Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda property posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. No action was taken. 28. Sheriff's report on inmate population. Chief Deputy Jim Stewart stated there was a peak 605 inmates in jail, but now there were 592 inmates in jail, 62 have electronic monitors and 21 are pending for monitors. 29. Announcement of interest items and possible future agenda topics. Commissioner Cauley thanked the Court for allowing her to participate with the Chamber of Commerce on the legislative trip to Washington D.C. While there she met with Paul Ryan, Budget Chairman, Kevin McCarthy, Senator Ted Cruz, Sam Graves, and Representative Paul Canter. She also highlighted the schedule followed while there. 30. Call for Citizen input and /or concerns. Commissioner Cauley asked that the Court be updated on the progress of the career program Dr. Milton Radke spoke to the Court about. 31. Malinowski was ordained on May 25, 1963 at St. Mary's Cathedral in Austin, Texas by Most Reverend Louis J. Reicher, Bishop of the Diocese of Austin; and WHEREAS In June 1973, after serving in other parishes of the diocese, the bishop asked him to take the pastorate of St. Anthony Church, Bryan, Texas in which he faithfully served for 23 years; and WHEREAS 1979 -1982, he served on the Presbyterial Council in Bryan/College Station, working with fellow pastors of all religious denominations; and WHEREAS February 8, 1985 — At the request of Bishop Vincent M. Harris for his outstanding service to the people in every parish or place he had served, Pope John Paul B granted him the title of Reverend Monsignor (which makes one a honorary member of the papal household). WHEREAS 1996 — With his giftedness of extraordinary compassion for all people, he began ministering as Chaplain at St. Joseph Health System in Bryan, Texas. WHEREAS May 13, 2004 — Monsignor John served as Chaplain for the Bryan Police Department and was on call whenever they needed his assistance. WHEREAS Known by most as Father John, he also comes to the aid of his brother priests in area parishes; whenever he is requested or they are in need of his assistance. He is currently serving as the Dean of the Bryan College Station Deanery of Priests for the Austin Diocese. WHEREAS To this day, he continues to serve Brazos County as a Chaplain at St. Joseph Health System. NOW, THEREFORE, BE IT PROCLAIMED that the Brazos County Commissioners Court does hereby ask that all citizens pay tribute to Reverend Monsignor John C. This Agreement shall become effective on the date this Agreement is signed by all of the Parties (the "Effective Date ") and shall continue thereafter on an annual basis, unless sooner terminated as provided herein. 2.2 Commencement Date. This Agreement shall commence on June 3, 2013, and is subject to the termination provisions stated herein. 2.3 Termination. This Agreement may be terminated by the mutual agreement of the County and the MPO with ninety (90) days written notice. This Agreement shall automatically terminate without notice or other action by the Parties when the MPO position is no longer filled by a County employee and such position has either been eliminated or been filled by an MPO employee(s). Article III Borrowed Employees 3.1 Use of County Employee. The Parties understand and agree that on the Effective Date, the MPO shall utilize for the purpose of performing administrative duties, as set forth in the Recitals of this Agreement, an employee of County who, prior to the Effective Date, was employed by County for the same or similar purposes. The County employee serving in the MPO position shall remain an employee of County and shall he entitled to the same employee benefits as other County employees while performing services forthe MPO. 3.2 Vacancy or Reassianment. The Parties understand and agree that when a County employee occupying a MPO position pursuant to this Agreement leaves the employ of County for any reason Including, but not limited to, termination, resignation or retirement, or is reassigned by County to a position that results in the County employee no longer being assigned to the MPO position, a County employee may apply for the vacant MPO position. In the event that such vacant MPO position is not filled by a County employee, the MPO position shall be eliminated, at which time the MPO may establish an MPO employment position and employ any person for such newly created MPO employment position. 3.3 MPO Payment. The MPO shall pay the County on a monthly basis, as consideration for the employee, an amount of $833.33. Payment shall be prorated as of the Commencement Date set forth in Paragraph 2.2 of the Agreement and payment for the prorated portion of that particular month shall be made according to the prorated number of days. 3.4 Control and Supervision of Borrowed Employees. The MPO Director shall direct the County employee serving in the M PO position and shall provide scope of work and requests for services to the County employee for the administrative duties. 