Persons are Invited to submit comments in writing on the agenda items and /or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and /of addressing the Court; In participating in public discussions before the Court; and In all actions in the presence of the Court. Those members of the public who arm inappropriately attired and/or who do not conduct themselves In an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order andfor continued disruption of the meeting may result in a Contempt of Court Citation. It Is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Coud; 3. a Contempt Citation; andlor 4. such other and /or criminal sanctions as may be authorized . under the Constitution, Statutes and Codes of the Stale of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda property posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge of Commissioners to unlisted public comment topics could became deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will coWder, the County Judge and /or Commissioners may choose not to respond to public mmments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. J_-- -- littp ://bcagendaintrauet /MeetingV iew. aspx ?Meeti ❑g1D =15 &MinutesMeetiI1gID =- l 7/30/2010 COMMISSIONERS' COURT REGULAR MEETING AUGUST 3, 2010 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 3, 2010 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and then led the pledge of allegiance. There was no citizen input /and or concerns. The Court next considered Budget Amendment #09/10 -42.1 that would transfer funds from Courthouse Renovation to Courthouse Renovation -North Wall. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted. A Vol 1 3 Page 000 Commissioners Court meeting August 3, 2010 copy is attached. 2 The next matter for consideration was a request from the 361st District Court Judge, Steve Smith for an exception to the County Travel Policy to allow Judge Smith to stay the final night of the American Bar Association Annual Meeting at an airport hotel at a rate of $125 per night rather than at the host hotel with a rate of $189.00 per night. This would save the County $64.00. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The next matter for consideration by the Court was a request submitted by Wayne Dicky, Jail Administrator seeking approval for out of state travel for Deputy Sheriff Carl D. Chambers and Deputy Sheriff Joseph P. Gonzales to travel to Cambridge, Massachusetts to extradite and inmate back to Texas. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to grant the request from the Jail Administrator and approved payment of out of state travel expense for Deputies Chambers and Gonzales. The Court next considered setting the date and time for a Public Hearing on the Re- subdivision of Lake Millican Estates, Lot 3, 4.76 Acres in Precinct 1. On motion by Commissioner Vol ! 3 ( Page 91 Commissioners Court meeting August 3, 2010 3 Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to set the Public Hearing for Tuesday, August 31, 2010 at 10:00 a.m. in the Commissioners Courtroom of the Brazos County Administration Building. The next matter for consideration was asbestos abatement for the boiler flue. Pat Howard, Purchasing Agent recommended acceptance of the bid submitted by Inland Environments Ltd. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the bid to Inland Environments Ltd. A copy of the bid tabulation is attached. The Court next considered a manual requisition in the amount of $4,500.00 to Austin Environmental for monitoring asbestos and mold on the second floor of the Road and Bridge Department building. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the requisition. The Court next considered awarding Competitive Sealed Proposal (CSP) No. 2010 -38, Exposition Center Paved Fairgrounds. Pat Howard, Purchasing Agent, recommended acceptance of the proposal bid submitted by Collier Construction, Inc. On motion by Commissioner Peters, seconded Vol 131 Page gd� Commissioners Court meeting August 3, 2010 4 by the County Judge, the Court voted unanimously toiaccept the recommendation of the Purchasing Agent and award the contract to Collier Construction, Inc. A copy of the tabulation sheet is attached. The next matter for consideration was a request from the Purchasing Department to reject all bids received on Bid No. 2010 -40, Pharmaceuticals for Indigent Inmates. This is necessitated due to there being a second year left on the contract with Pharmacy Services. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request to reject all bids received. The vendors will be notified and made aware of the error. The Court proceeded to consider a change order to purchase order #1003620 to Austin Environmental. It is for additional boiler stack monitoring. This change order will add $4,000.00 to the original purchase order making the new total $$35,500.00. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the change order to purchase order #1003620. The next matter for consideration was a change order in the amount of $1,721.88 to the contract with Jim Singleton, Architects PC. This is necessitated due to the Architect Vol 13 Page S 3 Commissioners Court meeting August 3, 2010 5 receiving 6 percent of contractor's cost. The contractor, Collier Construction was paid additional funds for the inclusion of an audio system in the new Exhibit Hall at the Exposition Complex. On motion by Commissioner Peters, seconded by the County Judge, the Court voted unanimously to approve the change order. A copy is attached. The Court proceeded to consider a manual requisition in the amount of $1,037,831.10 to Madison Construction for the Courthouse North Wall Project. