ConstiWltonal Court , with both judicial and legislative powers, created under Article V. Section I and Sedan 18 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Govemmem Code. Accordingly, members of the public in
attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themseves with proper respect and
decorum in speaking lo, andlor addressing the Court; in participating in public discussions before me Court; and in all actions

sancions:
1. cancellation of a speakers time;
2. removal from the Commissioners Court
3, a Contempt Citation, andlor
4. such other andlor criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the Sao of Texas.
The Counry Commissioners Court can deliberate or take action only if a matter has been listed on an agenda property posted
prior to the meeting. During the public comment pence. speakers may address matters not listed on the published agenda, The
Open Meeting Law does net expressly prohibit responses to public comments by the Commissioners Court. However,
responses from the County Judge or Commissioners ro unlisted public cornment topics could become deliberation on e matter
without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider. the County
Judge and /or Commissioners may ;home not M respond to public comments, except to correct factual inamuraciss, recite
existing policy in response to an inquiry or to ask that a matter be listed on a lunure agenda. See Texas Open Meetings Act 7

Any invocation that may be offered before the official start of line Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have net bean previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in par', o. as a whole. No member of the community is required
to attend or participate in the invomtlon and such decision will have no impact on their right o actively participate in the
business of the Court.

A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on
Tuesday, May 20, 2014 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;

3. Resolution 14 -008 celebrating the 100th anniversary of the signing of the Smith -Lever
Act.

The Court voted unanimously to adopt Resolution #14 -008 celebrating the 100th
Anniversary of the Signing of the Smith -Lever Act, the founding legislation of the nation
wide cooperative extension system. The County Judge then presented the signed
Proclamation to Dusty Tittle and Charla Anthony along with other representatives of the
extension service. Mr. Tittle then presented the Court with the Building A Better Texas
Award.

4. Proclamation 14 -024 declaring June 1 - 7, 2014 as National Garden Week.

The Court voted to approve Proclamation #14 -024 declaring June 1 -7, 2014 as "National
Garden Week' in Brazos County. The Court joins with the Mayors of the cities of Bryan
and College Station to encourage everyone to get out and garden because it promotes a
healthy lifestyle that lasts a lifetime, helps reduce stress from other areas of our lives
and teaches us that rewards can come from diligent efforts.

Celebrating the 100th Anniversary of the Signing of the Smith -Lever
Act, the Founding Legislation of the Nationwide Cooperative
Extension System
WHEREAS, May 8, 2014 marks the centennial of the signing of the Smith -Lever Act (Act of
May 8, 1914, Ch. 79, 38 Star. 372, 7 U.S.C. 341 et seq.), which established Cooperative
Extension, the nationwide transformational education system operating through land -grant
universities in partnership with federal, state and local governments; and
WHEREAS, U.S. Sen. Hoke Smith of Georgia and U.S. Rep. A. F. Lever of South Carolina
authored the Smith -Lever Act to expand the "vocational, agricultural and home
demonstration programs in rural America" by bringing the research -based knowledge of the
land -grant universities to people where they live and work; and
WHEREAS, Cooperative Extension is a critical component of the three -part land -grant
university mission and works collaboratively with research, particularly the Agricultural
Experiment Station System, and academic programs in 106 colleges and universities,
including historically black, Native American and Hispanic - serving institutions; in all 50
states, the District of Columbia and six U.S. territories to reach traditional and underserved
audiences in all communities; and
WHEREAS, the Cooperative Extension System continues to receive federal programmatic
leadership and support enabled by the Smith Lever Act and other legislation through the
U.S. Department of Agriculture's National Institute of Food and Agriculture; and
WHEREAS, Cooperative Extension's research -based education for farmers and ranchers
helped establish the United States as a leading agricultural- producing nation in the world;
and
a
WHEREAS, Since 1924, when the clover emblem was adopted by USDA to represent 4.
H, Cooperative Extension's nationwide youth development program has reached millions
of youth and helped prepare them for responsible adulthood; and
WHEREAS, Cooperative Extension prepares people for healthy, productive lives through
sustained education, such as the Expanded Food and Nutrition Education Program,
breaking the cycle of poverty and reducing expenditures for federal and state assistance
programs; and
WHEREAS, Cooperative Extension provides rapid response to disasters and emergencies
through the Extension Disaster Education Network and other similar efforts by providing
real -lime alerts and resources so Extension educators can respond to urgent needs resulting
from hurricanes, floods, oil spills, fire, drought, pest outbreaks and infectious diseases
affecting humans, livestock and crops; and
WHEREAS, Cooperative Extension translates science -based research for practical
application through local and online learning networks where educators are uniquely
available to identify emerging research questions, connect with land -grant university
faculty to find answers and encourage application of findings to improve economic and
social conditions; and