3.5 Compliance with Personnel Policies. In addition to the personnel policies adopted by County with which the County employee must comply, the County employee serving in the MPO position shall at all times comply with MPO site policies and procedures. With respect to the County employee serving in the MPO position, County shall at all times retain the authority to discipline, up to and including termination, the County employee that is the subject of this Agreement, for failure to comply with County's personnel policies or such other laws, rules, and regulations, which may serve as the basis for demotion, suspension, or termination of other County employees. The MPO Director shall recommend to the County Judge, or his designee, when disciplinary action should be taken with regard to a County employee serving in the MPO position. Prior to making such recommendation, the MPO Director shall consult with the County Judge prior to requesting disciplinary action be taken. Following such consultation, any request from the MPO Director for disciplinary action with regard to a County employee serving in a MPO position shall be submitted in writing to the County Judge who shall refer the matter to the appropriate County department. Any disciplinary action involving a County employee serving in a MPO position shall be governed by the County personnel policies and procedures. 3.7 Removal of Emolovee at MPO Request. The Director may, without prior notice to County, suspend a County employee serving in a MPO position from providing services pursuant to this Agreement if said County employee is determined by the Director to be in possible violation of any MPO policies. 3.8 Adjustment of Salary and Benefits. The Parties understand, acknowledge, and agree that County shall remain in control of the compensation for the County employee performing duties in MPO position pursuant to this Agreement. 3.9 Performance Evaluations. The Director shall provide written comments regarding the performance of a County employee serving in a MPO position to the County Judge. The Director shall coordinate with the County Judge to ensure that such written comments are timely delivered for consideration In the preparation of any required County employee performance evaluation. Article IV Miscellaneous 4.1 Notice. Any notice required or permitted to be delivered hereunder shall be deemed received when sent in the United States Mail, Postage Prepaid, Certified Mail, Return Receipt Requested, by hand - delivery or facsimile transmission and addressed to the respective party. 4.2. Governing Law. The validity of this Agreement and any of its terms and provisions as well as the rights and duties of the Parties shall be governed by the laws of the State of Texas; and venue for any action concerning this Agreement shall be in Brazos County, Texas. The Parties agree to submit to the personal and subject matter jurisdiction of said court. 4.3. Entire Aereement. This Agreement represents the entire agreement among the Parties with respect to the subject matter covered by this Agreement. There is no other collateral, oral or written agreement between the parties that in any manner relates to the subject matter of this Agreement. 4.4. Recitals. Counterparts. This Agreement may he executed in any number of counterparts, each of which shall be deemed an original and constitute one and the same instrument. 4.8. Legal Construction. In the event anyone or more of the provisions contained In the Agreement shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect other provisions, and the Agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained in it. 4.9. Assignment. Neither Party may assign this Agreement without the prior written consent of the other Party. 4.10. Consents. Whenever the consent or the approval of a Party is required herein, such party shall not unreasonably withhold, delay or deny such consent or approval. 4.11. Survival of Covenants. Any of the representations, warranties, covenants, and obligations of the parties, as well as any rights and benefits of the Parties, pertaining to a period of time following the termination of this Agreement shall survive termination. INSPECTIONS & TESTING Acceptance of merchandise, work, and/or equipment provided shall be made by Brazos County at the sole discretion of the Commissioners Court when all terms and conditions of the contract and specifications have been met to its satisfaction, including the submission to Brazos County of any and all documentation as may be required. ADDITION/MODIFICATION OF LOCATIONS OR SERVICES Brazos County reserves the right to add locations as these additional locations may be required. Locations to be added may include, but not limited to, expansions or additions to existing facilities and acquisition or construction of new properties. In the event that Brazos County makes significant structural changes to an existing facility that impacts the contractor's cost in providing the services anticipated by this contract such change may be treated as a new facility and the procedures provided for in this section may be followed in determining an appropriate price. In the event Brazos County wishes to add other locations to a group under the Contract, a quotation will be solicited from the incumbent contractor in good standing for the group in which the new location is appropriately situated. In the event Brazos County shall sell, vacate, abandon, or otherwise dispose or terminate a location to which