Brazos County will hold a public hearing at 10:30 A.M. on May 21, 2013, in the Commissioners' Courtroom of the Brazos County Administration Building, 200 S. Texas Avenue, Suite 106, Bryan, TX 77803, regarding submission of a nomination form to the Texas Economic Development Bank to designate Prolamsa dba Axis Pipe and Tube, Inc., as an enterprise project in the Texas Enterprise Zone Program. Axis Pipe and Tube, Inc., is establishing a new steel tube manufacturing plant on Louis Mikulin Road at the Union Pacific rail track in the Texas Triangle Park in the unincorporated area of north- central Brazos County. This development site is located within a designated Texas Enterprise Zone. The County encourages interested individuals to attend this public hearing to discuss the Texas Enterprise Zone Program, enterprise project designation, nomination process, and other tax incentives being offered to the business. Written comments may also be submitted to County Judge Duane Peters in Suite 332 at the address above until May 28, 2013. The County Judge read aloud the points outlining the program, objective, benefit, participation, specific benefit to Axis and the commitment required from Axis. A copy of the points is attached. Brazos County Texas Enterprise Project Designation Public Hearing May 21, 2013 • Program: Texas Enterprise Zone Program — Enterprise Project Designation (Administered by the Texas Economic Development Bank, Office of the Governor's Economic Development and Tourism division) • Objective: The Texas Enterprise Zone program is an economic development tool for local communities to partner with the State of Texas to encourage job creation and capital investment in economically distressed areas of the state. • Benefit: Designated projects are eligible to apply for a refund of the state sales and use tax paid on the purchase of taxable items. The level and amount of refund is related to the capital investment and jobs created and /or retained at the qualified business site. This does not affect the local sales tax revenue that comes back to the County for property tax reduction. • Participation: For a business to receive state tax incentives under the Texas Enterprise Zone Program, the local community must nominate it for enterprise project designation. The Commissioners' Court will officially nominate Axis Pipe and Tube, Inc., as an enterprise project during the Court's May 28, 2013, meeting. The County can designate up to six projects during a biennium. The designation remains in place for five years plus a 90 -day window prior to application submission. The project can be re- nominated, but the business must be creating additional jobs and expending additional capital investment. The business site can be located within or outside of a designated Enterprise Zone. In this case, the Axis Pipe and Tube, Inc., site is located in a state - designated enterprise zone because it has a poverty rate of 23.49 %, according to the 2010 census. • Axis' specific benefit: The business will be eligible for a refund of $2,500 per job being created for a maximum refund of up to $312,500 during the five -year designation period. The refund is on Money paid to purchase capital assets to be used in the regular conduct of the business or activity at the qualified business site, or fixed assets including but not limited to land, buildings, labor used to construct or renovate a capital asset, furniture, manufacturing machinery, computers and software, or other machinery and equipment. • Axis must commit that at least 25% of its new hires will be considered economically disadvantaged. In Brazos County, the 2013 income limits to be considered disadvantaged begin at $31,000 for a one - person household and go up from there. \�N /� - pg, Z /SL i