WHEREAS, Cooperative Extension engages with rural and urban leamers through
practical, community-based and online approaches, resulting in the acquisition of
knowledge, skills and motivation to strengthen the profitability of animal and plant
production systems, protect natural resources, help people make healthful lifestyle choices,
ensure a safe and abundant food supply, encourage community vitality and grow the next
generation of leaders; and
WHEREAS, Many states are celebrating the centennial of the signing of the Smith -Lever
Act with resolutions and proclamations, and many land -grant institutions also are
commemorating the signing of the historic legislation.
NOW, THEREFORE, BE IT RESOLVED that the Commissioners Court of Brazos
County, Texas:
- Recognizes the significance of the Smith -Lever Act to the establishment of
Cooperative Extension nationwide.
- Encourages the people of the United States to observe and celebrate the centennial
with a focus on launching an innovative and sustainable future for Cooperative
Extension.
Honors the university faculty and local educators who dedicate careers to providing
trusted education to help people, families, youth, businesses and communities solve
problems, develop skills and build a better future.
Thanks Cooperative Extension volunteers who provide thousands of hours to promote
excellence for Agriculture & Natural Resources, 4 -H, Master Gardeners, family and
consumer sciences and other programs in their communities.
- Encourages continued collaboration and cooperation among federal, state and local
governments to ensure Cooperative Extension's sustainability as the nation's premiere
nonformal educational network.
Celebrates millions of youth, adults, families, farmers, ranchers, community leaders
and others who engage in Cooperative Extension learning opportunities designed to
extend knowledge and change lives.

INTERLOCAL AGREEMENT BETWEEN BRAZOS COUNTY, THE CITY OF
COLLEGE STATION, AND THE CITY OF BRYAN FOR THE 2014 BYRNE JUSTICE
ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into by and between Brazos County, Texas
(hereinafter referred to as the "County "), acting through its Commissioners' Court, the City of
College Station (hereinafter referred to as "College Station "), a Texas Home Rule Municipal
Corporation, acting through its City Council; and the City of Bryan, Texas (hereinafter referred
to as `Bryan"), a Texas Home Rule Municipal Corporation, acting through its City Council.
WHEREAS, the County, College Station, and Bryan wish to submit a joint application
for grant funds under the U.S. Department of Justice's 2014 Edward Byrne Memorial Justice
Assistance Grant (JAG) Program; and
WHEREAS, as a condition precedent to receiving a JAG award, the County, College
Station, and Bryan are required to enter into an inter -local agreement designating one joint
applicant to serve as the applicant/fiscal agent for the joint funds; and
WHEREAS, College Station will serve as the applicant/fiscal agent; and
WHEREAS, Chapter 191 of the TEXAS GOVERNMENT CODE, also known as the
INTERLOCAL COOPERATION ACT, authorizes all local governments to contract with each
other to perform governmental functions or services; and
WHEREAS, the parties represent that each is independently authorized to perform the
functions or services contemplated by this Agreement; and
WHEREAS, each governing body, in performing governmental functions or in paying
for the performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of all parties, that the undertaking will benefit the public, and that the division of
costs fairly compensates the performing party for the services or functions under this Agreement;
and
WHEREAS, College Station agrees to provide the County $8,876.25 from the JAG
award for the purpose of supporting local initiatives, technical assistance, training, personnel,
equipment, supplies, contractual support, information technology, research and evaluation
activities that will improve or enhance law enforcement programs; and
WHEREAS, College Station agrees to provide Bryan $26,872.75 from the JAG award
for the purpose of supporting local initiatives, technical assistance, training, personnel,
equipment, supplies, contractual support, information technology, research and evaluation
activities that will improve or enhance law enforcement programs; and

