PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and oil the agenda, and be limited to lour
minutes per person. Persons are Invited to submit comments in writing on the agenda items and/or attend and make comment
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Constitutional Court, with both judicial and legislative powers, created under Article V. Section 1 and Section 18 of the Texas
Constitution. As a Constitutional Court. the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in
attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and
decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Courl; and In all actions in
the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves
in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and /or
continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public lomm for the demeaning of any individual
or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty andor
integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Coud and/or any person in the Court's presence
and /or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following
sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However,
responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter
without notice to the public. To ensure the pubic has notice of all matters the Commissioners Court will consider, the County
Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite
existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act
§551.042.
The Commissioners Courtroom of the County Administration Building, 200 South Texas Ave., suite 106, Bryan, TX 77903 is

REGULAR MEETING
A regular meeting of the Commissioners' Court of Brazos County, Texas was held in
the Brazos County Commissioners Courtroom in the Administration Building, 200
South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on
Tuesday, February 15, 2011 with the following members of the Court present:
Duane Peters, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Sammy Catalena, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
IrmaCauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheets contain the names of the citizens and officials that were in
attendance.
1. Invocation and Pledge of Allegiance - Commissioner Wassermann asked Chaplain
Jones to lead the prayer and then Commissioner Wassermann led the pledge of
allegiance.

The County Judge read aloud the Proclamation and then presented it to Charlie P.
Briggs, the past President of the Republic of Texas. Mr. Briggs thanked the Court for the
Proclamation.

Commissioner Mallard voiced frustration that he hasn't interviewed or even met the
candidate. The County Judge explained that the position is not under the
Commissioners Court, but under the Director of the Expo Center. Mr. Quarles and the
HOT Committee were involved in interviews. There were very few candidates with this
particular candidate's experience. Commissioner Mallard said he appreciated that, but
he thinks this position is important and the Commissioners Court should be directly
involved. The County Judge thinks this will only delay the fair. Commissioner Mallard
would like to interview candidate first. The County Judge stated that they were on a
tight time frame. Commissioner Cauley stated she agreed with Commissioner Mallard.
She was not even in the loop and it is a courtesy to be allowed to meet the person
and participate. Commissioner Catalena stated that with all due respect, he can
appreciate the comments but the Commissioners Court is not involved in other
departments employment interviews. He thinks the candidate sounds good and time is
of the essence. The County Judge said it was normal for a department head to hire their
own employees without input from the Commissioners Court. He did get input from the
HOT Committee. Commissioner Cauley said she did not even get a resume, only a job
description. She went on to say that because of the investment, the Commissioners
Court should have at least been introduced. It appears, she said that we are rubber

stamping this candidate. Commissioner Wassermann asked if at one time the position
would be equal to Mr. Quarles or be supervised by him. Mr. Quarles stated that, that
person had not worked out and so now this candidate would be under his supervision.
Mr. Quarles went on by saying that he meant no disrespect, but he was the only person
in the room that knows who is qualified for this position. Also that he was not aware of
the Commissioners Court hiring for any other department heads. He will be very
disappointed if his authority is taken out of his hands. He added that responsibility was
vested in him when he was hired and that he needed to make that decision if the
candidate answers to him. Commissioner Wassermann stated that Brazos County has
over 700 employees and it sounded as if the Court wanted to get into micro managing
positions. As far as investments go he said, IT personnel make as much or more in
salary and Commissioners Court was not involved in those interviews.
Commissioner Cauley abstained for lack of information. A copy of the job description is
attached.

During budget hearings $800,000 was budgeted for distribution. $200,000 has been
distributed to date. The Court voted unanimously to transfer the remaining $600,000 to
the Texas Health and Human Services Commission for the Upper Payment Limit
Program for indigent heal services.

Purchasing Agent as allowed under Section 551.074 of the Texas Government Code.
Bill Ballard, Civil Counsel, Irene Jett, Budget Officer, Candy Gallego, Executive
Assistant, Gayle Bond, Administrative Assistant, Jennifer Salazar, Director of Human
Resources and Ruth McLeod, Administrative Assistant were asked to stay for the
Executive Session.

At 10:15 a.m. the County Judge opened the meeting to the public and announced that no
action would be taken on the Closed Executive Session.

Bill Ballard, Civil Counsel requested an agenda item on outdoor burning and the burn
ban.

Sheriff Chris Kirk
There were 549 inmates in jail, 42 have electronic monitors and 38 are pending for
monitors.
Kristy Roe, Tax Assessor /Collector said there were several questions on property tax
rates. They are holding steady and up about 2% over last year.

There were no agency,board, committee reports.

