The Commissioners' Court of Brazos County, Texas met in a Workshop Session in
the Justice of the Peace Precinct 2, Place 2 Courtroom in the Brazos County Administration
Building in Bryan, Brazos County, Texas, beginning at 2:00 p.m. on Tuesday, November 1,
2011 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, , Commissioner of Precinct 4;
Karen McQueen , County Clerk.
Attached is a list of the citizens and officials in attendance
1. Discussions with the Brazos County Health Department regarding updates to the food
establishment ordinances and a new food establishment order.
The County Judge called the meeting to order. Don Plitt, Head Sanitarian gave a
presentation on food borne illnesses. He reviewed the inspection reports and food
establishment fees for 36 county establishments. He then discussed disciplinary action
and fees by set by the State in Navasota, Cameron, Groesbeck, Refurio and Brookshire.
His point he said that the State has fees that are significantly higher and these places
are still in business.

Commissioner Catalena asked Mr. Plitt if any of the 36 establishments in the County
have been fined. Mr. Plitt couldn't answer saying he was looking at a state list. He said
that our county is inspected by the Health Department. Mr. Plitt and the Court discussed
fees and Mr. Plitt indicated that he has allowed stores to split the $500 fee into two
payments, 30 days apart.
Commissioner Wassermann asked how many years the Health Department has been
inspecting establishments. Mr. Plitt replied since 1939 or so, for as long as the Health
Department has been in existence. Mr. Plitt then said that there are 906 establishments
in all of Brazos County and 92 have been fined.
There was considerable discussion on the subject. Commissioner Mallard suggested
that it would be easier for the Health Department if the regulations were standardized
with those of two cities.
There were some slight changes that were recommended to the proposed order those
being Section 14, #4 in which blank spaces were inserted for protest and Section N #2
to site Chapter 437 of the Texas Health and Safety Code.
