PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a
Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas
Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in
attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and
decorum in speaking to, and /or addressing the Court; in participating in public discussions before the Court; and in all actions in
the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves
in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or
continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual
or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or
integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence
and /or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following
sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The
Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However,
responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter
without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County
Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite
existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act
§551.042.
The County Admin Building is wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive

COMMISSIONERS' COURT
REGULAR MEETING
AUGUST 17, 2010
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners Courtroom in the
Brazos County Administration Building, 200 South Texas Avenue,
in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on
Tuesday, August 17, 2010 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Wassermann gave the invocation and led the
pledge of allegiance.
Under citizen input /and or concerns the following spoke:
Sheriff Chris Kirk
a) There were 586 inmate in jail
b) He had some good news to relay to the court.
The jail has been re- inspected and it passed.
September 7th is most likely the first day they
will begin moving prisoners. He would like to
coordinate an open house.

The Court first considered the appointment for Democratic
Presiding Judge and Alternate Judge for elections conducted by
the county. The term is for a period of one (1) year, ending
on July 31, 2011. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to approve
the attached list of names of individuals appointed to serve
as Presiding Judge and Alternate Judge.
The Court next considered the appointment for Republican
Presiding Judge and Alternate Judge for elections conducted b
the county. The term is for a period of one (1) year, ending
on July 31, 2011. On motion by Commissioner Peters, seconded
by Commissioner Wassermann, the Court voted unanimously to
approve the attached list of names of individuals appointed to
serve as Presiding Judge and Alternate Judge.
The next matter before the Court was to consider adopting
of Order #10 -012 Calling for a General Election to be held
November 2, 2010. Commissioner Mallard warned that the
polling place on the A &M Campus is in jeopardy because of
construction. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to adopt
Order #10 -012 Calling for a General Election to be held
November 2, 2010. A copy of the Order is attached hereto.

The Court proceeded to consider a request from the Budget
Office to correct funding for the Buyer position in the
Purchasing department from Group 13, Step 2 to Group 13, Step
4. The error was discovered during preparation for fiscal
year 2011 proposed budget. On motion by the County Judge,
seconded by Commissioner Peters, the Court voted unanimously
to approve the request to correct funding.
The next matter for consideration by the Court was a
request submitted by Tom Quarles, Director of Special Events
Facilities seeking approval for out of state travel for
Marlene Cogwin and Jo Beth Wolfe to travel to Mesa, Arizona to
attend Fastbook Event Software Training seminar August 25
through the 26, 2010. On motion by Commissioner Cauley,
seconded by Commissioner Wassermann, the Court voted
unanimously to grant the request from the Director of Special
Events Facilities and approved payment of out of state travel
expense for Marlene Cogwin and Jo Beth Wolfe.
The Court next considered authorizing acceptance of
donated property from the Texas A &M Surplus Department. The
Information Technology Department has been offered seven (7)
laserjet toners and four (4) sets of PC speakers with an
estimated value of $1,170.00. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted

unanimously to accept the donated property.
The next matter before the Court was to consider a
request from Bryan Texas Utilities to place a pole with
overhead power line in the right -of -way of Jones Road to
provide temporary service to a construction site. The site is
located in Precinct 4. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the request from Bryan
Texas Utilities and authorized the installation. A copy of
the request is attached hereto.
The next matter before the Court was to consider a Mail
Service Agreement between Brazos County and DeLucia Mail
Service for mail processing and other ancillary mail duties
for the Brazos County governmental offices. In return for
such services, Brazos County shall pay 13.250 of the total
postage used on the dedicated mail meter used by DeLucia for
Brazos County mail only. On motion by Commissioner Cauley,
seconded by the County Judge, the Court voted unanimously to
approve the Mail Service agreement and authorized the County
Judge to execute the document. A copy is attached hereto.
The Court next considered the renewal of RFP 2009 -48R,
Legal Representation of Indigent Juveniles with Patrick