WHEREAS, College Station shall use their $23,426.00 from the JAG award for the
purpose of supporting local initiatives, technical assistance, training, personnel, equipment,
supplies, contractual support, information technology, research and evaluation activities that will

WHEREAS, College Station, Bryan and the County believe it to be in their best interest
to reallocate the JAG funds as described above,
NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants and
conditions contained herein, promise and agree as follows:
1. College Station agrees to pay the County a total of $8,876.25 of JAG funds.
2. The County agrees to use the $8,876.25 for the purpose of supporting local initiatives,
technical assistance, training, personnel, equipment, supplies, contractual support,
information technology, research and evaluation activities that will improve or enhance
law enforcement programs.
3. College Station agrees to pay Bryan a total of $26,872.75 of JAG funds.
4. Bryan agrees to use $26,872.75 for the purpose of supporting local initiatives, technical
assistance, training, personnel, equipment, supplies, contractual support, information
technology, research and evaluation activities that will improve or enhance law
enforcement programs.
5. College Station agrees to retain a total of $23,426.00 of the JAG funds.
6. College Station agrees to use $23,426.00 for the purpose of supporting local initiatives,
technical assistance, training, personnel, equipment, supplies, contractual support,
information technology, research and evaluation activities that will improve or enhance
law enforcement programs.
7. The parties to this Agreement do not intend for any third party to obtain a right by virtue
of this Agreement.
8. By entering into this Agreement, the parties do not intend to create any obligations
express or implied other than those set out herein; further, this Agreement shall not create
any rights in any party not a signatory hereto.
9. No party shall have the right to direct or control the conduct of the other parties with
respect to the duties and obligations of each party under the terms of this Agreement.
10. Each entity shall ensure that all applicable laws and ordinances have been satisfied.

11. Effective Date and Term. This Agreement shall be effective when signed by the last
parry who's signing makes the Agreement fully executed and will remain in full force
and effect until September 30, 2015.
12. Indemnification Subject to the limitations as to damages and liability under the Texas
Tort Claims Act, and without waiving its governmental immunity, each party to this
Agreement agrees to hold harmless each other, its governing board, officers, agents and
employees for any liability, loss, damages, claims or causes of action caused, or asserted
to be caused, directly or indirectly by any other party to this Agreement, or any of its
officers, agents or employees as a result of its performance under this Agreement.
13. Consent to Suit. Nothing in this Agreement will be construed as a waiver or
relinquishment by any party of its right to claim such exemptions, privileges and
immunities as may be provided by law.
14. Invalidity: If any provision of this Agreement shall be held to be invalid, illegal, or
unenforceable by a court or other tribunal of competent jurisdiction, the validity, legality
and enforceability of the remaining provisions shall not in any way be affected or
impaired thereby. The parties shall use their best efforts to replace the respective
provision or provisions of this Agreement with legal terms and conditions approximating
the original intent of the parties.
15. Written Notice. Unless otherwise specified, written notice shall be deemed to have been
duly served if delivered in person or sent by certified mail to the business address as
listed herein.

