The Commissioners' Court of Brazos County, Texas met in a Workshop Session
in Suite 332 of the Brazos County Administration Building in Bryan, Brazos
County, Texas, beginning at 2:00 p.m. on Tuesday, March 6, 2012 with the
following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, , Commissioner of Precinct 4, Late;
Karen McQueen , County Clerk, Absent.
Attached is a list of the citizens and officials in attendance.

The Commissioner's Court met to discuss the adoption of new flood plain maps and
flood ordinance. Megan Lott, representing the Road and Bridge Department began the
discussion on compliance with FEMA regulations and what needs to be done by May 16,

2012. To remain in compliance, Brazos County must draft a new Flood Damage
Prevention Ordinance and forward it to the Texas Water Development Board for review,
adopt the new FEMA maps and adopt a new Flood Damage Prevention Ordinance. The
Road & Bridge Department is proposing a change to the current ordinance to include a 2
foot free board rather than the 1 foot currently being used and designating the County
Engineer as the Flood Plain Administrator. Brent McCully with the City of Bryan reported
that the City of College Station is also discussing the 2 foot free board, although he is not
optimistic about it and the City of Bryan is staying at the 1 foot free board.
The Road and Bridge department and legal counsel will work to get the new ordinance
drafted within the next two weeks so it can be sent to FEMA for approval before being
submitted to Commissioners Court for its approval. Kendra Suhling, Civil Counsel stated
she liked the model ordinance but it needed some minor adjustments to make it clear to
landowners that the burden for penalties will be on them should an investigation reveal
they are in violation. Penalties for the County would be FEMA canceling flood insurance
if it is not satisfied that the county is handling the violations properly.
Commissioner Catalena was not sure about burdening the landowner with substantial
cost if the landowner feels they are right nor was he sure about enforcement. Brent
McCully, with the City of Bryan, explained that the Flood Plain Administrator does have
the authority to enforce. Enforcement is currently being handled by the Sheriff's Office
and not being very well received by the land owners. It was suggested that it would be
better handled by the Road and Bridge department who would not be looking for
violations but acting on neighbor complaints.