the contract applies, all existing contracts or agreements or services applicable to such location, the portion of this contract that applies to such locations is terminated. All remaining portions of the contract wilt remain intact. Brazos County will endeavor to give the Contractor written notice of such termination of locations a minimum of thirty (30) days in advance. INVOICES & PAYMENTS Payments to Contractors will not be made if the Contractor cannot produce a Brazos County Purchase Order. Offerors shall submit an original invoice on each purchase order or purchase release after each delivery, indicating the purchase order number. Invoices must be itemized. Any invoice, which cannot be verified by the contract price and/or is otherwise incorrect, shall be corrected by the Contractor. When multiple deliveries and/or services are required, the offeror may invoice following each delivery or performance of service and Brazos County will pay on invoice with in thirty (30) days upon receipt of invoice. Contracts providing for a monthly charge will be billed and paid on a monthly basis only. The Contractor will provide an invoice for each month in which Brazos County is responsible for payment, during the duration of the contract. Prior to any and all payments made for goods and/or services provided under this contract, the offeror should provide his Taxpayer Identification Number or social security number as applicable. This information must be on file with Brazos County Auditor's office. Failure to provide this information may result in a delay in payment and/or back -up withholding as required by the Internal Revenue Service. Prices shall be all inclusive: No price changes, additions, or subsequent qualifications will be honored during the course of the contract. All prices must be written in ink or typewritten. Pricing on all transportation, freight, drayage and other charges are to be prepaid by the contractor and included in the bid prices. If there are any additional charges of any kind, other than those mentioned above, specified or unspecified, offeror MUST indicate the items required and attendant costs or forfeit the right to payment for such items. Where unit pricing and extended pricing differ, unit pricing prevails. TAXES Brazos County is exempt from all federal excise, state and local taxes unless otherwise stated in this document. Brazos County claims exemption from all sales and/or use taxes under Texas Tax Code §151.309, as amended. Texas Limited Sales Tax Exemption Certificates will be furnished upon written request to Brazos County Purchasing Agent. GOVERNING FORMS In the event of any conflict between the terms and provisions of these requirements and the specifications, the specifications shall govern. In the event of any conflict of interpretation of any part of this overall document, Brazos County's interpretation shall govern. In the event of a conflict between the terms, conditions, provisions, and specifications of this document and any other terms, conditions, provisions, and specifications provided by the Contractor; the terms of this document shall supersede. GOVERNING LAW This bid solicitation is governed by the competitive bidding requirements of Brazos County Purchasing Act, Texas Local Government Code, §262.021 et seq., as amended. Offerors shall comply with all applicable federal, state and local laws and regulations. Offeror is further advised that these requirements shall be fully governed by the laws of the State of Texas and that Brazos County may request and rely on advice, decisions and opinions of the Attorney General of Texas and Brazos County Attorney concerning and portion of these requirements. DISQUALIFICATION OF OFFEROR Upon signing this bid document, an offeror offering to sell supplies, materials, services, or equipment to Brazos County certifies that the offeror has not violated the antitrust laws of this state codified in Texas Business and Commerce Code §15.01, et seq., as amended, or the federal antitrust laws, and has not communicated directly or indirectly the bid made to any competitor or any other person engaged in such line of business. SILENCE OF SPECIFICATIONS The apparent silence of specifications as to any detail, or the apparent omission from it of a detailed description concerning any point, shall be regarded as meaning that only the best commercial practice is to prevail and that only material and workmanship of the finest quality are to be used. All interpretations of specifications shall be made on the basis of this statement. The items furnished under this contract shall be new, unused of the latest product in production to commercial trade and shall be of the highest quality as to materials used and workmanship. Manufacturer furnishing these items shall be experienced in design and construction of such items and shall be an established supplier of the item bid. TERMINATION Brazos County reserves the right to terminate the contract for default if offeror breaches any of the terms therein, including warranties of offeror or if the offeror becomes insolvent or commits acts of bankruptcy. Such right of termination is in addition to and not in lieu of any other remedies which Brazos County may have in law or equity. Default may be construed as, but