16. Entire Agreement. It is understood that this Agreement contains the entire agreement
between the parties and supersedes any and all prior agreements, arrangements, or
understandings between the parties relating to the subject matter. Nor oral
understandings, statements, promises, or inducements contrary to the terms of this
Agreement exist. This Agreement cannot be changed or terminated orally. No verbal
agreement or conversation with any officer, agent, or employee of any parry before or
after the execution of this Agreement shall affect or modify any of the terms or
obligations hereunder.
17. Amendment. No Amendment to this Agreement shall be effective and binding unless
and until it is reduced to writing and signed by duly authorized representatives of both
parties.
18. Texas Law. This Agreement has been made under and shall be governed by the laws of
the State of Texas.
19. Place of Performance. Performance and all matters related thereto shall be in Brazos
County, Texas, United States of America.
20. Authority to Enter Contract. Each parry has the full power and authority to enter into
and perform this Agreement and the person signing this Agreement on behalf of each
party has been properly authorized and empowered to enter into this Agreement. The
persons executing this Agreement hereby represent that they have authorization to sign
on behalf of their respective corporations.
21. Waiver. Failure of any party, at any time, to enforce a provision of this Agreement, shall
in no way constitute a waiver of that provision, nor in anyway affect the validity of this
Agreement, any part hereof, or the right of either parry thereafter to enforce each and
every provision hereof. No term of this Agreement shall be deemed waived or breach
excused unless the waiver shall be in writing and signed by the party claimed to have
waived. Furthermore, any consent to or waiver of abreach will not constitute consent to
or waiver of or excuse any other different or subsequent breach.
22. Agreement Read. The parties acknowledge that they have read, understand and intend
to be bound by the terms and conditions of this Agreement.
23. Assignment. This Agreement and the rights and obligations contained herein may not be
assigned by any party without the prior written approval of the other parties to this
Agreement.
24. Multiple Originals. It is understood and agreed that this Agreement may be executed in
a number of identical counterparts, each of which shall be deemed an original for all
purposes.

LEASE AGREEMENT
This lease agreement which is effective as of the day of t 2014,
is made by and between Brazos County, Texas, ( "Lessor") whose address for purposes of this
agreement is 3232 Briarcrest Drive, Bryan, Brazos County, Texas, 77802, and the Junior League of
Bryan - College Station, Inc. ( "Lessee ") whose address for purposes of this agreement is 3232
Briarcrest Drive, Bryan, Brazos County, Texas, 77802.
In consideration of the mutual covenants and agreements herein set forth and other good and
valuable consideration, Lessor does hereby demise and lease to Lessee and Lessee does hereby lease
from Lessor the premises situated In Brazos County, Texas, and being a part of the property commonly
referred to as the Brazos Center, and more particularly described and shown in Exhibit A attached
hereto with such property hereinafter called the "leased premises ".

I.
TERM
The term of this lease shall be one (1) years commencing on June 1, 20114, and ending on June
11.
RENT AND USE OF THE LEASED PREMISES
A. Lessee agrees to pay to Lessor without any prior demand therefore and without any deduction or
setoff as a fixed minimum rent of the sum of Six Hundred Fifty Dollars ($650.00) per month during
the entire term of this lease, such amount to be referred to herein as the "Base Rent," Unless
otherwise expressly set forth herein, Lessee shall have the use of the leased premises as described
below in consideration for the payment of the Base Rent and no other amount.
S. Inconsideration for the payment of the Base Rent, the Lessee shall have access to and use of the
leased premises as follows:
1. At all times, the exclusive use of the office space described and designated at Exhibit "A"
attached hereto.
2. Occupancy of two storage cabinets in the "receiving area" of the leased premises as
described on Exhibili
3. Each year, on or prior to August 1, the Lessee shall submit to the Lessor a calendar of
general membership, board, and provisional meetings scheduled for the twelve months to
follow. The Lessor shall, within two weeks of receiving the calendar of meetings, respond to
the Lessee with a confirmation of the proposed schedule. Once the proposed calendar is
confirmed by the Lessor, the scheduled meetings and locations shall be reserved by the
Lessor for use by the Lessee. The room set -up for these three types of meetings can be
auditorium style or banquet style. If Lessee will not require the use of the requested rooms for
the meetings on any given day. Lessee will give Lessor at least 30 days notice. it is generally
understood and agreed by Lessor and Lessee that the general membership meetings will be
held in either Assembly I, ill, IV, or in Lecture /Rehearsal 102.
4. Those areas designated on Exhibit "A" as Room 106, Room 108, and Room 102 may be used
for committee and council meetings at no extra charge provided the following conditions
prevail:
a. Meetings are to be held only during normal business hours, or after 5 P.M. when
another activity is scheduled requiring a Brazos Center attendant to be on the
premises.

