PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for as matters, both on and o8 the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in
attendance at any Regular, Spacial and /or Emergency meeting of the Court shell conduct themselves with proper respect and
decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court', and in all actions
in the presence of the Court. Those members of the public who are mappropnately attired and/or who do not conduct
themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order
and/or continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual
or group. Neither Is it the intention of the Court to allow a member (or members) of the public to Insult the honesty and/or
integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Court and /or any person in the Court's presence
and /o1 rciel, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result In the following
sanctions'.
1. cancellation of a speakers tune;
2. removal from the Commissioners Court;
3. a Contempt Citation; and /or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the Stale of Texas.
The County Commissioner Court can deliberate or take action only if a matter has been listed on an agenda propedy posted
prior to the meeting. During the public comment period, speakers may address matter not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioner Court. However,
responses from the County Judge or Commissioners to unlisted pudic comment topics could become deliberation on a matter
without notice to the public. To ensure the public has notice of all matters the Commissioner Court will consider, the County
Judge and/or Commissioners may choose rat to respond to public comments, except to correct factual inaccuracies, recite
existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act 7
551.042.
INVOCATION
Any invocation that may be offered before the official start of the Courl meeting Shall be to and for the benefit of the Court The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required
to attend or participate in the invocation and such decision will have no impact on their right to actively participate in the
business of the Court.
The Commissioner Courtroom of the County Administration Building, 200 South Texas Ave., Suite 116, Bryan, TX 77803 is
wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive services must be made two

A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on
Tuesday, April 1, 2014 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;

applauding the Brazos County American Cancer Society for all that they do for those
facing cancer in our community.

The Court approved as submitted the cancellation of bid contract #2013 -63 Roadside
Vegetation Management with Roadside Inc.
Commissioner Wassermann read aloud a statement stating that the County will continue
limited spraying around mailbox posts, culverts ends, bridge abutments, award rails on
approaches to bridges, chevrons and regulatory signs. Also the County will spray one
foot into the right -of -way so that vegetation does not penetrate the pavement and cause
it to loosen or become comprised.
The following individuals voiced their concern about spraying and the perceived damage
it has caused. Their other comments are here below:
D. J. Hohertz - Thanked the public for coming out in support of this agenda item.
Suggested the savings of canceling this contract be used to re -seed affected areas.
Wanted to know what instructions were given to Road & Bride employees.
Dusty Tittle - Ag Extension Agent - discussed the three (3) herbicides used. All, he said,
could be purchased at a home and garden center. He took questions from members of
the public that were there for the meeting. He gave out his phone number, invited calls
and offered to make home visits.
Deborah Howard - said that she was still having issues with plant survival since her area
was sprayed in August of 2012. She is worried about the long term effect on trees. Will
they die she asked.

Nancy Yung - Went on a website and read that the chemicals should not be sprayed on
bar ditches, and it was harmful to animals. Asked when they can re -seed. The reply
was that it depended on weather conditions.
Barbara Lewis - Asked Mr. Tittle if he was consulted prior to the spraying. Mr. Tittle
replied that he was not. Ms. Lewis asked if there was a spray scheduled for April. She
was told there was not.
Dr. Ray Frisbie - Commented that he thought Mr. Tittle was being too positive
James Harrison - addressed commercial products and not spraying the bar ditches.
He says he has no sight issue along his road. Said lack of analysis may cause more
lawsuits than sight issues and that this was an indiscriminate use of herbicides. Mr.
Tittle replied that all pesticides have warning labels and that they should be abided by.
Andrew Hajash - discussed application for aquatics.
Dana Roese - questioned Brazos County's goal of having bermuda grass.
Robert Richards - asked about the life span of the spray and when foliage might return.
Asked if there was any method of notification for an upcoming spray.
Warren Dixon - asked why the County was spraying now. He is angered because of the
indiscriminate nature in which the herbicide was sprayed and there was no supervision
of sprayers. Alan Munger replied there was a county employee with every sprayer.
Susan Bouse - asked Mr. Tittle if the contract had been reviewed, if this would cause
erosion, and if he were the homeowner how would he feel. Asked that the next time Mr.
Munger had a good idea to consult the community first.
Edmond Solymosy - stated that it was a fire hazard.
William Sheffield - reiterated about the area being a fire hazard and has pictures. Should
have had a meeting like this prior to spraying. He would rather trim than have it sprayed.
Commissioner Lloyd Wassermann - wanted everyone to know that he had invited the Ag
Extension Agent to come speak today on herbicides that were used.
County Judge Duane Peters - Has spoken with an attorney on the traffic because of the
oil industry and was told that accidents had increased. Safety was the reason for
spraying. He didn't like how it looked either, but intersections are much more visible.
Alan Munger - County Engineer was asked to speak. He explained that he has had
liability training for not maintaining brush in the right -of way. Road & Bridge has
removed 120 dead trees for safety reasons so that they wouldn't fall and cause an
accident. Right now they are removing dead limbs. Dr. Frisbee asked if it was
necessary to spray all areas or look at potential danger.
Renee Frisbee - said there was no line of sight issue on her road but it was sprayed
anyway. Wants to opt out of the cleaning up of dead foliage. Mr. Munger informed her
that it is a liability issue and it needs to be cleaned up.

