PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items andlor attend and make comment
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in
attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and
decorum in speaking to, and /or addressing the Court; in participating in public discussions before the Court, and in all actions in
the presence of the Court. Those members of the public who are inappropriately attired andlor who do not conduct themselves
in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and /or
continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual
or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or
integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence
and/or racial, ethnic or gentler slurs or epithets will not be tolerated. Violation of these rules may result in the following
sanctions:
1. cancellation of a speakers time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and /or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only If a matter has been listed on an agenda property posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court However,
responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter
without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County
Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite
existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act?
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required
to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the
business of the Court.
The Commissioners Courtroom of the County Administration Building, 200 South Texas Ave., Suite 106, Bryan, TX 77803 is
wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive services must be made two

A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas
Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, March 10,
2015 with the following members of the Court present:
Duane Peters, County Judge, Presiding,
Lloyd Wassermann, Commissioner of Precinct 1, Absent;

3. Resolution 15 -006 in Support of the Proposal by Texas A &M University to Host a 2016
Presidential or Vice Presidential Debate.

Representatives from Texas A &M University thanked the Court for their support of the
resolution. It was stated that a Presidential or Vice Presidential debate would strengthen the
community as well as have an economic impact. A copy of the resolution is attached.

The County Judge announced that the deadline to submit the resolution for legislation is
March 13, 2015. Commissioner Cauley requested a workshop be scheduled in the future to
discuss details in the creation of this court. A copy of the resolution is attached.

At 11:13 a.m. the County Judge announced the meeting open to the public. The following
action took place:
On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted
unanimously to approve an economic agreement between Brazos County and Fuji Film
Diosynth Biotechnologies for a 7 year cash incentive. A copy of the agreement is attached.

Whereas Texas A &M University and the twin cities of Bryan/College Station have enjoyed a
mutually beneficial relationship for generations; both cities have grown exponentially as Texas
A &M has grown and each continues to develop and thrive as diverse, multi - ethnic environments,
fostering a friendly and inclusive hometown for Aggie students, faculty and staff that far exceeds
the average college town; and
Whereas Texas A &M University engages with the state, region and community in a multitude of
ways, through service learning projects, such as the largest one -day, student -run service project
in the nation, The Big Event, as well as countless other service organizations; and through
educational enrichment programs and summer camps from teacher education to STEM to 4 -H;
and entertainment not just for Aggie students but for the entire community, through high - quality
direct- from - Broadway shows to the many notable events and distinguished speakers who have

addressed the university -- from former presidents to renowned scientists to civil rights leaders
and numerous others; and
Whereas Texas A &M University has also long recognized the demands of a global society and
the necessity for global reach, maintaining a center in Costa Rica, facilities in Italy and Mexico
and branch campuses in Galveston and Doha, Qatar (fully funded by Qatar Foundation) as well
as nurturing a long history of international cooperation and collaboration to facilitate study
abroad, global competence, international research partnerships such as the collaborative research
grant program between Texas A &M and Mexico's CONACYT, and membership in such
initiatives as The Confucius Institute to enhance Chinese language and culture at the university;
all to enhance educational, cultural and research opportunities around the world and prepare
students to live and compete in a global society; and
Whereas Texas A &M University and other members of the Texas A &M University System
based locally continue to increase their economic impact on the area; in 2013 the economic
impact was $4.42 billion, an increase of almost $113 million from 2012 levels (based on the use
of a standard 2.5 multiplier effect representing the number of times such generated dollars are
typically spent and re -spent in the local economy); and
Whereas Texas A &M University and the cities of Bryan/College Station and the Brazos Valley
have partnered to mutual advantage on projects such as the agreement between the city of
College Station regarding the expansion of Kyle Field; expenditures by visitors attending
sporting events and other campus activities totaled an estimated $385 million, almost $8 million
more than for the previous year. The estimated number of visitors totaled more than 1.3 million,
with the average visitor from out -of -town staying 2.5 days in the local community.
Therefore, be it RESOLVED that the cities of Bryan and College Station, Brazos County and
the region known as the Brazos Valley, as well as the Bryan Independent School District and the
College Station Independent School District join and fully support Texas A &M University in its
bid to host a Presidential or Vice Presidential Debate.

