Fyo,. �o� Pg. ©,5;� PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and /or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and /or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and /or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court- Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and /or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and /or any person in the Court's presence and /or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and /or 4, such other and /or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda property posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and /or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act 7551.042. INVOCATION Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the business of the Court. Commissioner Mallard stated that he did not understand why bonds were being considered for a private school. Executive Assistant Candy Gallego stated that Harmony School is a public school and a non profit entity. Legal Counsel Bill Ballard commented that the request for bonds has to be approved by the Commissioners Court in order to obtain the tax exempt status. Commissioner Cauley explained that the school needs the approval of a governmental body and it must be done this way according to the federal tax law. The County Judge commented that the Court is not funding anything by approving the bonds. Commissioner Mallard said that he is still not comfortable with it and voted nay. The County and Affiliated Hospital may be referred to individually in this Agreement as a Parry or collectively as the Parties. Article I. BACKGROUND AND PURPOSE Section 1.01 The Parties' responsibility to provide Indigent Care. (a) The County bears primary responsibility under Texas law to provide health care for indigent persons who reside in the county. The financial responsibility for such care principally is borne by the taxpayers of the County. (b) As a safety -net hospital, a core mission of Affiliated Hospital is to provide health care services to the needy residents of the community, including persons who are eligible for indigent care from the County. (c) Both the County and Affiliated Hospital have a statutory and/or fiduciary duty to pursue public and private sources of payment for care, including payment through the Texas Medicaid program. Section 1.02 Inadequacy ofstate funding and insurance for the needy. (a) The State of Texas historically has reimbursed healthcare services furnished through the Texas Medicaid program at levels that are inadequate to cover the costs of health care providers, including Affiliated Hospital. Additionally, the State has elected not to expand Medicaid eligibility under the Affordable Care Act. (b) Neither the County nor Affiliated Hospital dispute these actions and in fact recognize the important state policies that these decisions represent. However, both the County and Affiliated Hospital acknowledge that these actions have had and will continue to have several effects: Pg ��`y INDIGENT CARE AFFILIATION AGREEMENT (1) The number of county residents who are unable to pay for primary and emergency healthcare has risen and will continue to rise for the foreseeable fature; (2) A significant number of these residents is eligible for indigent care services from the County; (3) These residents typically obtain their primary healthcare through hospital emergency room services, which the Parties recognize is costly, inefficient, and does not promote good public health outcomes or effective primary or preventive healthcare; and (4) The lack of insurance and adequately funded state programs has increased demand on the County's indigent care program and the amount of uncompensated care for Affiliated Hospital. (5) These factors place the financial burden for indigent care largely on the county taxpayers, Affiliated Hospital, and the local community. Section 1.03 The Parties therefore agree that, without an effective source of revenue to support services to the indigent and needy of the County, the financial burden for indigent care in the County will continue to rise, strain the County's and local communities' budgets, and ultimately threaten the availability of quality healthcare in the County. Medicaid Supplemental Hospital Payment Programs help address these challenges by allowing our local safety - net hospitals to access Texas Waiver payments without increasing any taxes on local residents. (a) Medicaid is a joint state and federal program established under Title XIX of the Social Security Act that provides healthcare primarily to children, pregnant women, the elderly, and persons with disabilities. Federal law requires the State to bear a portion of the cost of care to persons who are eligible for Medicaid. (b) Texas Medicaid also administers programs to support public and private hospitals that furnish a significant amount of uncompensated healthcare services to people who do not have the ability to pay for their healthcare. Affiliated Hospital traditionally has participated in these supplemental payment programs. (c) The State traditionally has required that local governments use local funds to supply the state's share of the Medicaid supplemental hospital payments. (1) This practice has favored counties with a hospital district, which assess property taxes to fund district operations. (2) Because the County does not have a hospital district, hospitals like Affiliated Hospital are not assured of receiving their fair share of such funding. (d) The State also requires hospitals and local governments that wish to participate in these programs to certify certain facts that demonstrate the parties' compliance with state and federal laws. The certifications for Affiliated Hospital and the County are attached to this Agreement as Exhibit 1. Vol. v2 d pg C_ 511 INDIGENT CARE AFFILIATION AGREEMENT Section 1.04 Local Provider Participation Fund (a) The 84h Texas Legislatures, in recognition of the financial burden bome by the County and its taxpayers and the potential loss of available Medicaid funding to hospitals like Affiliated Hospital, anticipate legislation