THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN
REGULAR SESSION ON APRIL 26, 2011 AT 4:00 PM IN THE
COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATION

1. Invocation and Pledge of Allegiance -
Chaplain G.H. Jones will lead the Invocation and Commissioner Wassermann will lead
the Pledge of Allegiance.

3 Order Dividing One Election Precinct, Combining into Another Election Precinct and Creation of two
newly established Election Precincts.

5 Consider and take action on the Final Plat of Shirley Acres Subdivision, 19.29 Acres, William King
Survey A -149, recorded in Volume 8605, Page 184 (Official Records of Brazos County), Being Lots One
(1), Two (2) and Three (3), Brazos County, Texas. Site Is located in Precinct 2.
6 Request to change the current three Lieutenant positions at the Sheriff's Office to be salary instead of
hourly. To be effective April 30, 2011.
7 Approval of the attached payment authorization in the amount of $1,236.00 to B.A.D. Company for an
asbestos abatement on the Brazos County Courthouse Renovation.
8 Approval of the attached capital requisition # 00033539 to Motorola, Inc for the purchase and
installation of a Radio Dispatch Center for the Brazos County Sheriff's Office. Total amount of this
requisition is $83,066.90, using HGAC Contract.

PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and /or attend and make comment
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in
attendance at any Regular, Special and /or Emergency meeting of the Court shall conduct themselves with proper respect and
decorum in speaking to, and /or addressing the Court; in participating in public discussions before the Court; and in all actions in
the presence of the Court. Those members of the public who are inappropriately attired and /or who do not conduct themselves
in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and /or
continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual
or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and /or
integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence
and /or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following
sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and /or
4. such other and /or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However,
responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter
without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County
Judge and /or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite
existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act ?
551.042.

A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 4:00 p.m. on
Tuesday, April 26, 2011 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheets contain the names of the citizens and officials that were in

Pursuant to Section 42.007 of the Texas Election Code:
1. Election Precinct 2a be divided and be combined with Election Precinct 80;
2. Election Precinct 80 be extended to follow the new City of College Station city limit
lines and vote at the current polling location;
3. Election Precincts 50 and 51 be created to follow the new City of College Station city
limit lines with the polling place to be at the Wellborn Community Center.

Charles Wendt, Purchasing Agent recommended awarding the bid to Wellman based on
information given and on references. Comments on the low bidder's performance were
unfavorable. The low bidder stated that he was now unable to take the job but didn't
want to be penalized in future bidding because of his inability to do the job. There were
concerns with the second lowest bidder as well. Wellman has done a tremendous job for
Brazos County in the past and is only $2 more than the second lowest bidder.
Commissioners Court voted below to award the bid to Wellman and pull the bid from
Meyer Smith Inc. A copy of the bid tabulation is attached.

The County Judge skipped ahead to consider items 18, 19, 20, 21 and 22 before the
Executive Session.
At 4:23 p.m. the County Judge announced the meeting closed to the public so that the
Court could meet in Closed Executive Session to receive legal advice concerning the
existing animal shelter contract and the relocation of the Brazos Animal Shelter to an
unincorporated portion of Brazos County as allowed under Section 551.071 of the Texas
Government Code. The following individuals were asked to stay for the meeting:

Sheriff Chris Kirk - There were 559 inmates in jail, 52 have electronic monitors and 60
are pending for monitors. The female population is increasing. There were 97 females
in the jail last month.
22. Agency/ Board/ Committee reports by Court members.
Commissioner Wassermann - personally thanked Deputy Banks of the Sheriff's
Department along with his work crew for helping him clean an illegal dump site in
Precinct 1.
Commissioner Cauley - attended an OSR Water Supply Corporation meeting at the
Smetana Community Center. The Corporation voted to merge with Wellborn Water.
At this point the County Judge went back to consider item #16 of the agenda.

PRESENTATION:
REQUIREMENTS:
• No work will be permitted between front slope and /or back slope.
• All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be I) within 3-5' of and parallel to the right -of -way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
• If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility
to do so and to remove all cleared brush, trees etc. from county right-of -way.
• Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test shall be
conducted by an independent geotechnical testing firm;copies of all test results shall be furnished to
the office of the Brazos County Engineer.
• Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all
other State and Federal laws governing utility construction.