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition. The next matter for consideration was a change order in the amount of $594,021.96 to Madison Construction for the installation of a curtain wall on the east side of the Brazos County Courthouse. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the change order. The Court next considered a change order deducting $113,786.56 from the North Curtain Wall Contract with Madison Construction, LP. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to approve the change order. The Court proceeded to consider capital requisition # Vol 13 � Page 84 Commissioners Court meeting August 3, 2010 6 00029162 in the amount $2,500.00 to The Software Group, Inc. for the purchase of a Mugshot Interface Program for the Brazos County Detention Center. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the capital requisition. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for June 2010. A copy is attached to and made a part of these minutes. The next matter for consideration was a request from the Road and Bridge Department to use $100,000.00 of State Lateral Fund to complete the Elmo Weedon Road reconstruction project. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The Court next considered the request from ETC Texas Pipe Line to construct a road bore for a natural gas pipeline in the right -of -way of Macey Road near the intersection with Old Bundick Road. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the request from ETC Texas Pipe Line Vol 131 Page 85 Commissioners Court meeting August 3, 2010 7 and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Final Plat of Lot 8A, Block 2 Bentwood Estates Phase 1 being an Amending Plat of Lots 8 and 9, Block 2 Bentwood Estates Phase 1 in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the final plat of Lot 8A, Block 2 Bentwood Estates Phase 1 being an Amending Plat of Lots 8 and 9, Block 2 Bentwood Estates Phase 1 as submitted. The next matter for consideration was the Texas Department of Public Safety, Texas Division of Emergency Management Notice of Sub - recipient Grant Award in the amount of $47,965.00 for Fiscal Year 2010. On motion by Commissioner Cauley, seconded by the County Judge, the Court voted unanimously to authorize the County Judge to accept the funds. The next matter for consideration was approval of tax refund applications from the following individuals and /or companies: a. Karen Elaine Claridge, over payment $41.19 b. BCS Joe Kent LP, over payment $425.38 c. Tax Ease Funding, over payment $134.92 Vol 13 w Page 8(p Commissioners Court meeting August 3, 2010 8 On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the tax refund applications. The Court next considered Budget Amendment #09/42.2 through 42.8, which would reallocate funds for the Road and Bridge Department Shop, Sheriff's Office -TECH Enhancement -ARRA Grant; transfer funds from Contingency to Capital Improvement Fund (3), from Courthouse Renovation -North Wall to Courthouse Renovation from Road and Bridge Department General to Capital Improvements. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendment as submitted, a copy is attached hereto. The next matter for consideration was a Capital requisition in the amount of $151.00 to Dealers Electric for the purchase of circuit breakers for the County Administration Building North Wing Project. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition. The Court next considered a Capital requisition in the amount of $259.46 to Crawford Electric Supply for the purchase of electrical wiring for the County Administration Building North Wing Project. On motion by Commissioner Cauley, Vol 13 (e Page 97 Commissioners Court meeting August 3, 2010 0 seconded by Commissioner Wassermann, the Court voted unanimously to approve the requisition. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7077132 through 7077375 On motion by Commissioner Peters, seconded by the County Judge, the Court voted unanimously to approve the Claims as submitted. The Court acknowledged receipt of the Extension Service reports submitted in July 2010 and acknowledged receipt of reports from the following County and Precinct Offices showing revenues collected and remitted to the County Treasurer: County Clerk District Clerk Justice of the Peace Precinct 1 Justice of the Peace Precinct 2, Place 1 Justice of the Peace Precinct 2, Place 2 Justice of the Peace Precinct 3 Justice of the Peace Precinct 4 Constable, Precinct 1 Constable Precinct 2 Constable Precinct 3 Constable Precinct 4 Road & Bridge Vol 13 (e Page 29 Commissioners Court meeting August 3, 2010 10 A copy of the Officials' reports can be viewed in the County Auditor's office. There were no announcements of interest items and possible future agenda topics the following spoke: Under citizen input and /or concerns, the following spoke: Wayne Dicky, Jail Administrator a) There were 581 inmates in jail, 53 have electronic monitors and 37 are pending for monitors. Richard Vance, County Engineer a) Wanted to let everyone know that the repair work being done on Elmo Weedon road was the direct result of overloaded, heavy trucks driving on the road. There were no Agency /Board /Committee reports by Court members. There being no further business to come before the Court, the meeting was adjourned.