D.J. Hohertz expressed frustration that her residence was sprayed when she has no
right of way issue while she has called Road & Bridge numerous times about concern
over visibility and brush grown up at the intersection of FM 974 and Edge School House
Road.
County Judge - said FM 974 is TxDOT property. Mrs. Hohertz said it would have been
nice if Road & Bridge had given her that information when she called.
Darla Neisemier - Thanked the Court with regard to the safety issue but her concern
was oil drilling. She is in the city limits, but the rig is in the county. She said Brazos
County needs more regulations in the county. A lightening strike could be catastrophic
and with everything brown there is a great fire hazard. There are no fire hydrants.
There is no benefit to what was done.
Commissioner Catalena - said that if you maintain your own trees etc. the Road &
Bridge crews try to skip them and not spray. Just let Road & Bridge know.
Walt Wendel - There were no sight issues in his area
Judy Leunes - was concerned about wildlife and suggested a mass email be sent out
the next time they spray.
Commissioner Sammy Catalena - agreed with everything Commissioner
Wassermann said earlier. He thanked everyone for coming and invited residents of his
precinct to call him. He will make sure to relay any message to the Road & Bridge
Department.

Darla Neisemeier asked that someone notify landowners. There has been no
consideration. It should be made mandatory that someone from the company notify
them.
The County Judge explained that the County has very little ordinance making power. A
county cannot do anything unless the legislature specifically says that we can.

and /or settlement offer as allowed under Section 551.071 of the Texas Government

Sheriff Chris Kirk stated there were 595 inmates in jail, 35 have electronic monitors and
11 are pending for monitors.

Commissioner Cauley said last week was Chamber Day and that she would report on
the results as soon as they were available.

The American Cancer Society is a nationwide, community - based, voluntary
health organization dedicated to eliminating cancer as a major health problem by
preventing cancer, saving lives, and diminishing suffering from cancer, through
research, education and advocacy; and
this year alone, more than 1,665,540 Americans will be diagnosed with cancer
and 585,720 will die from the disease. In Brazos County, an estimated 525 people
will be diagnosed with cancer in 2014; and
the American Cancer Society's Relay for Life is afundraising event that allows
communities to fight back against cancer and to help raise money that saves over
400 lives nationally each day. The donations made to support Relay teams fight
cancer by fueling ground- breaking cancer research, providing up -to -date
prevention and early detection information, advocating for cancer, and improving
quality of life for cancer patients and their families; and
C/Mermr since Relay For Life of Brazos County began, more than $1 million has been
raised to fight cancer and support patients. In 2013, in addition to funding life-
saving research, our local American Cancer Society office provided 677 services
to patients fighting cancer in Brazos County, 419 of them to newly diagnosed
patients: 72 transportation services, 58 personal health managers, 199 information
requests, 204 gift items, 21 Reach to Recovery visits, 58 wigs, 5 Feel Good, Feel
Better makeovers and 60 guest room nights; and

DONATION OF COUNTY PROPERTY POLICY

Brazos County shall follow all statutory requirements for the acceptance and donation of County
property. Chapter 81 of the Local Government Code set the requirements for Commissioner's
Court and §81.032 provides the commissioners court with the authority regarding donations on
behalf of the county. Section 263.152(a)(4) further offers direction as to who the county may
donate to. Accounting and reporting for donations will follow account pronouncements issued
by the Government Accounting Standards Board as well as other generally accepted accounting
procedures.
The Brazos County Commissioner's Court on this day, April 1, 2014, adopted the following
policy.