Gendron and Lane Thibodeaux. The new RFP number will be 2010-
40R and will increase the pay amount 8 percent from
$153,000.00 to $165,240.00. Commissioner Cauley asked if this
was a renewal of a contract. The County Judge replied it was
where upon Commissioner Cauley moved to approve the contract
with the amount of $165,240.00. The motion was seconded by
Commissioner Peters and carried unanimously.
The Court proceeded to consider a quote by Quest Group
for audit /sourcing proposal and for downstream auditing
services. This is necessitated due to the impending contract
expiration with Caremark for prescription drug coverage. On
motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to approve the quote by
Quest Group for audit /sourcing and for downstream auditing
services subject to the parties entering into an agreed
contract..
The next matter before the Court was to consider a change
order in the amount of $59,402.20 to Patterson Architects for
the East Curtain Wall Project. This 10 percent increase is
due to the $594,021.96 added to the Madison contract for the
East Curtain Wall Project. On motion by Commissioner Peters,
seconded by Commissioner Mallard, the Court voted unanimously
to approve the change order in the amount of $59,402.20.

The Court proceeded to consider exemptions from
competitive bidding requirements for vendors for FY 2011.
Commissioner Mallard said he has discussed with Purchasing
about possibly forming a committee to streamline this
especially all the vehicle vendors. On motion by Commissioner
Wassermann, seconded by Commissioner Peters, the Court voted
unanimously to exempt the attached vendors from competitive
bidding requirements for FY 2011.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in July 2010 on the
following dates:
Regular Meetings - 6th 13th 20th 27th
Special Meeting - 15th 23rd
Workshop Session - 27th
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the minutes
as submitted.
The next matter before the Court was Budget Amendment
#09/10 -44.1 through 44.11, which would reallocate funds for
the Jail Expansion 2007 (3), Juvenile Services -TYC Parole (2),
Brazos Center; transfer funds from Contingency to Magistrate
#2, Purchasing, District Clerk - Collections; transfer funds
from Building Renovation Courthouse to Building Renovation

Courthouse North Wall; and recognize additional funds from
Help America Vote. On motion by Commissioner Peters, seconded
by Commissioner Mallard, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached.
The next matter before the Court was to consider a
capital requisition in the amount of $92,404.54 to Patterson
Architects for the design of a curtain wall for the North Wall
Project. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the capital requisition.
The Court next considered a capital requisition in the
amount of $4,760.00 to Norix Intensive Use Furniture for the
purchase of floor mount stools for the Brazos County Jail
Expansion. On motion by Commissioner Cauley, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the capital requisition.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Wassermann, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the change of status as submitted.

The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Wassermann, seconded by Commissioner
Mallard, the Court voted unanimously to approve the Claims as
submitted.
The County Judge deviated from the agenda and skipped
down to number 23 acknowledgement of the County investment
Report for the quarter ending June 30, 2010.
There were no announcements of interest items and
possible future agenda topics.
There was no citizen input and /or concerns.
Under Agency /Board /Committee reports by Court members,
the following spoke:
Commissioner Mallard
a) spent last week at the Transportation Summit
in Irving, Texas. It was an excellent
meeting.
At 6:20 p.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed
Executive Session to discuss economic development
negotiations as allowed under Section 551.087 of the Texas
Government Code. Bob Malaise, representative of the Research
Valley Partnership, Dennis Goehring, representative of the

McDaniel, Representative of the Research Valley Partnership,

At 6:53 p.m. the County Judge announced the meeting open
to the public and that no action would be taken on the close
Executive Session.
There being no further business to come before the
Court, the meeting was adjourned.

1 am working on getting temporary power to a construction site on Jones Road. I am proposing to set one
pole approximately 22' off the fence line to maintain proper clearance. This Is only a temporary Installation
for about one year. After the need for temporary power Is no longer needed, BTU will remove ilia pole
and line crossing Jones Road providing the temporary service.