Access Security Requirements for Reseller End -Users
for FCRA and GLB SA Data
The following information security controls are required to reduce unauthorized access to consumer.
information. It is your (company provided access to Experian systems or data through DCS Information
Systems, referred to as the "Company") responsibility to implement these controls. If you do not understand
these requirements or need assistance, it is your responsibility to get an outside service provider to assist you.
DCS Information Systems reserves the right to make changes to these Access Security Requirements without
prior notification. The information provided herewith provides minimum baselines for information security.
In accessing DCS Information System's services, Company agrees to follow these Experian security
requirements. These requirements are applicable to all systems and devices used to access, transmit, process,
or store Experian data:
1. Implement Strong Access Control Measures
1.1 All credentials such as User names /identifiers /account numbers (user IDs) and user passwords
must be kept confidential and must not be disclosed to an unauthorized party. No one from
DCS Information Systems will ever contact you and request your credentials.
1.2 If using third party or proprietary system to access DCS Information System's systems, ensure
that the access must be preceded by authenticating users to the application and /or system
(e.g. application based authentication, Active Directory, etc.) utilized for accessing DCS
Information Systems data /systems.
1.3 If the third parry or third party software or proprietary system or software, used to access DCS
Information Systems data /systems, is replaced or no longer in use, the passwords should be
changed immediately.
1.4 Create a unique user ID for each user to enable individual authentication and accountability
for access to DCS Information System's systems infrastructure. Each user of the system access
software must also have a unique logon password.
1.5 User IDs and passwords shall only be assigned to authorized individuals based on least
privilege necessary to perform Job responsibilities.
1.6 User IDs and passwords must not be shared, posted, or otherwise divulged in any manner.
1.7 Develop strong passwords that are:
• .Not easily guessable.(i.e. your name or company name, repeating numbers and letters
or consecutive numbers and letters)
• Contain a minimum of eight (8) alphabetic and numeric characters for standard user,
accounts
• For Interactive sessions (i.e. non system -to- system) ensure that passwords /passwords
are changed periodically (every 90 days is recommended)
1.8 Passwords (e.g. user /account password) must be changed immediately when:
• Any system access software is replaced by another system access software or is no
longer used
• The hardware on which the software resides is upgraded, changed or disposed
• Any suspicion of password being disclosed to an unauthorized party (see section 4.3
for reporting requirements)
1.9 Ensure that passwords are not transmitted, displayed or stored in clear text; protect all end
user (e.g. internal and external) passwords using, for example, encryption or a cryptographic

hashing algorithm also known as "one -way' encryption. When using encryption, ensure that
strong encryption algorithm are utilized (e.g. AES 256 or above).
1.10 Implement password protected screensavers with a maximum fifteen (15) minute timeout to
protect unattended workstations. Systems should be manually locked before being left
unattended.
1.11 Active logins to credit information systems must be configured with a 30 minute inactive
session timeout.
1.12 Ensure that personnel who are authorized access to credit information have a business need
to access such information and understand these requirements to access such information are
only for the permissible purposes listed in the Permissible Purpose Information section of the
membership application.
1.13 Company must NOT install Peer -to -Peer file sharing software on systems used to access,
transmit or store Experian data.
1.14 Ensure that Company employees do not access their own credit reports or those reports of any
family member(s) or friend(s) unless it is in connection with a credit transaction or for another
—-permissible purpose. - -I.---- - - — __
1.15 Implement a process to terminate access rights immediately for users who access Experian
credit information when those users are terminated or when they have a change In their job
tasks and no longer require access to that credit information.
1.16 Implement a process to perform periodic user account reviews to validate whether access is
needed as well as the privileges assigned.
1.17 Implement a process to periodically review user activities and account usage, ensure the user
activities are consistent with the individual job responsibility, business need, and in line with
contractual obligations.
1.18 Implement physical security controls to prevent unauthorized entry to Company's facility and
access to systems used to obtain credit information. Ensure that access is controlled with
badge readers, other systems, or devices including authorized lock and key.
2. Maintain a Vulnerability Management Program
2.1 Keep operating system(s), firewalls, routers, servers, personal computers (laptops and
desktops) and all other systems current with appropriate system patches and updates.
2.2 Configure infrastructure such as frewalls, routers, servers, tablets, smart phones, personal
computers (laptops and desktops), and similar components to Industry best security practices,
including disabling unnecessary services or features, and removing or changing default
passwords, IDs and sample files /programs, and enabling the most secure configuration
features to avoid unnecessary risks.
2.3 Implement and follow current best security practices for computer virus detection scanning
services and procedures:
• Use, implement and maintain a current, commercially available anti -virus software on
all systems, if applicable anti -virus technology exists. Anti -virus software deployed
must be capable to detect, remove, and protect against all known types malicious
software such as viruses, worms, spyware, adware, Trojans, and root -kits.
• Ensure that all anti -virus software is current, actively running, and generating audit
logs; ensure that anti -virus software is enabled for automatic updates and performs
scans on a regular basis.