b. The Lessee must request use of the space at least one week in advance. Such
notice must include the date of the meeting, the start and end time, and the name of
the person presiding over the meeting.
5. In addition, Lessee has permission for free use of Assembly I, Assembly II, or Assembly
IV, or Room 102 for 2 - six hour periods as scheduled in advance with the Brazos Center for
Agency Orientation and Candidate Orientation.
C. Lessor shall provide cleanup service after General Membership, Board, Provisional and Committee
meetings, including Agency Orientation and Candidate Orientation, held in Assembly I, III, IV or rooms
102, 106, and 108. Cleanup service includes emptying trash cans and disposing of trash in the
dumpster, sweeping and mopping floor and disposing of all remaining items left In room unless
otherwise notified. Lessee is responsible for the care and removal of their property, decorations, and
equipment.
111.
BUSINESS
Lessee shall use the leased premises solely for the use and purpose for which it Is let that
being the conduct of Junior League meetings and related Junior League meetings and related
Junior League activities as described herein.
IV.
CONSTRUCTION AND ACCEPTANCE OR PREMISES
Lessor will provide to Lessee exclusive use of all property described in Exhibit "A" attached
hereto. Lessee accepts the property in its present condition, and Lessee shall not construct any
Improvements on or in such without the express written consent of the Lessor.
V.
MAINTENANCE AND SURRENDER
Lessor shall maintain the roof, foundation, underground and otherwise concealed plumbing, the
structural soundness of the exterior walls, and all other parts of the building and other Improvements on
the leased premises In good repair and condition. Lessor shall be responsible and keep in a good state of
repair all interior plumbing, windows, window glass, plate glass, doors, heating system, air conditioning
equipment, fire protection, sprinkler system and the interior of the building in general including the
reasonable care of the entrance and exit of the premises.
Lessee shall provide all furniture for the leased premises. Lessee shall provide all custodial
services for the leased premises as well as minor maintenance of the leased premises. Lessee shall
throughout the lease term maintain the leased premises and keep them free from waste or nuisance, and
shall deliver up the premises in a clean and sanitary condition at the termination of this lease, reasonable
wear and tear and damage from fire, tornado and other casualties excepted.
VI.
TAXES AND ASSESSMENTS
Lessor shall pay and fully discharge all taxes, special assessments and governmental charges, K
any, assessed against the real estate herein leased, and Lessee shall pay and fully discharge all taxes,
special assessments and governmental charges, if any, for any and all personal property located on the
above premises.

VII.
UTILITIES
Lessor shall pay all utility charges for electricity, heat, gas and water and power used in and about
the leased premises.
Lessee shell pay all charges for its dedicated telephone service and answering service.
Vlll.
INSURANCE
Lessor and Lessee shall each be responsible for purchasing and maintaining insurance in
amounts and for risks as each determines to be appropriate. Lessee will maintain in effect at all times a
police of general liability insurance, including coverage for property damage, In an amount no less than
$600,000.00.
Lessee bears the risk of loss of all property owned by or under the care of Lame, and Lessee
holds Lessor harmless from any claims or causes of action for the loss of or damage to the property
owned by or under the care of the Lessee.
IX
SIGNS
Lessee may not erect signs on any portion of the leased premises, with the exception of small
signs identifying the leased premises which have been approved by Lessor in advance.
X.
INDEMNITY
The Lessee agrees to and shall Indemnify and hold harmless and defend the Lessor, its
officers, agents, elected officials and employees from and against any and all claims, losses,
damages, causes of action, suits and liablllty of every kind, including all expenses of litigation,
court costs and attorney's fees, for injury to or death of any person, or damage to any property, or
for any breach of contract arising out of or In connection with this lease agreement and the
purposes for which this lease agreement was entered Into, Including but not limited to property
damage, injuries and death due to the act, omission, mistake, fault, defautt, or negligence of (1)
the Lessor, Its officers, agents, employees; (2) the Lasses, Its agents and employees; and (3) any
hulloes, licensees or guests of the Lessee.
XI.
DEFAULT
If Lessee shall allow the rent to be in arrears more than ten (10) days after written notice by U.S.
mail, return receipt requested, of such delinquency, or shall remain in default under any other conditions of
this lease for a period of ten (10) days after written notice by U.S. malt, return receipt requested, from
Lessor, or should any other person than Lessee secure possession of the premises, or any part thereof,
by reason of receivership bankruptcy proceedings, or other operation of law in any manner whatsoever,
Lessor may at Its option, following notice by U.S. mail, return receipt requested to Lessee, terminate this
lease, or in the alternative, Lessor may reenter and take possession of said premises and remove all
persons and property therefrom, without being deemed guilty of any manner of trespass and relet the
premises or any part thereof, for all or any part of the remainder of said term, to a party satisfactory to
Lessor, and at such monthly rental as Lessor may with reasonable diligence be able to secure. Should
Lessor by unable to relet after reasonable efforts to do so, or should such monthly rental be less than the
rental Lessee was obligated to pay under this lease, or any removal thereof, plus the expense of reletting,
then Lessee shall pay the amount of such deficiency to Lessor.