'Nftereas March 2, 2011, marks the 175'" anniversary of Texas Independence Day, when
56 brave Texians and Tejanos met at Washington -on- the - Brazos to declare Texas
an independent nation; and
'Whereas These 56 men signed the Texas Declaration of Independence on March 3, 1836,
and 3 more men signed later. These 59 men continued to work on a Constitution
which was approved, even after news of the fall of the Alamo; and
Wftere(LS These 59 men pledged their lives for freedom while their friends were dying at
the Alamo and continued to support independence even after members of their
family were massacred at Goliad on Palm Sunday, March 27, 1836; and
Whereas The advancing Mexican Army caused a retreat, called the Runaway Scrape,
expanded until most of the Texans had left their homes in fear, but still patriots
continued to join General Sam Houston's army as he retreated east and separated
from General Santa Anna and from most of his 5,000 man army; and
"Whereas Many of these 59 men joined General Sam Houston's "Rag -Tag" army and
continued to retreat in the face of a 5,000 man army until the odds were as good
as they were going to get on the plains of San Jacinto; and
'Whereas Texas Independence Day is a unique event in Texas history, and should be
remembered and celebrated every year, The Sons of The Republic of Texas is
dedicated to commemorate this historic event every year, and especially on this
the 175 anniversary of Texas Independence Day, as a reminder to everyone of
those brave 59 men who met on those cold days in an uncompleted little building
with no windows of doors at Washington -on- the - Brazos and risked their lives so
all of us could have the privilege of living in the forest state in the United States
of America.

RESOLUTION IN SUPPORT OF
LEGISLATION TO INCREASE THE WARRANT FEE
WHEREAS, the execution of criminal warrants by local law enforcement
agencies is a critical function that promotes the rule of law and compels
compliance with court actions, and
WHEREAS, the costs of providing warrant execution services are
intended to be covered by a $50 warrant fee for each warrant executed
that is authorized by Article 102.011(a)(2), Texas Code of Criminal
Procedure and paid for by criminal defendants, and
WHEREAS, a warrant fee is assessed only against a person who has
violated a court order, including an order to appear in court, and
WHEREAS, the Texas Legislature has not increased the warrant fee in 10
years, and
WHEREAS, the Brazos County Planning and Budget Office determined in
2008 that the costs of executing warrants exceed $75 per warrant, and
WHEREAS, Brazos County taxpayers currently bear nearly 40% of the
costs of executing criminal warrants that should be paid from warrant
fee proceeds and not by the general citizenry, and
WHEREAS, State Representative Allen Fletcher has filed House Bill 443,
and State Senator Jeff Wentworth has filed Senate Bill 374, both of
which would raise the warrant fee from $50 to $75,
THEREFORE BE IT RESOLVED that the Brazos County Commissioners
Court urges the Texas Legislature to reduce this under - funded mandate
on Texas counties by increasing the warrant fee, and
BE IT FURTHER RESOLVED that the Brazos County Commissioners
Court expresses its support for House Bill 443 and Senate Bill 374 and
wishes to communicate that support to members of the Travis County
delegation.

AUTOMATED INFORMATION SERVICES AMENDMENT TO
MASTER SERVICES AGREEMENT
This Automated Information Services Amendment ("AISTM Amendment ") is made as of the last date signed
by the parties below (the "AISTM Amendment Effective Date"), and amends that certain Master Services Agreement
with an Effective Date of June 24, 2008 between Brazos County, Texas ( "you" or "Customer") and Evercom Systems,
Inc. ("Provider or "we" or " Evercom"). This AISTM Amendment supersedes any and all other AISTM Amendments
(oral, written, or otherwise) that may have been made between the parties. Any capitalized term used herein, but not
defined, shall have the meaning set forth in the Agreement.
WHEREAS, Customer desires and Evercom agrees to amend the terms of the Agreement to add the Automated
Information Services TM .
NOW, THEREFORE, in consideration of the mutual covenants, representations, promises, obligations and other
valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties agree as follows:
1. AUTOMATED INFORMATION SERVICES. In addition to the services provided under the Agreement,
Provider will provide the Automated Information Services (AISTM) through our third party vendor, Telerus, as
described herein.
2. TERM. The Automated Information ServicesT"' shall commence on the AISTM Amendment Effective Date
and, subject to paragraph 5 below, shall remain in effect through the term of the Agreement.
3. LEGALITY/LIMITED LICENSE AGREEMENT. Notwithstanding anything to the contrary in the Agreement,
for services related to any and all applications which may allow you to monitor and record inmate telephone
calls, or transmit or receive inmate electronic messages ( "e- mail "); by providing the application, we make no
representation or warranty as to the legality of recording or monitoring inmate telephone calls or transmitting
or receiving inmate e-mail messages. Further, you retain custody and ownership of all recordings, and
inmate e-mail messages; however you grant us a perpetual limited license to compile, store, and access
recordings or inmate calls and access inmate e-mail messages for purposes of (i) complying with the
requests of officials at the facility, (ii) disclosing information to requesting law enforcement and correctional
officials as they may require for investigative, penological or public safety purposes, (iii) performing billing
and collection functions, or (iii) maintaining equipment and quality control purposes. This license does not
apply to recordings of inmate calls or e-mail messages with their attorneys or to recordings or e-mail
messages protected from disclosure by other applicable privileges.
4. DESCRIPTION.
a) AUTOMATED INFORMATION SERVICES (AISTM). We will provide the Automated Information
Services through our third party vendor, Telerus, as described herein. The AISTM application is
designed to automate internal inquiries from detainees and outside calls from friends and family
members on one single platform. In addition, the application is designed to allow inmates' friends 8
families the ability to open or fund a pre -paid telephone account as well as fund an inmate's trust
account. The application is accessed through a telephone IVR system that is available to all callers.
Once facility staff has uploaded all required information, the system is able to automate information
such as:
• Commissary Balances*
• Charge Information
• Court Appearance Dates, Times, Locations
• Bond Amounts, Types
• Projected Release Dates
• Visitation Eligibility, Times
*Pending MIS system data flow
Automated Information Services 2.0 is configurable to meet the specific needs of your facility. The standard
option includes automation of inmate and facility information to constituents who call your existing main
telephone number and to inmates at your facility. You can also choose to add any of the following additional
options (mark all that apply):
Automation of inmate and facility information to constituents (standard)
Automation of inmate and facility information to inmates (standard)
Ability to open or fund a Securus pre -paid telephone account
Ability to fund an inmate trust account