DONATION OF COUNTY PROPERTY

PURPOSE
To establish a standard procedure for handling the acceptance of donated property by the County
and the donation of County property to outside organizations.
BACKGROUND
The local government code permits the commissioners court to accept donated property or
donate property on behalf of the County. All departments must submit a request for
commissioners court approval prior to accepting donated property or donating property to
another organization,
PROCEDURE
A. Acceptance of Donated or Awarded Property
County departments must request approval by Commissioners Court for the acceptance
of donated property. The department must complete the donation form found on BCWeb
with all required information which must include:
1. Date asset would be placed into service
2. Item description (including make /model /SNNIN, etc)
3. Estimated value of item being donated
County departments must be awarded property by order of court judgment and based on
usefulness must decide to retain the property and put into use. The department must
request approval by Commissioners Court to accept this awarded property. The
department must complete the donation form found on BCWeb, with all required
information as stated above, but must also include a copy of the court judgment .
Requests for acceptance of property by the County must be reviewed by the Auditor,
Budget and Purchasing departments for accounting, budgetary and asset accuracy. Upon
approval by all departments, the request must be submitted for commissioner's court
approval through the agenda software. Items requesting approval from commissioner's

court must be submitted no later than the 5pm the Wednesday prior to the Tuesday
meeting to ensure adequate time for review by the approving group.
a. Auditor
The auditor will review the request for correctness of the accounting. This will include
both the expenditure and revenue account that will be affected by the acceptance of this
property. The expense of the approved property will be recorded in the county financial
system by journal entry. This should coincide with the budget amendment that will be
submitted for approval by the budget office. The journal entry will record the increase in
the expenditure and revenue accounts as submitted.
The donation form requires an estimated value be given. This should be the fair market
value of the item being received and the value at which the item will be placed on the
County's financial records.
1. Items valued under $500 will not be tagged under the fixed asset policy.
2. Items valued between $500 - $4999 will be considered minor property
and given a County asset number and tracked on the requesting
department's asset report.
3. Items valued over $5000 will be considered capital property and given a
county asset number and tracked on the requesting department's asset
report.
b. Budget
The budget office will prepare on behalf of the requesting department a budget
amendment based on the value of the item being received to be approved by
commissioner's court the meeting following the acceptance of the donated property.
The budget amendment will increase the appropriate expenditure budget by the value of
the item being received

67010000 —Minor property - $500 - $4999
80010000— Capital property —over $5000
The budget amendment will increase the appropriate revenue budget by the value of the
item being received.
• 46023000 — Donations-Other— under $4999
• 46024000 —Donations of Capital Asset —Over $5000
c. Purchasing
The purchasing department will review the request to ensure the property is in
compliance with the statutes applicable to accepting the donated property. They will also
verify the asset level of the property based on the value provided.
The purchasing department will reconcile assets monthly and will assign the donated
property an asset number and add to the county asset system once the property is

expensed. It will be the department's responsibility to ensure that all identifying
information has been provided to purchasing to be added to the asset system.
B. Donation of County property to outside organizations
County departments must request approval by Commissioners Court to donate county
property to an outside organization. The department must complete the donation form
found on BCWeb with all required information which must include:

departments for accounting and asset accuracy. Upon approval by all departments, the

a. Auditor
The purchasing department will provide a copy of the approved donation form to the
auditor's office for the journal entry to be prepared. The auditor's office will prepare
the journal entry for the donation of capital assets in fund 0004.
b. Purchasing
The purchasing department will ensure that the requesting department is in
compliance with statutory requirements and that the property is able to be donated.
Purchasing will also ensure the asset information and value are provided accurately
on the form being submitted for approval.
Upon approval by commissioner's court to donate the property to an outside
organization, the signed donation form should be provided to the purchasing
department with all required signatures for the asset to be retired in the asset system.
The requesting department is responsible for ensuring all documents are received by
the purchasing department and that the asset is retired.

