BRAZOS COUNTY COMMISSIONERS COURT WILL CONDUCT A PUBLIC
HEARING ON FRIDAY, DECEMBER 20, 2013 AT 10:00 A.M. IN THE
COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATION
BUILDING, 200 SOUTH TEXAS AVENUE, SUITE 106, BRYAN, TEXAS 77803
Pursuant to Article V, Section 18 of the Texas Constitution, Senate Bill 1747 enacted in 2013 by
the Texas Legislature, Chapters 222 and 256 of the Texas Transportation Code, and other authority,
Brazos County, Texas ( "County"), by and through its Commissioners Court ( "Commissioners
Court "), has elected to pursue, initiate, and complete a certain project ( "Project ") to obtain grant
funding from the Texas Department of Transportation to alleviate degradation caused to public
roads, bridges, and culverts by the exploration, development, or production of oil or gas, including
the acquisition of grant funds for the planning, design, construction, reconstruction, and
maintenance/repair of the aforesaid transportation infrastructure. One of the requirements for the
Project is the County's creation of one or more County Energy Transportation Reinvestment Zones
(or "Zone ") pursuant to the aforesaid authority.
A public hearing regarding the Project will be conducted by the Commissioners Court of Brazos
County, Texas on December 20, 2013 at 10:00 a.m. in the Commissioners Courtroom of the
County Administration Building, located at 200 South Texas Avenue, Suite 106, Bryan, Texas
77803. The purpose of this public hearing is to discuss and obtain comment on and regarding the
creation, requirements, and administration of one or more County Energy Transportation
Reinvestment Zones to be located in the county pursuant to the Project, including but not limited to
the benefits to the County and to property located in any such Zone. At this public hearing, any
interested person may speak for or against the designation of any such Zone, its boundaries, the
joint administration of any such Zone, if any, or the use of a tax increment paid into the required
tax increment account for any such Zone. Please make plans to attend and participate in this public
hearing to be conducted by

A public hearing of the Commissioners' Court of Brazos County, Texas was held in the
Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas
Avenue, in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Friday, December 20,
2013 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4, Late;
Karen McQueen, County Clerk, Absent.
The attached sheets contain the names of the citizens and officials that were in attendance.

The purpose of the hearing is to hear commentary on Senate Bill 1747 and House Bill
1025 enacted in 2013 by the Texas Legislature, Chapters 222 and 256 of the Texas
Transportation Code.
The County Judge called the meeting to order and turned the floor over to Bill Ballard
Civil Counsel who explained the need for the public hearing. Mr. Ballard then turned the
floor over to Mr. Charles Kimbrough from Bickerstaff who then gave a presentation. Mr.

Kimbrough explained that the funds are to alleviate degradation caused to public roads,
bridges and culverts by the exploration, development or production of oil or gas. The
County would need to create one or more County Energy Transportation Reinvestment
Zones prior to the funding being awarded. The estimated allocation for Brazos County
is $573,625. This is not a hard number in that not all counties will participate and in that
event those funds allocated for the non participating county will be redistributed. Until
the eligible applicant pool is determined, the dollar amount could fluctuate.
The County Judge said that the Court would vote in January 2014 to create a zone.
These zones last for ten (10) years and can be extended for an additional five (5) years.
Alan Munger, County Engineer voiced his thoughts on the issue.
Brad McCaleb, with the Metropolitan Planning Office asked questions about Zone 1 and
Mike Mclnturff made comments as an engineer.
There were no other citizens present wishing to speak for or against the issue.
The foregoing minutes of the Commissioners Court Public Hearing held December 20,