XII.
ASSIGNMENT AND SUBLEASE
Lessee shall not assign this lease and any interest therein, or sublet the leased premises, or
part thereof, or any right or privilege pertinent thereto.

NOTICES AND ADDRESSES
All notices provided to be given under this Agreement shall be given by regular U.S. mall, with the
sole exception that notice of defauh must be delivered by U.S. mail, certified return receipt requested,
addressed to the Lessors agent, and the Lessee's agent, and the Lessee's then serving President at the
following addresses:

TEXAS LAW TO APPLY
This agreement shall be construed under and in accordance with the laws of the State of Texas,
and all obligations of the parties created hereunder are performable in Brazos County, Texas.
XV.
PRIOR AGREEMENTS SUPERSEDED
This agreement constitutes the sole and only agreement of the parties hereto and
supersedes any prior understandings or written or oral agreements between the parties
respecting the within subject matter,
XVI.
AMENDMENT
No amendment, mcdification or alteration of the terms hereof shall be binding unless the same be
in writing, dated subsequent to the date hereof duty executed by the parties hereto.
XVII.
ATTORNEY'S FEES
In the event Lessor or Lessee breaches any of the terms of this agreement whereby the party not
in default employs attorneys to protect or enforce its rights hereunder and prevails, then the defaulting
party agrees to pay the other party reasonable attorney's fees so incurred by such other party.
XVIII.
FORCE MAJEURE
Neither Lessor nor Lessee shall be required to perform any term, condition or covenant In this
lease to long as such performance is delayed or prevented by force majeure, which shall mean acts of
God, material or labor restrictions by any governmental authority, civil riot floods and any other cause not
reasonably within the control of the Lessor or Lessee and which by the exercise of due diligence Lessor or
Lessee is unable, wholly or in part, to prevent or overcome.
IN WITNESS WHEREOF, the undersigned Lessor and Lessee hereto execute this agreement as
of the date and year first above written.

The location and description of the proposed installation and appurtenances must be fully shown on the attached
detailed drawings.
The Company shall commence actual construction/work in good faith within 60 days from the date of said permit and
shall complete said construction /work within 1 working days. (COMPANY MUST FILL W. If such
construction is not begun by the 60'h day, Company will be required to apply for a new permit.
Company declares that prior to filing this application, it has ascertained the location of all existing utilities, both aerial
and underground, and the filing of this application is prima facie evidence that the proposed installation will not
conflict with any existing utility.
A copy of this permit shall be kept at thejob site any time work is being performed.
It is expressly stipulated that this Permit is a license for permissive use only and that the placing of facilities upon
public property pursuant to this permit shall not operate to create or vest any property right in said holder.
It is understood and agreed that the rights and privileges herein set out are granted only to the extent of the County's
right, title and interest in the land to be entered upon and used by the holder and the holder will at all times assume risk
of and indemnify, defend and save harmless Brazos County from and against any and all loss, damages, cost or