not limited to, failure to deliver the proper goods and/or services within the proper amount of time, and/or to properly perform any and all services required to Brazos County's satisfaction and/or to meet all other obligations and requirements. Brazos County may terminate the contract without cause upon thirty (30) days written notice. SOVEREIGN IMMUNITY The parties understand that Brazos County does not waive or relinquish any immunity or defense on behalf of itself, officers, employees, agents, and volunteers as a result of its execution of this Agreement and the performance of the covenants contained herein. Further, Brazos County is not responsible for any civil liability that arises from any act or omission made within the course and scope of this Agreement. AVAILABILITY AND RETENTION OF RECORDS All records relating to the "service provided under this contract and supporting documentation for invoices submitted to Brazos County by the Contractor shall be retained and made available by the Contractor for audit by Brazos County, it duly authorized representatives, the State of Texas (including, but not limited to the Auditor of the State of Texas, Inspector General or duly appointed law enforcement officials) and agencies of the United States Government. Such records shall be returned by Contractor and made available for any time period required by state or federal law. If changes. occur in the governing state or federal law, regarding retention records, Contractor shall comply with such changes. If an audit is initiated before the expiration of such time periods required by state or federal law regarding retention of records, the Contractor shall retain.such records until the audit is concluded and all issues resolved. Contractor shall provide Brazos County with copies of such audits that be conducted with respect to the contract. AUDIT RESPONSIBILTY The Contractor shall be responsible for receiving, replying to and/or complying with any audit exception by appropriate federal, state or local audit directly related to the provision of this contract. The Contractor shall repay to Brazos County the full amount received for duplicate billings, erroneous billings, false or deceptive claims. The Contractor recognizes and agrees that Brazos County may withhold any money due and recover through any,appropriate method any money erroneously paid under this contract if evidence exists of less than full compliance with this contract. Only two times we have had repairs in the past since the purchase in 1999 . Their labor rate was at $88.00 per hour back in 2009 which is not a drastic increase to the $90.00 they are biding now. Fairbanks is the manufacture of this scale which means a lot of times getting the job done right the first time. SCOPE OF BID Bids are solicited for furnishing the merchandise, supplies, service, and /or equipment set forth in this bid request for a two (2) year period beginning June 1, 2013 through May 31, 2015 in accordance with the following Conditions of Bidding. B. CONDITIONS OF BIDDING The following instructions apply to all bids and become a part of terms and conditions of any bid submitted to the Brazos County Purchasing Office, unless otherwise specified elsewhere in this bid request. All bidders are required to be informed of these Terms and Conditions and will be held responsible for having done so: Definitions: In order to simplify the language throughout this bid, the following definitions shall apply: a. BRAZOS COUNTY - Same as County. b. COMMISSIONERS' COURT - The elected officials of Brazos County, Texas given the authority to exercise such powers and jurisdiction of all county business as conferred by the State Constitution and Laws. C. CONTRACT - An agreement between the County and a Supplier to furnish supplies and/or services over a designated period of time during which repeated purchases are made of the commodity specified. d. CONTRACTOR - The successful Bidder(s) of this bid request. e. COUNTY - The government of Brazos County, Texas and its authorized representative. f. SUB - CONTRACTOR - Any contractor hired by the Contractor or Supplier to furnish materials and services specified in this bid request. g. SUPPLIER - Same as Contractor. Upon acceptance and approval by the Commissioners' Court, this bid effects a working contract between Brazos County and the successful bidder for the period designated. This agreement shall be governed by the Uniform Commercial Code as adopted in the State of Texas as effective and in force on the date of this agreement. 15. Bids must be submitted on quantities and units of measure specified by the bid documents. In the event of errors in extended prices the unit price shall govern. Any suggested change in quantity on the part of the bidder to secure better price or delivery is welcomed and may be given consideration provided that the bidder also bids on the quantity specified. 16. Bids must specify the number of consecutive calendar days required to deliver the commodities under normal conditions. Failure to specify delivery time will be considered reason enough to cause the bid to be disregarded. Delivery time quoted will be given consideration in awarding orders. If delivery is not made within a reasonable time of the specified delivery in the bid, the entire order or contract may be canceled and the bidder barred from quoting in future bids. 17. Bids cannot be altered after receiving time. No bid may be withdrawn after opening time without acceptable reason and with the approval of the Purchasing Agent. 