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses
from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without
notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge
and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing
policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act Section
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required
to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the
business of the Court.

REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South
Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, May
3, 2016 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;

The Court voted unanimously to adopt Proclamation 16-023 proclaiming the month of

May as Older Americans Month and urges every citizen to take time this month to
acknowledge older adults and the people who serve them as powerful and vital
individuals who greatly contribute to the community. A copy of the proclamation is
attached.

Doctor Michael Jones explained the Brazos County Health and Wellness clinic logo
contest. Dr. Jones said a prize of a one hundred and fifty dollar ($150.00) gift card
would be given to the winner of the contest.

Commissioner Irma Cauley. Passed. 5-0. Ayes: Catalena, Cauley, Mallard, Peters,

12. Request from the Information Technology Department to approve an amendment to the

Information Technology Director Eric Caldwell requested that this item be removed from
the agenda. Mr. Caldwell stated that some of the information needs to be modified and
re -submitted. On a motion by Commissioner Cauley and seconded by Judge Peters the
Court unanimously voted to remove this item.

Commissioner Catalena asked Purchasing Agent Charles Wendt about the additional
services.
Mr. Wendt explained that the original purchase order did not include all aspects of the
project such as roofing issues, removal of asbestos, and fiber re-routing. A copy of the
change order is attached.

14. Award of contract 2016-168 Copiers for FY2017.
The Court voted unanimously to accept the recommendation of the Purchasing Agent
and awarded Bid Contract 2016 -168 Copiers to Texas Document Solutions. A copy of
the bid tabulation and contract is attached.

The Court acknowledged receipt of the Investment Report for quarter ending March 31,

21. Sheriff's report on inmate population.
Sheriff Chris Kirk introduced former Sheriff Thomas Keiss who is the Law Enforcement
Field Representative for the Texas Association of Counties. Sheriff Kirk said that Mr.
Keiss was given a tour of the jail and would also be touring the Juvenile Detention
Center.
Sheriff Kirk stated there were 611 inmates in jail, 43 have electronic monitors and 14 are
pending for monitors.
22. Announcement of interest items and possible future agenda topics.
Commissioner Cauley announced she is traveling next week to Washington D. C. with
the Bryan College Station Chamber of Commerce to represent Brazos County.

23. Call for Citizen input and/or concerns
Commissioner Wassermann stated that there have been some meetings with
constituents that live on the edge of the College Station city limits. Mr. Wassermann said
that with the City of College Station allowing so much building and growth without the
consideration of the drainage system, the citizens in those areas are now experiencing
water drainage issues. He said that he and County Engineer Alan Munger have been
contacted by those citizen's with their concerns.
Dr. Jones asked the Court to be mindful as budget deadlines approach about increasing
staff at the Jail. Dr. Jones said the number of staff in the medical area has been the
same since 2002 even though the jail population has increased. Dr. Jones is requesting
one (1) full time night position and two (2) full time positions.

WHEREAS the Brazos Valley Council of Govemments Area Agency on Aging celebrates Older Americans
Month each May and the Administration on Aging has issued the theme `Blaze a Trail' which
encourages older Americans to stay engaged and active; and
WHEREAS Brazos County, the Brazos Valley Council of Governments, and the Brazos Valley Area Agency
on Aging are committed to helping all individuals maintain their health and independence in later
life; and
WHEREAS Brazos County recognizes that older adults are trailblazers - advocating for themselves, their
peers, and their communities - paving the way for future generations; and
WHEREAS we appreciate the value of inclusion and support in helping older adults successfully contribute to
and benefit from their communities; and
WHEREAS our community can provide opportunities to enrich the lives of individuals of all ages by:
• Promoting and engaging in activity, wellness, and social involvement.
• Emphasizing home and community based services that support independent living.
• Ensuring community members can benefit from the contributions and experience of older
adults.

General Summary:
j Manages and administrates elections in the Elections Administrator Office by performing the
following duties personally or through election clerks.