expense arising in any manner on account of the exercise or attempted exercise by said holder of the aforesaid rights
and privileges.
Any deviation from these specifications must be approved by Brazos County Engineer's Office or its designated
representative.
Approval of County Engineer's Office may take as long as two weeks after complete application is received.
Applicant agrees to comply with all rules of the County Commissioners and the County Engineer in construction of
said installation attached hereto as BRAZOS COUNTY DESIGN STANDARDS AND SAFETY PRECAUTION
REQUIREMENTS FOR WORK CONDUCTED IN BRAZOS COUNTY RIGHTS OF WAY and incorporated
herein for reference.
In the event Company fails to obtain a permit prior to the installation or does not install utilities in compliance with
installation requirements sel forth herein (le. depth, location, etc), Company assumes all financial responsibility for
damages andlor destruction of lines, cables, etc, based upon its failure to comply with Brazos County requirements.
Applicant agrees that if Brazos County demonstrates a violation of the lerms of this policy, Applicant stipulates that
requisites jar injunctive relief exist and that Brazos County is entitled to relief enjoining any conduct by applicant
which is contrary to the policies.
This permit is a revocable permit. Brazos County reserves the right to revoke this permit at any time, in the sole
discretion of Brazos County, for interests of public health, safely or welfare, or jar failure to repair any damages
upon demand, or for any other reason deemed sufficient by Brazos County.
In the event Company jails to comply with any or all of the requirements as set forth herein, the County may take
such action as it deems appropriate to compel compliance. The County Engineer further retains the right to revoke
this Permit by verbal notification to the Applicant/Company.
Failure to obtain this permit and/or notify the County Engineer's Office within 24 hours of beginning construction
shall constitute grounds for job shutdown.

BRAZOS COUNTY ROADWAY SAFETY AND ROAD
PRESERVATION STANDARDS FOR WORK CONDUCTED IN
BRAZOS COUNTY RIGHTS OF WAY
A. General Requirements
1. Adequate drainage shall be maintained in ditches at all times.
2. Permittee will use best management practices (`BMP ") (EPA and TCEQ both provide lists of examples of
BMPs) to minimize erosion and sedimentation resulting from the proposed installation.
3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall
be restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed
representative.
4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior
occupant.
5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur,
permittee will be liable to the County or other utilities running through the right of way.
6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is
determined that inconvenience to the public exists, then the County Engineer will decide whether such project
will be allowed or if an alternative exists so as not to inconvenience the public.
B. Safety Requirements
I . Proper traffic control measures must be put in place prior to beginning work and remain in place during the
duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control
Devices ( TMUTCD). See Traffic Control Requirements below.
2. During construction, all safety regulations of the Texas Department of Transportation shall be observed.
3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may
be necessary, in order to safely conduct the public through the project area. Company shall provide flagmen,
signs, signals or devices necessary to provide complete safety to the public.
4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners.
S. No cable, conduit and/or pole line shall be laid, constructed, maintained and/or repaired so as to constitute a
danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for
future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the County
Engineer.
C. Traffic Control Plan
I. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided for the
following:
a. Any construction (i.e. pit, excavation, hole) left open over night, requires specific nighttime traffic
control measures pursuant to the TMUTCD;
b. if construction is within ten (10) feet of the roadway; or
c. Any work performed in the road right-of -way;
2. Plan must be attached to the permit and kept at the job site anytime work is being performed.

3. Plan must set forth the time of completion for the job.
D. Design Standards
1. All overhead installations shall conform to clearance standards of the Texas Department of Transportation and
the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section
181:045.
2. All pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure safety to
the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate
location at the company's expense. Exceptions may be approved by the County Engineer.
3. All underground installations shall (these are minimum depths — utility may place deeper):
a. be placed at a minimum depth of forty-eight (48) inches below the top of the pavement;
b. be at least thirty-six (36) inches below ditch flow line when installation is within the area measured from
top of bank to top of bank;
c. beat least forty -eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For high
pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below;
d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of less
than 60'
4. Water Lines: All water lines must be a minimum 36- inches below the ditch flow line and cased. Waterlines
shall be cased if crossing under the roadway.
5. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within
designated locations based upon the type of utility. The locations shall be as follows: (measured from back of
right -of -way).
Power— 0 -2 feet, nominally P
Phone — 2 -4 feet, nominally 3'
Gas — 4 -6 feet, nominally 5'
Cable -6 -8 feet, nominally 7'
6. Utilities with less than 60 feet right-of-way in all new developments shall install the utility in a similar manner
as referenced in No. 3 above, however, the County Engineer or its designated representative will provide final
approval of each utility location.
7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if
left open over night or unattended.
8. Crossings under a county road shall:
a. be bored orjacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT;
b. be pressure grouted for the full length of the crossing if the annular space between pipe and casing and
soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting operations
and have the opportunity to have an inspector on site to observe pressure grouting operations;
c. TxDOT Standard Specification Item 476 shall be followed for all boring, jacking, tunneling and joints.
9. Bore Pits
a. no pits shall remain open longer than 2 days;
b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above.
c. pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval from the
County Engineer or his representative;
d. when pits are to remain open for more than 8 hours, due diligence will be used in protecting the spoil pile
to prevent drainage problems;