Dear Mr. Salvato,
Lonestar Resources, Inc. is an oil & gas operator located in Ft. Worth, Texas. We recently
acquired the production & acreage facilities located in Brazos County from Clayton Williams
Energy. We will conduct our business under the title of Lonestar Operating, LLC.
We have a well that we would like to conduct fracturing operations on, known as the Peters
Unit k2 located off of Weeden Loop. We plan to pump water from a pond, and that pond has a
Lat /Long of 30.653245,-96.199914. We will lay a 10" layflat water line (rubber with Victaulic
connections) along Weeden Loop road, and cross under same road thru an existing 18" culvert
that has a Lat /long of 30.657510,-96.196398. The water line will continue up Weeden Loop,
then turn & go along Treebrook Lane for approximately % mile. At this point, we will make
another turn that takes us up into private land, and continue to our location.

BRAZOS COUNTY ROADWAY SAFETY AND ROAD
PRESERVATION STANDARDS FOR WORK CONDUCTED IN
BRAZOS COUNTY RIGHTS OF WAY
A. General Requirements
I. Adequate drainage shall be maintained in ditches at all times.
2. Pennittee will use best management practices ( "BMP ") (EPA and TCEQ both provide lists of examples of BMPs)
to minimize erosion and sedimentation resulting from the proposed installation,
3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be
restored to its o6ginal condition, as far as practical, in the opinion of the County Engineer or appointed
representative.
4. 'file construction and maintenance of such utility shall not interfere with the property or rights of a prior occupant.
5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, permittee
will be liable to the County or other utilities running through the right of way.
6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. II' it is
detennined that inconvenience to the public exists, then the County Engineer will decide whether such project
will be allowed or if an alternative exists so as not to inconvenience the public.
B. Safeq, Regairenrenrs
1. Proper traffic control measures must be put in place prior to beginning work and remain in place during the
duration of the job. All traffic control measures must follow the Texas Manual of Uniform TratYic Control
Devices (TMUTCD). See Traffic Control Requirements below.
2. During construction, all safety regulations of the Texas Department of Transportation shall be observed.
3. Pennittee must take such precautions and measures, including placing and displaying safety devices, as may be
necessary, in order to safely conduct the public through the project area. Company shall provide Flagmen, signs,
signals or devices necessary to provide complete safety to the public.
4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners.
5. No cable, conduit and/or pole line shall be laid, constructed, maintained and /or repaired so as to constitute a
danger or hazard of any kind to persons or vehicles using such road-Any poles placed in the Right of Way for
future installation shall be placed al the back of the Right of Way. Exceptions may be approved by the County
Engineer.
C. Traffic Control Plan
I. A traffic control plan, pursuant to the TMUTCD or Engineered TrafYic Control Plan must be provided for the
following:
a. Any construction (i.e. pit, excavation, hole) left open over night, requires snrcific ni httg ime itiffic control
measures pursuant to the TMUTCD;
b. If construction is within ten (10) feet of the roadway; or
c. Any work performed in the road right -of -way;
2. Plan must be attached to the permit and kept at the job site any time work is being perlarnred.
3. Plan must set forth the time of completion for the job.

D. Design Standards
I. All overhead installations shall conform to clearance standards of the Texas Department ot-Transpottatiou and the
pole be placed in the designated area for power specified as set forth in the Terms Dililies Code, Section 131.045.
2. All pole installation (including lighting) shall be placed at the backside of the Rigid of Way to ensure safety to
the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate
location at the company's expense. Exceptions may be approved by the County Engineer.
3. All underground installations shall (these are minimum depths— utility may place deeper):
a. be placed at a minimum depth of forty -eight (48) inches below the top of the pavement;
b, be at least thirty -six (36) inches below ditch flow line when installation is within the area measured from top
of bank to top of bank;
c. be at least forty -eight (48) inches below ditch Flow line if low pressure gas or petroleum lines. For
high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below;
d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of
less than 60'.
4. Water Lines: All water lines must be a minimum 36- inches below the ditch Flow line and cased. Waterlines shall
be cased if crossing under the roadway.
5. Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated
locations based upon the type of utility, The locations shall be as follows: (measured from back of right -of- way).
Power — 0.2 feet, nominally P
Phone — 2 -4 feel, nominally 3'
Gas — 4 -6 feet, nominally 5'
Cable — 6 -8 feet, nominally 7'
6. Utilities with less than 60 feet right -of -way in all new developments shall install the utility in a similar manner as
referenced in No. 3 above, however, the County Engineer or its designated representative will provide final
approval of each utility location.
7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if left
open over night or unattended.
8. Crossings under a county road shall:
a. be hoed orjacked. ABSOLUTELY NO OPEN CUT'S WITHIN COUNTY ROAD PAVEMENT;
b. be pressure grouted for the full length of the crossing if tile annular space between pipe and casing and
soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting operations
and have the opportunity to have an inspector on site to observe pressure grouting operations;
c. TxDOT Standard Specification Item 476 shall be followed for all boring, jacking, tunneling and joints.
9. Bore Pits
a. no pits shall remain open longer than 2 days;
b, all pits shall have proper traffic control measures in place. See Ti- affic Control Plan listed above.
c. pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval from the
County Engineer or his representative;
d. when pits are to remain open for more than 8 hours, due diligence will be used in protecting the spoil pile
to prevent drainage problems;
C. based upon soil conditions, the County Engineer or his representative may require shoring to protect
pavement integrity;
f. based upon soil conditions, the County Engineer or his representative may require pits be placed further
from tlse edge of road.