18. Bids must be submitted on this form and returned in a sealed enveloue clearly marked with Vendor Name and Bid Number to ensure proper recognition upon its arrival. Bids will not be considered if submitted by telephone, fax or any other means of rapid dispatch, nor will a bid be considered if submitted to any other person or department other than specifically instructed. Bids received after the expressed date and time listed in this bid will be returned unopened to the vendor. Bids submitted by any other person or department other than the Brazos County Purchasing Department will not be accepted. 19. If vendor in receipt of notice is unable to bid, the bid should be submitted as a "No Bid" and returned to the Purchasing Department before opening time. This is necessary if vendor wants to remain on vendor list and receive future bid notifications. 20. Bids must show full firth name, mailing address and telephone number and be manually signed by an authorized sales or quotation representative of the bidder. Firm name and authorized signature shall appear in each space provided. 21. In the event of a needed change in the specifications sent to the bidder, it is understood that all the foregoing terms shall apply to the addendum or addenda. 22. Unless other arrangements have been made; all invoices to be paid in full within 30 days after satisfactory delivery of commodities and or services and receipt of invoice at the listed address. As a governmental subdivision, Brazos County is exempt from most types of taxes, including but not limited to sales tax, excise tax, and import duties. Such costs must not be included in bid prices. Upon acceptance of a purchase order for any commodity or materials purchased by Brazos County, the vendor agrees to protect the county from any claim involving patent right infringement, copyright infringement, sales franchise disputes. 37. Unless otherwise specified, all items ordered from the successful vendor must be new, unused, and in first class condition. Products usually packaged for commercial sale shall be fumished in proper container so as to facilitate storage and handling. 38. Potential Vendors are advised they may have disclosure requirement pursuant to Texas Local Govemment Code, Chapter 176. This law requires persons desiring to do business with the County to disclose any gifts that have an aggregate value in excess of $250.00 given to any employee of the County, County Official to the County Official's family members or employment of any employee of the County, County Official or the County Official's family members during the preceding twelve (12) month period. The disclosure questionnaire must be filed with the Brazos County Clerk. Refer to Texas Local Government Code, Chapter 176 for the details of this law. 39. Bidder understands that Brazos County is a government subject to Texas State and Federal public information statutes. The Contractor shall provide a qualified supervisor or foreman on the site at all times during any maintenance activities to be responsible for the progress of the work and the conduct of the Contractor's personnel. This superintendence shall also apply to any work sub - contracted. c. The personnel performing the services contracted herein shall be under the sole responsibility and the employ of the Contractor and shall be constantly supervised and shall be competent, experienced, skilled lawn and plant maintenance- oriented people. d. All materials and equipment brought to the site are the full responsibility and liability of the Contractor until removed from the site as required. e. While on the site, the Contractor and his/her employees are directly responsible to the Project Manager. Each month a schedule of activities and anticipated dates should be provided to the Project Manager for review. The Contractor shall provide the Project Manager with a check list of items completed at the end of each visit. f. The Contractor shall supervise and direct the work, using his/her best skill and attention. The Contractor shall be responsible for all turf maintenance methods, techniques, and procedures; and for coordinating all portions of the work herein contracted to be done. g. Unless otherwise specifically noted, the Contractor shall provide and pay for all labor, materials, equipment, tools, transportation, and other facilities and services necessary for the proper execution and completion of the work herein contracted to be done. h. The Contractor shall at all times enforce strict discipline and good order among its representative(s). The Contractor shall only utilize personnel who are, in the opinion of the County satisfactorily and sufficiently skilled for the efficient performance of all work herein contracted to be done. i. The Contractor shall give all notices and comply with all laws, ordinances, rules, regulations, and order of any public authority in connection with the performance of the work herein contracted to be done. j. The Contractor shall be responsible