PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matter&, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment
al the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 16 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public In
attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and
decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in
the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves
in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or
continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual
or group. Neither is It the intention of the Court to allow a member (or members) of the public to insult the honesty and/or
integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively.
Accordingly, profane, insulting or threatening language directed dwarf the Court and/or any person in the Courts presence
and/or rectal, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following
sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.

At this point, the County Judge considered an addendum to the agenda which was the
consideration of an amendment to Order 11 -001 Prohibiting Outdoor Burning. Bill
Ballard, Civil Counsel gave a presentaton on outdoor burning. An issue has come up
with a local farmer concerning agricultural burning. This was straightened out and he is
allowed to burn under the ban for "cultivating ". The Health and Saftey Code Section 382
details the rules. The Local Government Code Section 352 allows burning only for the
following reasons:
Firefighter Training
Natural gas pipeline operations
planting or harvesting.

There were 529 inmates in jail, 42 have electronic monitors and 44 are pending for
monitors.
22. Agency/ Board/ Committee reports by Court members.
Commissioner Mallard - attended the quarterly High Speed Rail meeting last week. The
Tampa to Orlando High Speed Rail route is a dead issue and people are pulling back.
Japan is still looking at Texas for the rail site. On Friday he will be in Austin before the
State Legislature educating the legislators on the High Speed Rail topic. He feels things
are still looking good. He mentioned that the name had changed from the Japanese /US
Rail to the Lone Star Rail.
Commissioner Wassermann - on Saturday, January 29, Keep Brazos Beautiful had a
clean up day. There were 110 volunteers who picked up 2.22 tons of debris along with
20,000 pounds of tires. Prior to that event, Code Enforcement had picked up 11.12 tons
of debris.
Commissioner Cauley - Told the members of the Court that she had received notice
today of her acceptance into the 2 year leadership class conducted by the V. G. Young
Institute.

RESOLUTION
Resolution Authorizing the Submission of a General Juvenile Justice and Delinquency
Prevention Program Grant Application
WHEREAS The name of the project for which funding is being requested is the Brazos
County Attendance Improvement Management (AIM) Truancy Intervention and
Prevention Project;. and
WHEREAS The goals and objectives for the Brazos County Attendance Improvement
Management (AIM) Truancy Intervention and Prevention Project include the
following: 1) Decrease the number of truancy cases filed with the Court by
providing AIM program services to chronically truant students and hosting one
parent education class, per semester, that focuses on the definition of truancy,
penalties, and ways to eliminate it. 2) Decrease antisocial behavior, pregnancies
and substance abuse among students participating in the AIM program. 3) Build
stronger family relationships and family situations and provide community
resource information and referrals to the parents. 4) Improve school attendance of
students participating in the AIM program; and
WHEREAS In 2010 there were 514 cases of truancy brought before Judge Munoz, Justice
of the Peace, Precinct 2, Place 2. The AIM program contract was approved in
2009 to enhance services by allowing for both monitoring and mentoring by AIM
program staff. The AIM program partners with schools, law enforcement,
juvenile justice, community based organizations and other agencies which
recognize the link between truancy and students' future success. The Truancy
Intervention and Prevention Program has been in place since 2007 and has had a
significant impact on truancy in Brazos County; and
WHEREAS The requested funding of $20,000 will be utilized to continue the AIM program
that is currently in place and expand it by contracting additional GPS monitors to
serve middle school and high school students; and
WHEREAS Justice of the Peace Tommy Munoz has been active in this program and wishes
to be named the Official designated to apply for, accept, reject, or altler the
submission of a Genereal Juvenile Justice and Delinquency Prevention Programs
grant application to the Criminal Justice Division of the Governor's Office;
NOW THEREFORE BE IT RESOLVED by the Commissioners Court of Brazos
County, Texas that Judge Tommy Munoz shall be named the Official designated to apply
for, reject, or alter the submission of a General Juvenile Justice and Delinquency
Prevention Program grant application to the Criminal Justice Division of the Governor's
Office.

RE: BANK DEPOSITORY CONTRACT
Page 1, Section I of the Bank Depository Contract between Brazos County and Citibank
designates Citibank as a depository for the period beginning June 1, 2007, through
May 31, 2011, for a term of four years. At the end of this four -year contract, Bank agrees
to a 90 -day extension if necessary to provide time for contract negotiations and a
transition period.
According to Local Government Code, Section 116.021, established by the 80
Legislature, effective June 15, 2007, this contract may be renewed once for a two year
period under terms negotiated by the conunissioners court. Citibank has indicated their
interest in extending services for the two additional years with no changes in the terms or
conditions and with rates to stay the same (see letter attached).
It is my recommendation that Brazos County extend the existing contract with Citibank
for an additional two years, ending no later than May 31, 2013.

REOUIREMENTS:
1) No work will be permitted between front slope and /or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 35' of and parallel to the right -of -way line
and/or 2) in the case of a road bore, perpendicular to the right -of -way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc. from county right-of-way.

This Agency claims partial racial profiling report exemption because:
Our vehicles that conduct motor vehicle stops are equipped with video and audio equipment and we
maintain videos for 90 days.

Article 2.132(b) CCP Law Enforcement Policy on Racial Profiling
BRAZOS CO. CONST. PCT. 3 has adopted a detailed written policy on racial profiling. Our policy:
(1) clearly defines acts constituting racial profiling;
(2) strictly prohibits peace officers employed by the BRAZOS CO. CONST. PCT. 3 from engaging
in racial profiling;
(3) implements a process by which an individual may file a complaint with the BRAZOS CO.
CONST. PCT. 3 if the individual believes that a peace officer employed by the BRAZOS CO.
CONST. PCT. 3 has engaged in racial profiling with respect to the individual;
(4) provides public education relating to the agency's complaint process;
(5) requires appropriate corrective action to be taken against a peace officer employed by the
BRAZOS CO. CONST. PCT. 3 who, after an investigation, is shown to have engaged in racial
profiling in violation of the BRAZOS CO. CONST. PCT. 3's policy adopted under this article;
(6) require collection of information relating to motor vehicle stops in which a citation is issued and
to arrests made as a result of those stops, including information relating to:
(A) the race or ethnicity of the individual detained;
(B) whether a search was conducted and, if so, whether the individual detained consented to the
search; and

(C) whether the peace officer knew the race or ethnicity of the individual detained before
detaining that individual; and

(B) the governing body of each county or municipality served by the agency, if the agency is an
agency of a county, municipality, or other political subdivision of the state.