to authorize the County to establish a local provider participation fund (LPPF) to support the payment of Medicaid supplemental hospital payments to Affiliated Hospital and other eligible hospitals in the County. (b) The LPPF relies on mandatory payments by institutional healthcare providers like Affiliated Hospital and does not add to the burden of the County's property taxpayers. (c) The commissioners court of the County supports the County's implementation of the LPPF. Affiliated Hospital supports the County's decision to implement the LPPF. Section 1.05 Purpose and Intent of the Parties (a) The Parties desire to ensure that the indigent residents of the County continue to have access to and receive quality healthcare services. (b) The Parties recognize that it is in their mutual best interests to access greater amounts of federal funding to help cover the costs of services to indigent persons and people who are eligible for Medicaid. The Parties also agree that another benefit of such additional funding is that all residents of the County will continue to have access to quality healthcare. (c) The County and Affiliated Hospital recognize that implementation of the LPPF will help achieve these benefits for all residents of the County. ACCORDINGLY, in view of their common obligations and interests, and to fulfill their statutory, fiduciary, charitable obligations to the residents and communities of the County, the Parties agree as follows: Article II. INDIGENT CARE COLLABORATION Section 101 Improving Access to Healthcare for Indigent. The County and Affiliated Hospital will assess opportunities to improve access to healthcare for indigent persons residing in the community through participation in the Medicaid program including the Medicaid payments authorized by supplemental hospital payment programs, including the Texas Healthcare Transformation and Quality Improvement Program Section 1115 Waiver (the "Section 1115 Waiver "), the Disproportionate Share Hospital Program and their successors. Section 2.02 Implementation of the LPPF The County and Affiliated Hospital will also cooperate to ensure the prompt, efficient, and accurate implementation of the LPPF in the County in a manner consistent with state and federal law. 3 Vol. vZ� Pg•�S°. j INDIoENT CARE AFFILIATION AGREEMENT Section 2.03 Administration ofthe LPPF (a) The County and Affiliated Hospital agree that the County will retain discretion to determine: (1) The term and content of rules to govern the LPPF; and (2) The timing and amount of the mandatory payment to be paid by institutional healthcare providers, consistent with the requirements of state and federal law. (b) Except as provided in Section 2.04, the County also retains the discretion to apply the LPPF to uses authorized under the law, including conduct intergovernmental transfers of funds to the Texas Health and Human Services Commission Section 2.04 No Implementation of Affordable Care Act Article Ill. GENERAL PROVISIONS Section 3.01 Term and Termination. The term of this Agreement shall be one year from Effective Date and shall automatically continue thereafter for additional terms of one year unless the parties agree otherwise; provided, however, that this Agreement shall terminate immediately upon written notice by either the Governmental Entity or the Affiliated Hospital to the other party. Section 3.02 Notices. All notices required or permitted hereunder shall be in writing and shall be sufficiently given and deemed to have been received upon personal delivery, by overnight carrier, by email, or by United States mail, postage prepaid, registered or certified mail, addressed to the parties as follows: Governmental Entity: County of Brazos 300 E. 261" Street Bryan, Texas 77803 Affiliated Hospital: Scott & White Hospital — College Station 700 Scott & White Drive College Station, Texas 77845 Section 3.03 Relationship Between the Parties. The relationship between the County and the Affiliated Hospital is solely a contractual relationship between independent contractors. No party hereto is an agent or employee of any other party. Nothing in this Agreement shall prevent any affiliation or contracting by any party with any third party, with the exception that no party may contract or affiliate with other party to gain entitlement to Medicaid supplemental payments pursuant to this Agreement. The Governmental Entity has not received and has no agreement to receive any portion of any Medicaid payments made to Affiliated Hospital; i. The Governmental Entity has not entered into a contingent fee arrangement related to its participation in the Section 1115 Waiver program; j. The Governmental Entity is authorized to participate in the Section 1115 Waiver program pursuant to a vote of its governing body in a public meeting preceded by public notice published in accordance with its usual and customary practices or the Texas Open Meetings Act, as applicable; and k. The Affiliated Hospital agrees to retain qualified professionals to ensure health care is provided in compliance with state and federal charity care laws, anti -trust laws, and any other applicable laws, and the Medicare and Medicaid programs. 4.0. OBLIGATIONS OF THE GOVERNMENTAL ENTITY 4.1 Agreement to Cooperate with the Affiliated Hospital. The Governmental Entity agrees to work cooperatively with the Affiliated Hospital to improve access to health care for indigent persons. 4.2 No Condition on Medicaid Funding. The Governmental Entity agrees that it will not condition the amount to which it funds the non - federal share of Medicaid supplemental payments on a specified or required minimum amount of prospective indigent care. 4.3 Retrospective Evaluation of Services. The Governmental Entity may retrospectively evaluate the amount and impact of the Affiliated Hospital's indigent care delivery and can rely on such historical information in determining whether and to what degree it will provide an IGT in the future. 4.4 Documents Publicly Available. The Governmental Entity agrees to make publicly available any documentation utilized in connection with intergovernmental transfers of funds and any documentation executed by the Governmental Entity related to its participation in the Section 1115 Waiver, including this Agreement. 