e. based upon soil conditions, the County Engineer or his representative may require shoring to protect
pavement integrity;
f. based upon soil conditions, the County Engineer or his representative may require pits be placed further
from the edge of road. '
10. Any installation within ten (10) feet of edge of pavement shall meet the following:
a. location must be approved by the County Engineer or his representative
b. backfilled with cement stabilized material.
c. based upon soil conditions, the County Engineer or his representative may require shoring to protect
pavement integrity.
d. All excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed
during a rainy period or at other times where excess water cannot be prevented from entering the trench
will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material
as soon as weather permits;
e. All disturbed base and pavement materials shall be removed and restored to the satisfaction of the County
Engineer or his representatives.
f. No side or lateral tamping to fill voids under the base and pavement materials is allowed.
11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event
Company damages the slope, shoulder or any other portion of the right -of -way, Company will be responsible
for repairing the damage and replacing the right-of-way to the condition it was prior to commencing
construction.
12. Operation of construction and/or maintenance equipment on the traveled surface of any improved County road
will not be permitted, except in an instance whereby the laying, construction, maintenance and/or repair of
cables, conduits and/or pole lines cannot be accomplished by any other method and in this event all such
equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD
requirements.
13. In the event said constriction and/or maintenance and/or repair requires Company to remove, cut or
jeopardize any section of the road (asphalt, cement, road base, etc), Company will be required to provide a
performance bond or letter of credit securing necessary repairs. Said bond amount will be determined by the
County Engineer.
14. The applicant shall submit a letter of "No Objection" from the Army Corps of Engineers for all designated
wetlands and environmentally sensitive lands.
E. Emergency work
1. In the event Company is required to perform emergency services, that requires excavation in a County Right
of Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company shall
notify County Engineer within 24 hours of beginning construction/repairs. This will allow the County
Engineer and Road & Bridge Office an opportunity to inspect the site to ensure the integrity of the County
Right of Way and traffic safety controls used.
R Repairs to existing facilities
1. Maintenance and/or repair to existing cables, conduits, and/or pole lines which require disturbance of the soil,
shall not be performed until plans describing such maintenance and/or repair have been approved by the
County Engineer or designated representative and a permit has been obtained.
G Relocation of utilities.
1. When and if the County Engineer determines that it is necessary for the construction, repair, improvement,
alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables or other facilities
and- appurtenances:authotized hereunder, shall be removed from said road, or reset or relocated thereon, as
required by the County Engineer within a reasonable time as determined by the County Engineer and Utiliry
Company, and at the expense of the Utility Company.

H. High Pressure Pipelines
1. All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to controlled
access or non - controlled access installations, should contain the following additional information in the
description of the permit.
- diameter
-wall thickness
- material specification
- minimum yield strength
- maximum operation pressure of the pipeline
2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied for
both the carrier pipe and the casing.
3. Assurance must also be given that the installation material and design meet the minimum Federal Safety
Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed by an
authorized representative of the company.
4. Petroleum Pipelines

The Concrete pad shall be minimum of 3" thick and width shall be pipe diameter plus 18"
minimum.
5. Under no circumstances will a pipeline be installed parallel to a County Road within the Right -of-
Way. Transmission lines have been determined to be petroleum pipelines (which includes natural gas lines)
and shall not be parallel to a County Road.
6. Natural Gas Distribution is a line that serves the final customer.