The location or description of the proposed installation is more folly shown by 3 copies of the
drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 bongs prior to the beginning of construction in
order that he, or his designated inspector, may inspect the actual installation;
2. All damage to the roadways and rights -of -way will be repaired to their original condition
to the satisfaction of the County Engineer,
3. Brazos County reserves the right to require Applicant to relocate or lower any such line
at no cost to Brazos County, should same become nten-nary due to widening or
lowering, or other alteration of the roadway or rightof -way;
4. Brazos County will in no way be responsible for any damage which might occur to any
existing utility lines in the right -of -way;
5. The line will be constructed and maintained on the County right-of-way in accordance
with the Utility Accommodation Policy which was adopted by the Texas Department of
Transportation on May 29, 1989;
6. The line or lines will be constructed no less than twenty-four inches (24 ") lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (2') below the center of the roadway;
7. All sites will be barricaded during the construction period.

Ave., Ste. 352, Bryan, Texas, until 2:00 p.m., Tuesday, March 22, 2011, at which time bids will be
publicly opened and read aloud.
A. SCOPE OF BID
Bids are solicited for furnishing the merchandise, supplies, service, and /or equipment set forth in this bid
request for a period beginning April 30, 2011 through April 29, 2012 in accordance with the following
Conditions of Bidding.

The following instructions apply to all bids and become a part of terms and conditions of any bid
submitted to Brazos County Purchasing Office, unless otherwise specified elsewhere in this bid request.
All bidders are required to be informed of these Terms and Conditions and will be held responsible for
having done so:
Definitions: In order to simplify the language throughout this bid, the following
definitions shall apply:
a. BRAZOS COUNTY - Same as County.
b. COMMISSIONERS' COURT - The elected officials of Brazos County, Texas
given the authority to exercise such powers and jurisdiction of all county
business as conferred by the State Constitution and Laws.
c. CONTRACT - An agreement between the County and a Supplier to furnish
supplies and/or services over a designated period of time during which repeated
purchases are made of the commodity specified.
d. CONTRACTOR - The successful Bidder(s) of this bid request.
e. COUNTY - The govemment of. Brazos County, Texas and its authorized .
representative.
f. SUB CONTRACTOR - Any contractor hired by the Contractor or Supplier to
furnish materials and services specified in this bid request.
g. SUPPLIER - Same as Contractor.

2. Upon acceptance and approval by the Commissioners' Court, this bid effects a working
contract between Brazos County and the successful bidder for the period designated.
3. Bids must be received by the Purchasing Office prior to the time and date specified.
The mere fact that the bid was dispatched will not be considered; the bidder must have
the bid actually delivered.
4. The County reserves the right to accept or reject in part or in whole, any bids submitted,
and to waive any technicalities for the best interest of the County.
5. Brazos County shall not be responsible for any verbal communication between any
employee of the County and any potential bidder. Only written specifications and written
price quotations will be considered.
6. Brazos County reserves the right to reject any bid that does not fully respond to each
specified item.
7. Bidder must include Employer Identification Number or Social Security Number for the
bid to be valid.
8. Should there be a change in ownership or management; the contract shall be canceled
unless a mutual agreement is reached with the new owner or manager to continue the
contract with its present provisions and prices. This contract is nontransferable by either
party.
9. The County may cancel this contract at any time for any reason, provided a thirty -day
written notice is given.
10. The bid award shall be based on, but not necessarily limited to, the following factors:
a. Unit price
b. Total price
c. Special needs and requirements of Brazos County
d. Results of testing samples (if needed)
e. Delivery
f. Brazos County's experience with products bid
g. Vendor's past performance record with Brazos County
11. Although the cost of products to be provided is an essential part of the Bid, Brazos
County is not obligated to award a contract on the sole basis of cost.
12. Acceptance of merchandise, work, and/or equipment provided shall be made by the
County at the sole discretion of the Commissioners Court when all terms and conditions
of the contract and specifications have been met to its satisfaction, including the
submission to the County of any and all documentation as may be required.
13. Title and Risk of Loss of the goods shall not pass to Brazos County until the County
actually accepts and takes possession of the goods at the point or points of delivery.