4.5 Use of Public Funds. To the extent the Governmental Entity decides to provide funding for Medicaid supplemental payments, the Governmental Entity agrees to use public funds for such funding. WHEREAS, College Station shall use their $24,531.00 from the JAG award for the purpose of supporting local initiatives, technical assistance, training, personnel, equipment, supplies, contractual support, information technology, research and evaluation activities that will improve or enhance law enforcement programs; and WHEREAS, College Station, Bryan and the County believe it to be in their best interest to reallocate the JAG funds as described above, NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants and conditions contained herein, promise and agree as follows: 1. College Station agrees to pay the County a total of $8,418.75 of JAG funds. 2. The County agrees to use the $8,418.75 for the purpose of supporting local initiatives, technical assistance, training, personnel, equipment, supplies, contractual support, information technology, research and evaluation activities that will improve or enhance law enforcement programs. 3. College Station agrees to pay Bryan a total of $23,175.25 of JAG funds. 4. Bryan agrees to use $23,175.25 for the purpose of supporting local initiatives, technical assistance, training, personnel, equipment, supplies, contractual support, information technology, research and evaluation activities that will improve or enhance law enforcement programs. 5. College Station agrees to retain a total of $24,531.00 of the JAG funds. 6. College Station agrees to use $24,531.00 for the purpose of supporting local initiatives, technical assistance, training, personnel, equipment, supplies, contractual support, information technology, research and evaluation activities that will improve or enhance law enforcement programs. 7. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement. 8. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. 9. No party shall have the right to direct or control the conduct of the other parties with respect to the duties and obligations of each party under the terms of this Agreement. 10. This Agreement shall be effective when signed by the last party who's signing makes the Agreement fully executed and will remain in full force and effect until September 30, 2016. 12. Indemnification Subject to the limitations as to damages and liability under the Texas Tort Claims Act, and without waiving its governmental immunity, each party to this Agreement agrees to hold harmless each other, its governing board, officers, agents and employees for any liability, loss, damages, claims or causes of action caused, or asserted to be caused, directly or indirectly by any other party to this Agreement, or any of its officers, agents or employees as a result of its performance under this Agreement. 13. Consent to Suit. Nothing in this Agreement will be construed as a waiver or relinquishment by any party of its right to claim such exemptions, privileges and immunities as may be provided by law. 14. Invalidity: If any provision of this Agreement shall be held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. The parties shall use their best efforts to replace the respective provision or provisions of this Agreement with legal terms and conditions approximating the original intent of the parties. 15. Written Notice. Unless otherwise specified, written notice shall be deemed to have been duly served if delivered in person or sent by certified mail to the business address as listed herein. Failure of any party, at any time, to enforce a provision of this Agreement, shall in no way constitute a waiver of that provision, nor in anyway affect the validity of this Agreement, any part hereof, or the right of either party thereafter to enforce each and every provision hereof. No term of this Agreement shall be deemed waived or breach excused unless the waiver shall be in writing and signed by the party claimed to have waived. Furthermore, any consent to or waiver of a breach will not constitute consent to or waiver of or excuse any other different or subsequent breach. 22. Agreement Read. The parties acknowledge that they have read, understand and intend to be bound by the terms and conditions of this Agreement. 23. Assignment. General Reauirements 1. Adequate drainage shall be maintained in ditches at all times. 2. Permittee will use best management practices ( "BMP ") (EPA and TCEQ both provide lists of examples of BMPs) to minimize erosion and sedimentation resulting from the proposed installation. 3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed representative. 4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior occupant. 5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, permittee will be liable to the County or other utilities running through the right of way. 6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is determined that inconvenience to the public exists, then the County Engineer will decide whether such project will be allowed or if an alternative exists so as not to inconvenience the public. A Safety Requirements I. Proper traffic control measures must be put in place prior to beginning work and remain in place during the duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control Devices ( TMUTCD). See Traffic Control Requirements below. 2. During construction, all safety regulations of the Texas Department of Transportation shall be observed. 3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may be necessary, in order to safely conduct the public through the project area. Company shall provide flagmen, signs, signals or devices necessary to provide complete safety to the public. 