PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and on the agenda. and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Ccnstitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in
attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and
decorum In speaking to, and/or addressing the Court; in participating In public discussions before the Court; and in all actions In
the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves
In an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Courts Order and/or
continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual
or group. Neither Is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or
integrity of the Court, as a body, or any member or members of the Court, or County employees, Individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Courts presence
and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following
sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution. Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However,
responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter
without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County
Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite
existing policy in response to an inquiry or to ask that a matter be listed on a future agenda Sea Texas Open Meetings Act ?

INVOCATION
Any Invocation that may be offered before the official start of the Court meeting shall be to and for the benefit of the Court. The
views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Court and do not
necessarily represent the religious beliefs or views of the Court in part or as a whole. No member of the community is required
to attend or participate in the Invocation and such decision will have no Impact on their right to actively participate in the
business of the Court.
The Commissioners Courtroom of the County Administration Building, 200 South Texas Ave., Suite 106, Bryan, TX 77803 is
wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive services must be made two

A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 4:00 p.m. on
Tuesday, December 6, 2011 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheets contain the names of the citizens and officials that were in
attendance.

Presentation regarding citizens of the Republic of Texas buried in Boonville Cemetary.
Mervin Peters gave a presentation on Boonville Cemetery outlining the plans of the Sons
of the Republic of Texas for placing a new memorial monument in the cemetery and
relocating an existing marker there. Mr. Peters said he has spoken with Henry Mayo,
current president of the Historical Commission and Mr. Mayo agrees that the markers will
only improve the cemetery. These markers will be free standing, not touching any
existing stones, nor will they be placed over any known grave site. Mr. Peters detailed
exactly how the work will be done and stated that his group will be doing this in other
cemeteries as well. The ceremony will be held March 7, 2011.

4. Consider and possible action regarding an Order Prohibiting Outdoor Burning.
Chuck Frasier, Emergency Management Coordinator said that the KBDI maximum was
down about 21 points from last week and he thinks that it is ok for the ban to remain
lifted.

5. Order relocating polling places for the State Representative, District 14 Special Run -Off

15, 53, 55, 25, 38, 31, 39, 72, 74, 24, 2a, 2b, 2c, 50, 51, 82, 83, 62, 29, 70a, 64, 67, 5a,

avoid a financial burden on the political subdivision it is recommended that the above

34, 35a, 36, 40, 41, 45, 63a and 80 and that submission be made to the Assistant
Attorney General, Civil Rights Division, Voting Section, Department of Justice,
Washington D.C. requesting preclearance of this Order pursuant to Section 5 of the
Federal Voting Rights Act. A copy of Order 11 -020 Relocating Polling Places for the
State Representative, District 14 Special Run -off Election is attached.

meeting closed to the public at 4:25 p.m. so that the Court could meet in Closed

WHEREAS, there exists at the present time certain polling places that will not be
used for the purpose of conducting the December 13, 2011 Special Run -off election; and
WHEREAS, the polling places for Election Precincts 4c,16,14,18a,18c, I Oa,1 Ob,

WHEREAS, for the convenience of the voters and to avoid a financial burden on
the political subdivision it is recommended that the above Election Precincts be
consolidated with Election Precincts 4b, 8, 9, 11, 17, 19 ,32,33,34,35a,36,40,41,45,63a, and
80 as allowed by Chapter 42, Section 42.008 of the Texas Election Code;
NOW THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, THAT:
Pursuant to Chapter 42, Section 42.008 of the Texas Election Code that the voting
locations of the above listed Election Precincts be relocated in Brazos County as
recommended on the attached list;
THAT submission be made to the Assistant Attorney General, Civil Rights
Division, Voting Section, Department of Justice, Washington D.C. requesting the
preclearance of this Order pursuant to Section 5 of the Federal Voting Rights Act.

The Following benefits apply to dependent coverage:
• Dependent children are covered to age 26.
Automatic coverage for newborns for the first 31 days following birth. Infants not enrolled for coverage within the first 31 days after birth will not be eligible for
coverage until the following open enrollment period or special enrollment event.
Payments: Network providers agree to accept amounts negotiated with BCBSTX and are paid according to this BCBSTX- determined Allowable Amount. Covered
individuals are responsible for any required Deductibles, Coinsurance Amounts, and Copayments. Plan benefits paid to Out -of- Network providers are also based on the
BCBSTX- determined Allowable Amount. Covered individuals will be responsible for charges in excess of the Allowable Amount in addition to any applicable Deductibles,
Coinsurance Amounts, and Copayments. For cost savings information, refer to the section on ParPlan Providers and the definition of Allowable Amount in the benefit
booklet.
Preexisting conditions Provision: Benefits for Eligible Expenses incurred for treatment of a Preexisting Condition will not be available during the twelve -month period
following the individual's initial Effective Date, or if a Waiting Period applies, the first day of the Waiting Period. In accordance with state and federal law, certain
conditions will not be considered Preexisting Conditions and the Preexisting Condition exclusion will not apply to certain individuals. Details are provided in the benefit
booklet.
Replacement of Medical Coverage: In compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the following provisions apply to
each eligible participant who has health coverage under the employer's plan immediately prior to the effective date of the health contract between the employer and
BCBSTX (the contract date):
• Benefits for eligible expenses incurred for any service or supplies prior to the contract date, are not covered under the contract.
• Eligible expenses for services or supplies incurred on or after the effective date will be considered for benefits subject to all applicable contract provisions.

