Y O F 1 i) BRAZOS COUNTY BRYANJEXAS MINUTES November 8, 2011 BRAZOS COUNTY COMMISSIONERS COURT WORKSHOP SESSION Minutes D Signature Page Ll -8 Workshop pdf :D File Stamped Agenda Workshop gdt Sian in sheet- Workshop pdf A Workshop meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Administration Building, 200 South Texas Avenue, Suite 332 in Bryan, Brazos County, Texas, beginning at 4:00 p.m. on Tuesday, November 8, 2011 with the following members of the Court present: Duane Peters, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Sammy Catalena , Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, , Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheets contain the names of the citizens and officials that were in attendance. 1. Discussions with legal counsel regarding the drafting of a new food establishment order and updates to the food establishment ordinances. The County Judge called the meeting to order and then turned the floor over to Bill Ballard, Civil Counsel who asked the Court for direction on the contents of the Order. He went on to explain the rules that needed to be included in the Order, along with the steps to be taken in the approval process. Those steps include a Public Hearing, and notice of the Public Hearing placed in the Legal Ads section of the newspaper running for three (3) consecutive days, two (2) weeks prior to the Public Hearing. He mentioned that the Vol. ( i Pg.— 1- - County also has the authority to regulate establishments in the ETJ and that the Food Handler statue is discretionary, meaning that the County does not have to regulate. The County can set fees up to $300, but must have a basis for setting a sliding scale. The current fees are $150. Commissioner Mallard said he feels it is important to have a food manager and handier and that every establishment have a permit to serve food. Commissioner Wassermann doesn't like that the fees aren't listed in the Order. Mr. Plitt replied that they are given on a separate sheet. They are set by the state and can change. Mr. Ballard also suggested wording in the Order addressing the procedure for shutting down an establishment when necessary and asked about emergency suspension or closure authority. He said that he didn't think our Health Department had that authority and will need to do more research. He is concerned about the liability if this is done and thinks it should come from the State. Commissioner Wassermann referred to Page 2 C1 saying that he had issues with the entire paragraph. The Health Department has extensive control over a remodel with lots of regulatory authority. Also he noted that the sample order from Travis County does not require a Food Handler Card. Mr. Ballard recommended the following changes to the Order: A section that includes jurisdiction up to the city limits inclusive of the ETJ Section E page 5 - Check Authority Coordination effort with suspension. Address due process in the Order making it clear and consistent. Commissioner Catalena is concerned with Section C and the fees. He stated there is a blank in the Order after Penalty, Fees and Injunction in accordance with. Mr. Ballard said he would cite the statute there. Mr. Catalena said he was not in favor of approving an Order and would like to continue as is. The County Judge said he thought the Order was ok but wanted the Commissioners Court to regulate the fees and govern the hearing for suspension. Commissioner Wassermann asked if a new Order would require more inspections. Mr. Plitt replied that yes it would. He said his department is currently doing two (2) each year. It could go to three (3) or (4). Commissioner Wassermann asked if it would require more personnel, whereupon Mr. Plitt replied it would not that they were doing that now for the cities. 2.