10. Any installation within ten (10) feet of edge of pavement shall meet the following:
a. location must be approved by the County Engineer or his representative
b. backfilled with cement stabilized material.
C. based upon soil conditions, the Comity Engineer or his representative may require shoring to protect
pavement integrity.
d. All excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed
during a rainy period or at other times where excess water cannot be prevented from entering the trench
will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material
AS soon as Wcathcr pemrits;
e. All disturbed base and pavement materials shall be removed and restored to the satisfaction of the County
Engineer or his representatives.
f. No side or lateral tamping to fill voids under the base and pavement materials is allowed.
H. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the
event Company damages the slope, shoulder or oily other portion of the right-of-way, Company will be
responsible for repairing the damage and replacing the right -of -way to the condition it was prior to commencing
construction.
12. Operation of construction and /or maintenance equipment on the traveled surface of any improved County road
will not be permitted, except in an instance whereby the laying, construction, maintenance and /or repair of
cables, conduits and /or pole lines cannot be accomplished by any other method and in this event all such
equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD
requirements.
13. In the event said construction and/or maintenance and /or repair requires Company to remove, cut orjeopardize
any section of the road (asphalt, cement, road base, etc), Company will be required to provide a perfomtance
bond or letter of credit securing necessary repairs. Said bond amount will be determined by the County
Engineer.
14. The applicant shall submit a letter of "No Objection" from the Ann y Corps of Engineers for all designated
wetlands and environmentally sensitive lands.
E. Emergency work
I. In the event Company is required to perform emergency services, that requires excavation in a County Right of
Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company shall notify
County Engineer within 24 hours of beginning construction /repairs. This will allow the County Engineer's
Office an opporitunity to inspect the site to enure the integrity of the County Right of Way and traffic safety
controls used.
F. Relirtirs to erisfing facififies
I. Maintenance and /or repair to existing cables, conduits, and /or pole lines which require disturbance of the soil,
shall not be performed until plans describing such maintenance andlor repair have been approved by the County
Engineer or its designated representative and a permit has been obtained.
G. Relocation of afififfes.,
1. When and if the County Engineer determines that it is necessary for the construction, repair, improvement,
Alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables or other facilities
and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated thereon, as
required by the County Engineer within a reasonable time as determined by the County Engineer and Utility
Company, and at the expense of the Utility Company,

I. All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to controlled
access or non - controlled access installations, should contain the following additional information in the
description ofthe permit.
- diameter
-wall thickness
- material specification
- minimum yield strength
- maximum operation pressure of the pipeline
2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied.for
both the carrier pipe and the casing.
3. Assurance must also be given that the installation material and design meet the minimum Federal Safety
Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed by an
authorized representative of the company.

Way. Transmission lines have been determined to be petroleum pipelines (which includes natural gas
lines) and shall not be parallel to a County Road.
6. Natural Gas Distribution is a line that serves the final customer.