The application provides all information automatically without staff intervention 24/7 from any standard day -
room or outside telephone with no new wiring required. Facility staff personnel must maintain information on
the system. The Customer shall be responsible for any /all integration fees incurred by their JMS /MIS
system provider in order for AIS to receive inmate data.
5. PAYMENT:
ADP:
a) 60 DAY FREE TRIAL
The sixty (60) day free trial is available to customers who have accepted:
• Automation of inmate and facility information to constituents (standard)
• Automation of inmate and facility information to inmates (standard)
• Ability to open or fund a Securus pre -paid telephone account.
The Customer must also make available all necessary administrative, telecom, and data resources
and must accept the project plan and sixty (60) day completion target in order to be eligible for the
sixty (60) day free trial. Customer must:
(i) Be available for the project kickoff call, which will be held within 15 days following the date the
Customer signs this Amendment;
(ii) Complete the site questionnaire within 15 days following the date the Customer signs this
Amendment;
(iii) Export data from the Jail Management System (JMS) within 60 days following the date
Customer signs this Amendment;
(iv) Set resources to route calls to the Telerus System data center within 90 days following the
date Customer signs this Amendment. Customer will be responsible for all JMS export fees if
any.
It is the customer's responsibility to cancel the AIS" services by written notice to the provider prior to the end of the
sixty (60) day trial. Notice must be given in writing, signed by a person who has binding authority for the customer,
and must be delivered to provider addressed to:

during the relevant month, then we will invoice you for the balance which shall be due within thirty

invoice, which shall begin on the sooner of (1) the month following the AIST" installation, or (ii) sixty
(60) days following the date the Customer signs this Amendment. The invoice shall be due within
thirty (30) days after the date of the invoice.

Notwithstanding anything to the contrary, the parties acknowledge that the AIST" monthly fee is based on
Customer's estimated Average Daily Population ( "ADP ") count. Therefore, on January 1st of every year
during the term of service, Customer will provide its average ADP count so that the per inmate charge for
AIST" may be adjusted accordingly for the following year. The AIST" Fee is calculated using a minimum
Fee based on the Facility's ADP. It is the Customer's responsibility to provide the ADP numbers, and
request a modification in the price of AIST" Fee. Provider will modify the AIST" Fee per year based on a
comparison of any three (3) consecutive months' ADP levels. If the ADP levels have fluctuated by more
than fifteen percent (15 %), Provider will modify the AIST" Fee on a going forward basis.
Compensation (Set -up Charge and Monthly Fee) is determined by AIS features chosen. Securus has the
rights to modify and increase compensation if feature set is modified or changed by the facility after contract
execution.
6. STATEMENT OF WORK:

The system will contain two primary applications. The first application will automate answering of
incoming calls from the public or "friends and family; the second will automate inmate information
requests via existing inmate phones.

implementation plan, confirm system features, goals, and confirm specific dates

On this the 15th day of February 2011 at a regular meeting of the Commissioners' Court, the
following members were present:

The following proceedings were held:
THAT WHEREAS, on 15th day of February 2011 the Court heard and approved a budget
amendment for the 2010- 2011budget year for Brazos County, Texas; and
WHEREAS, expenditure is necessary due to the necessity to meet unusual and unforeseen conditions
which could not be reasonably included in the original budget adopted 14 September 2010, the following
amendment(s) to the original budget are hereby authorized, as described on the attached page(s).
