Ilf' Signature Page 1- 23.odf 92 File Stamped Agenda.ipy E Sign in sheet.odf The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 3:00 p.m. on Monday, January 23, 2012 with the following members of the Court present: Duane Peters, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Sammy Catalena, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; IrmaCauley, Commissioner of Precinct 4, Late; KarenMcQueen, County Clerk, Absent. Attached is a list of the citizens and officials in attendance. 2. Discuss changes in the Brazos County Subdivision and Development Regulations: D Item 2.odf Article XII- Maintenance • Section E, Maintenance InspectionsSection • F, Expiration of Maintenance Term Vol. -- I �� The Commissioner's Court met to discuss changes in the Brazos County Subdivision and Development Regulations. Commissioner Wassermann led the discussion on Section E & F of Article XII of the Subdivision Regulations that deals with periodic inspections made quarterly of streets being considered for acceptance into the county road maintenance program. The change being considered is that the County Engineer will now initiate the inspections rather than having the owner or the developer request the inspections. Alan Munger, County Engineer is in agreement with the change and says this can be done. Commissioner Wassermann said he would like to see us catch up on the two (2) year road acceptance. The County Judge asked if the intent was that if they don't meet the requirements, the county takes over the land owners bond money to fix the road? He then asked if there was ever a time when the bond money wouldn't be enough to cover the cost of the road? Commissioner Wassermann said he felt if the county does it in two (2) years, it will be enough. He added that it's the waiting that causes more problems. 3. Maintenance Inspections: Periodic inspections initiated by the Brazos County Engineer will be made quarterly during the period of liability after Brazos County's acceptance of the construction phase or period of liability covered by the Maintenance Bond. In the event any or all of said streets are not being maintained in a good state of repair, the owner will be so advised in writing after each quarterly inspection by the Brazos County Engineer. During the last quarter of the two (2) year Maintenance Bond, and after the final inspection, written notification will be sent to the owner from the Brazos County Eggin_ gr in an advisory manner stating problems existing on the date of the last quarterly inspection that need to be addressed on any or all said streets. After a reasonable time, if the owner fails or refuses to properly repair or maintain said streets, they shall be repaired and maintained at the cost and expense of obligation on the bond or from cash on deposit as required in paragraphs B and D above. F. Expirations of Maintenance Term: If, after the expiration of the two (2) years from the date of acceptance of the construction phase for plotting purposes, such streets and improvements are in good repair, Brazos County, at the sole discretion of the Brazos County Engineer, may, in writing, accept such streets and other improvements for county maintenance (except if such streets are to be privately maintained) on the second anniversary of construction acceptance, and release the security on its bond or refund the cash on deposit, as appropriate. Note: Anytime during the last quarter of the two (2) year waiting period, if the developer or owner has made all of the improvements required in the last periodic inspection, the developer or owner may request that the Brazos County Engineer schedule a final inspection, and if everything is in compliance, begin the formal process of acceptance in Brazos County Commissioner's Court on the second anniversary date after the construction acceptance in said subdivision. Note: As per mention in Resolution No. 2813 with the City of Bryan (4)(c). As per mention in Resolution No. 2002 -004 with the City of College Station (4) (c). As per mention in Regulations of Brazos County for Subdivision and Development - Article XII, (A) adopted October 31, 2000.