for initiating, maintaining and supervising appropriate safety precautions and programs in connection with the work herein contracted to be done. INSURANCE REQUIREMENTS Bid Request No. 2013 -50 Page 9 of 15 Pages The Bidder shall instruct his insurance agent or carrier to furnish to the County a Certificate of Insurance attesting to the issuance of the following parts of this section. Please note that such Certificates of Insurance and any required bonds must be issued and then approved by Brazos County Risk Management. The Certificate of Insurance must be approved by Risk Management before any deliveries can be made. 2. The Bidder shall furnish and keep in full force the following insurance during the term of this Contract: a. Statutory Workmen's Compensation and Employer's Liability Insurance with waiver of subrogation. b. General Liability with limits for bodily injury and for property damages of not less than $1,000,000 CSL with Brazos County named as an additional insured. C. Comprehensive Automotive Liability with single limits of $1,000,000 for Bodily Injury and Property Damage Liability. d. Cargo Insurance to sufficiently cover materials transported. 3. All of the aforementioned policies and Certificates of Insurance should be issued immediately after the Bidder receives notification of award. 4. The Vendor agrees to hold harmless Brazos County from any and all claims and liability due to the acts of the Vendor's employees and the operation of his equipment. The Vendor also agrees to hold harmless Brazos County from any and all expenses, including attorney fees, incurred by Brazos County in litigation or otherwise resisting such claims or liabilities as a result of the Vendor's employees' activities. Further, the Vendor agrees to protect, indemnify and hold harmless Brazos County from and against all claims, demands and causes of action of every kind and character brought by any employees of the Vendor against Brazos County due to personal injuries and/or death to such employee resulting from any neglect act, by either commission or omission on the part of the vendor or Brazos County. Vendor will need to create a project timeline to. include. the square footage measurements /estimates, number of cycles, price per cycle (or square foot) with a maximum yearly total. Include plan for shifts of cycles if inclement weather does not allow the completion of scheduled monthly operations.. 3. The yearly total maintenance cost will be paid out on a monthly basis determined by services performed each month. Contractor shall submit an invoice for the previous month's maintenance operations by the first day of each month. Invoice should itemize the type of maintenance function and number of completed trips. 4. Each bid should include from 3 references of similar work that has been performed. 5. Applicable standards: a. Structural Pest Control Board and/or Texas Department of Agriculture (application of herbicides, insecticides, aquatic week herbicides) b. Immigration.Reform and Control Act C. Occupational Safety and Health Administration (all maintenance operations) d. American National Standards Institute (all maintenance operations) 6. Related Work: a. Owner will perform plant material replacement, tree pruning and/or removal, seasonal color change outs, top dressing, and irrigation system operational checks and repairs, unless otherwise noted. Contractor is encouraged to bring any deficiencies in these areas to the attention of the Project Manager.. Any bids to improve aspects of the site beyond the scope of these specifications should be submitted to the Project Manager for consideration. Bid Continuation Sheet BRAZOS COUNTY, TEXAS 9. Bid Request No. 2013 -50 Page 13 of 15 Pages a) All turf perimeters along and around walks, curbs, walls, beddings, and all other above ground infrastructure and trees will be edged or trimmed at each mowing cycle to produce a crisp and neat appearance. Use of string - trimmers in such a fashion to cause bare strips around objects or unsafe crevices behind curbs is unacceptable. Extreme care should be taken so as to not girdle trees. b) Sprinkler heads are to be trimmed as often as needed for proper operation C) Irrigation control valve and all other valve boxes to be trimmed around with each mow cycle. 10. Clean uo: a) All drives, parking areas, storm drains, ditches, culverts, valley curbs, and sidewalks are to be kept clean.of vegetation, litter, and soil. These cleanup operations should occur with each visit to the site. Litter in turf areas to be picked'up prior to mowing operations. b) After each .mow /trim cycle, all hard surfaces are to be swept or cleaned with blowers of any grass clippings, etc. in such a manner as to not leave unsightly clumps in or around the site. 11. Tree Protection and Maintenance: a) In order to avoid bark damage from mower decks and trimmers, all trees are to have established "spray rings ". Rings should be circular, concentric on the trunk, and no more than 12" from the trunk. A Glyphosate type herbicide. is acceptable. A second option is the use of "tree guards ". These are to be supplied by the Contractor upon commencing the project, and removed at the expiration of the contract. b) String trimmers should only be used around trees on an occasional basis to keep the rings crisp in appearance. C) The 12 inch ring size should allow ample room for equipment operations on the surrounding turf without tree damage. d) Newly planted trees with bark mulch wells present will have the entire mulched area maintained weed free. After becoming established, these newly planted.trees can be converted to the spray rings at the direction of the Project Manager. e). Low limbs that impede mowing operations can be removed after consulting with the Project Manager. General Requirements 1. Adequate drainage shall be maintained in ditches at all times. 