• If you suspect an actual or potential virus infecting a system, Immediately cease
accessing the system and do not resume the inquiry process until the virus has been
eliminated.
3. Protect Data
3.1 Develop and follow procedures to ensure that data is protected throughout its entire
information lifecycle (from creation, transformation, use, storage and secure destruction)
regardless of the media used to store the data (i.e., tape, disk, paper, etc.).
3.2 Experian data is classified Confidential and must be secured to in accordance with the
requirements mentioned in this document at a minimum.
3.3 Procedures for transmission, disclosure, storage, destruction and any other information
modalities or media should address all aspects of the Hecycle of the information.
3.4 Encrypt all Experian data and information when stored electronically on any system including
but not limited to laptops, tablets, personal computers, servers, databases using strong
-- encryption such AES 256 or above: —
3.5 Experian data must not be stored locally on smart tablets and smart phones such as iPads,
!Phones, Android based devices, etc.
3.6 When using smart tablets or smart phones to access Experian data, ensure that such devices
are protected via device pass -code.
3.7 Applications utilized to access Experian data via smart tablets or smart phones must protect
data while in transmission such as SSL protection and /or use of VPN, etc.
3.8 Only open email attachments and links from trusted sources and after verifying legitimacy.
3.9 When no longer in use, ensure that hard -copy materials containing Experian data are crosscut
shredded, incinerated, or pulped such that there Is reasonable assurance the hard -copy
materials cannot be reconstructed.
3.10 When no longer in use, electronic media containing Experian data is rendered unrecoverable
via a secure wipe program in accordance with industry- accepted standards for secure deletion,
or otherwise physically destroying the media (for example, degaussing).
4. Maintain an Information Security Policy
4.1 Develop and follow a security plan to protect the confidentiality and Integrity of personal
consumer information as required under the GLB Safeguards Rule.
4.2 Suitable to complexity and size of the organization, establish and publish information security
and acceptable user policies identifying user responsibilities and addressing requirements in
line with this document and applicable laws and regulations.
4.3 Establish processes and procedures for responding to security violations, unusual or suspicious
events and similar incidents to limit damage or unauthorized access to information assets and
to permit identification and prosecution of violators. If you believe Experian data may have
been compromised, Immediately notify DCS Information Systems within twenty-four (24) hours
or per agreed contractual notification timeline (see also Section 8).
4.4 The FACIA Disposal Rules requires that Company implement appropriate measures to dispose
of any sensitive information related to consumer credit reports and records that will protect
against unauthorized access or use of that information.
4.5 Implement and maintain ongoing mandatory security training and awareness sessions for all
staff to underscore the importance of security in the organization.
4.6 When using third party service providers (e.g. application service providers) to access,
transmit, store or process Experian data, ensure that service provider is compliant with the