The Affordable Care Act (ACA) provides that a group health plan in which an individual was enrolled on March 23, 2010,

This Agreement is entered into by and between Icon Enterprises, Inc., d /b /a CivicPlus ( "CivicPlus ") and Brazos County, TX, ( "Client ").
This Agreement constitutes the complete statement of Agreement between the Client and CivicPlus and shall commence on December
6, 2011 ( "Effective Date ") and renew annually per Terms 13 -15.
Client Deliverable
1. Icon Enterprises, Inc., d/b /a CivicPlus will create a unique website for Brazos County, TX that includes all functionality as
defined in Exhibit A — CivicPlus Project Deliverables, attached hereto.
2. After 48 consecutive months under these terms and associated pricing, Client becomes fully eligible for a CP Advanced
Redesign at no additional cost. See Exhibit B for complete details.

3. Client may contract with CivicPlus for additional Consulting, Website Design, Setup, Programming, and Training services
(Project Development Services) that exceed those defined in Exhibit A. CivicPlus will invoice Client for the additional services
immediately prior to project Go -Live.
4. Client may contract with CivicPlus for additional Annual Support, Maintenance & Hosting services that exceed those defined in
Exhibit A. CivicPlus will invoice Client for annual services immediately prior to project Go -Live.
5. Services that involve billable time beyond the contracted amount will be documented and invoiced. Written approval by the
client is necessary before billable time is incurred.
6. Modules that incur additional usage fees maybe purchased and activated at anytime.
Billing & Payment Terms
7. Phase 1,2 & 3 of the total Project Development fee, as referenced in Exhibit A, will be billed upon completion of design, for a
sum of $17,579; Phase 4 and 5 of the total Project Development fee will be billed upon completion of content, for a sum of
$20,221. The remainder of the Project Development fee,for phase 6 -10, for a sum of $18,511 and any additional Project
Development services will be invoiced upon Go -Live.
B. The client shall sign a project completion and acceptance form prior to project go -live. The date may be extended if material
system or operational failures are encountered. At the time of project acceptance, immediately prior to website go -live, if you
don't agree that we have built you an amazing website, we will refund any project development fees paid, or cancel any project
development invoices outstanding, and cancel our agreement completely, with no remaining obligations.. Immediately upon
project Go -Live the final bill for the project development services will be billable and payable. All Parties agree that the website
will not go -live until the project is accepted in writing by the client.
9. Project Development invoices are due by the first of the following month, but no sooner than 30 days from Client's receipt of
invoice.
10. Fees for year 1 of this Contract for Civic Plus Project Deliverables and Annual Support, Maintenance & Hosting Services are
described on Exhibit "A ", attached hereto and incorporated herein for all purposes.
11. Fees for CivicPlus Annual Support, Maintenance & Hosting services are invoiced prior to the year of service and are due by
the first of the following month, but no sooner than 30 days from invoice date. Base rate for year 2 begins at $10,480.15.
12. Project development will be discontinued if payment is not made within 30 days after the invoice due date.
13. After Project Go -Live, if the Client's account exceeds 90 days past due, Annual Support, Maintenance & Hosting will be
discontinued until the Client's account is made current. Client will be given 30 days notice prior to discontinuation of services
for non - payment.
14. Provided the Client's account is current, at any time the Client may request an electronic copy of the website Customer
Content and Content Management System (CMS) Software. Client agrees to pay $250 per completed request. Provided the
Client's account is current, upon termination of services client may request a complimentary electronic copy of website
Customer Content and CMS Software.
Agreement Renewal
15. This contract shall remain in effect for a period of one year (12 months) from signing. In the event that neither party gives 60
days' notice prior to the end of the initial or any subsequent term, this Agreement will automatically renew for an additional
contract term. After 48 consecutive months under the terms of this contract and associated pricing, Client will be fully eligible
for a CP Advanced Redesign at no additional cost.
16. Either party may terminate the agreement at the end of the contract term by providing the other party with 60 days written
notice prior to the contract renewal date.
17. In the event of contract termination, Client forfeits eligibility for the CP Advanced Redesign and all funds applied to such
eligibility In the event of early termination of this Agreement by the client, full payment for services provided is due within 15
days of termination.
18. Each year this Agreement is in effect, charges for Annual Support, Maintenance & Hosting services may be increased by
CivicPlus by no more than 5% per annum.