Dear Mr. Wendt:
As you are aware our original PO was modified to include the Voters Registration and Polling
Facility at the (old) Tax Office Building located at Washington Avenue and Wm. Joel Bryan Street
After I prepared two new Opinions of Probable Cost for the project the scope of work has grown
several times. I also provided a roof study and have added to the project the complete removal of
the existing roof and decking down to the bar joists and beams. I have detailed a new decking and
roofing system. The original roof could not be repaired and comply with building code.
We have now included the exterior building elevations. The elevations are being modified to
provide a new look as well as circulation to the parking across Washington Avenue. This requires
additional Architectural design time and detailing as well as bringing in a structural engineer and Civil
Engineering firm
After I hired a consulting civil engineering firm the scope of his services has also been modified.
The new scope of services also includes relocating the existing fiber lines below ground, to the
building, extending them south across the front of the property to Wm. Joel Bryan, boring under the
highway and extending the fiber underground to the courthouse.
Every time the project scope is modified it increases our project time and delays the issuance of
the bid documents. We are subject to the new consultants time line. We end up spending
additional time making changes to our completed work. I am not including any fees for the
duplication of work effort of time.
I am submitting my proposal for the additional architectural, structural engineering, civil
engineering, and mechanical, electrical and plumbing engineering design and scope of services for
the project as defined. The additional fee of $21,600.00 consists of the following:

All additional Engineering Fees would be invoiced at their typical, current, hourly rate without
mark-up. For example, an in depth evaluation of existing MEP systems may require additional
services not included in the MEP design fee included above.
All services would be itemized and invoiced monthly. Additional services if directed and
approved by the Owner would be provided at the same hourly rate or for an approved lump sum fee.
Changes to the design after approvals have been given will be considered as additional services.
Reimbursables
In addition, our standard reimbursable items e.g. shipping, printing, color renderings, models,
postage and long distance, would be invoiced without mark up.

ITEM: Consider and take action on acceptance of Green Branch Ridge Subdivision Phase 3 into
the Brazos Countv road maintenance system: the roadway (portion of Green Branch Loon) and
roadway drainage structures are in compliance with the Brazos County Subdivision and
Development Regulations. Site is located in Precinct 2.
SOURCE OF FUNDS: N/A
NOTES/EXCEPTIONS:
• Brazos County will assume no maintenance responsibility for drainage ways or easements
other than those running parallel to, or across the road/street right(s) of way. Private
drainage ways and easements shall be maintained by the individual property owners or the
Home Owners Association (HOA).
• Brazos County shall maintain the roadway, shoulders as needed and drainage facilities
which directly drain the roadway and associated ditches.
• The property owners/HOA shall be responsible for mowing and landscape maintenance of
all rights of ways and easements.
• County approved construction April 2013.

This report is made in accordance with provisions of Gov.Code 2256, The Public Funds Investment Act, which
requires quarterly reporting of Investment transactions to the Commissioners' Court,
The Brazos County Investment portfolio earned an average yield of 0.2633% on the quarterly average
balance of $2,354,305.76 invested with TexPool for the period ending 03/31/2016. Investment interest
deposited during the quarter was $1,752.21. Actual ending balance invested at 03/31/2016 was
$2,355,483.17.
The average rate of interest earned on the depository checking account balances for the quarter ending
03/31/2016 was 0.25% netting $72,700.55 for the quarter end on an average depository investable balance
of $117,170,373.49.
Total interest earned for quarter ending 03/31/2016 was $74,452.76.
Investment Strategy
The Brazos County Investment Strategy will remain unchanged, keeping investments very short -termed &
liquid. With the safety of principal as the foremost objective of the County's investment policy followed by
liquidity and yield - it seems prudent to continue keeping the majority of available funds in the Countys
depository where all funds are 110% collateralized. With the Brazos County depository contract Brazos
County earns a fixed rate of 0.25% on the funds held in the checking accounts for the term of the contract.

For diversification the County has an investment account with TexPool that provides the safety of an
overnight market.
Summary of Portfolio Changes
The deposit of interest is the only portfolio change to balances at this time and the Weighted Average
Maturity of investments remains at 1 day due to the liquidity of funds invested with TexPool and on deposit at
Branch Banking d Trust.