Experian Independent Third Party Assessment (E13PA) program, and registered in Experian's
list of compliant service providers. If the service provider is in the process of becoming
compliant, It Is Company's responsibility to ensure the service provider is engaged with
Experian and an exception is granted in writing. Approved certifications in lieu of E13PA can be
found in the Glossary section.
5. Build and Maintain a Secure Network
5.1 Protect Internet connections with dedicated, industry- recognized firewalls that are configured
and managed using industry best security practices.
5.2 Internal private Internet Protocol (IP) addresses must not be publicly accessible or natively
routed to the Internet. Network address translation (NAT) technology should be used.
5.3 Administrative access to firewalls and servers must be performed through a secure internal
wired connection only.
5.4 Any stand -alone computers that directly access the Internet must have a desktop firewall
— deployed that is installed-and-configured to block unnecessary/unused- parts; services; and
network traffic.
5.5 Change vendor defaults including but not limited to passwords, encryption keys, SNMP strings,
and any other vendor defaults.
5.6 For wireless networks connected to or used for accessing or transmission of Experian data,
ensure that networks are configured and firmware on wireless devices updated to support
strong encryption (for example, IEEE 802.11i) for authentication and transmission over
wireless networks.
5.7 When using service providers (e.g. software providers) to access DCS Information System's
systems, access to third party tools /services must require multi -factor authentication.
6. Regularly Monitor and Test Networks
6.1 Perform regular tests on information systems (port scanning, virus scanning, internal /external
vulnerability scanning). Ensure that issues identified via testing are remediated according to
the issue severity (e.g. fix critical issues immediately, high severity in 15 days, etc.)
6.2 Ensure that audit trails are enabled and active for systems and applications used to access,
store, process, or transmit Experian data; establish a process for linking all access to such
systems and applications. Ensure that security policies and procedures are in place to review
security logs on daily or weekly basis and thatfollow -up to exceptions is required.
6.3 Use current best practices to protect telecommunications systems and any computer system
or network device(s) used to provide Services hereunder to access DCS Information System's
systems and networks. These controls should be selected and implemented to reduce the risk
of infiltration, hacking, access penetration or exposure to an unauthorized third party by:
• protecting against Intrusions;
• securing the computer systems and network devices;
• and protecting against intrusions of operating systems or software.
7. Mobile and Cloud Technology
7.1 Storing Experian data on mobile devices is prohibited. Any exceptions must be obtained from
Experian in writing; additional security requirements will apply.

7.2 Mobile applications development must follow industry known secure software development
standard practices such as OWASP and OWASP Mobile Security Project adhering to common
controls and addressing top risks.
7.3 Mobile applications development processes must follow secure software assessment
methodology which includes appropriate application security testing (for example: static,
dynamic analysis, penetration testing) and ensuring vulnerabilities are remediated.
7.4 Mobility solution server /system should be hardened in accordance with Industry and vendor
best practices such as Center for Internet Security (CIS) benchmarks, NIS, NSA, DISA and /or
other.
7.5 Mobile applications and data shall be hosted on devices through a secure container separate
from any personal applications and data. See details below. Under no circumstances is
Experian data to be exchanged between secured and non - secured applications on the mobile
device.
7.6 In case of non - consumer access, that is, commercial /business -to- business (1328) users
accessing Experian data via mobile applications (internally developed or using a third party
application); ensure that multi - factor authentication and /or-adaptive /risk = Based -
authentication mechanisms are utilized to authenticate users to application.
7.7 When using cloud providers to access, transmit, store, or process Experian data ensure that:
• Appropriate due diligence is conducted to maintain compliance with applicable laws
and regulations and contractual obligations
Cloud providers must have gone through independent audits and are compliant with
one or more of the following standards, or a current equivalent as
approved /recognized by Experian:
o ISO 27001
o PCI DSS
o E13PA
o SSAE16- SOC2orSOO
• FISMA
• CAI / CCM assessment
S. General
8.1 DCS Information Systems may from time to time audit the security mechanisms Company
maintains to safeguard access to Experian Information, systems and electronic communications.
Audits may include examination of systems security and associated administrative practices
8.2 In cases where the Company is accessing Experian information and systems via third party
software, the Company agrees to make available to DCS Information Systems upon request, audit
trail Information and management reports generated by the vendor software, regarding Company
individual authorized users.
8.3 Company shall be responsible for and ensure that third party software, which accesses DCS
Information System's Information systems, is secure, and protects this vendor software against
unauthorized modification, copy and placement on systems which have not been authorized for its
use.
8.4 Company shall conduct software development (for software which accesses DCS Information
System's information systems; this applies to both in -house or outsourced software development)
based on the following requirements:

Internet Delivery Security Requirements
In addition to the above, following requirements apply where Company and their employees or an authorized
agent /s acting on behalf of the Company are provided access to DCS Information Systems provided services via
Internet ( "Internet Access ").
General requirements:
1. The Company shall designate in writing, an employee to be its Head Security Designate, to act as the
primary interface with DCS Information Systems on systems access related matters. The Company's
Head Security Designate will be responsible for establishing, administering and monitoring all Company
employees' access to DCS Information Systems provided services which are delivered over the Internet
( "Internet access"), or approving and establishing Security Designates to perform such functions.
2. The Company's Head Security Designate or Security Designate shall in turn review all employee requests
for Internet access approval. The Head Security Designate or its Security Designate shall determine the
appropriate access to -each DCS Information Systems product based upon the legitimate basiness heeds —
of each employee. DCS Information Systems shall reserve the right to terminate any accounts it deems a
security threat to its systems and /or consumer data.
3. Unless automated means become available, the Company shall request employee's (Internet) user
access via the Head Security Designate /Security Designate in writing, in the format approved by DCS
Information Systems. Those employees approved by the Head Security Designate or Security Designate
for Internet access ( "Authorized Users ") will be individually assigned unique access identification
accounts ( "User ID ") and passwords /passphrases (this also applies to the unique Server -to -Server access
IDs and passwords /passphrases). DCS Information Systems approval of requests for (Internet) access
may be granted or withheld in its sole discretion. DCS Information Systems may add to or change its
requirements for granting (Internet) access to the services at any time (including, without limitation, the
imposition of fees relating to (Internet) access upon reasonable notice to Company), and reserves the
right to change passwords /passphrases and to revoke any authorizations previously granted. Note:
Partially completed forms and verbal requests will not be accepted.
4. An officer of the Company agrees to notify DCS Information Systems in writing immediately if it wishes
to change or delete any employee as a Head Security Designate, Security Designate, or Authorized User;
or if the identified Head Security Designate, Security Designate or Authorized User is terminated or
otherwise loses his or her status as an Authorized User.
Roles and Responsibilities
1. Company agrees to identify an employee it has designated to act on its behalf as a primary interface with
DCS Information Systems on systems access related matters. This individual shall be identified as the
"Head Security Designate." The Head Security Designate can further identify a Security Designate(s) to
provide the day to day administration of the Authorized Users. Security Designate(s) must be an
employee and a duly appointed representative of the Company and shall be available to interact with
DCS Information Systems on information and product access, in accordance with these Experian Access
Security Requirements for Reseller End - Users. The Head Security Designate Authorization Form must be
signed by a duly authorized representative of the Company. Company's duly authorized representative
(e.g. contracting officer, security manager, etc.) must authorize changes to Company's Head Security
Designate. The Head Security Designate will submit all requests to create, change or lock Security
Designate and /or Authorized User access accounts and permissions to DCS Information System's systems

and information (via the Internet). Changes in Head Security Designate status (e.g. transfer or
termination) are to be reported to DCS Information Systems immediately.
2. As a Client to DCS Information System's products and services via the Internet, the Head Security
Designate is acting as the duly authorized representative of Company.
3. The Security Designate may be appointed by the Head Security Designate as the individual that the
Company authorizes to act on behalf of the business in regards to DCS Information Systems product
access control (e.g. request to add /change /remove access). The Company can opt to appoint more than
one Security Designate (e.g. for backup purposes). The Company understands that the Security
Designate(s) it appoints shall be someone who will generally be available during normal business hours
and can liaise with DCS Information System's Security Administration group on information and product
access matters.
4. The Head Designate shall be responsible for notifying their corresponding DCS Information Systems
representative in a timely fashion of any Authorized User accounts (with their corresponding privileges
and access to application and data) that are required to be terminated due to suspicion (or actual) threat
of system compromise, unauthorized access to data and /or applications, or account inactivity.
Designate
1. Must be an employee and duly appointed representative of Company, identified as an approval point for
Company's Authorized Users.
2. Is responsible for the initial and on -going authentication and validation of Company's Authorized Users
and must maintain current information about each (phone number, valid email address, etc.).

Authorized User's job responsibilities.

The location and description of the proposed installation and appurtenances must be fully shown on the attached
detailed drawings.
The Company shall commence actual construction/work in good faith within 60 days from the date of said permit and
shall complete said construction /work within 1 working days. (COMPANY MUST FILL IN). If such
construction is not begun by the 60" day, Company will be required to apply for a new permit.
Company declares that prior to filing this application, it has ascertained the location of all existing utilities, both aerial
and underground, and the filing of this application is prima facie evidence that the proposed installation will not
conflict with any existing utility.
A copy of this permit shall be kept at the job site any time work is being performed.
It is expressly stipulated that this Permit is a license for permissive use only and that the placing of facilities upon
public property pursuant to this permit shall not operate to create or vest any property right in said holder.
It is understood and agreed that the rights and privileges herein set out are granted only to the extent of the County's
right, title and interest in the land to be entered upon and used by the holder and the holder will at all times assume risk