MAIL SERVICE AGREEMENT
This contract is between Brazos County, Texas, hereinafter "County," and
ln91G SE i!C hereinafter "Vendor ", for the purchase of mail
operation services, as further described herein.
1. TERM
This Contract is for a term of one (1) year, beginning on August 16, 2010
and ending on August 15, 2011.
The County may, at its option and with the agreement of Vendor, extend
the period of this Contract for additional two one (1) year terms. The County shall
notify Vendor in writing of its intent to extend the Contract period at least thirty
(30) calendar days prior to the expiration of the original contract period, or any
additional term thereafter.
2. PAYMENT
As consideration for performance of the duties described herein, County
shall pay /52s'% of the total postage used on Brazos County mail as
measured by the amounts recorded on the dedicated mail meter used by Vendor
for Brazos County mail only.
Payment under this Contract shall be made in the manner provided by law.
Invoices shall be prepared and submitted to the Brazos County Auditor and in
accordance with any additional instructions provided on the purchase order.
Invoices shall contain the following information: contract number, purchase order
number, description of services, quantities, unit prices, and extended totals.
Payments to Vendor shall be made no later than thirty (30) days after receipt by
the Brazos County Auditor of a proper invoice.
3. INDEPENDENT CONTRACTOR
Vendor shall perform all duties stated in the Agreed Scope of Work,
Exhibit "A" and Exhibit "B ", attached hereto and incorporated herein. Vendor
shall perform services at the location(s) and time(s) stated in Exhibit "A" and
Exhibit `B ", or in the purchase order requesting such services. Vendor shall be
acting as an independent contractor and not as an employee of the County. As an
independent contractor, Vendor shall have no authority, express or implied, to
commit or obligate the County in any manner whatsoever.

4. GENERAL PROVISIONS
Vendor shall operate in accordance with all applicable federal and state
regulations. Vendor shall provide remediation as required.
Vendor shall provide a secure location for document storage if such
becomes necessary.
Vendor shall follow all U.S. Postal regulations and comply with the most
current edition of the United States Postal Service Domestic Mail Manual.
Vendor shall provide its services, as well as reasonably related services, in
accordance with all applicable professional standards of an independent contractor
providing mailing services. Vendor represents and warrants that it has the
requisite qualifications, experience, personnel and other resources to perform
mailing services as required by this contract. Vendor shall assign only qualified
personnel to perform the services contemplated by this contract. Vendor, in its
reasonable discretion, reserves the right to substitute appropriate key personnel to
accomplish its duties so long as the substituted personnel are equally qualified and
skilled in the tasks necessary to accomplish the tasks and services required.
The Brazos County Purchasing Department will serve as the point of
contact between Brazos County and Vendor. The Purchasing Department shall
supervise any review of Vendor's technical work, deliverables, payment requests,
schedules, and similar matters. The Purchasing Department does not have any
express or implied authority to vary the terms of the contract, amend the contract
in any way or waive strict performance of the terms or conditions of the contract.
5. INSURANCE / INDEMNIFICATION
Brazos County shall not be required to purchase any insurance against loss
or damage to any personal property to which this contract relates, nor shall this
contract require the County to establish a self - insurance fund to protect against any
such loss or damage. Subject to the provisions of the Texas Tort Claims Act,
Vendor shall bear the risk of any loss or damage to any personal property in which
Vendor holds title.
The Vendor, before starting work for Brazos County, must furnish the
County a Certificate of Insurance or other acceptable evidence from a reputable
insurance company or companies with A.M. Best Rating of AA@ (such
companies to be acceptable to the County) licensed to write insurance in the state
of Texas, showing that the Contract is covered by the insurance as follows:

Liability Insurance in the amount of $1,000,000. In the event any
work is sublet, the contractor shall require the subcontractor
similarly to provide the same coverage and shall himself acquire
evidence of such coverage on behalf of the subcontractor, pursuant
to TEX. LOCAL GOVT CODE ANN. § 401.011.
(2) Commercial General Liability Insurance with a $ 500,000
Combined Single Limit. The policy shall be on the Comprehensive
General Liability 1986/90 occurrence form, and shall include
coverage for acts of independent contractors, and shall name
Brazos County as an additional insured. Waiver of subrogation
is required. No claims made policies are acceptable without
prior approval by the Commissioners Court and Risk
Management.
(3) Automobile Public Liability Insurance with a $1,000,000
Combined Single Limit, in all self - propelled vehicles used in
connection with the contract, whether owned, non -owned or hired.
Waiver of subrogation is required.
The Certificate of Insurance fumished to the County shall contain a
provision that coverage under such policies shall not be canceled or materially
changed until at least 30 days prior written notice has been given to Brazos
County
The County reserves the right to require additional lines of insurance on a
case -by -case basis, depending upon the subject matter of the contract and the
attendant risks involved in the completion of the contractual work.
6. TERMINATION DUE TO LACK OF FUNDING APPROPRIATION
If sufficient funds are not appropriated to continue the function performed
in this agreement and for the payment of the charges hereunder, the County may
terminate this agreement at the end of its current fiscal year. The County agrees to
give written notice of termination to Vendor at least 30 days prior to the end of its
current fiscal year. The County will pay to Vendor all regular contractual
payments incurred through the end of its current fiscal year. The termination of
the contract pursuant to this paragraph shall not cause any penalty to be charged to
the County or to Vendor.

7. RESPONSIBILITY FOR TAXES
The County shall not be responsible for, nor indemnify Vendor for any
federal, state, or local taxes which may be imposed or levied upon the subject
matter of this contract.
8. TERMS HEREIN CONTROLLING PROVISIONS
It is expressly agreed that the terms of each and every provision in this
contract shall prevail and control over the terms of any other conflicting provision
in any other document relating to and any part of the contract in which the
attachment is incorporated.
9. SILENCE OF SPECIFICATIONS
The apparent silence of specifications as to any detail, or the apparent
omission from it of a detailed description concerning any point, shall be regarded
as meaning that only the best commercial practice is to prevail and that only
material and workmanship of the finest quality are to be used. All interpretations
of specifications shall be made on the basis of this statement.
10. ESCALATION
Any requests for reasonable price adjustments must be submitted thirty (30)
days prior to the contract anniversary date.
11. TERMINATION
The County may terminate this contract if Vendor fails to perform or
observe any other material term or condition of the contract, and such failure
continues for more than ten (10) days after receipt of written notice of such failure
from the County or if Vendor becomes insolvent.
12. OFFSET FOR DAMAGES
In addition to all other remedies at law or equity, the County may offset
from any money due to Vendor any amounts Vendor owes to the County for
damages resulting from breach or deficiencies in performance under this contract.
13. SUBCONTRACTING
Vendor may not assign this contract or subcontract to another party for
performance of the terms and conditions hereof without the written consent of the
County, which consent shall not be unreasonably withheld.

14. AMENDMENTS
All amendments to this contract must be in writing and signed by both
parties.
15. RETENTION OF RECORDS
Vendor agrees to retain all financial books, records, and other documents
relevant to this contract for five (5) years after final payment or until after the
resolution of any audit questions which could be more than five (5) years,
whichever is longer.
If Vendor's books, records, and other documents relevant to this contract
are not sufficient to support and document that requested services were provided,
Vendor shall reimburse the County for the services not adequately supported and
documented.
16. RIGHT TO INSPECT AND AUDIT
The County reserves the right to inspect the use of dedicated meter at
Vendor's place of business and to inspect Vendor's records of mail metered for
the County. Vendor agrees to allow the county to inspect its premises and
operations, including without prior notice the operation of the meter and the
records related to postal usage for Brazos County mail.
17. SEVERABILITY
If any term or provision of this contract is held by a court of competent
jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions
of this agreement shall remain in full force and effect and shall in no way be
affected, impaired, or invalidated.
18. NOTICES
Notices provided hereunder must be in writing to be effective, and shall be
deemed received upon the earlier to occur of (a) actual receipt; or (b) three days
after the same are mailed by U.S. certified or registered mail, postage prepaid and
return receipt requested, to the following address, or to such other address as shall
have been provided by notice:

19. GOVERNING LAW
This contract shall be governed by the laws of the State of Texas and
applicable federal law and shall be fully performable and enforceable in Texas.
20. NUMBER OF ORIGINALS
This Contract may be executed in multiple copies, each of which shall be
considered a true and original copy of this contract.