2. Permittee will use best management practices (`BMP ") (EPA and TCEQ both provide lists of examples of BMPs) to minimize erosion and sedimentation resulting from the proposed installation. 3. The permittee shall take precautions to avoid damage to property. All County Right of Way and property shall be restored to its original condition, as far as practical, in the opinion of the County Engineer or appointed representative. 4. The construction and maintenance of such utility shall not interfere with the property or rights of a prior occupant. 5. Permittee shall not interfere with other utilities located in the right of way. In the event damages occur, permittee will be liable to the County or other utilities running through the right of way. 6. County Engineer shall determine whether or not permittee's plans shall inconvenience the public. If it is determined that inconvenience to the public exists, then the County Engineer will decide whether such project will be allowed or if an alternative exists so as not to inconvenience the public. B. Safety Requirements 1. Proper traffic control measures must be put in place prior to beginning work and remain in place during the duration of the job. All traffic control measures must follow the Texas Manual of Uniform Traffic Control Devices ( TMUTCD). See Traffic Control Requirements below. 2. During construction, all safety regulations of the Texas Department of Transportation shall be observed. 3. Permittee must take such precautions and measures, including placing and displaying safety devices, as may be necessary, in order to safely conduct the public through the project area. Company shall provide flagmen, signs, signals or devices necessary to provide complete safety to the public. 4. Adequate provisions must be made to cause minimum inconveniences to traffic and adjacent property owners. 5. No cable, conduit and /or pole line shall be laid, constructed, maintained and/or repaired so as to constitute a danger or hazard of any kind to persons or vehicles using such road. Any poles placed in the Right of Way for future installation shall be placed at the back of the Right of Way. Exceptions may be approved by the County Engineer. C. Traffic Control Plan 1. A traffic control plan, pursuant to the TMUTCD or Engineered Traffic Control Plan must be provided for the following: a. any construction (i.e. pit, excavation, hole) left open overnight, requires specific niehttime traffic control measures pursuant to the TMUTCD; b. if construction is within ten (10) feet of the roadway; or c. any work performed in the road right -of -way; Vol. pg._ 4W 2- Plan must be attached to the permit and kept at the job site any time work is being performed. 3. Plan must set forth the time of completion for the job. D. Design Standards 1. All overhead installations shall conform to clearance standards of the Texas Department of Transportation and the pole be placed in the designated area for power specified as set forth in the Texas Utilities Code, Section 181.045. 2. All pole installation (including lighting) shall be placed at the backside of the Right of Way to ensure safety to the public. Any pole placed in violation of this requirement will be required to be moved to the appropriate location at the company's expense. Exceptions may be approved by the County Engineer. 3. All underground installations shall (these are minimum depths— utility may place deeper): a. be placed at a minimum depth of forty -eight (48) inches below the top of the pavement;. b. be at least thirty-six (36) inches below ditch flow line when installation is within the area measured from top of bank to top of bank; c. be at least forty -eight (48) inches below ditch flow line if low pressure gas or petroleum lines. For high pressure gas and petroleum lines, see High Pressure Pipelines requirements listed below; d, not be closer than.ten (10) feet from the edge of pavement. Exceptions may apply in rights of way of less than 60'. 4. Water Lines: All water lines. must be a minimum 36- inches below the ditch flow line and cased. Waterlines shall be cased if crossing under the roadway. ` Utilities in all new developments that have 60 feet or greater of right of way shall be installed within designated locations based upon the type of utility. The locations shall be as follows: (measured from back of right -of -way). Power — 0 -2 feet, nominally V Phone — 2 -4 feet, nominally 3' Gas — 4 -6 feet, nominally 5' Cable — 6 -8 feet, nominally 7' 6. Utilities with less than 60 feet right -of -way in all new developments shall install the utility in a similar manner as referenced in No.. 3 above, however, the County Engineer or its designated representative will provide final approval of each utility location. The length of any trench -to be opened in advance of the pipe, conduit or ducts may not be longer than 400' if left open over night or unattended. 