The Company shall commence actual construction/work in good faith within 60 days from the date of said pen»it and

Company declares that prior to filing this application, it has ascertained the location of all existing utilities, both aerial and
underground, and the filing of this application is prima facie evidence that the proposed installation will not conflict with
any existing utility.
A copy of this permit shall be kept at the job site any time work is being performed.
It is expressly stipulated that this Permit is a license for permissive use only and that the placing of facilities upon public
property pursuant to this permit shall not operate to create or vest any property right in said holder.
It is understood and agreed that the rights and privileges herein set out are granted only to the extent of the County's right,
title and interest in the land to be entered upon and used by the holder and the holder will at all times assume risk of and
indemnify, defend and save harmless Brazos County from and against any and all loss, damages, cost or expense arising

Imaroved Material Designations
The recent updates and additions to ASTM 03350
caused the EHMW -HDPE resins designated as PE3408
in 2006, to become PE3608 in 2007. The HDPE mate-
rial did not change, but the ASTM D3350 cell classifica-
tion that described the material did change, necessitat-
ing the upgrade to PE3e08. Those same changes en-
compassed the addition of PE4710 High Performance
Polyethylene (HPPE) into the arsenal of pipe grade res-
ins. A PE4710 HPPE piping system can result in a 151A
savings when compared to current costs of PE3408 pip,

PRESERVATION STANDARDS FOR WORK CONDUCTED IN
BRAZOS COUNTY RIGHTS OF WAY
A. Genetttl Requirentears
I . Adequate drainage shall be maintained in ditches at all times.
2. Permittee will use best management practices ( "BMP ") (EPA and TCEQ both provide lists of examples of BMPs)
to minimize erosion and sedimentation resulting from the proposed installation.
3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be
restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed
representative.
4. The construction and maintenance of such utility shall not interfere with the property or rights of a prig• occupant.
5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, perninee
will be liable to the County or other utilities running through the right of way.
6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. It' it is
determined that inconvenience to the public exists, then the County Engineer will decide whether such project
will be allowed or if an alternative exists so as not to inconvenience the public.
B. Safety Requirements
I. Proper traffic control measures must be put in place prior to beginning work and remain in place during the
duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control
Devices (TMUTCD). See Traffic Control Requirements below.
2. During construction, all safety regulations of the Texas Department of Transportation shall be observed.
3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may be
necessary, in order to safely conduct the public through the project area. Company shall provide flagmen, signs,
signals or devices necessary to provide complete safely to the public.
4. Adequate provisions must be made to cause minimuni inconveniences to traffic and adjacent property owners.
5. No cable, conduit and/or pole line shall be laid, consbvcted, maintained and/or repaired so as to constitute u
danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for
future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the Canty
Engineer.
C. Trajfrc Control Plnn
I. A traffic control plan, pursuant to the 7'MUTCD or Engineered Traffic Control Plan must be provided for the
following:
a. Any construction (i.e. pit, excavation, hole) left open over night, requires ayg. i llttinne traffic control
measures pursuant to the TMUTCD;
b. If construction is within ten (10) feet of the roadway; o'
c. Any work performed in tlnc road right -of -way;
2. Plan must be attached to the permit and kept at the job site any time work is being performed.
3. Plan must set forth the time of completion for the job.
D. Design Standards
I . All overhead installations shall conform to clearance standards of the Texas Depailment of Transportation and the
pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section 181.045.
2. All pole installation (including lighting) shall be placed at the backside of the ]tight of Way to ensure safety to
the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate
location at the company's expense. Exceptions may be approved by the County Engineer.
3. All underground installations shall (these are minimum depths — utility may place deeper):
a. be placed at a minimum depth of forty -eight (48) inches below the top of the pavement;
b. be at least thirty -six (36) inches helove ditch flow line when installation is within the area measured from top
of bank to top of bank;
c. be at least forty -tight (48) inches below ditch flow line if low pressure gas or petroleum lines. For
high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below;
d. not be closer than ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of
less than 60'.
4. Water Lines: All water lines must be a minimum 36- inches below the ditch now line and cased. Waterlines shall
be cased if crossing under the roadway.
5. (Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated
locations based upon the type of utility, The locations shall be as follows: (measured from back of right -of -way).
Power — 0.2 feel, nominally I'
Phone — 2.4 feet, nominally 3'
Gas -4 -6 feet, nominally 5'
Cable — 6 -8 feet, nominally 7'
6. Utilities with less than 60 feet right-of-way in all new developments shall install the utility in a similar manner as
referenced in No. 3 above, however, the County Engineer or its designated representative will provide final
approval of each utility location.
7. The length of any trench to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if lefl
Open over night or unattended.
8. Crossings under a count)' road shall:
a. be bored or jacked. A13SOLUTELY NO OPEN CUPS WITHIN COUNTY ROAD PAVEMENT;
b. be pressure grouted for the full length of the crossing if the annular space between pipe and casing and
soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting operations
and have the opportunity to have an inspector on site to observe pressure grouting operations;
C. TxDOT Standard Specification Iterir 476 shall be followed for all baring, jacking, tunneling and joints.
9. Bore Pits
a. no pits shall remain open longer (halt 2 days;
b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above,
c, pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval fi•om the
County Engineer or his representative;
d. when pits are to remain open for more than 8 hours, due diligence will be used in protecting the spoil pile
to prevent drainage problems;
e. based upon soil conditions, the County Engineer or his representative may require sharing to protect
pavement integrity;
f. based upon soil conditions, the County Engineer or his representative may require pits be placed further
from the edge of road.

