Vol. PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes par person. Persons are Invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to Issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court: In participating in public discussions before the Court; and in all actions In the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Courts Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or Integrity of the Court, as a body, or any member or members of the Court, or County employees, Individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or radal, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speakers time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissloners Court can deliberate or take action only 0 a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaco wacies, recite existing policy In response to an inquiry or to ask that a matter be listed on a future agenda. Vol. BRAZOS COUNTY BRYANJEXAS MINUTES June 14, 2011 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 4:00 p.m. on Tuesday, June 14, 2011 with the following members of the Court present: Duane Peters, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Sammy Catalena, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. Pg.- C 00 A Juvenile Services Departmental vehicle was towed by All American Roadrunners Towing and Recovery Service while the officer was performing routine surveillance checks. Commissioner Wassermann noted that the towing company overcharged the county by $10 over the established fees set by the court. There have been reports of people being charged per mile and this is not allowed. It is a criminal violation. The County Judge suggested that the Purchasing Department call about the overcharging. Katie Conner, County Auditor said her office has received invoices for unpaid tolls and that her office has always recommended the individual pay the ticket. Wayne Dicky, Jail Administrator said the Sheriff's office would look into the $10 overcharge. Katie Conner said her office would not approve the $10 overcharge. Commissioner Wasserman's motion was to approve the payment authorization in the amount of $115. This amount does not include the $10 overcharge. Item 18.odf Commissioner Wassermann was concerned about the increase in cost for the graphics on the vehicle. The County Judge explained that the new vehicle design and the old Vol. Pg. 0 2 (p 1 graphics do not fit on the car. He went on to say that the new design is not much more than the cost to re- design the old to fit. Commissioner Wassermann said he thought this was excessive and if everyone keeps changing the graphics it is going to amount to a lot of money. He would like to see a more standardized design used that will cost significantly less and save on set up costs. Some of those activities include upgrading gravel roads to paved roads; building of new county roads; reconstructing many miles of county roads; installation of thousands of culverts; negotiation for hundreds of parcels of land for right -of -way; installation of fencing along county rights -of -way; installation of roadway signs; issuing Flood Plain permits; reviewing hundreds of subdivision plats; reviewing utility and pipeline permit requests; issuing oversized/overweight permits resulting in thousands of dollars of revenue; implementing herbicide treatment/control of county rights -of -way. WHEREAS, Richard Vance has saved the county many thousands of dollars by designing, engineering and overseeing the construction of numerous roads and bridges. He has developed a Storm Water Plan for submission to TCEQ and assisted in remapping Flood Plain digitals for the County; installed flood gates and developed a plan for mapping and recording Flood Plain permits. WHEREAS Richard Vance has streamlined operations in the equipment maintenance shop for servicing and maintaining all county road and bridge equipment including the heavy road equipment. WHERAS Richard Vance has assisted the County with many other major building projects not associated with his duties at the Road and Bridge Department. WHEREAS, Richard Vance has proven to be a dedicated servant to this community and the state always performing the highest caliber of work, giving wholeheartedly of himself which has earned the respect and appreciation of all who have worked with him; and WHEREAS, Richard Vance has chosen to retire from his position as County Engineer effective June 15, 2011; NOW THEREFORE, BE IT PROCLAIMED, that the Commissioners Court of Brazos County, Texas wishes to express its appreciation and gratitude to Richard Vance for his many years of service and wish him the best of health and happiness in his retirement years. This Act authorized the BCHFC to provide help on mortgage loans made to local low or moderate income persons. The Auditor's Office conducted research to determine whether the entity should be a component unit of Brazos County for financial statement purposes. A component unit is a legally separate organization that a primary government must include as part of its financial report entity for fair presentation in conformity with Generally Accepted Accounting Principles ( "GAAP "). In addition to being a legally separate organization, the entity must meet one of the three tests to qualify as a component unit: 1). Does the primary government (Brazos County) appoint a voting majority (accompanied by either the potential imposition of will or ongoing financial benefit/burden)? 2). Is the entity fiscally dependent on the primary government (Brazos County)? 3). Is it misleading to exclude the entity? The affairs of the BCHFC were originally managed by a Board of Directors which was composed of three members. All of them were the members of the Commissioners' Court Later, the Board appointed two more Board members, which are the county judges of the two neighboring counties. After reviewing the aspects of the organization, we conclude that the BCHFC meets the first one of the three tests and should be reported as a component unit in the County's financial statement (CAFR). GAAP further directs a component unit should be reported as a blended component unit if it meets either of 1) Is it substantively share the same board with the primary government (Brazos County)? 2) Does the entity provide services or benefits entirely, or almost entirely, to the primary government (Brazos County)? 4( Pg. ,3 Vol. BCHFC meets both tests and should be reported as a blended component unit in the County's financial statement (CAFR). In the past, BDHFC was disclosed as a related organization in the notes to the County's financial statements (CAFR). The organization started with two CD accounts and one checking account in the 1980s. One of the CD accounts was closed and rolled over to the checking account in 2007. Currently, the organization has one checking account with the balance about $150,000.00 and a CD account about $4,000.00. The volume of the financial transactions was not high until recent years. All financial transactions and reconciliations have been recorded and kept by Candy Gallego, but none of them has ever been presented in the County's financial statements (CAFR). Data of blended component units are treated in the same way as data of the primary government, without distinction. As directed by GAAP, the general Ruud of a blended component unit should be reclassified as a special revenue fund whenever the component unit is presented as part of the primary government's financial reporting entity. It is believed that such treatment would not only ensure compliance with GAAP, but also improve internal control, automate bookkeeping and promote efficiency. By setting up a new special revenue fund for BCHFC, we should be able to close the existing accounts of BCHFC, transfer the balances to the County's operating account, and still account for all financial transactions of BCHFC separately.
