Vol. I N 2 ) Pg. 149 PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to tour minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and I decorum in speaking to, and /or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or 1 continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and /or any person in the Court's presence and /or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following I sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and /or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct tactual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. BRAZOS COUNTY BRYAN,TEXAS MINUTES November 30, 2010 BRAZOS COUNTY COMMISSIONERS COURT REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 4:00 p.m. on Tuesday, November 30, 2010 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; IrmaCauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. Sheriff Chris Kirk There were 531 inmates in jail, 42 have electronic monitors and 52 are pending for monitors. Consider and take action on agenda items 3 - 14: 3 Order 10 -016 Drohibltina outdoor burning in Brazos County for ninety (90) days, effective Immediately fprevlously tabled). von lir a Pg. 63 Chuck Frazier, Emergency Management Coordinator said the KBD Index was up 8 points. He had polled the fire chiefs and they reported no increase in fire runs at this time. 9 -1 -1 reported that there were a total of 7 runs this week. There was a grass fire earlier this afternoon. Commissioner Peters said he was concerned about this last fire because the person was burning under windy conditions. Constable Precinct 2, Donald Lampo answered questions about this fire as he was out there with the volunteer fire department. The fire chiefs asked that the Court continue to monitor conditions but did not ask for a ban at this time. Also noted was that there is no rain in the forecast. The ban is effective immediately and will remain in effect for 60 days. TEXAS COMMISSIONERS COURT ORDER PROHIBITION OF OUTDOOR BURNING WHEREAS, in accordance with provisions of the Texas Disaster Act of 1975, a state disaster has been based on the imminent threat of disaster from wildfire; and WHEREAS, declaration of such disaster authorized the imposition of controls on activities which tend to increase the likelihood of such fires: BE IT THEREFORE ORDERED that the following emergency regulations are hereby established for all unincorporated areas of Brazos County Texas for the duration of the above mentioned declaration; A person violates this order if he or she burns any combustible material outside of an enclosure serving to contain all flames and/or sparks, or orders such burning by others. A. Upon notification of suspected outdoor burning, the fire department assigned to the location of the fire shall respond to the scene and take immediate measures to contain and/or extinguish the fire. B. As soon as possible, a duly commissioned peace officer shall be sent to the scene to investigate the nature of the fue. C. If in the opinion of the officer at the scene and/or the fire chief, the goal of the order can be attained by informing the responsible party about the prohibitions established by this order, the officer may, at his discretion, notify the party about the provisions of this order and request compliance with it. In such instances, an entry of the notification shall be made into the dispatchers log containing the time, date, and place of the warning, and the name of the person receiving the warning. 3. At the discretion of the peace officer or the fire chief, second or flagrant violations of this order may be prosecuted in accordance with the statutes and procedures governing misdemeanors. BE IT ALSO ORDERED that this order may be enforced by any duly- commissioned peace officer and that the venue for prosecution of this order will be the Justice of the Peace. TEXAS Resolution Supporting State Legislation requiring Producers of Televisions • & Other Electronics to participate in Producer Takeback Recycling Programs, and providing an effective date. Whereas, discarded electronic products, including televisions, computers and cell phones, contain toxic materials that can pose hazards to human health; and Whereas, the State of Texas passed electronics takeback legislation in 2007 that covers computers but does not include televisions or other electronic products; and Whereas, Texas lawmakers passed a television recycling bill in June 2009, but was vetoed by Gov. Rick Perry; and Whereas, the federally mandated switch from analog to digital television signal on June 12th, 2009 rendered millions of analog televisions obsolete; and Whereas, millions of obsolete televisions containing lead and other heavy metals making their way to Texas landfills could prove environmentally unsafe and fiscally unsound; and Whereas, television recycling is an unregulated business and non - working televisions are often exported to developing countries wherein they are illegally dumped or disassembled by unprotected workers directly exposed to toxic materials; and Whereas, the cost incurred by Brazos County for disposal of products that contain toxic material and are not easily recyclable, particularly electronics, are in effect taking away funding that could easily be spent on other recycling programs; and Whereas, efforts to educate the general public about producer takeback recycling programs should not fall solely on municipal and county governments; and Whereas, requiring electronics producers to implement takeback recycling programs will shift the burden of disposal costs for electronic products from local ratepayers back to the producers, internalize the cost associated with such a program, and give producers a market incentive to design products that are more durable and recyclable, and less toxic. NOW, THEREFORE, BE IT RESOLVED BY BRAZOS COUNTY OF TEXAS, THAT: Section I. Brazos County will continue to promote recycling collection programs until there is an acceptable solution that will protect public health, the environment and tax payer dollars. Section 11. Brazos County supports the passage of this resolution to extend the electronics takeback law to cover televisions and other electronic products. Section III. Brazos County encourages other Texas municipalities and counties to express their view that the ingenuity of the high tech sector should be directed to solving the e-waste crisis following the digital switch, and thereafter to relieve local governments and taxpayers of any financial burden in dealing with e-waste recycling. Commissffiner Lloyd Wassermann Precinct 1 ane Peters Commissioner K y Mallard Precinct 3 ATTEST: ` Karen McQueen Vol. County Clerk Randy Sims County Judge I �+a N.1\ Commissi P� ' adi Commis Precinct 4 Pg Resolution 010 - 018 Whereas, mercury- containing products, such as fluorescent lighting (including compact fluorescent bulbs or CFLs) and mercury home thermostats contain 5 milligrams to 3,000 milligrams of the heavy metal, respectively; and, Whereas, mercury from these products can be released into the environment during various stages of the product life cycle including production, transportation, manufacturing, use and disposal, and should be kept out of Texas landfills and incinerators; and, Whereas, once mercury is released into the air, soil or water, microorganisms transform it into organic forms which are highly toxic to humans and wildlife; and, Whereas, infants and children are most susceptible to nervous system damage from mercury, including deafness, blindness, mental retardation and cerebral palsy; and, Whereas, currently, local governments are financially responsible for the proper disposal of certain mercury- containing products through existing Household Hazardous Waste programs; and, Whereas, having producers fund and manage the collection system for mercury- containing products is in line with an overall framework for an Extended Producer Responsibly (EPR) system where manufacturers are accountable for recovering their obsolete products from consumers, recycling those products properly, and covering the costs of the end -of -life disposal; and, Whereas, manufacturer -based CFL and home thermostat takeback programs can create new jobs in the recycling and processing industries; and Whereas, manufacturer -based takeback laws should be designed to establish convenient collection for consumers throughout the state. Whereas, beverage containers and packaging make up approximately 31% of the waste stream nationally; and, Whereas, beverage container waste is a major source of litter along roadways and pollution in. Texas waterways, with taxpayers bearing the brunt of the cleanup costs; and Whereas, properly designed beverage container recycling refund systems create industrial and job growth in the collection, hauling, processing and remanufacturing of recyclable materials; and Whereas, states with laws for recycling refund systems for beverage containers have recycling rates of 70- 80% overall, which decreases the total volume of waste headed to Texas landfills and incinerators; and Whereas, recycling refund systems for beverage containers can promote funding for charities and schools; Whereas, laws for recycling refund systems for beverage containers establish convenient collection for consumers throughout the State.