10. Any instal lation within ten (10) feet of edge of pavement shall meet the following:
a. location must be approved by [lie County Engineer or his representative
b. backfilled with cement stabilized material.
C. based upon soil conditions, the County Engineer or his representative may require shoring to protect
pavement integrity.
d. All excess water and mud shall be removed from the trench prior to backfilling. Any backftll placed
during a rainy period or at other times where excess water cannot be prevented from entering the trench
will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material
as soon as weather permits;
e. All disturbed base and pavement materials shall be removed and restored to the satisfaction of the County
Engineer or his representatives.
f No side or lateral tamping to fill voids under the base and pavement materials is allowed.
11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the
event Company damages the slope, shoulder or any other portion of the right -of -way, Company will be
responsible for repairing the damage and replacing the right- of -wny to the condition it was prior to commencing
construction.
12. Operation of construction and /or maintenance equipment on the traveled surface of any improved County road
will not be permitted, except in an instance whereby the laying, construction, maintenance and /or repair of
cables, conduits and /or pole lines cannot be accomplished by any other method and in this event all such
equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD
requirements.
17. in the event said construction and /or maintenance and /or repair requires Company to remove, curt orjeopardize
any section of the road (asphalt, cement, road base, etc), Company will be required to provide a performance
bond or letter of credit securing necessary repairs. Said bond amount will be determined by the County
Engineer.
14. The applicant shall submit a letter of "No Objection" from the Army Coups of Engineers for all designated
wetlands and environmentally sensitive lands.
E. Entergency work
1. In the event Company is required to perform emergency services, that requires excavation in a County Right of
Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company shall notify
County Engineer within 24 hours of beginning con structiou/repairs. This will allow the County Engineer's
Office an opportunity to inspect the site to ensure the integrity of the County Right of Way and traffic safety
controls used.
F. Repairs ro evisling jaciliries
1. Maintenance and/or repair to existing cables, conduits, and /or pole lines which require disturbance of the soil,
shall not be performed until plans describing such maintenance and /or repair have been approved by the County
Engineer or its designated representative and a permit has been obtained.
G. Relocrrllou of ti illtles:
1. When and if the County Engineer determines that it is necessary for the construction, repair, improvement,
alteration or relocation of all or any portion of said road, any o all poles, wires, pipes, cables or other facilities
and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated thereon, as
required by the County Engineer within a reasonable time as determined by the County Engineer and Utility
Company, and at the expense of the Utility Company.

H. High Pressure Pipelines
I. All utility Perin its for Itigh pressure pipelines (generally 60 PSI or greater), whether pertaining to controlled
access or non - controlled access installations, should contain the following additional information in the
description of the permit.
- diameter
.wall thickness
- material specification
- minimum yield strength
- maximum operation pressure of the pipeline
2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied for
both the carrier pipe and the casing.
3. Assurance must also be given that the installation material and design meet the mininunn Federal Safety
Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed by an
authorized representative of the company.
4. Petroleum Pipelines:

The Concrete pad shall be minimum of 3" thick and width shall be pipe diameter plus 18" minimmn.
5. Under no circumstances will a pipeline be installed parallel to a County Road within the Right -of-
Way. Transmission lines have been determined to be petroleum pipelines (which includes natural gas
lines) and shall not be parallel to a County Road.
6. Natural Gas Distribution is a line that serves the final customer