19. Either party may terminate the Annual Support, Maintenance & Hosting Agreement at the end of the contract term by providing
the other party with 60 days written notice, prior to the contract renewal date.

Support
22. CivicPlus will provide unlimited telephone support Monday - Friday, 7:00 am — 7:00 pm (Central Time) excluding holidays, for all
trained Client staff. Emergency Support is provided on a 24/7/365 basis for emergency contacts named by the Client. Client is
responsible for providing CivicPlus with contact updates.
23. Support includes providing technical support of the CivicPlus Content Management Software, application support (pages and
modules), and maintenance of Client's website. Following initial setup, additional page design, graphic design, user training,
site modification, and custom programming may be contracted separately for an additional fee.
24. During the period of this agreement and subsequent annual renewals, CivicPlus warrants that it will, without additional charge
to the client, immediately correct any problems or defects discovered in the Software and reported to CivicPlus by the client,
such warranty to include ongoing maintenance upgrades and technical error correction.
25. CivicPlus provides online website statistics software at no extra charge. If Client desires to use other website statistic software,
CivicPlus will provide the necessary log file access.
Marketing
26. Client will make a reasonable attempt to work with the CivicPlus Marketing Department to gather information and meet
deadlines associated with website award contest entries throughout the term of this Agreement.
27. Client permits CivicPlus to include an example of the Client's home page and a link to the Client's website on the CivicPlus
corporate website.
28. Client will make a reasonable attempt to work with the CivicPlus Marketing Department to create a news item to be released in
conjunction with their project Go -Live date. Client will provide CivicPlus with contact information for local and regional media
outlets. CivicPlus may use the press release in any marketing materials as desired throughout the term of this Agreement.
29. Client will make a reasonable attempt to work with the CivicPlus Marketing Department to create a case study related to their
website.
30. Client agrees to allow CivicPlus to display a "Powered by CivicPlus" insignia and web link at the bottom of their web pages.
Client understands that the pricing and any related discount structure provided under this Agreement assumes such perpetual
permission.
Intellectual Property, Ownership & Content Responsibility
31. Upon full and complete payment of submitted invoices for the project development and launch of the website, client will own
the graphic designs, web content, page designs and banners ( "Customer Content ") as well as the CMS Software.
32. Upon completion of the development of the site, client will assume full responsibility for Web site content maintenance and
content administration. Client, not CivicPlus, shall have sole responsibility for the accuracy, quality, integrity, legality, reliability,
appropriateness, and intellectual property ownership or right to use of all Customer Content.
33. Client shall not (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make
available to any third party the Software in any way; (ii) modify or make derivative works based upon the software; (iii) create
Internet "links" to the Software or "frame" or "mirror" any functionality on any other server or wireless or Internet -based device;
or (iv) reverse engineer or access the Software in order to (a) build a competitive product or service, (b) build a product using
similar ideas, features, functions or graphics of the Software, or (c) copy any ideas, features, functions or graphics of the
Software.
29. The CivicPlus name, the CivicPlus logo, and the product and module names associated with the System are trademarks of
CivicPlus, and no right or license is granted to use them.

Memorandum of Agreement between
Brazos County and Brazos County Office of the Sheriff and Recovery Healthcare Corporation
This Memorandum of Agreement is written between Recovery Healthcare Corporation, Brazos County
and the Brazos County Sheriffs Office for the purpose of providing GPS, SCRAM, Drug Testing and
Alcohol Monitoring Services to Brazos County Jail Inmates and those under bond supervision.
II. Recovery Healthcare Corporation has been identified as a certified GPS provider in Brazos County.
(a) This Agreement shall become effective on December 1, 201 land shall terminate on
September 30, 2012. The Agreement may be continued from year to year, October 1
through September 30) for a total period not to exceed three years upon the written
agreement of the Parties.
Ill. General Duties of Recovery Healthcare Corporation.
(a) Recovery Healthcare Corporation will be responsible for providing GPS, RF Monitoring,
SCRAM and random alcohol /drug testing. Recovery Healthcare Corporation shall continue
to maintain up to date monitoring equipment.
(b) Recovery Healthcare Corporation will be responsible for the installation, monitoring, de-
installation.
(c) Recovery Healthcare Corporation will invoice the offenders in advance for the services
used. Recovery Healthcare Corporation understands that offenders will report directly from
court for monitoring services and will provide offenders a reasonable time to pay for
services.
(d) Recovery Healthcare Corporation will provide Brazos County access to 3M web -based
software for the purpose of managing all clients for whom Brazos County is responsible.
(e) Recovery Healthcare Corporation will provide a list of offenders, as well as, daily compliance
reports on all offenders. An annual and monthly report will be generated to show all
offenders remaining on the program and those who have completed or were terminated
from the program.
(f) Recovery Healthcare Corporation will provide evidence and reporting of non - compliance.
Recovery Healthcare Corporation will notify the referring agent or Court of non - compliance
as required by agreement with the referring agent, typically within 24 hours of reporting of
non - compliance.
(g) Recovery Healthcare Corporation staff will troubleshoot all alerts and tamper events.
(h) Recovery Healthcare Corporation will help develop and implement a referral process.