4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners. 5. No cable, conduit and /or pole line shall be laid, constructed, maintained and /or repaired so as to constitute a danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the County Engineer. C. Traffic Control Plan 1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided for the following: a. Any construction (i.e. pit, excavation, hole) left open overnight, requires specific nighttime traffic control measures pursuant to the TMUTCD; voi. o Pg. a �/ b. If construction is within ten (10) feet of the roadway; or c. Any work performed in the road right -of -way; 2. Plan must be attached to the permit and kept at the job site anytime work is being performed. 3. Plan must set forth the time of completion for the job. D. Desien Standards 1. All overhead installations shall conform to clearance standards of the Texas Department of Transportation and the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section 181.045. 2. All pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure safety to the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate location at the company's expense. Exceptions may be approved by the County Engineer. 3. All underground installations shall (these are minimum depths — utility may place deeper): a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement; b. be at least thirty-six (36) inches below ditch flow line when installation is within the area measured from top of bank to top of bank; c. be at least forty-eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below; d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of less than 60 feet. 4. Water Lines: All water lines must be a minimum 36-inches below the ditch flow line and cased. Waterlines shall be cased if crossing under the roadway. 5. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated locations based upon the type of utility. The locations shall be as follows: (measured from back of right -of -way). Power — 0 to 2 feet, nominally 1' Phone -2 to 4 feet, nominally 3' Gas — 4 to 6 feet, nominally 5' Cable — 6 to 8 feet, nominally 7' 6. Utilities with less than 60 feet right -of -way in all new developments shall install the utility in a similar manner as referenced in No. 3 above; however, the County Engineer or its designated representative will provide final approval of each utility location. 7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if left open over night or unattended. 8. Crossings under a county road shall: a. be bored or jacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT, b. be pressure grouted for the full length of the crossing if the annular space between pipe and casing and soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting operations and have the opportunity to have an inspector on site to observe pressure grouting operations; Vol. 0 pg._ �� c. TxDOT Standard Specification Item 476 shall be followed for all boring, jacking, tunneling and joints. Bore Pits: a. no pits shall remain open longer than 2 days; b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above. c. pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval from the County Engineer or his representative; d. when pits are to remain open for more than 8 hours, due diligence will be used in protecting the spoil pile to prevent drainage problems; e. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity; f. based upon soil conditions, the County Engineer or his representative may require pits be placed further from the edge of road. 10. Any installation within ten (10) feet of edge of pavement shall meet the following: a. location must be approved by the County Engineer or his representative b. backfilled with cement stabilized material. c. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity. d. all excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed during a rainy period or at other times where excess water cannot be prevented from entering the trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material as soon as weather permits; e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the County Engineer or his representatives. f. no side or lateral tamping to fill voids under the base and pavement materials is allowed. 11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event Company damages the slope, shoulder or any other portion of the right -of -way, Company will be responsible for repairing the damage and replacing the right -of -way to the condition it was prior to commencing construction. 12. Operation of construction and/or maintenance equipment on the traveled surface of any improved County road will not be permitted, except in an instance whereby the laying, construction, maintenance and/or repair of cables, conduits and/or pole lines cannot be accomplished by any other method and in this event all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD requirements. 13. In the event said construction and/or maintenance and/or repair requires Company to remove, cut or jeopardize any section of the road (asphalt, cement, road base, etc.), Company will be required to provide a performance bond or letter of credit securing necessary repairs. Said bond amount will be determined by the County Engineer. 14. The applicant shall submit a letter of "No Objection" from the Army Corps of Engineers for all designated wetlands and environmentally sensitive lands. E. Emereencv work 1. In the event Company is required to perform emergency services, that requires excavation in a County Right of Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company Vol. ,2cZ 0 —2 3 shall notify County Engineer within 24 hours of beginning construction/repairs. This will allow the County Engineer's Office an opportunity to inspect the site to ensure the integrity of the County Right of Way and traffic safety controls used. F. Repairs to ezistine facilities 1. Maintenance and/or repair to existing cables, conduits, and/or pole lines which require disturbance of the soil, shall not be performed until plans describing such maintenance and/or repair have been approved by the County Engineer or its designated representative and a permit has been obtained. G. Relocation of utilities 1. When and if the County Engineer determines that it is necessary for the construction, repair, improvement, alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables or other facilities and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated thereon, as required by the County Engineer within a reasonable time as determined by the County Engineer and Utility Company, and at the expense of the Utility Company. H. H12h Pressure Pipelines 1. All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to controlled access or non - controlled access installations, should contain the following additional information in the description of the permit. - diameter -wall thickness - material specification - minimum yield strength - maximum operation pressure of the pipeline 2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied for both the carrier pipe and the casing. 