14. This agreement shall be governed by the Uniform Commercial Code as adopted in the
State of Texas as effective and in force on the date of this agreement.
15. Bids must be submitted on units of quantity specified. In the event of errors in extended
prices the unit price shall govern. Any suggested change in quantity on the part of the
bidder to secure better price or delivery is welcomed and may be given consideration
provided that the bidder also bids on the quantity specified.
16. Bids must specify the number of consecutive calendar days required to deliver the
commodities or service under normal conditions. Failure to specify delivery time will be
considered reason enough to cause the bid to be disregarded. Delivery time quoted will
be given consideration in awarding orders. If delivery is not made within a reasonable
time of the specified delivery in the bid, the entire order or contract may be canceled and
the bidder barred from quoting in future bids.
17. Bids cannot be altered after receiving time. No bid may be withdrawn after opening time
without acceptable reason and with the approval of the Purchasing Agent.
l 8. Bids must be submitted on this form and returned in a sealed envelope, clearly marked
with Vendor Name and Bid Number to ensure proper recognition upon its arrival. Bids
will not be considered if submitted by telephone, fax or any other means of rapid
dispatch, nor will a bid be considered if submitted to any other person or department
other than specifically instructed.
19. If the recipient of bid notification is unable to bid, this form should be returned to the
Purchasing Department prior to bid opening with a reason for not bidding, if the bidder
desires to receive notification of future Brazos County bids.
20. Bids must show full firm name, mailing address and telephone number and he manually
signed (no photocopies accepted) by an authorized sales or quotation representative of
the bidder. Firm name and authorized signature shall appear in each space provided.
21. In the event of a needed change in the specifications sent to the bidder, it is understood
that all the foregoing terms shall apply to the addendum or addenda
22. It is our policy not to furnish bid results over the phone. Bid results and tabulation sheets
will be posted on the Brazos County web site upon bid award by Commissioner's Court.
23. Brazos County reserves the right to extend this contract annually for no more than three
(3), one year periods, provided that both the County and the vendor agree to the same
terms and conditions of this bid, including no increases in price.
24. The successful offeror agrees to extend prices and terms to all entities that have entered
or will enter into joint purchasing inter -local cooperation agreement(s) with Brazos
County.

C. SPECIAL PROVISIONS
All deliveries are to be made F.O.B. Brazos County Road and Bridge Department, during
regular working days, Monday through Thursday, and between the hours of 7:30 a.m.
and 5:00 p.m., unless otherwise requested by the County.
D. INSURANCE REQUIREMENTS
E. SPECIFICATIONS
The Bidder shall instruct his insurance agent or carrier to furnish to the County a
Certificate of Insurance attesting to the issuance of the following policies affording
coverage's as required and listed in the following parts of this section. Please note that
such Certificates of Insurance and any required bonds must be issued and then approved
by the Brazos County Risk Manager. The County must approve the Certificate of
Insurance before work begins.
2. The Bidder shall furnish and keep in full force the following insurance during the term of
this Contract:
a. Statutory Workmen's Compensation and Employer's Liability Insurance with a
waiver of subrogation. _
b. General Liability with limits for bodily injury and for property damages of not
less than $1,000,000 CSL with Brazos County named as an additional insured.
c. Comprehensive Automotive Liability with single limits of $500,000 for Bodily
Injury and Property Damage Liability.
3. All of the aforementioned policies and Certificates of Insurance should be issued
immediately after the Bidder receives notification of award.
Equipment
All equipment operating on County rights of way shall be licensed in accordance with the
laws of the State of Texas. Rotary mowers will be required in the mowing of all rights of
way. The Contractor shall provide a minimum of four (4) mowers, 60 HP (unless
otherwise approved by the County Engineer) and shall not begin mowing until all four
(4) mowers are in Brazos County. All rotary mowers must be equipped with four (4)
sections of safety chains or the manufacturer's safety device to prevent damage to
property caused by flying debris propelled out from under the mower. All mowers shall
be kept in good operating condition and shall be maintained to provide a clean sharp cut
of vegetation at all times.

