IN THE COMMISSIONERS COURTROOM OF THE ADMINISTRATION BUILDING, 200 S. TEXAS AVENUE, SUITE 106, BRYAN, TEXAS. The Brazos County Commissioners Court will hold a public hearing to consider the following: e Application for the operation of a junkyard by Joy Trust located at 7044 Elmo Weedon Road, Bryan, TX 77808 The public hearing will be held in the Commissioners Courtroom of the fist floor of the Administration Building, 200 S. Texas Avenue, Suite 106 located at the intersection of South Texas Avenue and 28th Street. Interested parties are invited to speak for or against approval of the application and conditions to be imposed on the location. Vol. 204 Pg. / � j ®r,�c BRAZOS COUNTY BRYANJEXAS MINUTES July 16, 2014 BRAZOS COUNTY COMMISSIONERS COURT PUBLIC HEARING G File Stamped Aoenda.pdf L-" Sign in sheet.odf The Commissioners' Court of Brazos County, Texas held a Public Hearing at the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 1:30 p.m. on Wednesday, July 16, 2014, with the following members of the Court present: Duane Peters, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Sammy Catalena, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4, Late; Karen McQueen, County Clerk, Absent. Attached is a list of the citizens and officials in attendance. tit Back up.pdf The purpose of the hearing is to hear commentary for and against an application for a junkyard by Joy Trust located at 7044 Elmo Weedon Road, Bryan, Texas 77808. The County Judge called the meeting to order and turned the floor over to Bill Ballard, Civil Counsel who began by reviewing the criteria for approving or denying the application for a junkyard. Alan Munger, County Engineer then spoke on the location of the junkyard. Vol. 204 Pg. / N b" James Hall, Deputy Sheriff reported on complaints filed on the property and other issues with the site. He went on to say that he had not received information on the storm water permit or license through the State Comptroller's office. Dr. Janet Blumel a neighbor living very close to the site said there is oil leaking, air conditioner fluid, and gasoline from the cars which means she can not use her well water. Her residence value has decreased. Junkyards attract criminal elements with the theft of metal. She has a safety concern. There is also increased truck traffic in the area, junk pieces in the street along with stray dogs. Suzette Kyle whose husband is Don Kyle, the developer of the subdivision, has invested his money in this subdivision. There are homes in there up to a million dollars in value. The plat is being filed next week. This junkyard will seriously affect the subdivision. They are worried about traffic on the nearby corner. It would be dangerous. Rex Warden a tenant on the site spoke to address complaints and said he is sensitive to issues. He said he has no intention of running a junkyard. He has 11 vehicles and he doesn't consider them junk. All can be made to run but can't afford to register them right now. These are restoration projects. He is just applying for the right to keep his vehicles and be in compliance. He informed the developers that they shouldn't worry about appearance. He is working on planting natural hedges and wants to make it look nice. The traffic is not from him. He is not planning on disturbing neighbors or leaking fluids. Neighbors directly around him have not complained about noise being a problem. As far as the criminal element, he is more concerned with the RV park down the road. He said he doesn't have dogs. Dan Warden congratulated Rex Warden on a good presentation and his work to fix up his place. Dan Warden is the trustee of the "Joy Trust ". He asked that the Court find them in compliance. He went on to say that he didn't like the term junkyard and would like it taken off the property. Lindsay Guindi of the City of Bryan voiced some concerns. Wayne Vinson lives next door to Mr. Rex Warden and he's been told he has to get a junkyard permit too. He would like the permit to say something besides junkyard. He just has lots of cars too. Commissioner Cauley asked how many he has and he replied that he as 30 -40 cars. Judge Peters said there is not another licensing other than junkyard even if its not the traditional sense of one. The Court is not voting on this matter today but stated that he has reservations and is reluctant to support this based on the facts presented. Rex Warden asked how many cars could he have without being considered a junkyard. Deputy Hall explained the transportation code to Mr. Warden. Mr. Warden defined the word junk from Webster's Dictionary but Deputy Hall replied that the cars were not operational nor were they registered. Dan Warden said he had owned the property since 1998 and asked if it could be grandfathered in so they can store the vehicles. He asked if this was a new law. Wayne Vinson also stated that he had been there since 1988 so he doesn't know why it has to change now. He asked what the alternative was if this is not approved. Charlene Heath stated that she appreciates the fencing put in by Rex Warden. She also Vol. 204 pg. I �% wants something done about ordinances and notifying the public. She asked for a committee to develop new rules. The County Judge explained that counties are limited to what the state tells them they can do. Ms. Heath went on to state that she also thinks junkyard is the wrong title and said she would see if they could do something new.