3. Assurance must also be given that the installation material and design meet the minimum Federal Safety Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed by an authorized representative of the company. 4. General Requirements 1. Adequate drainage shall be maintained in ditches at all times. 2. Permittee will use best management practices (`BMP ") (EPA and TCEQ both provide lists of examples of BMPs) to minimize erosion and sedimentation resulting from the proposed installation. 3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed representative. 4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior occupant. 5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, permittee will be liable to the County or other utilities running through the right of way. 6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is determined that inconvenience to the public exists, then the County Engineer will decide whether such project will be allowed or if an alternative exists so as not to inconvenience the public. A Safetp Requirements 1. Proper traffic control measures must be put in place prior to beginning work and remain in place during the duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control Devices ( TMUTCD). See Traffic Control Requirements below. 2. During construction, all safety regulations of the Texas Department of Transportation shall be observed. 3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may be necessary, in order to safely conduct the public through the project area. Company shall provide flagmen, signs, signals or devices necessary to provide complete safety to the public. 4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners. 5. No cable, conduit and/or pole line shall be laid, constructed, maintained and/or repaired so as to constitute a danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the County Engineer. C. Traffic Control Plan 1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided for the following: a. Any construction (i.e. pit, excavation, hole) left open overnight, requires specific nighttime traffic control measures pursuant to the TMUTCD; ' Vol. b _ 71Z b. If construction is within ten (10) feet of the roadway; or c. Any work performed in the road right -of -way; 2. Plan must be attached to the permit and kept at the job site anytime work is being performed. 3. Plan must set forth the time of completion for the job. D. Design Standards 1. All overhead installations shall conform to clearance standards of the Texas Department of Transportation and the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section 181.045. 2. All pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure safety to the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate location at the company's expense. Exceptions may be approved by the County Engineer. 3. All underground installations shall (these are minimum depths — utility may place deeper): a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement; b. be at least thirty-six (36) inches below ditch flow line when installation is within the area measured from top of bank to top of bank; c. be at least forty -eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below; d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of less than 60 feet. 4. Water Lines: All water lines must be a minimum 36- inches below the ditch flow line and cased. Waterlines shall be cased if crossing under the roadway. 5. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated locations based upon the type of utility. The locations shall be as follows: (measured from back of right -of -way). Power — 0 to 2 feet, nominally 1' Phone — 2 to 4 feet, nominally 3' Gas — 4 to 6 feet, nominally 5' Cable — 6 to 8 feet, nominally 7' 6. Utilities with less than 60 feet right -of -way in all new developments shall install the utility in a similar manner as referenced in No. 3 above; however, the County Engineer or its designated representative will provide final approval of each utility location. 7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if left open over night or unattended. 8. Crossings under a county road shall: a. be bored or jacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT; b. be pressure grouted for the full length of the crossing if the annular space between pipe and casing and soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting operations and have the opportunity to have an inspector on site to observe pressure grouting operations; c. TxDOT Standard Specification Item 476 shall be followed for all boring, jacking, tunneling and joints. 9. Bore Pits: a. no pits shall remain open longer than 2 days; b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above. c. pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval from the County Engineer or his representative; d. when pits are to remain open for more than 8 hours, due diligence will be used in protecting the spoil pile to prevent drainage problems; e. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity; L based upon soil conditions, the County Engineer or his representative may require pits be placed further from the edge of road. 10. Any installation within ten (10) feet of edge of pavement shall meet the following: a. location must be approved by the County Engineer or his representative b. backfilled with cement stabilized material. c. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity. d. all excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed during a rainy period or at other times where excess water cannot be prevented from entering the trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material as soon as weather permits; e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the County Engineer or his representatives. f. no side or lateral tamping to fill voids under the base and pavement materials is allowed. 11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event Company damages the slope, shoulder or any other portion of the right -of -way, Company will be responsible for repairing the damage and replacing the right -of -way to the condition it was prior to commencing construction. 12. Operation of construction and /or maintenance equipment on the traveled surface of any improved County road will not be permitted, except in an instance whereby the laying, construction, maintenance and/or repair of cables, conduits and/or pole lines cannot be accomplished by any other method and in this event all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD requirements. 13. In the event said construction and/or maintenance and /or repair requires Company to remove, cut or jeopardize any section of the road (asphalt, cement, road base, etc.), Company will be required to provide a performance bond or letter of credit securing necessary repairs. Said bond amount will be determined by the County Engineer. 14. The applicant shall submit a letter of "No Objection" from the Army Corps of Engineers for all designated wetlands and environmentally sensitive lands. E. Emereeucv work 1. In the event Company is required to perform emergency services, that requires excavation in a County Right of Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company shall notify County Engineer within 24 hours of beginning construction/repairs. This will allow the County Engineer's Office an opportunity to inspect the site to ensure the integrity of the County Right of Way and traffic safety controls used. F. Repairs to existine facilities 1. Maintenance and/or repair to existing cables, conduits, and/or pole lines which require disturbance of the soil, shall not be performed until plans describing such maintenance and/or repair have been approved by the County Engineer or its designated representative and a permit has been obtained. G. Relocation of utilities I. When and if the County Engineer determines that it is necessary for the construction, repair, improvement, alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables or other facilities and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated thereon, as required by the County Engineer within a reasonable time as determined by the County Engineer and Utility Company, and at the expense of the Utility Company. H. Hich Pressure Pipelines 1. All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to controlled access or non - controlled access installations, should contain the following additional information in the description of the permit. - diameter -wall thickness - material specification - minimum yield strength - maximum operation pressure of the pipeline 2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied for both the carrier pipe and the casing. 3. Assurance must also be given that the installation material and design meet the minimum Federal Safety Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed by an authorized representative of the company. 4. BACKGROUND Unclaimed or abandoned property that is seized by a peace officer of the state and not being held for evidence, ordered destroyed or returned to the person entitled to receive it, and which remains unclaimed for thirty (30) days, may be delivered for disposition to the purchasing agent. The Code of Criminal Procedure provides the disposition procedure for unclaimed or abandoned property according to the value and knowledge of ownership. PROCEDURE A. Property with Known Owner Property that has been categorized as abandoned /unclaimed by a department must have due diligence performed. A letter should be mailed by the department to the owner's last known address by certified mail prior to any property being delivered to the purchasing department. The notice must provide general description of the property, the name of the owner, the name and address of the agency holding the property, and a statement that if the property remains unclaimed, within ninety (90) days it will be disposed of and proceeds will be deposited with the county treasurer. Evidence 1. If a response is received, the department is responsible for making arrangements for the owner or the owner's designee to pick up the property. 2. Upon no response from owner after ninety (90) days, the officer /agency may request a judgment from the court. Property should be awarded to Brazos County specifying whether the property should be disposed of by the purchasing department through auction/surplus or destroyed by the law enforcement agency to which it was awarded. Vol. �` Personal Property Seized by any Peace Officer of the State of Texas 1. If a response is received, the department is responsible for making arrangements for the owner or the owner's designee to pick up the property. 