Sequence of work. The sequence of work shall be established by the County Engineer or
his designee. Map and road lists will be provided to establish roads to be mowed.
Mowing Type. Mowing will be from fence to fence. The Contractor shall mow as close
as possible to all fixed objects exercising extreme care not to damage county, public or
private property. Contractor shall be responsible for damages. Safety mowing will
consist of mowing the total length of County roads six (6) to eight (8) feet off the
roadway in wet soil / weather conditions. Safety mowing will be done only when
coordinated with the County.
Debris Thrown on Roadway. The Contractor shall immediately remove and properly
dispose of any debris thrown on the "roadway" by the snowing operation. Contractor is
"not" responsible for disposing of debris in the rights of way; however, he /she shall
notify the County Engineer /designee of the debris.
3. Requirements
a. County roadside mowing shall be for the period of April 30, 2010 to April 29, 2011
with the option to renew annually for no more than three (3), one year periods.
b. All mowing from the beginning of the cycle to the end of cycle, shall take place
within thirty (30) calendar days. If the mowing cycle takes longer than thirty
days, the contractor will be responsible for the full compensation to the County
for additional County supplied or hired mowers to finish the mowing cycle.
This does not include rain days or other conditions that are approved by the
County Engineer or their designee. Additional costs that are accrued by the
County due to not finishing the cycle within the 30 day period will be subtracted
from the contractor's invoice or the County will send an invoice to the
Contractor.
c. The Contractor shall observe and comply with all federal, state and local laws, safety
and health regulations including all warning and traffic control signs, ordinances, and
all ordinances and all regulations which in any manner affect the conduct of the
work.
d. In order to insure the safety of the traveling public, the Contractor shall coordinate all
work with the County Engineer /designee.
e. County rights of way will be mowed in cycles, that is, one (1) cycle = mowing of
entire county roads rights of way; the County anticipates three (3) or more cycles per
year depending on weather conditions.
f. No hand trimming or weed - eating will be required of the Contractor.
g. County will notify Contractor, approximately ten (10) to twelve (12) days prior to the
start of a cycle.
h. Contractor shall notify County Engineer /designee at least twenty -four (24) hours
prior to beginning any work cycle.
i. Contractor will confine all operations to daylight hours with no work perfonned on
Saturday, Sunday or County observed holidays unless otherwise authorized by the
County Engineer /designee.
j. Contractors are strongly urged to perform an actual drive -thru of County roads prior
to bidding the job; this will familiarize the Contractor with right of way hazards and
conditions (driveways, signs, culverts, bridges, etc.).
k. Contractor shall provide a company representative (foreman) to serve as a contact
person for field operations; representative shall report to the County
Engineer /designee. The foreman will remain with the mowing crew at all times and
will be able to converse in English.
I. Contractor agrees to accept full responsibility for any and all damages, including
damage to County rights of way, public or private property (i.e., signs, fences, phone
cables/pedestals, guardrails, etc.), as a result of his operations thereon; the Contractor

further agrees to promptly repair such damage in accordance with the County
Engineer's instructions. County forces, at the Contractor's expense will repair all
damages not repaired by the Contractor. All expenses charged by the County for
repair work shall be deducted from the Contractor's money due.
m. Contractor shall notify the County of any damages immediately.
n. Prior to beginning operations, a conference between representatives of the County
and the Contractor will be arranged by the County. In this meeting, the Contractor
will outline the proposed mowing procedures and give his plans for performing the
specifications, unusual conditions, methods for making non - mowing areas and other
pertinent items regarding the work will also be discussed. The County shall
determine all non - mowing areas.
o. Mowing will not be permitted when, in the opinion of the County Engineer/designee,
soil and weather conditions are such that the rights of way would be damaged.
p. Equipment shall not be left within thirty (30) feet of the travel lane during non-
working hours.
q. The cutting height shall be five (5) to seven (7) inches.
r. County will advise Contractor of any and all areas to be excluded from a mowing
cycle.
s. Payment to the Contractor for services rendered will be made based upon the
completion of a cycle (lump sum per cycle) and the submission of applicable
invoices. By Texas statute, Brazos County will pay the vendor for services provided
within thirty (30) days from the Auditor's receipt of the invoice.

4. Mileage
Mileage is an estimate. The County Engineer will determine the number of times the
County will be mowed. It is anticipated to be three (3) times per year; however, that
depends on weather conditions.

This report is made in accordance with provisions of Gov.Code 2256, The Public Funds Investment Act, which
requires quarterly reporting of investment transactions to the Commissioners' Court.
The Brazos County Investment portfolio earned an average yield of 0.1533% on the quarterly average
balance of $2,344,748.17 invested with TexPool for the period ending 03/31/2011. Investment interest
deposited during the quarter was $871.37. Actual ending balance for March 31, 2011 was $2,345,030.33.
The average rate of interest earned on the depository checking account balances for the quarter ending
03/31/2011 was 0.4900% netting $83,888.64 on an average depository investable balance of
$69,550,515,31.
"With inflationary expectations rising only modestly in spite of a substantial rise in commodity prices, it

Following the anticipations of TexPool and other economists the Brazos County Investment Strategy will
remain unchanged, keeping investments very short - termed & liquid. With the safety of principal as the
foremost objective of the County's investment policy followed by liquidity and yield - it seems prudent to
continue keeping the majority of available funds in the County's depository where all funds are 110%
collateralized. For diversification the County has an investment account with TexPool that provides the
safety of an overnight market.
Summary of Portfolio Changes
The deposit of interest is the only portfolio change to balances at this time and the Weighted Average
Maturity of investments remains at 1 day due to the liquidity of funds invested with TexPool and on deposit at
CitiBank of Texas.