8. Crossings under a.county road shall: a. be bored or jacked. ABSOLUTELY NO OPEN CUTS WITHIN COUNTY ROAD PAVEMENT; b, be pressure grouted for the full length of the crossing if the annular space between pipe and casing and soil exceeds one (1) inch. Brazos County must be given 24 hours notice of pressure grouting operations and have the opportunity to have an inspector on site to observe pressure grouting operations; c. TxDOT Standard Specification' Item 476 shall be followed for all boring;.jacking, tunneling and joints. 9: -Bore Pits a. no pits shall remain open longer than 2 days; b. all pits shall have proper traffic control measures in place. See Traffic Control Plan listed above. c. pits shall NOT be located within ten (10) feet from the edge of pavement without prior approval from the County Engineer or his representative; d. when pits are to remain open for more than 8 hours, due diligence will be used in protecting the spoil pile to prevent drainage problems; e. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity; £ based upon soil conditions; the County Engineer or his representative may require pits be placed further from the edge of road. 10. Any installation within ten (10) feet of edge of pavement shall meet the following: a. location must be approved by the County Engineer or his representative b. backftlled with cement stabilized material. c. based upon soil conditions, the County Engineer or his representative may require shoring to protect pavement integrity. d. all excess water and mud shall be removed from the trench prior to backfilling. Any backfill placed during a.rainy period or at other times.where excess water cannot be prevented from entering the trench will be considered TEMPORARY and shall be replaced with PERMANENT cement stabilized material as soon as weather permits; e. all disturbed base and pavement materials shall be removed and restored to the satisfaction of the County Engineer or his representatives. £ no side or lateral tamping to fill voids under the base and pavement materials is allowed. 11. Company must be careful to not jeopardize the slope or integrity of the shoulder of the road. In the event Company damages the slope, shoulder or any other portion of the right -of -way, Company will be responsible for repairing the damage and replacing the right -of -way to the condition it was prior to commencing construction. 11 Operation of construction and/or maintenance equipment on the traveled surface of any improved County road will not be permitted, except in an instance whereby the laying, construction, maintenance and/or repair of cables, conduits and/or pole lines cannot be accomplished by any other method and in this event all such equipment shall be of the rubber tire variety. Appropriate traffic control shall be provided meeting TMUTCD requirements. 13. In the event said construction and/or maintenance and/or repair requires Company to remove, cut or jeopardize any section of the road (asphalt, cement, road base,. etc.), Company will be required to provide a perfonnance bond or letter of credit securing necessary repairs. Emergency work In the event Company is required to perform emergency services, that requires excavation in a County Right of Way, and unable to notify the County Engineer prior to conducting emergency repairs, Company shall notify County Engineer within 24 hours of beginning construction/repairs. Repairs to existing facilities Maintenance and/or repair to existing cables, conduits, and/or pole lines which require disturbance of the soil, shall not be performed until plans describing such maintenance and /or repair have been approved by the County Engineer or its designated representative and a permit has been obtained. G. Relocation of utilities When and if the County Engineer determines that it is necessary for the construction, repair, improvement, alteration or relocation of all or any portion of said road, any or all poles, wires, pipes, cables or other facilities and appurtenances authorized hereunder, shall be removed from said road, or reset or relocated thereon, as required by the County Engineer within a reasonable time as determined by the County Engineer and Utility Company, and at the expense of the Utility Company. H. High Pressure Pipelines 1. All utility Permits for high pressure pipelines (generally 60 PSI or greater), whether pertaining to controlled access or non - controlled access installations, should contain the following additional information in the description of the permit. - diameter -wall thickness - material specification - minimum yield strength - maximum operation pressure of the pipeline 2. With the exception of the maximum operation pressure of the pipeline, this information is to be supplied for both the carrier pipe and the casing. 3. Assurance must also be given that the installation material and design meet the minimum Federal Safety Standards for Liquid and Gas Pipe Lines. Assurance must be provided on company letterhead and signed by an authorized representative of the company. 4.