Applicant agrees that if Brazos County demonstrates a violation of the terms of this policy, Applicant stipulates that
requisites for injunctive relief exist and that Brazos County is entitled to relief enjoining any conduct by applicant
which is contrary to the policies.
This permit is a revocable permit. Brazos County reserves the right to revoke this permit at any time, in the sole
discretion of Brazos County, for interests of public health, safety or welfare, or for failure to repair any damages
upon demand, or for any other reason deemed sufficient by Brazos County.
In the event Compairy fails to comply with any or all of the requirements as set forth herein, the County may take
such action as it deems appropriate to compel compliance. The County Engineer further retains the right to revoke
this Permit by verbal notffwation to the Applicant/Company.
Failure to obtain this permit and/or notify the County Engineer's Office within 24 hours of beeginning construction
shall constitute grounds for job shutdown.

BRAZOS COUNTY ROADWAY SAFETY AND ROAD
PRESERVATION STANDARDS FOR WORK CONDUCTED IN
BRAZOS COUNTY RIGHTS OF WAY
A. General Requirements
I. Adequate drainage shall be maintained in ditches at all times.
2. Permittee will use best management practices (`BMP ") (EPA and TCEQ both provide lists of examples of
BMPs) to minimize erosion and sedimentation resulting from the proposed installation.
3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property
shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or
appointed representative.
4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior
occupant.
5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur,
permittee will be liable to the County or other utilities running through the right of way.
6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is
determined that inconvenience to the public exists, then the County Engineer will decide whether such
project will be allowed or if an alternative exists so as not to inconvenience the public.
B. Safety Requirements
t. Proper traffic control measures must be put in place prior to beginning work and remain in place during
the duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic
Control Devices ( TMUTCD). See Traffic Control Requirements below.
2. During construction, all safety regulations of the Texas Department of Transportation shall be observed.
3. Permittee must take such precautions and measures, including placing and displaying safety devices, as
may be necessary, in order to safely conduct the public through the project area. Company shall provide
flagmen, signs, signals or devices necessary to provide complete safety to the public.
4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property
owners.
5. No cable, conduit and /or pole line shall be laid, constructed, maintained and /or repaired so as to constitute
a danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of
Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved
by the County Engineer.
C. Traffic Control Plan
1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided
for the following:
a. Any construction (i.e. pit, excavation, hole) left open overnight, requires specific ni hg ttime traffic
control measures pursuant to the TMUTCD;

b. If construction is within ten (10) feet of the roadway; or
c. Any work performed in the road right -of -way;
2. Plan must be attached to the permit and kept at the job site any time work is being performed.
3. Plan must set forth the time of completion for the job.
D. Design Standards
1. All overhead installations shall conform to clearance standards of the Texas Department of Transportation
and the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code,
Section 181.045.
2. Alt pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure
safety to the public. Any pole placed in violation of this requirement will be required to be moved to the
appropriate location at the company's expense. Exceptions may be approved by the County Engineer.
All underground installations shall (these are minimum depths — utility may place deeper):
a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement;
b. be at least thirty -six (36) inches below ditch flow line when installation is within the area measured
from top of bank to top of bank;
c. be at least forty -eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For
high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below;
d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of
less than 60 feet.
4. Water Lines: All water lines must be a minimum 36- inches below the ditch flow line and cased.
Waterlines shall be cased if crossing under the roadway.
5. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within
designated locations based upon the type of utility. The locations shall be as follows: (measured from
back of right -of -way).
Power— 0 to 2 feet, nominally 1'
Phone — 2 to 4 feet, nominally 3'
Gas — 4 to 6 feet, nominally 5'
Cable — 6 to 8 feet, nominally 7'
6. Utilities with less than 60 feet right -of -way in all new developments shall install the utility in a similar
manner as referenced in No. 3 above; however, the County Engineer or its designated representative will
provide final approval of each utility location.
7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400'
if left open over night or unattended.
8. Crossings under a county road shall:
a. be bored or jacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT;
b. be pressure grouted for the full length of the crossing if the annular space between pipe and casing and
soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting
operations and have the opportunity to have an inspector on site to observe pressure grouting
operations;

