THE PUBLIC HEARING WILL BE HELD ON TUESDAY, FEBRUARY 5, 2013 at 10:30 A.M. IN THE BRAZOS COUNTY COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATIVE BUILDING, 200 S. Vol, Kill P9• BRAZOS COUNTY BRYANJEXAS MINUTES February 5, 2013 BRAZOS COUNTY COMMISSIONERS COURT PUBLIC HEARING D Signature Paae.odf "t1= File Stamoed Aaendamdf 7D Sian in sheet.odf The Commissioners' Court of Brazos County, Texas held a Public Hearing at the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 10:30 a.m. on Tuesday, February 5, 2013, with the following members of the Court present: Duane Peters, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Sammy Catalena, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3, Presiding; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. Attached is a list of the citizens and officials in attendance. The purpose of the hearing is to hear commentary to consider the adoption of an order /ordinance under Texas Transportation Code Chapter 496 requiring the licensing of a junkyard or automotive salvage yard. Commissioner Mallard opened the public hearing then asked Civil Counsel Bill Ballard to lead the discussion. Mr. Ballard stated that Commissioners Court had asked him to draft some standards of salvage yards and explained the process. Commissioner Catalena said there are salvage yards that follow the rules and do what they are supposed to do, but there are some where there are issues. Vol. - / 0? - Keith Toomer of Doggett Auto Parts spoke on the requirements that need to be met prior to even filing for a license such as a million dollar insurance policy and a storm water permit. He said that he does know of some yards set up outside the city limits without meeting these requirements. He went on to discuss other requirements needing to be met to stay licensed such as water testing. Commissioner Cauley would like to know if the proposed policy would affect his business and asked Mr. Toomer to review it and let her know. Mr. Ballard explained that our proposed order /ordinance would not affect Mr. Toomer's business since his is inside city limits. This proposed order /ordinance would only affect salvage yards located outside city limits. Mr. Joseph Lynch who is retired from FEMA stressed the importance of protecting the environment and eliminating the fly by night businesses. Commissioner Catalena stated to Mr. Toomer that while the policy would not affect his business, it would even the playing filed and require them to do the same things for licensing. Donnie Manry, county resident lives near one of those fly by night junkyards and explained the problems he is having with them. He said this is a massive environmental issue with fluids draining into creeks, standing water, West Nile Fever and rats. He went on to say that you could use Mr. Toomer's business as a model for how a salvage yard should be set up. Commissioner Wassermann discussed situations with this that he has encountered and he agrees that this is needed. Mr. Lynch said that Florida is the showcase state for this. He spent a lot of time there after hurricanes. Ken Bost, Director of the Health Department voiced concerns on the enforcement side. He sited issues with staff, expertise, budget etc. This involves greater parameters than they could enforce. Don Plitt, Head Sanitarian stated that he does not feel he has the background to enforce the proposed requirements. He expressed concern with the wording in Article 1. He said we could be involved in enforcing city yards too. Commissioner Mallard does not feel the Health Department should be required to handle this. Commissioner Catalena said that it is all for the health and safety of the citizens and we will do whatever it takes. Mr. Ballard encouraged Mr. Lynch and Mr. Manry to contact him about things that can be done about their situation. The state should be able to address this. He then said that he would take comments and work further on the guidelines for adoption on a future agenda.