2. Upon no response from owner after ninety (90) days, the officer /agency should complete a transfer sheet with ALL required information, along with any backup documentation and a copy of the ninety (90) day letter. The transfer sheet will require the owner's name of the abandoned property, the description of the abandoned property and the fair market value of the property being turned over to the purchasing department. a. Property with a fair market value over $500 will be itemized in an advertisement that the purchasing department puts in our local newspaper to include property description, and the opening date of the auction in which the property will be sold. b. Property with a fair market value less than $500 does not require publication in our local newspaper prior to being sold in auction. Property Seized as the result of a Class C Arrest 1. If property, other than money, is seized by a peace officer at the time the owner of the property is arrested for an offense punishable as a Class C misdemeanor, the law enforcement agency may provide notice to the owner at the time the owner is taken into or released from custody. On receiving the notice, the owner must sign the notice and attach a thumbprint to the notice. The notice must include: c. a description of the property being held; d. the address where the property is being held; and e. a statement that if the owner does not claim the property before the 31st day after the date the owner is released from custody, the property will be disposed of and the proceeds of the property, after deducting the reasonable expense of keeping and disposing of the property, will be placed in the treasury of the municipality or county providing the notice. f. If the property for which notice is provided is not claimed by the owner before the 31st day after the date the owner is released from custody, the law enforcement agency holding the property shall deliver the property for disposition to the purchasing agent. The purchasing agent may sell or donate the property without mailing or publishing any additional notice. BACKGROUND The local government code permits the commissioners court to accept donated property or donate property on behalf of the County. All departments must submit a request for commissioners court approval prior to accepting donated property or donating property to another organization. PROCEDURE A. Acceptance of Donated or Awarded Property County departments must request approval by Commissioners Court for the acceptance of donated property. The department must complete the donation form found on BCWeb with all required information which must include: 1. Date asset would be placed into service 2. Item description (including make /model /SNNIN, etc) 3. Estimated value of item being donated County departments must be awarded property by order of court judgment and based on usefulness must decide to retain the property and put into use. The department must request approval by Commissioners Court to accept this awarded property. The department must complete the donation form found on BCWeb, with all required information as stated above, but must also include a copy of the court judgment. All judgments for vehicles must be awarded to `BRAZOS COUNTY" in order for the purchasing department to be able to title the vehicle. Property donated by County Inmates at release /transfer of facilities must be authorized by the inmate with execution of any /all of the following: 1) 30 day letter 2) TDCJ Inmate Fvol--� 2-,n _ pg. `9z 0� )1� (S Property letter 3) TDCJ Property Disposition. The department must request approval by Commissioners Court to accept this donated inmate property. The department must complete the donation form found on BCWeb, with all required information as stated above, but must also include a copy of all authorizing documentation for the inmate. All clothing or shoes, depending on condition will be donated to a non-profit or disposed of by the department. All cell phones will be destroyed due to the passibility of containing sensitive personal information. Requests for acceptance of property by the County must be reviewed by the Auditor, Budget and Purchasing departments for accounting, budgetary and asset accuracy. Upon approval by all departments, the request must be submitted for commissioner's court approval through the agenda software. Items requesting approval from commissioner's court must be submitted no later than the 5pm the Wednesday prior to the Tuesday meeting to ensure adequate time for review by the approving group. a. Auditor The auditor will review the fequest for correctness of the accounting. This will include both the expenditure and revenue account that will be affected by the acceptance of this property. The expense of the approved property will be recorded in the county financial system by journal entry. This should coincide with the budget amendment that will be submitted for approval by the budget office. The journal entry will record the increase in the expenditure and revenue accounts as submitted. The donation form requires an estimated value be given with the exception of donated inmate property. This should be the fair market value of the item being received and the value at which the item will be placed on the County's financial records. 1. Items valued under $500 will not be tagged under the fixed asset policy. 2. Items valued between $500 - $4999 will be considered minor property and given a County asset number and tracked on the requesting department's asset report. 3. Items valued over $5000 will be considered capital property and given a county asset number and tracked on the requesting department's asset report. b. Budget The budget office will prepare on behalf of the requesting department a budget amendment based on the value of the item being received to be approved by commissioner's court the meeting following the acceptance of the donated property. Purchasing The purchasing department will review the request to ensure the property is in compliance with the statutes applicable to accepting the donated property. They will also verify the asset level of the property based on the value provided. The purchasing department will reconcile assets monthly and as applicable, will assign the donated property an asset number and add to the county asset system once the property is expensed. It will be the department's responsibility to ensure that all identifying information has been provided to purchasing to be added to the asset system. The purchasing department will accept donated inmate property for surplus /auction/disposal. B. Donation of County property to outside organizations County departments must request approval by Commissioners Court to donate county property to an outside organization. The department must complete the donation form found on BCWeb with all required information which must include: 1. Date asset would be placed into service 2. Item description (including makehnodel /SNNIN, etc) 3.