EXHIBIT A
AGREED SCOPE OF WORK
INTENT
The intent of this contract is to provide services to facilitate U.S. mail processing
and other ancillary mail duties for the Brazos County governmental offices located at the
Brazos County Administration Building and the Brazos County Tax Office. Vendor is an
independent contractor and shall be responsible to provide all tools, implements,
personnel, supervision, labor, supplies, equipment, vehicles, and all effort necessary to
carry out the services as required for this operation.
Vendor will affix postage to the mail retrieved by the Vendor from the Brazos
County offices located at 200 S. Texas Ave. (Brazos County Administration building)
and 300 E. Wm. J. Bryan Pkwy (Brazos County Tax Office).
SCOPE OF SERVICES / TECHNICAL REQUIREMENTS
Vendor will pick up Brazos County's outgoing mail each Monday through Friday
(exclusive of Federal and county holidays) between 2:00 p.m. and 2:30 p.m. at two (2)
Brazos County locations, to -wit, the Brazos County Administration Building at 200 S.
Texas Ave., Bryan, Texas, and the Brazos County Tax Office at 300 E. Wm. J. Bryan
Pkwy, Bryan, Texas.
When required by special circumstances, Vendor agrees to accept Brazos
County's outgoing mail at Vendor's location at 2021 S. Texas Avenue, Bryan, Texas
when delivered there by Brazos County prior to 4:00 p.m. Outgoing mail delivered to
Vendor prior to 4:00 p.m. will be affixed with postage that same day and delivered to the
main Bryan U. S. Post Office for mailing.
Vendor will sort, weigh and affix first class postage to all mail the same day it is
picked up from Brazos County.
Vendor will deliver by courier to a processor of choice, all .first class mail
weighing two (2) ounces or less which can be bar - coded. The processor of choice will
bar -code and deliver the mail to the United States Post Office in Houston, Texas.
Vendor shall inform Brazos County of the processor of their choice before any
service is started. Vendor shall inform Brazos County with in 30 (thirty) days of any
change of processors during the course of this contract.

Vendor will use the bulk mail permit number issued to Brazos County by the
United States Postal Service.
Vendor will take all mail that is not suitable for bar- coding, to -wit items weighing
more than two (2) ounces, or of a non - standard size, or larger than a #10 envelope to the
Bryan Main United States Post Office at 2121 E. Wm. J. Bryan Pkwy, Bryan, Texas for
mailing on the same day that it is picked up from Brazos County.
Vendor will provide a monthly report showing the number of pieces of mail
processed each day, the number of pieces processed for bar- coding and the total amount
of postage cost registered by the dedicated postage meter for the Brazos County mail.
VENDOR SHALL CHOOSE ONE OF THE TWO FOLLOWING
POSTAGE METER OPTIONS BELOW
POSTAGE METER - OPTION 1
Vendor will provide a postage meter that will be dedicated solely for Brazos
County Mail.
Vendor shall be responsible for the lease, all necessary repairs, service,
maintenance and/or replacement of the dedicated meter.
Vendor will use the dedicated postage meter for Brazos County mail only.
Vendor will use bulk mail permit number issued to Brazos County by the United
States Postal Service for Brazos County mail only.
The vendor will be responsible for providing all labor, equipment, material and
consurnables necessary for the production of the mailing service.
Vendor will be responsible for monitoring postage usage and for making a timely
request for additional postage.
Subsequent filling of the meter will be handled as follows: Vendor shall be
responsible for submitting a memorandum.to the Brazos County Purchasing Agent at
least 30 (thirty) days prior to the projected completed consumption of the postage on the
postage meter or when the meter registers less than $7,500.00 in postage. Vendor shall
be responsible for monitoring postage usage and for making a timely request for
additional postage. Brazos County will be responsible for adding postage amounts to the
dedicated meter.

Successful bidder must provide evidence of Workers' Compensation
and General Liability Insurance prior to award.
(1) Statutory Workers Compensation Insurance with Employers Liability
Insurance in the amount of $1.000.000. In the event any work is sublet,

1986/90 occurrence form, and shall include coverage for acts of