(i) Recovery Healthcare Corporation will provide installation of equipment on clients per RHC
recommended guidelines, who are referred by Brazos County or any other referral source
within a reasonable amount of time as required by agreement with the referring agent.
(j) Recovery Healthcare Corporation will explain the rules and stipulations of the program, and
the functions of the device to the client as well as have the client complete the Participant
Agreement;
(k) Recovery Healthcare Corporation will monitor clients through SMART WARE, 3M's Web
Based Software.
(l) Recovery Healthcare Corporation will report all stolen, lost and damaged equipment to
Brazos County.
(m) Recovery Healthcare Corporation is responsible for all lost, damaged or stolen equipment.
The client will be 100% financially responsible for all lost, damaged or stolen equipment.
Clients will be billed for lost or damaged equipment. Stolen equipment cases will be
turned over to the Brazos County District Attorney for prosecution.
(n) Recovery Healthcare Corporation will report to Judges, the Sherriff's Office, supervising
Probation Officers or other referral sources on all compliance /non - compliance violations,
including reports, as required by agreement with the referring agent.
(o) Recovery Healthcare Corporation will provide de- instailation of equipment at the time of
expected termination or as requested by the referring agent.
(p) Recovery Healthcare Corporation will be bill clients as follows:

(q) Recovery Healthcare Corporation can provide a drug test notifier program. Price is
determined on volume. Additional cost will be included in the Urine Drug Screen Testing or
Sweat Drug Patch Fee.
(r) Recovery Healthcare Corporation can provide Voice Verification (Curfew) program though
Anytrax. Price is determined on volume.
(s) Recovery Healthcare Corporation will start the deactivation process when a client has an
outstanding balance of $500 or more.

compliance of fees.
IV. Brazos County will provide reasonable workspace for installer(s).
V. Insurance
Under this agreement, Recovery Healthcare Corporation shall act as independent contractors
and are solely responsible for required workman's compensation insurance, personal
property insurance, property damage and automobile insurance for all employees and
subcontractors;
VI. Limitations and Liabilities
(a) Recovery Healthcare Corporation expressly disclaims any warranty that it's service or that its
system is impervious to tampering. In no event shall Recovery Healthcare Corporation be
liable for any direct, indirect, special, consequential, or incidental damages in connection
with or arising out of the performance or use of the products or services provided under this
agreement or any orders hereunder. In no event Recovery Healthcare Corporation assume
or bear any responsibility or liability for acts that may be committed by an offender or
persons subject to, using or monitoring the equipment;
(b) Recovery Healthcare Corporation and Brazos agree to hold each other and its employees
and agents, harmless and agrees to indemnify, its employees, and agents from claims or
litigation, notwithstanding any other limitations in this agreement, from bodily injuries that
may be caused by this equipment;
(c) Recovery Healthcare Corporation shall not be liable for any failure or delay in performance
hereunder which is due in whole or in part to any cause beyond its control;
VII. Termination
(a) This Agreement maybe terminated upon 30 day written notice, by either Party.
(b) The Parties agree that it is in the best interests of all Parties and the Public that, should the
contemplated services to be provided be terminated, pursuant to the terms of this
terminated, the monitoring shall not be terminated en masse.
(c) The Parties mutually agree that they shall use their best efforts during the proposed 30 day
Notice of Termination period to insure any services being provided shall be terminated
evenly and in such a manner as to allow the replacement of said services during said 30 day
period without loss of monitoring.
(d) The parties mutually agree that said above actions shall be conducted with specificity,
providing written notice, in advance, of the date of termination by Customer Name and

On this the 6th day of December 2011 at a regular meeting of the Commissioners' Court, the following