c. TxDOT Standard Specification Item 476 shall be followed for all boring, jacking, tunneling and joints.
9. Bore Pits:
a. no pits shall remain open longer than 2 days;
b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above,
c. pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval from
the County Engineer or his representative;
d. when pits are to remain open for more than g hours, due diligence will be used in protecting the spoil
pile to prevent drainage problems;
e. based upon soil conditions, the County Engineer or his representative may require shoring to protect
pavement integrity;
f. based upon soil conditions, the County Engineer or his representative may require pits be placed
further from the edge of road.
10. Any installation within ten (10) feet of edge of pavement shall meet the following:
a. location must be approved by the County Engineer or his representative
b. backfilled with cement stabilized material.
c. based upon soil conditions, the County Engineer or his representative may require shoring to
protect pavement integrity.
d. all excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed
during a rainy period or at other times where excess water cannot be prevented from entering the
trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized
material as soon as weather permits;
e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the
County Engineer or his representatives.
f. no side or lateral tamping to fill voids under the base and pavement materials is allowed.
11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event
Company damages the slope, shoulder or any other portion of the right -of -way, Company will be
responsible for repairing the damage and replacing the right -of -way to the condition it was prior to
commencing construction.
12. Operation of construction and /or maintenance equipment on the traveled surface of any improved County
road will not be permitted, except in an instance whereby the laying, construction, maintenance and /or
repair of cables, conduits and/or pole lines cannot be accomplished by any other method and in this event
all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided
meeting TMUTCD requirements.
13. In the event said construction and /or maintenance and /or repair requires Company to remove, cut or
jeopardize any section of the road (asphalt, cement, road base, etc.), Company will be required to provide
a performance bond or letter of credit securing necessary repairs. Said bond amount will be determined by
the County Engineer.
14. The applicant shall submit a letter of "No Objection" from the Army Corps of Engineers for all
designated wetlands and environmentally sensitive lands.
E. Eneereency work
1. In the event Company is required to perform emergency services, that requires excavation in a County
Right of Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company

shall notify County Engineer within 24 hours of beginning construction /repairs. This will allow the
County Engineer's Office an opportunity to inspect the site to ensure the integrity of the County Right of
Way and traffic safety controls used.
F. Repairs to existing facilities
1. Maintenance and/or repair to existing cables, conduits, and /or pole lines which require disturbance of the
soil, shall not be performed until plans describing such maintenance and /or repair have been approved by
the County Engineer or its designated representative and a permit has been obtained.
G. Relocation oftailities
I. When and if the County Engineer determines that it is necessary for the construction, repair, improvement,
alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables or other
facilities and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated
thereon, as required by the County Engineer within a reasonable time as determined by the County
Engineer and Utility Company, and at the expense of the Utility Company.
H. Hielt Pressure Pipelines
1. All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to
controlled access or non - controlled access installations, should contain the following additional
information in the description of the permit.

- minimum yield strength
- maximum operation pressure of the pipeline
2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied
for both the carrier pipe and the casing.
3. Assurance must also be given that the installation material and design meet the minimum Federal Safety
Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed
by an authorized representative of the company.

gas lines) and shall not be parallel to a County Road.
6. Natural Gas Distribution is a line that serves the final customer.

1. If bad weather is forecasted, will the event be canceled? If so, how will attendees
be notified?
Email notification is first followed by contact by phone. We will also post notifications of
changes /cancellation due to inclement weather conditions on
www.Facebook.com/rexasWineRuns and on the event website, www.TexasWIneSeries.com.
Finally, Messina Hof has agreed to advise Incoming callers of the change /cancellation.
2. Develop a plan for sudden onset of severe weather. Where will people go and who
is designated to assist in their successful arrival at the safe refuge place?
Messina Hof has several buildings on their premises. We would use those buildings for refuge in
the event of a sudden onset of severe weather. We will also advise the runners of this plan ahead
of time in the Race Day Details electronic missive they will receive. We also use
www.Facebook.com/rexasWineRuns as a means of communication as the majority of our runners
receive the communication on their cell phones.
3. Is there an area of safe refuge in case of a tomado?
In the event of a tornado watch/warning, we will adopt the TAMIL! Campus Safety & Emergency
procedures. Their website states:
"Tornado Watch — This means that tornadoes are possible. You should remain alert for
approaching storms, watch the sky and stay tuned to NOAH Weather Radios, commercial
radio or the local news for more information.;
Tornado Warning —This means that a tornado has been sighted or Indicated by
weather radar. You should take shelter immediately."
We have permission to use the buildings on premises at Messina Hof and implement Instructions

be happy to seek additional counsel upon request on this topic toward review and implementation.
