IN THE COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATION BUILDING, 200 S. TEXAS AVENUE, SUITE 106, BRYAN, TEXAS. The Brazos County Commissioners Court will hold a public hearing to consider the following: . Application for Operation of an automotive wrecking yard and salvage yard by BCS Salvage Yard located at 6701 Chick Lane, Bryan, TX 77807 The public hearing will be held in the Commissioners Courtroom on the first floor of the Administration Building, 200 South Texas Ave., Suite 106 located at the intersection of South Texas Avenue and 28th Street. Interested parties are invited to speak for or against approval of the application and conditions to be imposed on the location. For additional information please contact the Road and Bridge Department at (979)822 -2127. ID Public Participation Forms.pdf Back up.pdf The purpose of the hearing is to hear commentary for and against the application for operation of an automotive wrecking yard and salvage yard by BCS Salvage yard located at 6701 Chick Lane, Bryan, Texas 77807. The County Judge called the meeting to order, welcomed those in attendance and turned the floor over to Bill Ballard, Civil Counsel. Vol. % 7 Pg Mr. Ballard then addressed the Court and presented rules that have been established for junkyards. He explained that this public hearing is for comments only for or against the junkyard on Chick Lane. The next step he said is to vote for or against it at a regular meeting. Alan Munger, County Engineer explained the criteria for approval. Deputy James Hall spoke of a compliant he received on this matter and what permits were needed. He went on to say that TCEQ has not completed the impact study on the property. The County Judge opened the meeting up for public comments. Michael Cullison, President of the Autumn Lake Subdivision HOA stated that there were 124 homes in the subdivision and that the property owners were opposed to the junkyard because of parking issues and for the potential for runoff of antifreeze and other fluids. The subdivision sits downhill from the yard. Donnie Manry, resident of the area stated that there are multiple lakes, tributaries that could receive the runoff. There would be a massive increase in traffic and damage to the road. There has been an increase in speeding along the road since the appearance of the yard. The County is spending more money to maintain this road as a result. Having this yard next to the subdivision will affect property values. There is a multicolored tin fence that only goes part way around the property and it looks worse than the junk cars. There is lots of activity at night, heavy, noisy machinery running at night is annoying especially when you have school age children to get to bed. This yard he said, does not meet county criteria /standards. Mr. Manry asked the Commissioners to reject the application for a salvage yard and permanently reject it based on the location of the subdivision so that the property owners will not have to go through this again each time a new piece of tin is put up. Carlos Ramirez sole proprietor of the junkyard, addressed the parking complaint of being in the street. Oil and antifreeze will be properly disposed of. He explained the 18 wheeler incident saying it was a mechanical issue. The fence will be painted, will go all the way around the property and landscaped. Hours of operation will be 8 -5. He stated that he does not have heavy machinery. He is currently working on all the permits required and asked the Court to put a hold on any action to allow them to finish all that is required. Jim Connor, representative of the HOA of Autumn Lakes discussed the property value issue along with the fact that another subdivision is also being built there. Scott Hill resident of Chick Lane stated that he has lived there since the early 1980's and this is completely incompatible with the pasture area. He continued saying that he shares the noise concerns of Donnie Manry. His most valuable asset is his home and it's next to the junkyard. Joseph Lynch resident said the junkyard is almost in his front yard and the noise goes on to 11:00 pm. The car crusher is squeezing the juice out of cars. The burning has the air solid black sometimes. They have three (3) dogs that are a general nuisance. They may not be licensed as they do not wear a tag and are in his yard all the time. The area will attract rats. He agrees with all other complaints as well. This junkyard does not fit Vol. / /r% Pg� in. He finished saying he doesn't know how they will sell a house in the new subdivision that sits next to a junkyard. Rusty Adams, resident is trying to sell his home that sits just outside of the 1,500 feet around the junkyard. He went on to say that Mr. Ramirez owner of the junkyard talks about what he will do which indicates he's not handling things correctly now. He is concerned about run off as well. The lake is used for fishing and other activities. He lives in Oak Meadow subdivision and asked that the permit be denied. James Moughon resident of Autumn Lake drives on Chick Lane regularly passing the site. He has a document with plans for a park and homes right across the street. He has also seen an increase in stray dogs. It concerns him that this business has been operating illegally and didn't go through proper licensing. Chris Peterson attorney for the Edgewater Subdivision developers. He has already had complaints and the yard is not fully operational. He thinks it will only get worse. These owners should have done their homework/research before opening not just open and then attempt to regulate. Mr. Peterson submitted the TCEQ checklist that needs to be met and the owners do not have a TCEQ permit to operate. There is no permit from the Texas Department of Licensing and Regulating either. This property is surrounded by residents. Property taxes paid on this land have not exceeded $200 per year which does not offset the damage to the road or the salary of the Road & Bridge crews or the Constables that have spent time out there. If this junkyard decreases property values, taxes from all subdivisions go down also. He then asked the Court to deny the license application because it does not meet any of the criteria. Garrett Nordyke, developer. He had multiple meetings with the City of Bryan before getting involved. Has had strict guidelines as a developer from both the City and TCEQ. He asked the County to deny the application. Randy French, Stylecraft Builder noted that there were several blatant violations. This is a residential area. The salvage yard is incompatible with the area. Asked for denial of the application. Karen Snowden resident. She is within a 1,000 foot radius of the junkyard and states this is not a good place for a junkyard. David Hartzog resident is downhill from the property and has seen runoff from the yard running into his pond during heavy rains. It is a residential area and not a place for a junkyard. This area is booming and he cannot see why the Court would want a junkyard to bring property values down. There are lots of walkers on Chick Lane some with their dogs. The dogs from the junkyard race out and scare the walkers. He also said that he was concerned with a park across from the junkyard as it is conducive to bad behavior. Duane Peters, County Judge asked Mr. Ramirez if he had actually filed the application with TCEQ. Mr. Ramirez said he had not but was researching it. Bill Ballard, Civil Counsel said the Court must consider approval or denial within 60 days or it will be approved automatically. Mr. Ballard said he would get notice of the meeting to consider action out to the residents. Mr. Ballard submitted an email for the record from resident Kim Manry. Donnie Manry resident spoke again in rebuttal. He also mentioned empty tires and water standing in cars as being a breeding ground for mosquitoes and West Nile Fever. Joseph Lynch spoke again saying that his driveway is blocked at times because of the junkyard. The meeting was adjourned at 11:42 am. Vol. / 9? pg.
